at cal state campuses boils over. today.. it's the facu your realtime captioner is linda marie macdonald. student anger at cal state campuses boils over. today it's the faculty's turn what they are doing for the first time ever. a major development in the same-sex marriage debate. how a court decision today could affect the fight over proposition 8. good morning. it is thursday, november 17. i'm frank mallicoat. >> i'm grace lee. we begin with breaking news. right now, police are raiding the "occupy" camp this time at uc-berkeley. >> we just got off the phone with a protestor from "occupy cal." he said 50 to 100 officers showed up about an hour ago and started taking down tents at sproul plaza. this is video from yesterday. police gave verbal warnings yesterday in hopes that the

campers would pack up and leave. about 20 people were still sleeping in the plaza and a few others were hanging around. now we have word that police have started removing the tents and have made at least two arrests. our reporter anne makovec is on the way to cal. she will be there shortly. we'll have a live report in about 20 minutes or so. meantime, the "occupy wall street" movement is planning a day of action at sites all across the country today to mark two months since the protests began in new york city. here in san francisco activists occupied a bank of america branch near their camp at justin herman plaza. they stood on chairs and desks, honked horns and set up a tent at the branch on california street yesterday afternoon the 95 protestors were arrested when they refused to leave. they said they targeted bank of america because of its ties to the university of california regents. and in new york city, activists are marking the two- month anniversary of the "occupy wall street" movement.

you can see these are live pictures as we speak. that's why it's moving around like that. this day of action includes a march over bridges and plans to "occupy" the city's subway system. that's going to be a mess. two days ago new york authorities cleared out the camp where the protests began. faculty is going on strike this morning at cal state east bay, dominguez hills in southern california also. the one day walkout is to protest negotiated raises that have not yet been delivered. the strike comes a day after the csu trustees voted implement the ninth tuition increase in nine years. police and protestors fault outside the trustees meeting -- fought outside the trustees meeting in long beach. one officer was sent to the hospital, four protestors arrested. with the increase basic tuition will be almost $6,000 next fall and there is a $1,000 fee that raises next year total to $7,017. some students at sonoma state university in rohnert

park are camping on campus this morning. it's to protest the latest fee hike. one of the protestors is worried she might have to drop out because of the higher college costs. >> kind of just to show administration and everyone else that we're not just going to sit back and let it happen. >> students are also protesting the cap on the number of units they can take at a time. some of them say it will take them longer to graduate because of that. 4:33 now. some grim news out of sacramento this morning. the state is $13 billion in the hole. among the possible options, $100 million cut each to the uc and california state systems, $200 million from social services mostly from the disabled, and public, elementary, middle and high schools may have to cut their teaching year by 7 days. state leaders are expected to decide on those cuts next month. the collapse of fremont- based solyndra will be a big

issue in the nation's capital this morning as a house committee questions energy secretary steven chu. the energy commerce committee is looking into a half million- dollar federal loan to the company which declared bankruptcy and ceased operations this summer. according to chu's prepared remarks, he is taking responsibility for the key decisions on the solyndra loan, decisions made after rigorous scrutiny and a healthy debate. state supreme court this morning plans to release an opinion on an issue connected to the same-sex marriage battle. it's about sponsors of proposition 8 and whether they are entitled to defend the measure in court. when the governor afternoon attorney general refused to do so. voters in 2008 approved prop 8 which limits marriage in the state to men and women couples. prop 8 supporters want to appeal the federal ruling that declares the law unconstitutional. we are learning more about the uc-berkeley student shot and killed by police. he was 32-year-old christopher travis. we have video of him that a

former employee made a few years ago. travis was an undergraduate transfer student from fremont. tuesday, officers responded to a computer lab after a staff worker saw a gun in travis' backpack. an officer fired at him after he refused to drop the gun. travis' uncle believes police were too quick to act. >> if they did ask him for the guns, i can see him reaching in the bag and grabbing it by the handle and you know, going like that and to hand it to them. i can just see him doing that. and not even thinking, you know, by grabbing it by the barrel and handing it to them. >> witnesses say they saw travis acting strangely in the last few weeks. surveillance video of the incident has been handed over for the investigation. and for the first time in yearsings the fbi now says they have a lead on an animal rights activist wanted for two bombs in the east bay. daniel san diego was apparently

spotted in massachusetts. 393-year-old has been on the run since 2003 after attacks on the chiron corporation in emeryville and shaklee in pleasanton. after battling 1,000 since, what, sunday i guess we had rain orn saturday. our weatherman is about to strike out today. [ laughter ] >> he already has. >> yeah. we have a chance of some showers. how are you guys today, good. >> pretty good. >> a little here's today, grace. glad you're back from a midweek vacation. >> it was not a vacation i wanted to take. >> glad to have you back. around the bay area, we have a lot of clouds in the valleys but we have a cold front that will be diving in later on that could bring showers to the bay area. 39 degrees in santa rosa. 46 in livermore and 50 in san jose. here's a cold front for you. not a strong one but it's going to limp as it makes its way down the coastline here into the afternoon. i think a better chance of showers into the late afternoon

into the evening hours. numbers today will be noticeably cool the other side. plan on 63 degrees clouds in san jose, 63 in concord. 59 degrees in san francisco. and out over the next couple of days now the weather is going to change quite a bit. this looks like it will open the door to more showers on friday. going to keep things unsettled possibly into saturday and on sunday. drying out monday and tuesday, but heading into the holiday we could see some rain on thanksgiving. more on that in a bit. that's a look at weather. let's check on traffic now with elizabeth. >> thank you, lawrence. there's some horsing around going on in this studio. where are the bosses? all right. [ laughter ] let's go out towards -- what did i put up first? the golden gate golden gate. we have some roadwork right now that may slow you down including if you are coming up northbound 101 they are doing some more work on the doyle drive reconstruction project. the last exit, the last san francisco exit before the golden gate bridge is closed until about 5:00 this morning. that is according to caltrans. just a heads up there. otherwise you can see a little bit of fog in this camera, as well. once again, it was a foggy commute yesterday there, as well. out towards the bay bridge, nice and light this morning

heading into san francisco. you will find some lower deck roadwork on eastbound 80 as you approach the decline and more roadwork in oakland. this time, it is between 16th avenue and fruitvale so watch out for that. looks okay past the coliseum. westbound 580 no delay out of the altamont pass. most drive times around the east bay are clear including 24 out of the caldecott tunnel and bart, ace, muni and caltrain and your ferries all on time. back to you. >> horsing around? >> that's you, elizabeth. children's hospital. they want to know why he died following a dental surgery. jermaine mcelroy survived multiple open heart surgeries. the family of a 4-year-old boy wants answers from oakland children's hospital. he died during dental surgery after surviving multiple open heart surgeries and having a pacemaker. he was getting dental surgery and went into cardiac arrest and died last week. >> they said, unfortunatelier, didn't make it. we worked on him for 45 minutes. >> his vital signs were excellentful the carbon dioxide coming out of him during the procedure was normal and excellent. >> the boy's grandmother says he was given gas as an anesthetic which he was not supposed to have because of his heart condition. the results of an autopsy may be released next month. and do you recognize this

man? detectives say he tried to kidnap a 17-year-old girl near the los gatos trail last weekend. the girl fought back using her martial arts skills. he interested in the scene in a dark brown station wagon with a bad paint job. bart's board of directors will meet in oakland this morning and the agenda may include more discussion about cell phone services for passengers. at issue is whether the transit agency should be allowed to turn off the antenna in parts of the underground system. there was controversy this august when bart temporarily sit off the phone service to prevent a -- shut off the phone service to prevent a rumored disruption by protestors. board members will consider using buses for new overnight service on bart trains. leaders wanted to extend the service for people working night jobs. they ran into resistance for others who needed bart for transportation who needed jobs early in the morning. today members will consider running buses after midnight

when the stations are closed. a temporary worker is accused of stealing from the videogame maker zynga in san francisco. 21-year-old keith brown from san ramon was arrested at the company's headquarters. the examiner reports that he was caught on video taking computers and software worth about $100,000. brown is due in court this afternoon. and music fans, hey, you guys have a new option. >> we do. google has unveiled its answer to apple's itunes store. google music launching yesterday. users can use the site to store, stream, share music with their friends, which is nice. songs will be accessible through computers, tablets androids, smart phones and the google plus social network. apple's itunes does not allow users to share music free but google apparently does so that's a big bonus. he is said to be obsessed with president obama. the details about the man accused of shooting at the white house. pizza a vegetable? the nutrition guidelines that's

u-c berekeley. police are raiding the occupy cal camp.. a spokesperson with the breaking news at uc- berkeley. this is video from chopper 5 last night. right now police are raiding the "occupy cal" camp. a spokesman with the "occupiers" says about 50 to 100 officers showed up about an hour ago and they started dismantling, taking down the tents at sproul plaza this after protestors refused officers' verbal warnings to pack up and leave. about 20 people were still sleeping in the plaza. a few others were hanging around. police have made at least two arrests. anne makovec has just arrived on the scene. we're going to get a live update coming up in a few

minutes. in the meantime a man suspected of shooting at the white house is due in federal court this afternoon. 21-year-old oscar romero ortega hernandez from idaho was arrested at a hotel in pennsylvania yesterday. he is accused of firing an assault rifle at the white house on friday. authorities say he was apparently obsessed with president obama and felt he was on a mission from god to attack the white house. 4:47. a pennsylvania lawyer says his client will testify that he was sexually assaulted by jerry sandusky, a former assistant football coach at penn state. now, the attorney says he expects other sandusky accusers to come forward, as well. sandusky is accused of sexually abusing eight boys. others have stepped forward, as well. the mother of one alleged victim says her son's school questioned the boy after she complained about sandusky actually taking him out of class without her permission. she spoke by phone with her

voice altered to cnn. >> i three times called the police right now and they said no, you need to think about -- they said i needed to think about the ramifications of what would happen if i did that. >> what do you think they meant by that? >> i don't know. i'm assuming what we're going through now. i don't really know. >> sandusky is awaiting a preliminary hearing next month on 40 criminal counts. police say they have no records that indicate mike mcqueary contacted them with allegations that sandusky abused a boy in a locker room shower on campus. mcqueary was a graduate assistant at the time of the alleged incident a few years ago. he reportedly emailed a friend recently saying he told police what he saw at the time but police departments at penn state and the city of college station say they don't have any evidence of that. four people are dead after a storm system unleashed several possible tornadoes in the southeast. three of the deaths were in south carolina in a rural community near rock hill. five others were injured there

yesterday. suspected tornadoes were also reported in louisiana, mississippi and alabama leaving thousands without power. storm systems down there are no joke. >> our weatherman was on a cleaning spree a few minutes ago, cleaning the tabletops in the entire newsroom. so if you want to rent him out, you can. >> come to my house! >> frank is starting to say that he's getting sick. he is doing that whole sore throat thing. >> tomorrow's friday. [ laughter ] >> i see what he's doing now. >> i'm on you, frank. i gotcha. >> hey, folks, are you headed around the bay area today, we are going to see some big changes as even a chance of vein going to move in buy late in the day. this morning -- even a chance of rain is going to move in by late in the day this. morning, low clouds and fog and low clouds into the bay. but as we head toward the afternoon, there's a chance we could see some showers. nothing major but it can be a little wet for the commute on the way home especially in the north bay and toward the coastline. temperatures will be noticeably cooler toward the afternoon as this cold front begins to pull into town and usher in some

much different weather over the next few days into the weekend. not much to this cold front. probably going to die towards the bay area as well so the low dropping south for today. not a big storm system. but enough to possibly get things a little bit wet as we head toward the latter part of the afternoon and evening hours. so chance by the evening around the bay area with some much cooler temperatures en route toward the bay area. low clouds and fog extending inside the bay right now. then you will notice that cold front starts to move in. and by 3:00 we begin to notice on our computer model the chance at least of scattered showers. you can see nothing really well defined and that's what we are going to see as the system moves through just widely scattered showers. behind that overnight tonight and into tomorrow we get into some more scattered showers and it will be unsettled and wet toward tomorrow and much cooler around the bay area where many of those temperatures will struggle to get out of the 50s by tomorrow afternoon. highs today about 63 degrees in san jose. 63 in concord. 59 degrees in san francisco. and about 57 degrees in pacifica. looking out over the next few days, yeah, it's been nice but

now we get back to some wintry weather as it looks like a few storm systems are likely to roll in here. it will be interesting. none look very big but we have a chance of showers this evening. a better chance of showers around the bay area much cooler temperatures for tomorrow. another storm system swings in on saturday but doesn't look like a real big deal but could get wet into sunday morning so i don't think it's a complete washout for the weekend. i think just on and off possibly a few scattered showers here and there. cold on the weekend 50s and that's without the wind blowing. >> i can't believe it's going to rain on our weekend. >> and thanksgiving. >> great. >> you're all inside. you get all that comfort food. >> can't move anyway after that meal. >> we'll be all comatose by 5:00. >> no kidding. >> friday show should be good. >> it's going to be great. >> a turkey coma. >> going to stay inside, hide from the rain. >> all about the coastline sir, the soup, the fire. the fireplace. i know, i'm all about it. let's go outside. i think we have a life shot of

the golden gate bridge. from marin we have overnight roadwork. if you are coming northbound 101 by doyle drive, they are doing more work on the reconstruction project. so the very last exit into san francisco it remains closed until about 5:00 this morning. so you don't want to get caught heading towards the golden gate bridge. again, they should be wrapping that up by 5:00 according to cam trans. southbound 101 looks okay from 580 towards the golden gate bridge plaza. 11 minutes. overnight roadwork could slow you down, quiet out of downtown san jose. here's of a live look just a couple of headlights there approaching the 880 interchange. but there is some roadwork on 880 both directions between old bayshore highway and 280 so watch out for that. looks good out of the altamont pass, not too bad towards vasco

road in livermore. 880 through oakland another live look. you can see oracle there, looks good to hayward. roadwork between fruitvale and 16th avenue so various lanes blocked likely to be pick them up shortly. in the meantime coming up along the peninsula, 101 is moving fine. this is a live look near bayshore and 280 looks okay, as well. so again, it is not quite 5:00 in the morning so that's why things look so good out there. and mass transit, bart on time. ace train one is looking great. muni, caltrain, ferries, everything pretty much giving us no problems and no metering lights at the bay bridge. no delay across the upper deck. roadwork on the lower deck approaching the decline section if you are heading into oakland. remember kcbs once you do hit the roads. they're our radio partners. and you can find them at 740-am and 106.9-fm.

plans for an independent study of scanners' health effects. he said studies have shown the back scanner machines emit the same amount of radiation as a passenger gets during three minutes in flight. tsa has 250 of the backscatter machines i guess they are called. they use x-rays to check passengers. pizza, yes, it tastes good but would you call it a vegetable? lawmakers in d.c. are set to vote on a bill that allows for just that, believe it or not, for pizza to be counted as a vegetable in school lunches. the reason? it's the tomato sauce. while some may balk at that, one bay area health expert says, yeah, there's some nutrition in there. >> i don't care if it's a canned tomato, i don't care if it's a frozen tomato, i don't care if it's a fresh tomato, it is still considered a serving. >> now, pizza would count as one vegetable serving as long as it has at least two
