[ laughter ] >> now i'm really depressed. what's going on with the wind? >> windy, windy, windy around the bay area. it's howling pretty good. toward the embarcadero you can see the waves out there and also a lot of debris on the roads. so if you are traveling, boy, had to dodge a couple of things on the highway this morning coming in. the winds expected to continue for the better part of the day. windy in spots, gusts in excess of 50 miles per hour, gusts up to 70 miles per hour across some of the tops of the mountains. those winds will be subsiding. we'll tell you when coming up in a couple of minutes. of course, the weekend not too far away now. elizabeth. >> thanks, lawrence. we have gone from fog advisories to wind advisories. be careful crossing bridges. we'll have a check in a few minutes. thank you. the wind is leaving a mess around the bay area. it's whipping out there. there are power out angles, fallen trees and some traffic

problems as well as power outages. a heavy pot plant blew over at the embarcadero center here in san francisco. pg&e is dealing with thousands of outages right now. more than 20,000 in the dark in the santa cruz mountains. and in the east bay, 480 are out of power in the south bay. 800 in the east bay. north bay just 50 there. now, winds sent a tree crashing on northbound highway 101 yesterday in sunnyvale yesterday afternoon. nobody was hurt but two lanes were closed to clean it up. traffic backed up for miles. there was another tree down on northbound 101 in sunnyvale blocking all lanes for a while but it's cleared. cal fire on high alert because of the winds. crews gearing up for potential problems. this is the time of year the fire season is winding down with the rain coming but today they have increased resources because of the wind threat.

we'll have a live report at 5:00. it's not just here. dangerous santa ana winds are whipping across southern california this morning. los angeles international airport has a number of flight delays. power was out for part of the airport for a while last night and they had to close one of the four runways so that crews could clear blowing debris. overnight shaking in the east bay. a magnitude 2.3 earthquake hit the berkeley hills at 10 after 11 clock last night. more than a dozen people in the area reported on the usgs website that they felt it. there was a magnitude 1.8 aftershock at 12572 this morning. it is 4:33 now. "occupy" protestors in san francisco face a deadline. if they are not out by noon, the city plans to move in on the big camp on the embarcadero. anne makovec at justin herman plaza with the campers's demands. >> reporter: this could be the last morning that you see --

not only that bus that's rolling through of course right in the middle of our view but the tents there behind me, between 100 and 200 tents still here this morning in front of a deadline of noon that the city says these tents have to go. officials said yesterday in another round of negotiations with these protestors, they are trying to encourage the camp to move to a former school site in the mission district. but so far, there aren't a lot of bites here from the camp. we don't see a lot of people pulling up stakes. the campers would have to sign a contract and agree to a list of conditions, like keeping the site clean, no alcohol, no minors, no stoves, protestors would have to be out of the mission site by the end of june. "occupiers" want more concessions, like allowing dogs at the new site. but the city's offer might not last much longer. the plan is to start cleaning justin herman

plaza today. >> city crews will start restoration of the grassy area and return the park back to the people of san francisco. >> reporter: the city is not giving any specifics on its plans. would it move in by force if the protestors refuse to leave? we're not sure. but officials do say no matter what protestors decide, there is only going to be only one "occupy sf" going forward, not the one here at justin herman plaza. san francisco has taken different tactics with this, negotiating much more than other cities and also offering this alternative camp. >> anne you get the feeling with what they did in l.a. yesterday, what they have done in philly and new york and, of course, oakland a few weeks back, that it was just a matter of time before they said, it's time. >> reporter: and the protestors that i have spoken with about this say, yeah, they realize that there's no way this camp is going to remain here. but the question is, do you go

down fighting take a stand or do you continue and move into the mission? >> at least they have an option if they want to move. okay, anne makovec live in windy san francisco this morning, thanks. and more "occupy" protestors up in santa rosa have taken down their tents because their camping permits expired at midnight this morning. last week, police cleared out campers without permits from their spots outside city hall. now, the city stopped issuing permits citing sanitary and health problems there. on their website, "occupiers" promise to maintain a daily presence at the santa rosa city hall. they will hold a rally for the students on saturday. protestors down at santa cruz occupied a vacant bank building last night. officers say the protestors using couches, filing cabinets, furniture, anything to keep the police out. the protestors and police said the situation turned hostile and almost got out of control. protestors lashing out at the media as well shouting for them to turn off their cameras.

officers left the area to reconsider their options. the family of a toddler is still holding out hope that he can survive a shooting. about 30 people gathered in west oakland yesterday evening at a vigil. this was for 23-month-old hiram lawrence, jr. the vigil was at a liquor store parking lot on willow and 7th streets where the boy was shot in the head monday. six others were wounded when gunmen opened fire on their group, which had been making a rap video. hiram lawrence, jr., is in a coma at children's hospital oakland. >> they ran a couple of tests, brain stimulation tests. he responded to them i guess in a manner that was positive. and right now it's just touch and go. >> police say the search for the gunmen has been hampered because victims and witnesses have not cooperated. today the mr. bush have a chance to pay respects to a san jose soldier killed in afghanistan. >> you know, he was just days

away two weeks away from returning home. i'm proud of him. >> that was the mother of a california national guardsman sean walsh speaking at moffett field where his body arrived by plane yesterday afternoon. he was 21 when he died in a battle two weeks ago in afghanistan. today's public viewing is between 9 a.m. and 9 p.m. at the oak hill memorial parks chapel of the roses. a funeral is planned for saturday in saratoga. and in vallejo, more than 4,000 police officers from all over the country attended the funeral for officer jim capoot. the 45-year-old was remembered as a lover of cars. he loved country music, too, and the dallas cowboys. he was shot and killed two weeks ago while chasing a suspected bank robber. the search is over for a man accused of running down a firefighter in san francisco. police arrested a man late tuesday night. he allegedly ran over albert

bartell early thanksgiving morning. bartell remains hospitalized in critical condition. the car that hit him is still missing. it is a black 2011 mazda with california plate number 6syv525. it may have front end damage. police say it may be at a body shop, possibly in vallejo or san mateo county. 4:39 now. if you haven't been outside, and many of you haven't i imagine at this hour, kind of windy at this hour. >> debris on the roads, be careful traveling this morning. a lot of stuff blowing around. strong winds overnight. here's some gusts for you right now around the area. looks like those winds gusting to 48 miles per hour right now in los gatos. berkeley checking in at 47-mile- an-hour gusts there in the oakland hills and half moon bay, 42-mile-an-hour gusts and 40-mile-per-hour gusts in oakland. it's variable out there so one minute it can calm down and the next minute they are blowing

through. high wind warnings above 1,000 feet gusts in excess of 70 miles an hour. down below wind advisories in effect until 6:00 tonight. as we head toward the afternoon the winds should subside. temperatures mild in many spots right now. 58 in oakland. it is 57 in san francisco. a cool 49 degrees in santa rosa. by the afternoon, the temperatures running up into the 60s almost 70 degrees in some spots like santa rosa. 68 in mountain view. plenty of sunshine all around the bay area. will that continue for the weekend? we'll talk about that coming up in a few minutes. right now, let's check on the roadways with elizabeth. >> thanks, lawrence. yeah, the sunshine was great to see yesterday. so from fog to wind now. we have advisories in effect mostly on the bridges. first a live look through walnut creek near the 24/680 interchange. so far everything is still fine on southbound 680 through the san ramon valley. you may find roadwork in lanes through danville. outside 880 the nimitz, usually when the winds pick up this camera starts to move back and

forth quite a bit. so far it looks okay. pretty steady there past the coliseum and all the way towards downtown oakland. but yes, doe have those high wind advice -- we do have those high wind advisories in effect overnight for the bay bridge, dumbarton bridge, san mateo bridge, and the golden gate bridge. even the antioch bridge. so just about every bridge in the bay area you got a wind advisory this morning. here's a live look at traffic from marin across the golden gate heading into san francisco. overnight a traffic alert in sunnyvale northbound 101 is cleared so all lanes are open. so 101 and 280 both fine through palo alto, redwood city. you see all green on all of our traffic sensors. and everything is on time for bart, ace, muni and caltrain and your ferries. that's traffic. back to you. >> in the green. >> in the green. >> all right. thanks, elizabeth. 4:41 now. some bay area mcdonald's are going to start charging for toys today. >> they are. and now there's another fast food giant jumping on the toy bandwagon, as well. >> we realize that ultimately

policy on disrupting cell phone signals. the issue, you may remember, came up in august when bart blacked out cell phone service at four san francisco stations because of a planned protest there. the "contra costa times" reports the new policy is expected to ban such blackouts except in the event of extraordinary threats to the bart system. its employees or passengers, as well. when you text from your smart phone you information could be recorded even before it gets to the person you send it to. an app developer claims a secret application inside millions of cell phones capture key strokes. the text information is then sent to computers at carrier iq. carrier iq says that data is used to monitor performance. >> our technology counts and summarizes performance. it is not recording key strokes or providing tracking tools. >> this is way beyond recording a phone call on a customer service. this is about tracking what you're doing with your phone,

where you're going when you have the phone with you, all of your texts everything. >> one person said it could be considered a federal wiretap leading to a lawsuit. tomorrow governor brown will unveil a ballot measure calling for an increase in taxes. the san jose "mercury news" reports that the plan includes a temporary increase in the state's sales tax probably less than 1%. it also reportedly calls for an income tax increase for people who earn more than $250,000 a year. the proposition would be on the ballot for the 2012 general election. california state university cancelled a vote on a policy for determining the salaries of its 23 campus presidents. monday's special meeting in long beach was put off because of safety concerns there. protestors have been angry that public university

administrators have been getting pay raises while student tuition is skyrocketing. and another fast food chain will comply with san francisco's new ban on toys with kid's meals. burger king says it won't offer toils in meals high in salt, fat and sugar, they wouldn't offer toys. the parents will have the option to buy the toys for 10 cents or more. mcdonald's announced the same thing yesterday. no word on what burger king will do with the 10 cents. a wake-up call for parents and students. >> the alarming truth about kids and fitness. and kids guzzle it up but could it be poisoning them? the health warnings about popular fruit juice brands coming up. >> rolling deep in nominations, the major stars facing off for awards. coming up. winds continuing to whip

to speak with his wife in person, before decidin republican presidential candidate herman cain says he wants to speak with his wife in person before deciding on the future of his campaign. >> we'll be deciding in the next several days. >> he hasn't seen his wife since a georgia woman said she had a 13-year affair with the businessman. cain has been reevaluating his campaign in the wake of that claim and earlier allegations of sexual harassment from other women. he has denied all the accusations but admits that they have hurt his family and his ability to raise campaign funds. sandusky was further of the penn state family. we all are. and i feel shame. >> penn state university held a

town hall forum yesterday regarding the scandal involving former assistant football coach jerry sandusky. he is accused of sexually abusing several boys. meanwhile a lawsuit was filed yesterday on behalf of an alleged victim who is not part of the criminal case. the 29-year-old plaintiff claims that when he was a child, sandusky abused him more than 100 times and threatened to harm his family to keep him quiet. a grinch won't be able to ruin the holiday for an oakland charity. a bank stepped up. we told you yesterday how someone stole $4,000 worth of donated toys and food for the allman grove elementary school. now wells fargo donated $4,000 to replace the stolen items. no arrests. they haven't got anything back yet, either. we have a fire in the mission district. let's check with elizabeth. >> yeah. sounds like it's an apartment fire right now. this is a breaking situation. we are sending a crew to the scene and we have a slight location change. it's a block farm.

er from where we thought it was. it was at 24th and valencia. we are understanding it's a two- alarm apartment fire in the mission district. 24th is closed between orange and mission. we'll have details and live pictures coming up. but our early reports we were hearing people were being rescued from the apartment building and it's windy so that doesn't help the firefighting efforts. in fact, we have wind advisories in effect for all our bridges this morning. here's a live look at the bay bridge toll plaza. no delays but caltrans has their warning signs up at all bridges warning it is going to be a windy commute across the bay area. we can see traffic. 880 through oakland was covered in fog for the past few days. so we have gone from wind -- from fog to wind including at the golden gate bridge. you can see this camera shaking back and forth quite a bit so if you are coming from marin again a two hands on the steering while kind of day.

live look at 880/237 in milpitas. couldn't see this at all yesterday. westbound 237 so far looks okay from milpitas to san jose. now, mass transit is always a good option. but if you want to skip the roads, once again, bart is running all trains on time. ace train number one no delay. bart, ace, muni and caltrain and your ferries all on time. we'll have more information on the apartment fire in san francisco's mission district, streets blocked off, at 24th and valencia. we'll have much more traffic coming up. let's get an update on your forecast with lawrence. >> elizabeth, clear as a bell out there today, no fog to speak of. the winds are kick up outside though and it is blustery especially over the mountaintops. so be careful traveling around the bay area today. debris in some of the roads, as well. we could still see some trees coming down and branches too. around the coast, we are going to see some gusty winds into the afternoon. some of those gusts down below in the valleys up to 50 miles

an hour. high wind warnings in effect above 1,000 feet in excess of 50 miles per hour and a gust yesterday on mount diablo over 70 miles per hour yesterday. clear skies, mild temperatures, the atmosphere well mixed right now. a good day ahead as far as temperatures are concerned. by the afternoon some places near 70. you will see sunshine but, of course, those winds are going to blow in spots all around the bay area today. so watch out for that. high pressure building in and a huge difference between this ridge and that area of low pressure that's make its way to the south. gusty winds today decreasing overnight into tomorrow. the pressure difference will separate a bit so things will calm down toward friday. this afternoon, 67 in san jose. about 69 and sunny in santa rosa. still blustery around parts of the bay area but plenty of 60s even down near the coastline and clear, no fog to speak of,

and it's going to stay clear through tomorrow. the winds subside. temperatures may come down a few degrees but look at a fantastic weekend. lots of sunshine coming our way, nothing but sun right on in through the next five days here. then toward the beginning of the next week, maybe a couple of changes, cloudy skies, but right now looking good as we'll see lots of sunshine coming our way. that's the latest from here. back to you. >> like it. thanks, lawrence. 4:55 now. and california children keep getting fatter. the latest state physical fitness test found nearly one- third of the schoolkids in the state are so fat that they are considered at risk for health problems. the "chronicle" reports only one-third of the children were able to pass all six measurements of fitness. a new warning on the fruit juice that kids love so much. consumer reports says that a.m. juice and grape juice have arsenic levels that may raise their risk of cancer. a new study finds 10% of the juices sampled had arsenic levels that exceeded the allowable limits for drink water. the food and drug administration says most arsenic in juices is organic

and, quote, essentially harmless. today here in the bay area, and around the world, communities are marking world age day. the white house is especially decorated for the event as you can see there. world age day was established by the world health organization back in 1988. here in san francisco, one of the observances will be a candlelight vigil at the harvey milk plaza they castro district tonight. it seven grammy nominations including one for best album of the year. british soul singer a dell is a close second with six nominations. two for best record and song. bruno mars lady gaga and rean in are among the nominees as well and those winners will be announced on february 12.
