"occupy oakland" protestors are regrouping this morning, they are on the move after police shut down their camp. kristy seifkin is in oakland this morning where they can continue to gather as long as they don't pitch their tents. >> reporter: well, interestingly there's lots of tents here at snow park. now, those tents taken down at frank ogawa plaza yesterday but

a lot of people have since moved over to the snow park encampment and you will remember that on sunday, the city said it's illegal to stay overnight or pitch any sort of tent or structure in any park. they specifically named snow park as one of those examples. but police haven't raided this park yet so the number of tents is growing here this morning. but they are entertaining the protestors are entertaining several options for where they will go over the next couple of days. one option obviously to stay right here at snow park. a final option is to rebuild that camp at frank ogawa plaza. now, of course, if campers choose to do this, it would be in direct violation. terms that chief jordan laid down yesterday. he told campers they can demonstrate at all hours of the day which is a different message than he originally told them a month ago but kept strong saying they cannot have any tents or any sort of

structures in the area. >> we really don't center any reason to keep people out of the plaza because it's a public domain. if people are coming here to break the law, cause property damage, then we intend to arrest them. >> reporter: now, campers are obviously concerned about where they are going to stay if they are going to be raided. but a concern tort whole public specifically oakland residents is the cost of this whole "occupy oakland" movement. some new figures came out yesterday from the city. they said that at least $2.4 million have been spent since the first tent was pitched at the plaza on october 10. that includes a little over a million dollars in police costs alone. and at a press conference yesterday we learned that of the 13 law enforcement agencies that were brought in yesterday to raid that camp, it will cost the city a half million dollars. and that clean-up that's happening at the plaza and will continue to happen throughout oakland is estimated at $16,000 a day. so certainly, a lot of costs to

contend with throughout this whole process. as we look back at snow park, the count of the number of tents here yesterday afternoon was about 40. it's a little difficult for us to see in the dark how many are here, but from a rough count in the pitch black it looks about roughly that number still this morning. campers are still waiting to see if and when they will be raided. chief jordan said in a police conference yesterday that he didn't raid this encampment yesterday, just raided the main plaza because he wanted to focus resources on that main encampment with the largest number of tents. so he said it's not a question of if but a question of when so the campers is thing here still wondering when they will be next. back to you. >> hard to decipher their message. thanks a lot, kristy seifkin live in oakland. some protestors are using the nickname flipper for oakland mayor jean quan for flipping her position on the "occupy oakland" protest camp. our poll finds 82% of oakland voters disapprove of how mayor quan has handled protestors. and 78% disapprove of how the

mayor is running the city. that is up 7% since our last poll. two top aides to mayor quan have quit including dan siegel her legal advisor. he said he resigned to protest her position to raid the "occupy oakland" encampment. quan says deputy mayor sharon core knew has also resigned effective immediately. the reason is unknown uc-berkeley students plan on an "occupy cal" strike today and participation could be in the thousands there. they plan to march from the city of oakland to the cal campus as seven cal students plan to sue the university now for alleged police brutality here. the students say they were beaten with batons by campus police during a protest last week. the lawsuit will call on the chancellor to resign. threats of violence have prompted uc regents to cancel meetings in san francisco tomorrow and thursday. the regents had planned to get updates from uc staff about using private fundraising to avoid raising tuition but uc

police say anarchists have been planning to attach themselves to peaceful protests by students and possibly commit violent acts. >> there was evidence that law enforcement found very credible that there was some rogue elements who were looking to cause trouble, violence and vandalism. >> several thousand people are still expected to travel to the city for protests and a rally is planned tomorrow in the financial district. there is a new concern at "occupy sf." the spca is urging protestors not to take their dogs to the camp because they could catch a deadly disease. "the examiner" reports that three cases of highly contagious parvo virus were diagnosed among dogs at the camp. experts also think that some dogs may have kennel cough. the camp is growing beyond the boundaries of justin herman plaza. and some businesses along nearby market street have barricades up in order to control the expanded crowds there. and up to 100 people were

arrested early this morning at the original "occupy wall street" protest in new york. police in lower manhattan used a bull horn to let protestors note that they had to clear out of zuccotti park so that sanitation crews could do some clean-up work. protestors were told they could return afterwards but many refused to leave. they even formed a human chain. that prompted officers to make the arrests and begin dismantling the tents. the penn state football scandal could soon be expanding. the "new york times" reports up to 10 more potential victims are now telling authorities about their contact with jerry sandusky. the former assistant coach at penn state already charged with molesting eight boys. meanwhile, sandusky has given his first broadcast interview since he was arrested more than a week ago. he told nbc's bob consist it's by phone last night that he is innocent of the charges but admitted to some detail in grand jury reports are accurate. at one point he said, quote, i have horsed around with kids.

i have showered after workouts. i have hugged them. and i have touched their legs without intent of sexual contact. in a separate interview with cnn sandusky's lawyer was asked if he believes his client's innocence. >> when people hear he got showers with kids, oh, my goodness, he got showers with kids, that makes him guilty, right? i mean, obviously anybody that's a shower with a kid who is an adult has to be guilty of something but the bottom line is, jocks do that. they kid around, they horse around. >> pennsylvania attorney general's office is not commenting on the interview citing, it's an active investigation. california's oldest university has a computer hacking scandal on its hand. the fbi is questioning people at santa clara university after someone broke into the computer system and changed the grades of more than 60 current and former students. all those grades were changed for the better. the unauthorized access happened between june of 2010 and july of this year.

again. >> yeah. we're going to have a great tuesday weather-wise. lots of sunshine coming our way. temperatures a little chilly in spots again and the fog a little thick especially in the north bay valleys. if you are head out the door, it's chilly in spots to the north. 39 degrees in santa rosa, 49 in concord, 51 oakland, 43 livermore. high pressure in control, continued mild weather around the bay area. and that's the way it's going to stay for at least the next couple of days but eventually the jet stream will sag to the south bringing a chance of rain back to the bay area. but not today. you will see sunshine and 67 degrees in livermore, 66 in san jose, cooler at the coast. temperatures there mainly into the 50s. next couple of days fantastic as we'll see plenty of sunshine in the afternoon, just some patchy morning fog early on. late in the day on thursday those clouds roll back n slight chance of showers toward thursday night. better chance of unsettled possibly wet weather as we head in through the weekend. that's a look at weather. let's check on traffic now with elizabeth. >> thank you, lawrence. not too bad so much this

los gatos police are searchg for the attacker. a 17-year-old fought off a kidnapper using martial arts. this morning, los gatos police are searching for the attacker. it happened sunday afternoon on lark avenue near los gatos creek trail. police say the suspect offered to give the girl a ride and when she refused, he jumped out of his car and tried to pick her up. then police used her martial arts training to break free. >> she punched him in the face and kneed him in the groin, causing him to double over in pain. >> the suspect was driving a dark brown sedan with areas on the car painted blue and black. the state assemblywoman accused of shoplifting in san francisco will be back in court today. mary hayashi was arrested last
