a swat team, bomb squad and san jose police have surrounded a house in stockton where they believe a murder s good evening. a s.w.a.t. team, bomb squad, and san jose police have surrounded a house in stockton, where they believe a murder suspect is holed up. the man is wanted in the shooting and killing of a hell's angel member at a funeral a week ago today in san jose. police have surrounded a house and have been there much of the day. we are outside the scene of the standoff. ben? >> reporter: we continue to monitor the situation of the standoff here in stockton that has been going on now for nearly 10 hours. we believe bebe ruiz, the man police believe shot and killed a hell's angel member at a funeral last week is inside the home here on mcdougall street in stockton. police and bomb squad, s.w.a.t. team, paramedics here, standing by just in case something happens. we are not getting much information from police. we don't know if ruiz is alone

or has people in the home with him. we talked to a man who called his friend who was in his home next door to where ruiz is believed to be. [ indescernible ] >> i asked him if he saw anybody that maybe -- might think they might be waiting -- you never know. >> he's sitting in his house watching? >> watching through one of his windows, had a pretty good view. >> reporter: the sun is beginning to set now here in stockton. it will be interesting to see how this develops, as darkness approaches. ann? >> ben, are any of the neighbors talking about whether or not this is a house where they had trouble before or if there's any connection to hells angels before the police moved in? >> reporter: i spoke to a man who had seen ruiz in the home before. he said he doesn't know him personally, seen him there a

couple of times. he does not believe he lives there year round, perhaps visiting friends there, perhaps visiting a loved one there. but he has seen ruiz there before, but not clear whether he lived in that home. >> ben, thank you so much for the update. well, they were told to pack up and move out. but the occupy oakland protesters are not going away. today, they marched through downtown, aided by police to stop traffic for them. the city threatened protesters with arrest if they didn't clear out of city hall by 10:00 last night. police never moved in and the protesters say they are staying put. >> we're not just fighting for us over here. we're fighting for everybody that's out there in that community, you know, that's dealing with foreclosures, losing everything, healthcare, closing down our schools, our libraries, all that, gangs, police brutality, all those things being addressed here, rape, all those issues are being

addressed. >> some nurses from the california nurse's association have set up first aid stations at the oakland and san francisco protest. two people have been arrested at the occupy san jose tent city. there were only three people camped out overnight. besides the arrest, one was cited and released. the city says the camp site was creating public and health hazards. the majority of the tent city was cleared out thursday. good samaritan has been killed in a violent crash in the east bay. 20-year-old malika cade got out of her car to help victims in a crash on 880 in heyward just after 2:00 a.m. that's when she was hit by a passing car and thrown to the other side of the freeway. she died at the scene. >> people's general nature is to help one another. we definitely want to help each other, but on a freeway this time of night, you have to error on the side of caution. there are intoxicated drivers, texting drivers, lot of people going on in the drivers mind these days.

in the end, probably not a good idea to stop. >> four people involved in the original accident were critically injured. several lanes of 880 were closed until 5:00 a.m. it is a horrific case of animal cruelty in berkeley. a stray pitbull puppy found shot dozens of times by a pellet gun. anne mackovic says what's most disturbing is this isn't the first case of this kind in the area. >> reporter: daphne the dog is stronger and sweeter than she may appear. this 1-year-old pitbull came to the berkeley animal care services shelter last month as a stray. >> frightened of people, with lots of small marks on her body. >> reporter: when she went in to be spayed, the vet found out why. >> actually, she had 38 buck shots in her body. >> reporter: shot with a beebee gun dozens of times, her ears cut almost in half, a job not done by a professional. >> just flat out cruel, flat out cruel. >> reporter: this parking lot

about a block away from the shelter is where daphne was found. shelter workers noticed a strange coincidence between daphne and two other puppies who were found here this past spring. >> they looked exactly like her. this is a very distinctive looking dog. >> reporter: the same markings, same crop job on the ears. >> we're now x-raying them to make sure they don't have the same problem. >> reporter: one already had a few pellets removed. the good news, the shelter says her sisters were already adopted. >> unbelievable. these dogs forgive people everything. they clearly have had traumatic lives. all it takes is the smallest act of kindness to win them over. >> reporter: daphne showed that to a woman who came to the shelter looking for a dog today. >> oh, she's beautiful. i mean, dogs are just like humans, fearful. they have been abused. >> reporter: berkeley animal care services is accepting donations for daphne's care. it could cost thousands to

remove the pellets. >> this is not an isolated case. there are lots of animal abuse that goes on and we really need the public's help. >> reporter: in berkeley, anne mackovic, cbs 5. it's always an unusual sight obey area streets. gun owners, bearing arms in public. a new state law bans openly carrying handguns. so protesters in san leandro and san jose brought out their unloaded rifles and shotguns. >> the main concern i have in protecting my family, i had an armed robbery at my apartment complex right inside my door. i wasn't the victim, but just knowing that that happened and i tried to help a guy out, you know, i decided to open carry. >> these gun owners hope the rallies will inspire legislators to repeal the new law. checking other bay area headlines, supporters of mayor ed lee's campaign are being accused of voter fraud. videos of a voting station yesterday appear to show workers

using a stencil to fill in ballots for people. the head of san francisco's election department says he's seen the video and turned the matter over to the da. supporters say they have done nothing wrong and mayor ed lee says he knows nothing about it. street lights are on the blink. about a quarter of the 2000 recently installed lights have malfunctioned, even though they worked perfectly during a pilot project. the street light replacements cost about $10 million, but the deal is part of a deal to make concord's infrastructure more energy efficient. oakland airport is offering free parking for travelers this holiday season. the deal runs between thanksgiving and the december holidays. travelers can park their car for free midweek for up to three days at the airport's daily lot. normally, that could cost as much as $66. and more earthquakes shaking

the east bay overnight, three of them. the first hit just after midnight. it measured 2.8, 2 miles southeast of berkeley. minutes later, there was a 1.3 tremor. at 12:45 a.m., 2.5. all the quakes were in the same general area. they followed two quakes on thursday in berkeley measuring 3.8 and 4.0. hundreds of bay area hospital records, missing. the woman police have arrested and why she told them she did it. and the frantic rescue of a distressed deer. when what animal control did to free this entangled buck. what a day around the bay. 80-degree temperatures all the way back to the beach. will it be back tomorrow? of course. we'll take a look at it, coming up in the complete forecast in just a few minutes. ,,,,,,

the oakland firestorm was 20- part of bay area history remembered today. the oakland fire storm was 20 years ago this week. 25 people died and 3000 homes were destroyed. survivors gathered at the rock ridge bart station mural to reflect. >> that was my career fire.

you know, by far the largest incident i've ever responded to. all the risks that we took that day, it gives you a real feeling of pride. >> today's event was followed by a ceremony at the gateway emergency preparedness exhibit center. a stockton marine has been killed by a hunter in oregon, apparently mistaken for a bear. 20-year-old christopher cho was hiking with a friend near silver creek falls park. police say he was wearing dark clothing, and the hunter fired when he saw something moving in the brush. so far, the hunter has not been charged. a bay area woman who was fatally shot in a salon masacre two weeks ago was remembered today at a funeral service in menlo park. 42-year-old rochelle scott was an atherton native. she was at the seal beach hair salon when 42-year-old scott dekraai walked in and killed eight people, including his ex-wife. dekraai was in the middle of a custody battle. the da is now seeking the death penalty.

a woman faces charges tonight of stealing hospital records. 49-year-old catharine smithso is charged with taking some 1500 files from mills peninsula hospital between 2009 and september of last year. the san mateo daily journal reports she told police that she was overwhelmed in her mail room job and was taking them home to shred. investigators say some records contained personal information, but none were misused. she is due in court monday. silicon valley is buzzing with the possibility of yahoo! being sold. the "wall street journal" reports google is thinking about bank rolling a deal for others to acquire yahoo!. the report cites an unidentified source. neither company is commenting. meanwhile, google just spent $100 million for an office complex in mountain view. the complex can hold almost 1000 workers. the summer camps continue to

well, a happy ending for an auburn deer who got tangled in a rope. the deer was snagged by his

antlers on a rope swing. he thrashed violently to free himself, but couldn't. a game ward came to his rescue, sedated him with a tranquilizer dart and cut the rope. he also cut his antlers to protect him from hunters. jim bernard is here with the forecast. i'm doing my happy temperature dance. it's been so gorgeous, still in a good mood. >> it's been very warm throughout the bay. everybody in a pretty good mood and temperatures are way above average, as we saw anything from 10 to 15 degrees above normal today. 80s, creating happy dances throughout the bay, as we see 80-degree temperatures even in the city and back to the beach. still clear skies out around the bay, as we take a look across the valley, things beginning to darken up a bit. clear at this hour, and again,

first thing in the morning, as the sun sets slowly in the west, we'll look for clear evening, as the offshore flow continues, continued mild and clear and warm for tomorrow. maybe not quite as warm as today. but still we'll look for upper 70s to prevail throughout the bay. cooling us down a bit on monday, but nothing dramatic. 86 in livermore, back to the beach, 82, 86, 81 in the downtown area of san francisco today. not a record, however. warm, but not record-setting. off show breeze clear on the coast, doing more of that tomorrow. we'll look for things to cool slightly on monday and then offshore breeze sets up again on midweek, bringing with it warm temperatures once again. we'll look for a slight cooldown tomorrow. mid to low 80s for the hot spots

into the upper 70s, low 80s as you come back to the water. not quite as toasty as today, but still warm. by midweek, looking at a fire weather watch, with warm temperatures, gusty winds and low humidity prevailing throughout the area. as we see a gradual cooldown in the beginning, midweek the chance of showers showing up on the horizon by the weekend. now on the horizon, kim with a preview of the raiders game coming up tomorrow. jason campbell isn't the only offensive weapon the raiders needed to replace this week. and would hue jackson finally announce his decision? the latest on the raiders choice of quarterbacks, next in sports. ,,,,,,,,,,,,,,

clemson dropped 59 points on north carolina. oregon beat colorado 45-2 without michael james and darren thomas. cal leads utah 34-3 in the fourth quarter. and stanford is up 38-14 at the half against washington. the sharks duking it out with the last year's stanley cup winners, the boston bruins. second period, martin sets up logan right in front of the net. he beats thomas, 2-0 sharks. third period, sharks up 2-0. here come the bruins. niemi doesn't have a chance and the game is tied at 2-2. later in the third, shot from the blueline, it's knocked down, but the putback for his first goal of the season. sharks add an empty-netter and beat the bruins 4-2. chiefs and raiders tomorrow on cbs 5 at 1:00. >> what are you expecting? >> chiefs had a lot of injuries
