familiar problem in two bay area communities. ducks and geese shot, left to die. it's happening at new hall and willow pass parks in concord. don knapp is at new hall park where the latest attack came last night. >> reporter: that's right. killing the water fowl at the park is not only cruelty to animals, but the killing poses a risk to humans. the call to police and animal control came in around 8:00 a.m., reporting dead and wounded ducks and geese. here by the ponds at new hall park, a sign warns visitors of coyotes, but animal services officer mike russell says the water fowl are being killed by people with guns. >> as far as we know, it's a very small caliber rifle or pellet rifle of some sort. >> reporter: five ducks and geese were killed, two more will probably die from injuries. most of the dead and wounded had been cleared at the time of the video was shot. one dead bird was on the ground, another bleeding through its

white feathers. brenda adams and her family live nearby and have heard gunshots at night. >> there were multiple shots. we called 911 right away and they were still shooting while they were doing that. >> reporter: it's the second geese and duck shooting here at new hall park. police and animal services don't know if these shootings are related to another park shooting. >> we're doing forensics, gathering the slugs from the animals, trying to match them. we're doing everything possible. >> reporter: martha sodder walks her dog her daily. she has seen dead and mamed birds. >> mutilated, wing was crooked, tail bent off, cut off, shot off. >> reporter: this is an area used by families. officer russell says police and animal services are taking the incidents very seriously. there's a risk to pets and even humans, he says. >> caliber weapons such as the type they are using, has a pretty good range on it. a miss could skip off the water, go into one of the houses.

people walk their dogs at night out through this area. they could be accidentally hit. >> reporter: here's how seriously they are taking it. concord police are involved, contra costa animal services, fish and game. if federal birds are killed, the federal government will step n. couple of accidents on the caltrain tracks have left two people dead. a northbound baby bullet train struck and killed a man at the california avenue station just after 11:00 this morning. an hour later, a second person was killed by a southbound train, north of the menlo park station. 16 people have been killed on caltrain tracks this year. well, the youngest victim of a mass shooting in oakland this week remains in critical condition tonight. the family is optimistic about the child's recovery, even as there is disagreement about how to conduct his treatment. anne mackovic on how the community is trying to help pay

the medical bills. >> he's going to get out of there, yeah. he's going to pull through. >> reporter: words of hope from hiram lawrence's uncle as the little boy lies in a coma today. at the same time, family members and supporters are trying to raise money for his care by washing cars. >> anything to help out. >> help with the baby, seeing how a terrible situation it was. >> reporter: hiram, almost 2 years old, was shot in the head monday night at a rap video music video shooting monday night. hiram was among seven people injured, now at children's hospital in critical condition. >> he's fighting. >> reporter: hiram's mother spoke out last night about an impasse the family has reached with the baby's doctors. >> unfortunately, we have come to a cross road and we are, and we are unable to agree on the continuum of care for baby

hiram. as a result, we are seeking support from patients rights attorneys. >> reporter: but the family won't say what doctors are recommending for hiram or what they are rejecting. >> thank you for the prayers, being with the family, and we don't want no violence, no retaliation, none of that. >> reporter: there is a $35,000 reward for information leading to the shooters in this case. police say they do have five persons of interest in custody on unrelated charges, but they don't have enough evidence to make arrests. >> nobody's fighting anymore. everybody's shooting. >> reporter: and anybody can be a victim. >> please keep, keep him in your prayers. >> reporter: in oakland, anne mackovic, cbs 5. >> a total of seven people were wounded the night hiram was shot. two are still in critical condition. gusty winds helped fuel a fire in santa rosa overnight. three acres and a motor home

burned on todd road, downed power lines created a hazard for firefighters, power was shut off in the area and crews had to truck water in to fight the fire. >> we're in a non-hydranted area, so it requires heavy contingent of water tenders from many agencies. >> nearby homes were temporarily evacuated, but there were no injuries and no word yet on the cause. occupy sf protesters on the move today to protest unfair housing policies. occupiers were joined by housing advocates as they marched through the bayview, castro districts before rallying at justin herman plaza this afternoon. protesters say today's actions were meant to target banks and landlords who make it difficult for families to live in san francisco. and in fremont, local religious leaders gathered for a nonviolent rally and march to show solidarity for the occupy movement. one clergy member spoke about his experience being arrested as part of occupy oakland.

today's event calls for banks to show some compassion in the midst of the current foreclosure crisis. checking some other bay area headlines -- health officials are acknowledging a breach in patient privacy. their names had been posted on the internet as part of a report to the board of supervisors. no medical information was released. the state is investigating. the money is in place for a new 49ers stadium in santa clara. three banks have agreed to put up more than $850 million to finance the project. final approval of the plans isn't expected until spring, but the funding is a major step. the stadium would be ready for the 2015 season. the state's oldest medical marijuana dispensary has been evicted. a judge ruled the club in fair

tax is violating its lease by selling cannabis, which is against federal law. the dispensary's founder has been cited since they opened. the case will likely be dried in january. a warning tonight about a mushroom recall. the state health department has found high levels of sulfide in whole and dried sliced shitake mushrooms. the trading company initiated a voluntary recall. high sulfide levels can pose a risk. the emotional statement from a young man's mother. how one bay area company is making sure good wood doesn't go to waste. . skies clearing out around the bay this evening will result in very cool temperatures by tomorrow morning, with a little

(taps being played) . full military honors for a bay area guardsman laid to rest today. specialist shawn walsh was killed two weeks ago in afghanistan. the san jose native was deployed a year ago. his mother offered a touching farewell. >> i'm really blessed to have been your mother and i'm grateful for all the time we had together. >> walsh is the 29th member of the california national guard. he died serving in iraq and afghanistan since 9/11.

, with downed trees . well, this week's monster wind storm left a mess around the bay area with, downed trees everywhere. looks like a lot of wasted firewood, but don ford found a company with a better use. >> reporter: winds swept across california this week, knocking very large trees down. winds crushed this house in the oakland hills. >> middle of the night, 1:00 a.m., we had a rumble, then the whole house shook. i just assumed earthquake, because everyone talks about earthquakes here. >> reporter: the five-ton tree crashed into his kids' room. thankfully the kids escaped, but what happened to all those trees that need to be cleaned up? standard industry practice is to take these downed trees and chip them or turn them into firewood, but there's another company which has a whole different

idea. lumber. keep the tree trunks whole, and with the company's own saw mill, recycles the downed trees into custom-cut lumber. >> when they do get to our yard, we, depending on the species and the quality of the log, we will mill that into lumber, flooring, landscape timbers, replace toxic railroad ties, anything you can do with wood, we do here. >> reporter: this creed dar wall may have fallen in your local park, while this eucalyptus floor may have once uprooted your sidewalk, or perhaps this walnut counter may have punched a hole in your roof. logs to lumber, there's still a lot of life left in these trees. >> if you've seen wood from 15th century france, you know the wood can stick around a long time. the forecast, coming up,

delighted crowds in downtown oakland today. this is the 12th annual america's children holiday parade. there were marching bands and floats and giant balloons, beloved cartoon characters. 150 children bikes were assembled by san francisco's bar pilots and their families today at pier 9. bikes will soon be donated to the san francisco fire department toy program. 25,000 kids receive toys through the gift-giving program last year. lot of people still talking about this wind blowing through the bay area. let's check in with jim to find out when it all might subside. >> gusty the last couple of days. 40 to 60 mile-an-hour range in the valley. down south, in excess of 100 miles an hour. it is settling down tonight and will continue to calm through the early morning hours. as it does so, skies will clear and temperatures will chill out. patchy valley frost in the north bay and across the valley, dry

and mild again tomorrow. breezy in the hills once again by tomorrow afternoon and into tomorrow night, as we have a dry week shaping up -- we saw a bump in temperatures, mid to upper 60s across the bay today, with 67 in oakland and fremont. 67 in santa rosa, 64 in san jose, 65 in the city as well. we'll look for lows tonight to chill under clear skies into the mid to upper 30s. across the north and bay, mid to low 40s, a few upper 30s possible in the south bay as possible. we see winds have kept the fog in the offshore waters, offshore direction moving on, clouds out to the west. that will continue, but weaken here into tomorrow morning. this high pressure system will continue to block the weather pattern sending the storm track

low to our north, disturbances out in the desert will ramp winds up again by tomorrow night. winds once again calming down tonight, only to pick up sunday night into monday before they finally settle down tuesday through the end of the week. another 24 hours or so of gusty winds before we calm down for the rest of the week, with highs again tomorrow in the mid to low 60s for the warmer locations, not quite as warm as today. upper 50s elsewhere, as we'll continue with cool evenings here the next several days. mostly clear skies, breezy conditions again sunday night, into monday. then winds calm down through the end of the week, as the clouds finally return with more of an onshore breeze. right now, time to get a sports update. >> thanks, jim. championship saturday, highlights from the big division 1 high school game and the sec championship game had lsu and georgia. bulldogs came to play, but lsu came to win. the tale of two halves, coming up in sports.

of lsu and saints grade dalton hilliard with a pair of touchdowns. lsu wins the championship, punched its ticket to the title game. they cruised 42-10. houston cougars hosting southern miss for the conference usa championship game. southern miss up 14-7 in the second quarter when johnson takes it down to the goal line, couldn't get it in. tied at 14-14. upset in the second half, davis to lambly to the 61-yard touchdown. 42-21, southern miss. houston suffered their first loss of the season, 49-28, your final. they are out of the bcs picture. how about uconn needing to beat cincinnati to become bowl eligible. didn't happen. huskies quarterback johnny mcactee in the end zone, ball stolen by cincinnati. look at this again! stewart came in and flat out took it from him! crazy! great play. they actually called that a fumble recovery.
