[ laughter ] we have some roadwork this morning in oakland between 980 and fruitvale in those southbound lanes. plus more roadwork in the east bay. we'll tell you all about it coming up in a few minutes. >> i don't think i have chained up on the bay bridge in five years. [ laughter ] there is a nasty odor in the east bay. >> hazmat crews have been working through the night it fix a broken crude oil pipeline at concord naval weapons station there. the strong sulphur odor chased some people from their homes in that area last night. now, some people spent the night away from home just so they could get away from the smell. health officials say there is no health risk, just doesn't smell good but they recommend staying indoors or like a lot of people just getting out of

town. some neighbors we talked to were feeling the effects. >> about 6:00 this afternoon it was super strong to where your eyes would get kind of sore, back of your throat would get sore. but supposedly since thursday the neighbors have been smelling it so we called the fire department yesterday and we called pg&e to make sure it wasn't a natural gas leak. >> some people have been smelling the foul odor since last week. the leak is in a 16" pipeline that's owned by conocophillips. no word yet on the cause or on how much oil leaked from that pipe. kristy seifkin is en route. we'll have a live report coming up at 5:00. meantime, it's expected to take at least two days for pg&e to repair that gas line that ruptured in woodside over the weekend. it broke during a pressure test using water. after the line is fixed they will run another test before putting gas in the line. a backhoe may have damaged the

pipeline years ago but nobody reported the damage, pg&e speculates. it's election day in san francisco and voters will choose a new mayor. the candidates include the current interim mayor, ed lee, who is leading in opinion polls. he could become the city's first elected asian-american mayor. other candidates can make history, too, such as state senator leland yee, defender jeff hadachi or city attorney herrera. >> the three leading candidates will be a first for san francisco. >> the election will be decided by ranked choice voting so people will be asked to make three picks in their offered preference so if no candidate gets a majority, the last place finisher is eliminated and the people will have those choices transferred to the second choice. the secretary of state will oversee the elections today in san francisco. several candidates requested the monitors after allegations

that volunteers supporting ed lee engaged in election fraud. it appears to show people in chinatown helping to fill out ballots and stencils. other contests in san francisco include races for sheriff and district attorney. ballot measures including two competing pension reform plans and a half cent sales tax for much-needed street improvements, as well. several bay area cities have mayoral races today including livermore, san rafael and vallejo. newark will elect a new mayor for the first time since the 1970s. dave smith is retiring after 33 years as mayor, one of the longest runs in the country by the way. sunnyvale will decide on measure a which would allow voters rather than the city council to elect the mayor. there are city council and school board races and ballot measures scattered throughout much of the bay area. you can follow the results on

cbssf.com. get complete coverage on the cw at 10 and cbs 5 at 11. some election vandalism. someone broke into mayoral candidate david chiu's campaign headquarters on van ness. his campaign manager says thieves made off with thousands of dollars in computer equipment and rifled through confidential papers. in the meantime, danville police are trying to identify the person caught on camera spraying graffiti. the "contra costa times" reports that the property on sycamore circle had been hit a number of times. so police set up a camera. this video was recorded just before midnight friday. it shows someone way, a light- colored hoodie, spray-painting the graffiti. it is 4:35 now. republican presidential candidate herman cain plans to address the latest allegations against him during a news conference in phoenix today. susan mcginnis report it comes just a day after a former acquaintance held a news

conference of her own claiming cain made a sexual advance on her back in 1997. >> reporter: herman cain will hold a press conference in phoenix today to fight the latest sexual harassment allegations against him. >> i want you, mr. cain to come clean. just admit what you did. >> reporter: monday sharon bialek became the first woman it go public n graphic detail she described how cain touched her inappropriate more than a decade ago when she was looking for work. >> i was very, very surprised and very shocked. i said, what are you doing? mr. cain said, you want a job, right? i asked him to stop and he did. >> reporter: cain insists he had never sexually harassed anyone. >> there's not an ounce of truth in all of these accusations. >> reporter: he tried to clear the air last night on jimmy kimmel live and promised the controversy would not derail his bid for the white house. >> here's one thing people don't know about herman cain.

i'm in it to win it and i'm not going to be discouraged by all of this stuff. >> reporter: the scandal does appear to be impacting cain's campaign. according to a new poll, about 35% of republican voters now say they have negative feelings about him up from 18% a month ago. >> even though he has been shown to be leading in the polls or right up there with mitt romney, there's at least some anecdotal evidence that his poll numbers are dropping. >> reporter: while some political observers think cain will have trouble bouncing back, the presidential hopeful says voters have the final word. dr. conrad murray is on suicide watch this morning after being convicted of involuntary in the death of michael jackson. he was handcuffed and led to jail after the verdict came in. >> week, the jury in the above entitled -- we, the jury in the above entitled action, find the defendant conrad robert murray guilty of the crime of

involuntary manslaughter. >> michael jackson's sister, latoya, gasped when the verdict was read. but murray showed no emotion at all. he will be held without bail until his sentencing on november 29. >> michael jackson trusted conrad murray. he trusted him with his life. he paid with his life. >> the trial lasted 23 days with testimony from 49 witnesses. the jury agreed with prosecutors that murray caused jackson's death by giving him a powerful anesthetic in his bedroom. murray's lawyers plan to appeal the verdict. okay. let's switch gears now. it is 4:38. you finally wore a jacket today, huh? >> i know. a coat, too. >> finally gave in because it is cold out there. and i guess we might have a little storm brewing out there in the latter part of the week center yeah. there's some storms out there, too. >> cold out there, frost advisories up in the north bay at this hour.

it's cold everywhere. it will be coldest in the north bay. some of the temperatures dipping down into the upper 20s and 30s outside so a chilly start to the day. you want to protect the plants, pets and people. numbers right now, running to 34 degrees in santa rose, 36 degrees in napa. some of those wind sheltered areas probably colder than that right now. 38 in livermore, 41 in san jose and a cool 44 degrees in pacifica. high pressure still building in overhead. it is holding on it looks like probably for the next day or so. patchy fog out there, as well. but it looks like we are going to keep the temperatures down. a little warmer than yesterday but still fairly cool. at the coast only 50s. you have some mid-60s in some of the warmer spots inland. but as we head out over the next couple of days, the clouds gather on thursday, move the timing back a little bit. we could see showers on thursday night and into veterans day. that's a look at weather. let's check on traffic now with elizabeth. >> thank you, lawrence. we'll start off with a look at san mateo county. there is some roadwork going on

this morning on 280 right before highway 92. actually closer towards bunker hill where we made this map. you can see a little slowing on our sensors. it looks like one lane will be blocked until 6:30 this morning according to officials with caltrans. now, coming off the upper deck of the bay bridge this is a live look near the fremont street exit. looks good on 101 along the peninsula. the bay bridge toll plaza, you can see no delay. you may find some roadwork in both directions of interstate 80 but that could be wrapping up here very shortly if the cones are not picked up already. and in the south bay now, 880 there are various lanes blocked on northbound 880 in san jose between 280 and old bayshore high. otherwise, coming out of downtown san jose you can see traffic is still nice and light towards cupertino and a quick check of mass transit on this morning, you can see everything is on time for bart, ace, muni and caltrain and your ferries. that is traffic. back to you. >> all right, thanks, elizabeth. hollywood takes on the world's largest ponzi scheme.

been working through the night to fix a broken crude oil pipeline the pipe broke at the concord naval weapons station and it's creating a nasty smell hazmat crews have been working through the night to fix an oil pipeline that broke at the concord navy weapons. kristy seifkin is on the phone from the scene. what can you tell us? how's it smell, i guess, is the big question? >> reporter: well, you know, our noses actually led the way to the scene. we were following the gps and we knew immediately we were at the scene where the leak was. still a very strong smell this morning. it smells a lot like sulphur and this is in fact what tipped residents off to the fact that there was something wrong.

some of them had been reporting the smell a couple of days and finally yesterday, conocophillips who operates the broken pipeline said this turned into a spill. it was reported as a 20-foot by 20-foot spill and a lot of residents report having nausea, dizziness, headaches, and while the health department says there aren't any immediate health threats, there are advising people to either stay indoors or stay way from the area. many couldn't tolerate it. we talked to some residents last night who packed up their bags and actually went to stay in a hotel. the good news is there's no long-term health threat to the residents. hazmat was on scene last night cleaning up the spill. they have continued to clean it into the overnight hours. but there's no telling how long this smell will stay in the air and i have noticed just all of the news trucks that are out here this mornings everyone's jumping right back into their advance after their reports this morning because it's a pretty strong smell, hard to ignore. >> that bad where the minute you got there you knew, oh, my

god. >> reporter: we definitely knew. my videographer was rolling the window down to let air in. i said don't let the air in! it will be worse. it reminds me of a smell when crops go bad in a feeling, mix of sulfur with that scent. i'll bring a dose back to you so you can have a little of the experience back in the station. the good news is there is no hazardous health effects for people so just waiting to get that spill cleaned up. >> kristy seifkin, thank you. we'll check back in later. a san francisco murder suspect is expected to plead guilty today. now, 44-year-old gary scott holland is accused of killing a woman inside her russian hill home. her russian hill apartment last year. publicist kathleen horan was killed with a crowbar and nile. holland was arrest aid few days later after police released a sketch of the suspect. it is 4:45 now. oakland businesses are considering filing a lawsuit

against the city over "occupy" protests. the chamber of commerce says business is down 30 to 40% since the demonstrations began. members say people are afraid to come downtown now and say the city should do more to control the chaos. >> this is having a negative effect on the -- how people view oakland and we're going to lose more business. we're now in a downward spiral. >> "occupiers" say they are not intending to hurt local businesses. they say they identified dozens of small shops and restaurants in the area and they are encouraging people to support those businesses. the financial crisis in italy is now threatening the career of the country's premier. silvio berlusconi insists he won't resign despite a growing call for him to do so even from a close ally. italy's debt is the equivalent of $2.5 trillion u.s. parliament will soon have a budget vote and many say it will be a measure of confidence in berlusconi. the story of ponzi schemer bernie madoff is a step closer

working. the amount of time drivers spend stuck in traffic dropped by 16 minutes. the new carpool toll reduced traffic in the lanes by 26% in the last year. more drivers may be driving in off-peak hours or taking bart. san jose councilmembers may sell city owned land to lew wolff to build a downtown ballpark near the hp pavilion and diridon train station. the city will sell it at a bargain rate but wolff would build it without public money. >> they have a lease to work out. legendary boxer and former world heavyweight joe frasier has died just weeks after being diagnosed with liver cancer. many can't forget the fight of the century with frasier and mohammed ali. as frasier beat ali, it was at madison square garden. it was 40 years ago 1971, believe it or not.

the two fought three times twice in new york city and, of course, who can forget the thrilla in manila in the philippines. joe frazier 67 passes away. a storm chaser got close to a tornado in southwestern oklahoma a little too close. he had a breakdown right as the tornado bore down on him. the car slid into a ditch. it tipped over. he managed to get into another vehicle to continue the storm chase. they're a rare breed. and, of course, the camera was still rolling. nobody was hurt in the accident or by the weather. but they get a little crazy out there in the midwest. >> can you imagine? i just crashed my car but i'm going to get in another one. >> by the way, i have been trying to talk our news director into that for years but insurance could be an issue! >> photographer could be anker

u too. >> exactly, getting somebody to go with me, too, might be a problem. outside now the big chill with frosty temperatures out there right now. north bay valleys frost advisories, 20s and 30s for overnight lows. yeah, it is going to be chilly and likely going to see some frost in spots there early on. so if you are headed out the door bundle up. it's cold to begin with. couple of patches of fog as well but by the afternoon mostly sunny skies and well, still some cool temperatures out there. 50s and maybe some mid-60s in the warmest parts of the bay area. but that's about as warm as it's going to get. numbers right now you have 40 degrees in concord. 38 in livermore. and a chilly 34 degrees in santa rosa. high pressure still holding on here. looks like it will extent end for another day but you already see that next system off the coast. this one likely to pay a visit to the bay area as we head in toward thursday. we are going to stay sunny and cool today. and then it looks like things begin to shift gears toward the latter part of the week. temperatures by this afternoon, plan on about 64 degrees in

santa clara and sunny there. 62 in fremont. 57 degrees, cool in pacifica. as you head to the east bay you will see those temperatures up many spots into the mid-60s and plenty of sunshine. and as you get inside the bay, sunny skies, 62 degrees in san leandro and 56 at stinson beach. next couple of days, we are going to see some nicer weather. warmer temperatures through tomorrow but late in the day on thursday, probably more like thursday night into friday, a chance of rain returns to the bay area showers into veterans day. could see another weak storm into the weekend. that's a look at weather. let's check on traffic now with elizabeth. >> thank you, lawrence. and we're going to enjoy this dry weather for now. take outside show you what it looks like on 101 near the alum rock exit this morning in san jose. you can see these headlights moving northbound and actually looks pretty good a nice smooth ride towards santa clara. to our maps check be the ride on the altamont pass westbound 580 so far in the green so no delay this morning past the wind turbines towards tassajara where we have another camera for you this morning. in fact, here's a liu look westbound and -- here's a live

look westbound and eastbound 580 through livermore, steady drive time 15 minutes or so, looks good. live look at 880 through oakland looks good, as well. overnight roadwork may not be picked up yesterday on southbound 880 between 980 and fruitvale but northbound traffic looks like everything is fine all the way towards downtown oakland. and a quick bridge check. san mateo bridge this is fine. now, if you are heading out towards the peninsula closer towards san mateo county we have ongoing roadwork until 6:30 this morning. it sounds like they have about one lane blocked off southbound 280 by bunker hill. again, that's some ongoing roadwork they are doing in the area but our sensors are picking up slower traffic a few brake lights across the stretch and the marin county commute southbound 101 they did the lane change across the golden gate bridge. i'm not sure what happened to traffic but overall we're not hearing of any major problems now across the span. that is traffic. back to you. >> that's good news. >> i guess so, yeah. >> thank you. the bigger more disturbing warning labels apparently will

not appear on cigarette packs as soon as planned. a judge has temporarily blocked a new federal law that would force tobacco companies to use the new labels. they have graphic images of diseased lungs, rotting teeth as well as other problems that are linked to tobacco. the tobacco company says that those labels violate their right it free speech. kids are still drinking sugar sweetened beverages even though schools have banned them. a university of illinois- chicago survey suggests bans on soda, sports drinks and high calorie fruit drinks in schools have not affected overall consumption rates. it is one of the most anticipated videogame releases of the year. overnight hundreds of people lined up across the bay area for a call of... call of duty modern warfare. there we go. i was thinking it was john madden but this is the army warfare game. this is the crowd outside coleman avenue in san jose at the game stop. the last call of duty game sold
