let me tell you. >> great. >> folks, if you're headed out today, spooky looking fog out toward the coastline, it is very chick and dense out toward the beaches and offer out for that and nice and clear in the valleys. by the afternoon, enjoying nice mild weather around the bay area. we will have the halloween forecast coming up. >> the golden gate bridge camera is socked in. we will show you in a couple of minutes. we want to let you know they reopened the lanes a short time ago from northbound 101 to 280 in san jose. a three-car injury crash. one of the cars overturned but they just cleared it moments ago to the right shoulder. so it is still slow in the area. things are improving so we will continue to watch that, the rest of the hot spots across the bay area. >> the funny thing, he didn't know he did it. >> oh, yeah. >> that's like our magic gold. important stuff. >> maintenance walked in. >> all right, thank you very much. it is 4:31. occupy oklahoma protesters expect to get emergency supplies back from the city of oakland

today. >> that's right. the city says they will return first aid and medical supplies taken by police last week and the protesters are calling for a general strike on wednesday. they hope to shut down the city of oakland operations and call attention to their messages. some protesters are supporting an effort to recall mayor gene quan. >> whether you love occupy oakland or whether you think it is a terrible thing, people are just not happy with the way that the mayor has handled this issue. >> mayor quan has come under fire. for last week's police action. to close down the encampment just outside of city hall. and then welcoming the campers to return. we will have a live report on the story, at 5:00 a.m. and in the meantime. doctors say former marine scott olsen will make a full recovery. olsen is the iraq war veteran who was allegedly injured by a tear gas canister during the occupy oakland clash with with police. his roommate says he visited

olsen at a medical facility over the weekend and olsen is still unable to talk but doctors still expect him to make a recovery. 4:33. occupy san francisco protesters are showing no signs of leaving any time soon. mayor lee made no possible mention of evictions but he repeated the need to set boundaries and city leaders and occupy protesters will hold a hearing urging lee not to use force on the protesters. >> i think the dialogue on it, we of course have to draw the line. as to where they could be at. and we will -- hopefully they will respect our position as well and keep the dialogue going. >> now, the biggest problem at the protest in san francisco is the overwhelming sten thatch is only getting worse. the cause of the problem portable toilets overflowing and unusable. >> let's solve the problem. and get on with the rest of the job that we all have to do on a

daily basis. no one wants to wall low in you know what. >> private donations provided the toilets for the protesters after san francisco health officials warned that human waste was an imminent public health hazard. 4:34. a surfer bitten by a shark off the monterey county coast could get out of a san jose hospital as soon as today. great white took 19 inches out of him but only millimeters from the jugular vein. linda ye spoke with those who say the surfer is the unluckiest unlucky guy he has ever met. >> his doctor says eric tear tino is the unluckiest unlucky guy in the world. attacked by a shark while surfing off the coast of monterey. the jaws of a great white, biting into a two-inch section of his neck. >> right here. along the neck. right along what we call the sterno can cleid mass muscle.

>> it missed his kroád artery and vain by two millimeters. >> the church -- the chunk from the surfboard shows the shark's power. >> he felt like it was a car or truck pulling him along. it had his arm. his arm in its mouth. and pulling him under the water. >> somehow tarantino escaped. he and a surfing buddy swam to shore. >> a wave came and i piled on the top of the wave and when i came over the top, he started yelling shark, shark, shark. th second attack in four years at the same spot and the beach won't close and only warnings posted about a shark attack. the gashes on tear tino's neck and arm are closed and doctors can't emphasize how lucky he is. >> full use of his arm. and no residual with regards to his neck. >> in san jose, linda yee, cbs

5. millions of people are waking um without power, all along the east coast this morning. the snow piled up quickly over the weekend. a camera in new jersey took a photo. once every minute. as the snow fell on saturday. this is pretty cool, they got more that two feet of snow in some areas, and four states have declared states of emergency. and it is a snow day for hundreds of schools. much earlier than school years than normally happen. some local officials have canceled or postponed halloween activities. in the northeast. crews are, as you might imagine, busy restoring power to more than 3 million homes and businesses but it could take a week to get everyone's power back on. the storm has smashed snowfall records for the month of october. >> mother nature has thrown us a few curve balls. over the past few months, but we're managing. >> 12 deaths are now blamed for the powerful october snowstorm. a 30-car pileup shut down interstate 95 in pennsylvania. it was a mess.

>> boy, it sure was. and air travel is back on track at sfo this morning, the east coast snowstorms canceled several flights over the weekend. and three outbound to the new york city area, and two inbound from boston. and a trip returning florida took a turn for the worst, passengers on a jet blue plane were on the way to newark but the storm forced a detour to connecticut. and if that wasn't bad enough, they were stuck on the tarmac for more than eight hours with no food, and no bathroom. and passengers reportedly broke into applause when they were finally allowed back into the terminal. jet blue has since apologized for that situation. and the qantas planes are now back in the air. >> after a labor dispute grounded the airlines entire fleet over the weekend. bad times there. an australian court made an emergency ruling yesterday to end weeks of strikes and a lockout. there will still be delays on qantas, as it clears a backlog of thousands of passengers. the world's 10th largest airline

expects to be back on a normal schedule within just a couple of days. all right, we got to know what the halloween forecast is going to be. >> a lot better than it is on the east coast. and that i can assure you. check in with lawrence. >> no kidding. no rain to worry about. the darkened clouds out there. a little spooky to the coastline and dense fog, showing up out at the beaches at this hour, and we're hoping to sweep that away. and still that fog is very thick. so if you're heading in that direction, be very careful, it is right down on the surface, and that can be a concern if you're traveled around the bay area. and 40s and some 50s outside. not a bad start to the morning, by the afternoon looking very mild outside, and 79 degrees, and warm in livermore, and 77 in concord p. and 78 degrees in fairfield. and 76 degrees in san jose and out toward the beaches, it is cooler there, 60s and we will try to squeeze in a little bit of sunshine anyway. the next couple of days, we actually have the fire weather watch coming up as we head into tomorrow and on wednesday as the winds sweep offshore. but then boy, we're going the other direction.

we're going from that fire weather, that warm weather to cold rain on thursday and friday. even with a chance of a couple of snowflakes on our local mountain tops, all right, let's get a check of the roadways with elizabeth. >> and here is that spooky creepy forecast he was talking about across the golden gate bridge. really thick this morning, as you come into san francisco, and especially on the san francisco side of the span, you can see a couple of headlights there. and so far no major delays across the deck. if are you commuting to marin county, there is road work northbound 101, through novato, and watch out for that. it should be wrapping up shortly. we had some updated information about the information in san jose. they have reopened the ramp and canceled the traffic alert after a three car fender-bender northbound 101 on the ramp to northbound 280. one of the cars overturned. it this was an injury crash. but they were able to reopen the ramp and clear it to the right shoulder. except for a couple of lanes are blocked on northbound 101. it sound like they're in the clearing stageses of this accident with slowing in the general area.

if we're coming out of downtown san jose on 280, a live look, near the 880 interchange, and it is very light traffic this morning. very early this morning on a monday, everything is looking good all the way up to cupertino. the bridges, a quick bridge check, the san mateo bridge is nice and quiet, and hayward and foster city. and lanes blocked heading to the peninsula through belmont and otherwise mass transit if you want to use it, everything is off to a great start and bart and ace and muni and cal train and your ferries. that is traffic. back to you. >> elizabeth, thanks much. >> 40:40 your time. some big changes may be coming to yosemite national park. why some tourists could actually be turned away. this is making national headlines this morning. a g.o.p. front runner fights a new scandal. how the herman cain campaign is defending sexual harassment allegations. plus, the customers pounced and the banks are now backtracking, the latest big bank changing its mind on controversial debit card fees. that and much more coming up:

he engaged in welcome back. 4:43. the herman cain presidential campaign is denying allegations he engaged in inprome -- inappropriate behavior with at least two women, when he was head of the national restaurant association. and accused cain of making inappropriate comments and contact during his tenure in the 90s and the allegations led to five figure financial settlements and yesterday morning cain appeared on cbs's face the nation and shortly after the interview, he was questioned about those allegations. >> i'm not going to comment about two people that you won't tell me who they are, okay? that's like negotiating -- i'm not going to pin it on that. >> according to documents obtained by politico, the women complained that cain asked sexually suggestive questions and made comments and gestures that made them uncomfortable. the allegations come as a new poll shows that the

businessman is in a dead heat in iowa with mitt romney. the des moines register survey gives cain a 23-22% edge over the former massachusetts governor with the rest of the pack a lot farther behind. iowa is the traditional site of the first caucuses. 4:44 now. president barack obama will sign an executive order this afternoon, all designed to help out the economy. the president says the country can't wait for congress. obama has begun taking unilateral steps that he says will encourage economic growth. the action does not require congressional approval. and today is the deadline to register for a special election in oklahoma. it is a vote by mail election. set up for november 15. and a couple of weeks, you can sign up at the register's office or at libraries, fire stations and post offices, three measures will be on the ballot in a couple of weeks. a key moment this week for the future of high speed rail here in california. tomorrow, the state's high speed rail authority will release its

final business plan. and then lawmakers and governor brown will use the day to to decide whether to go ahead with construction in the central valley. starting about a year from now. bullet even the rosiest snare -- but even the rosiest scenarios do not envision a single bullet train running on the first segment of the tracks. and positive news about the new 49ers stadium in santa clara. the 49 rers giving city officials assurances that they will submit a financial plan soon for the billion dollar stadium and the city hopes to approve the plan by the end of this year. the team reportedly wants to speed up the timetable and aim for a stadium opening in 2014. a year ahead of the current target date. and bank of america, rethinking that new debit fee that has caused so much trouble. >> probably a good idea. the bank is reportedly considering dropping the five dollars monthly charge for customers who use direct deposit for the paychecks and for those who maintain a to be determined minimum balance. other big banks including j.p.

>> hello, hello, hello. a lot of bodies. >> closer to home, yosemite could soon be offlimits to some visitors. >> it is true. park rangers are slugling with how to provide public access and at the same time protect the environment of the valley. millions visit each year. and tourists outnumber parking spaces. and the public is being asked to submit solutions to the problem. the final decision is expected sometime in june. but officials are warning, the final plan could limit the number of daily visitors inside the park. >> bummer. beautiful out there. >> it is gorgeous. gorgeous. >> it is going to be time to look at the weather. >> halloween night? >> sweaters? a good thing. >> and hey, folks, if you're headed out around the bay area today, on this halloween, we do have some patchy dense fog. out to the coastline, to begin with early on, mostly clear inside the bay. and also into the valleys. should be a spectacular day

ahead with very mild temperatures. around the bay area. and maybe a little cooler out toward the coastline. you will see a mixture of sunshine and some clouds. and the temperatures seasonal, inside the bay. and looking at the numbers and well into the 70s in many spots inland. and the high pressure building just off the coastline and you have the low passing to the north of us. and continued mild, around the bay area, for today. and it looks like we are going to see that ridge build in, pretty well as we het into tomorrow and the weather watch going up in the bay area as with we head into that period. the fog and low clouds, off the coast and try to clear you out even toward the beaches as we head to the afternoon and we should node some pretty good weather for trick-or-treaters heading to the even can. how about this? -- evening? >> how about this? 79 morgan hill. and 74 in redwood city. 72 are degrees in hayward. east bay temperatures moving well into the 70s. almost 80 degrees in livermore by the afternoon. and 78 in pleasant hill. and 75 degrees in vallejo. get inside the bay, and the temperatures there in the 60s and a few 70s.

and out toward the coastline, we will keep you cooler and patchy fog to start with. and still, big changes in the weather. we go from one extreme to another. and tomorrow we will be talking about a fire weather watch around the bay area and fire conditions on the rise and as we get into thursday, the rain moves in. not only the rain but we could see some snow in our local mountain tops here, as we're going to see much cooler air move in on thursday and friday. keeping things very unsettled and wet and another storm moving in for the weekend. please, some noise from you. >> [ghoulish laughter ] >> and temperatures in the 50s and the 60s. and i brought you guys some treats. >> oh, nice. >> you steal my clicker and i bring you something nice. >> something is not right about that. >> you get a snickers bar? >> while they enjoy candy why don't we kick it over to traffic. >> thanks, guys. let's go outside and talk about

this accident we've been following in san jose. it is the ramp that has now reopened but they just reissued the traffic alert. it is in san jose. northbound 101, the ramp to northbound 280. it sounds like the reason why they reissued the traffic alert is because they blocked two lanes on northbound 101 right before that ramp. so there is some slowing in the area. but the ramp is now accessible. and that accident actually happened about an hour ago. with a three-car injury crash. and one of the cars overturned. and now coming out of downtown san jose, things look great on 280 itself and it is a nice smooth quick ride all the way up towards cupertino. and elsewhere, across the bay area, let's get a check of the east bay and all of the approaches to the bay bridge. so far looking great. all the way through westbound 24. and eastbound 24, going against the commute is fine as well. and there is some construction going down the east shore freeway and westbound 80 between the albany exit and pal street and emeryville, watch out for various lanes blocked that should be picked up shortly but if you're headed to the bay bridge toll plaza. no delay. no metering lights. no problems getting into san

drug shortages here in the states and in other health news, doctors are now changing the recommendation for people who should receive regular hiv testing. the american academy of pediatrics, is now urging all teens between the ages of 16 and 18 to get regular routine tests for hiv. yale researchers found children saw more ads for soda and energy drinks in 2010 than they saw in 2008. the beverage industry had promised to reduce its marketing of unhealthy beverages to kids. the report also found drinking just one eight ounce sugary drink every day, increases a child's odds of becoming obese by 60%. the scary economy, not keeping people from spending this halloween. the national retail foundation says shoppers will spend more than $2 billion on just costumes alone. and spending is also up for decorations and candy. and analysts say it is a sign people are looking to relieve just a little anxiety.
