causing a huge traffic problem now. eastbound 24 at pleasant hill road. you can see it in the westbound lanes heading toward the caldecott tunnel but it's not impacting traffic in the commute direction. we'll have much more on this fatal accident, when they are expected to clear it plus a check of your other commute across the bay area. let's check the forecast. some rain is in the picture? >> yeah, elizabeth. nothing real impressive yet. but the clouds to the north will be dropping down to the bay area especially towards the afternoon. chance of scattered showers. temperatures are expected to be much cooler outside today only in the 50s for highs. we'll talk about your weekend forecast coming up in a just a couple of minutes. >> thank you. a memorial is growing for a fallen vallejo officer. the massive manhunt for the gunman is over. >> officer jim capoot was shot on janice avenue while trying to catch suspects from a bank robbery that happened a few miles away. gil diaz is in vallejo, where police are holding a suspect at

this hour. gil, good morning. >> reporter: hi, guys. good morning. we are outside the police station as you mentioned, frank, there is a growing memorial happening right outside the lobby. taking a closer look, you see bouquets the flowers, balloons, lit candles, even personal notes to officer james capoot and his family. now, something like this doesn't happen very often here in this town. in fact, officer capoot is the first vallejo officer to be killed in the line of duty in more than 11 years. take a look at his picture. this is officer capoot. he was 45 years old. 19 years served as part of vallejo police department. he received two medals of courage while he was working here. prior to vallejo pd, he worked for chp and also served in the marines. here's the scene yesterday afternoon. this is a 100 block of janice street. this tragedy began unfolding around 1:30 yesterday afternoon. capoot responded to an alleged bank robbery happening at a

nearby bank of america on springs road. he spotted the alleged suspect vehicle which was a silver suv. he chased after it for a good three to four miles. he forced that suv to spin out of control. and the suspect allegedly ran out and here's what happened next. >> shortly after exiting his vehicle and chasing the suspect, officers who were arriving just moments later heard several shots fired. they discovered our officer down in the backyard and he was mortally wounded. >> reporter: and capoot was rushed to kaiser hospital where he later died. as you can see, his comrades at the police department gathering outside the hospital for support. and taking a live look of a sign posted outside the police department's lobby doors, it says, the lobby is closed due to an emergency. of course, it's probably

referring to the tragedy that's happened yesterday afternoon. as for the suspect, there were preliminary reports that there were as many as three suspects but after a search last night, they think they got one person. they have not revealed or given any details of that suspect description. back to you guys. >> keeping those details very close to the vest. all right, thanks, gil. dozens of law enforcement officers and members of the community watched as a van carrying the body of officer james capoot drove away in a procession from kaiser vallejo. officers capoot was beloved in his community of vallejo where he worked and vacaville where he lived. he received two medals of courage, two life-saving medals and a number of other honors in the vallejo police department. and he was a mentor and a coach in the community helping a number of young people. >> our prayers go out to him and his family right now because i know it was a tough time. i'm going to miss him because he was there for me for a lot

of stuff with my family. >> he basically kind of helped raise me. he is basically family. he is like family to me. >> capoot was not coaching this year because he and his wife had taken in two children of their friends who were killed in a motorcycle crash. >> wow. it is 4:35 now. it is official. the "occupy" san francisco encampment is now a public health nuisance. but is a police raid imminent? protestors aren't sure. anser hassan is at justin herman plaza where campers i might imagine are anxious. >> reporter: that's right. they received word of a possible rate but the tents are still up. we are waiting to see what happens. that's the question since mayor ed lee is promising to crack down and enforcing stow code. there are a number of san francisco police officers and sheriff's deputies outside monitoring the tent city this morning.

city authorities say justin herman plaza where the tents are set up is now a public health nuisance. officials walked through the camp on thursday citing incidents of feces, urine, tents too close together, unserviced portable toilets. they gave demands including waste and illegal drugs. i spoke to protestors this morning and they say they are trying to make all the necessary changes. i walked through the camp with an "occupy sf" janitor who showed me they put up recycling bins, they closed down a kitchen as required. they are saying they are doing what they can to get in compliance. the health director of the city says there has been progress especially after getting rid of the animals. we haven't seen any pets here. that's a huge improvement from previous weeks. no animals. does anybody see any dogs or cats? you know, a few weeks ago there were as many as 25 here. that's a huge improvement. >> reporter: here are live

pictures of market street. you can see the tents on market street have been taken down as part of the city demands. both the city and protestors say they are trying to work cooperatively and make things happen, keep it peaceful but now still possible raid could happen. we're waiting to see if it will happen this morning. back to you. >> it looks like they are trying to work with the "occupiers" though trying to get them in compliance. you would think as long as the campers are trying to work with them, they are probably safe, don't you think? >> reporter: well, that's the big question, frank. you know, the "occupy" protestors that i spoke with say that the compliance rules that then given are hard to meet, that every time they meeting is, something new is added to this list. so that's one issue. also, mayor lee said they are in violation of the codes. but even if they get in compliance, how long will these tents stay up? you know, they doesn't want them here forever. so looks like something is going to have to come about and we are waiting to see what the

change will be and when. >> that's a good point. they will not be there forever. that is for sure. anser hassan live in san francisco, thank you. uc-berkeley administrators planning to meet with "occupy" protestors this afternoon to discuss whether tents should be allowed back at sproul plaza. it's basically tent-free for now after police raided the "occupy" cal camp yesterday morning. groups had a general assembly yesterday electing to postpone reee erecting the tents until monday. this was the scene in downtown san jose yesterday evening. hundreds of union members marched from king library to city hall, where they joined the "occupy san jose" protestors. they called for government and corporate reform to create more jobs. "occupy san jose" members voluntarily removed their tents from city hall plaza wednesday night as a result of city officials asking them. [ chanting ] and things are not so peaceful at new york city now

home to the original "occupy wall street" movement. yesterday, thousands of demonstrators angrily took to the streets. you see it here, as well as the subways and around the new york stock exchange. thousands of people many later marched to the brooklyn bridge. about 300 protestors were arrested including 5 accused of throwing liquid into the faces of several police officers. we have good news for commuters. a much cleaner bart ride is on the way. the transit agency will replace its blue wool seats with durable vinyl ones in 100 cars next year. this is costing bart close to $2 million. but if riders like the new seats, another 100 cars will get them, as well. bart leaders gave the green light to late-night service with buses. now them staff members to come up with a proposal for the service when trains shut down. they have to figure out who would operate the buses and how to pay. the board hopes to have the late-night bus service up and

running sometime next year. let's get traffic and weather. traffic first. a deadly accident out in the east bay. let's toss it over to elizabeth for the latest. >> reporter: in lafayette, it is against the commute eastbound 24 right there by the pleasant hill road exit. they have it all flared off. three left lanes are completely closed right now so traffic is getting by but only in that one far right lane. one person is confirmed dead according to chp. this was a multi-vehicle accident. at least three cars were involved. this happened about an hour ago but it sounds like they are still waiting for coronerget out there. they are still waiting for a tow crew. so we just don't know how long this investigation is going to go on so this will likely impact the morning commute. now, again, it is going in the eastbound direction. it is not impact the westbound lanes of 24 if you are heading towards the caldecott tunnel. mostly just a visual distraction in the commute drive. but otherwise, expect some delays because again we just don't have an estimated time of clearing. now, except for that problem everything else is quiet including if you are heading

towards the bay bridge toll plaza. but again, rain showers are possibly predicted i guess for later on in the morning commute so it could be slick in spots. we'll check mass transit coming up. in the meantime let's check the forecast. here's lawrence. >> does look a bit unsettled around the bay area. even seeing some light sprinkles now but widely scattered and not a lot out there but more to come especially as we head in toward the afternoon. the cold air in place. and you have these cold speckled clouds beginning to drop down to northern california. eventually that air makes its way into the bay area so not only is that going to make for a chilly day but we have a chance of occasional showers as the system begins to slide on by. so, it looks like we are going to see the temperatures much on the cool side. right now, you have 40s and 50s. by the afternoon, really not a whole lot of improvement. highs only as high as 58 degrees in livermore, about 54 in pacifica. and about 55 degrees in san francisco. the next couple of days, well, right now we're calling saturday just partly cloudy. it looks like we could see some showers overnight on saturday night possibly into sunday but even that one doesn't look like a big deal.

at 43. and now, hard to believe but it was 30 years ago this month that actress natalie wood died at the age of 43. and now homicide investigators are taking another look into what was declared an accidental drowning at the time. woods' body was found in the

waters off catalina island back in november of 1981. investigators concluded she had hit her head while falling off a yacht after a night of the drinking, possibly while trying to board a dinghy. but the l.a. county sheriff's department announced just yesterday it is now re-opening the case after new revelations from the coast guard and recent comments from the yacht captain. >> natalie would never in a million years take that dinghy out by herself. >> among the others on the yacht at the time wood's husband robert wagner and actor christopher walken who reportedly had an argument. a wagner spokesman released a statement saying the wagner family supports the sheriff's departments efforts but has not yet heard from any of the investigators. cbs series "48 hours: mystery" will have more on this show business mystery saturday night at 10:00 right here on cbs 5. there are new allegations of child molestation at a prominent college this time syracuse university in upstate

new york. syracuse police are investigating allegations against bernie fine who has been an assistant basketball coach at the university for 35 years. two former ball boys who are now adults have told espn that fine molested them for years starting in the late '70s. this follows a child sexual abuse scandal that broke two weeks ago at penn state. and secret service agents are now protecting herman cain. cain asked and got the protection after receiving what the homeland security department deemed credible death threats. normally the secret service provides a detail for each party's presidential nominee. but like the case with barack obama, the service can be provided to any presidential hopeful before the nomination if there are credible threats. on a lighter note david letterman spoke with herman cain on "the late show" last night. last night or tonight? could be tonight. >> cain talked with -- we'll see here. cain talked with dave about his 9-9-9 tax plan and about saving

nineteen- year- old alexander youshock is under court order to pay restiution of more than 100- thousand dollars for his attack

on s gh 29-year-old alexander youshock is under court order to pay restitution of more than $100,000 for his attack on san mateo's hillsdale high school two years ago. he pleaded no contest and is expected to be in custody for decades. the restitution is for damage from bombs he set off and for teachers salaries while the school was closed because of the attack. the family of slain east bay nursing student michelle le is organizing a group to help find other missing people. the group will meet tomorrow and plans to work with families of people missing in the bay area and eventually the entire west coast. le was missing more than three months before her body was found back in september. a possible roadblock for high-speed rail in california the u.s. senate yesterday approved yesterday that eliminates future funding for high-speed rail the house had a similar vote. it adds more doubt now to california's project with an

estimated cost that ballooned to $98.5 billion but governor brown said last week, he does intend to let the voters approve the project and hopefully move it forward. secretary of state hillary clinton will travel to the asian nation of mia mar next month. president obama says it could bring progress to the company known as burma. it's still under sanctions from the u.s. and other western nations because of brutal attacks on pro-democracy demonstrators as recently as 2007. went for a walk yesterday a lot of mist coming at me. >> we still have a little spritzing. >> this is a good day for a bowl of clam chowder. >> are you buying? >> i'm buying, guys! you're on! temperatures by the afternoon. widely dispersed sprinkles in the north bay right now, temperatures 40s and 50s. this afternoon not much improvement in the temperatures and looks like the showers will be on the increase throughout the bay area. numbers going to be way down with highs only into the 50s. you can see the system sliding on by. the main cold front is on its way to the south. but we have all that cold air behind it. and that's going to be working in toward the bay area as we head toward the afternoon. and that means unsettled weather and much cooler conditions. all that air really diving out of the gulf of alaska so yeah, nice and cool and as we head toward the weekend we are going to keep things unsettled. this next system moving in late saturday night into sunday. could skirt the coastline and bring us another round of showers. computer model picks up on this pretty well. lots of clouds not a lot of rain. but this afternoon we see showers in the bay area around 2 p.m. and then across the rest of the bay area and shut settle down overnight. tonight toward tomorrow morning doesn't look like a rainout for

the weekend. although we could see some occasional showers especially saturday night into sunday and especially near the coastline. highs today will be chilly though bundle up. 50s around the bay area. next couple of days unsettled partly cloudy for saturday. chance of showers as we head in toward sunday and then a return of dry weather on monday and tuesday. maybe some more rain as we head toward thanksgiving next week. that's a look at weather. let's check on traffic now with elizabeth. >> thank you, lawrence. unfortunately we are following a multi-vehicle fatal accident in lafayette. it's going against the commute eastbound 24 right by the pleasant hill road exit. they still have it flared off. three left lanes are closed so traffic is only getting by in the far right lane. again, one person was confirmed killed in the crash. we are not hearing of any other serious injuries. this happened around 3:15 and as far as we know the coroner still has not arrived on scene, still waiting for tow crews, as well. there are a lot of flashing lights a lot of emergency vehicles out there, as well.

it is not causing any major delays yet but don't have an estimated time for how long the investigation will go on so it's mostly a visual distraction if you are in the commute direction westbound 24 out of walnut creek towards the caldecott tunnel. again, no major slowing yet. in the meantime, as lawrence mentioned, we're expecting some spritzing i guess for the morning commute so mass transit might be a good option this morning. bart is systemwide on time. bart, ace, muni and caltrain and your ferries all on time. here's a live look at the nimitz 880 through oakland. so far everything is great past the coliseum. this camera looks different than typical. so the northbound commute direction is the left side of the screen. that's about 15 minutes between 238 and the maze. and a quick look at the golden gate bridge where everything actually looks okay. not a lot of fog out there so looks good across the deck. that's traffic. back to you. >> thank you. 4:54 now. there is increasing evidence that your blood type could

determine your risk for a stroke. men and women with type ab and women with type b blood face greater risk for stroke compared to people with type o blood. people say with type ab and b blood have more proteins on the surface of the red blood cells and that makes them more likely to clump an stick to the blood vessels. there are downs of whether an mri is the most effective screening test for breast cancer. doctors at a hospital in new york say mris can be useful for detecting breast cancer in high risk women but not all of them. researchers also found that mris do not always lead to better surgical treatments or survival rates. 4:55. cal and stanford fans gearing up for the annual rivalry football game this weekend. of course that's a big game but last night students from both schools had a common goal beat the machine. top students from both universities scaring off for a game -- square off for a game jeopardy against the all powerful watson the ibm

computer that bested jeopardy's all-time champion. although the school rivalry was on their minds, the students said they just wanted to see someone beat the machine. >> it's just a game of jeopardy. there's football and hockey to be played. we'll try to beat stanford at those but if stanford wants to beat watson, i think that's a lot more, a lot bigger. >> no such luck though. watson came on top by $1,000. cal finished second and, of course, they should have. stanford finished third. ucla did not participate. [ laughter ] >> trying to knock my alma mater. >> we'll see what happens in the football game. grand finale this morning for the man who spent five decades on tv. got to love it. >> today's is regis philbin's last day hosting live with regis and kelly. the talk show host broke his own guinness world record for having the most time on air. that adds up to, get this, more than 16,000 hours. philbin promises to keep his eyes dry when he signs off for the last time today. so far, there are no plans for his replacement.
