[ laughter ] out the door this morning, freeze warnings in the north bay some temperatures down into the 20s. so you got to be very careful. we're seeing fog and freezing fog in some of the valleys. temperatures are plummetting into the 20s, maybe some sneaking down into the low 20s so protect, plants, pipes, pets and people. freeze warning continues until 9 a.m. let's check the temperatures now. 27 degrees in the napa valley, 29 in santa rosa. these temperatures are going to continue to dip over the next hour or so. 38 degrees in vallejo, about 39 in fremont and 40 degrees in san jose. high pressure still holding on right now. we'll continue to build in so a cold start to the morning, another "spare the air" day today. but we have a cold front out in the gulf of alaska that's going to swing in along the coast, possibly bringing showers to the bay area as early as tomorrow. temperatures in the 50s and low

60s. next couple of days, changes in the works, cloudy late tonight, and then looks like a chance of showers by tomorrow morning. by friday and saturday, we dry out. high pressure builds in, some of the temperatures into the mid-60s. by sunday, just some partly cloudy skies but very cold out there this morning, freezing fog, elizabeth. you don't see that very often. >> little snowflakes symbol, that's usually my indicator that it's really cold outside. came up on my dashboard car the past couple of days. let's go to the south bay. an accident blocking a couple of lanes. northbound 87 at the garden of eatin', right around 101 there is an accident in the numbers 2 and 3 lanes so watch out for slower speeds across that stretch. towards the bay bridge toll plaza, there is some roadwork this morning on the upper deck. two right lanes coned off. once you get past the toll plaza towards the incline, watch out for that. otherwise no major delays this morning. the metering lights remain

off. fine on the san mateo bridge, good between foster city and hayward. a quick look at the golden gate bridge. they have done the lane change. free-flowing from marin into san francisco. that's traffic. back to you. >> watch out for the frozen fog. nfl owners are about to talk about the santa clara city council decision to finance the stadium for the 49ers. the vote for the stadium financing plan was unanimous. the team will pay $150 million for construction. and the city will finance $850 million for that billion-dollar project. and if costs go up, the 49ers promise to pay up. >> we are committing to covering the cost overruns for the building whatever that number is. >> our grandchildren and great- grandchildren will be burdened with this massive debt. santa clara residents have been

dereceived. >> banks won't loan money for the project until the nfl commits to paying its share and it's not clear when that might happen. the team hopes to start playing in santa clara in 2014. we'll have a live report at 5:00. 4:34 now. police handling a protest at public universities will be the focus of a legislative hearing this morning to be held in sacramento. it is in response to controversies involving pepper spray and other uses of force during recent protests at uc- davis here and at uc-berkeley. uc and csu officials are expected to testify today as are student representatives. two oakland police officers have been removed from street duty as internal affairs looks into an incident that led to a lawsuit. that's what sources are telling the "san francisco chronicle." one of the officers fired a nonlethal beanbag during an "occupy" protest last month and hit the leg of 30-year-old scott campbell who shot video of it posted it on youtube and

filed a suit against the oakland police department. monday's protest at the port of oakland was a million- dollar hit on the economy. only one of the seven terminals operated and three were shut down. the port losses are estimated at between 4 and $8 million. plus up to $1,000 each per truck driver. protestors say they plan to move on from the port and focus now on foreclosures. school buses, public education and social services. they are all victims of california's latest round of spending cuts. governor brown announced $1 billion in trigger cuts that kicked in when state revenue fell short. among them, $248 million for a school transportation. that effectively eliminates school buses for a lot of districts. $100million each from the uc and csu systems and $100 million for in-home support services. >> i'm sensitive to what these cutbacks do to real people.

but i'm also aware that over time, california does have to balance its budget. we have to exercise fiscal discipline. >> the los angeles county school district plans to file a lawsuit to block those cuts to school transportation. but they should take effect january 1. it took more than a year but pg&e is claiming liability for the san bruno explosion. the admission means pg&e is taking on financial responsibility to compensate the victims. how much the utility will pay is still unknown. eight people died in the explosion, dozens were injured. nearly 40 homes were destroyed. a court hearing on the case is set for friday. 4:36 now. san francisco police will meet tonight with neighbors in the mission district after a pair of violent sexual assaults. the latest attack happened before dawn last thursday when a woman was raped near 24th street. a similar assault occurred last month. the suspect was caught on surveillance video shown here. he is described as an african-

american man in his mid-30s between 5'9" and 6' tall. two former san francisco public health departments inspectors are facing bribery charges. the d.a. and other officials will talk about the case this morning. "the examiner" reports the two are accused of selling food safety certificates to hundreds of restaurants here in san francisco and elsewhere in the bay area. most of those restaurants have received legitimate certificates, though. no texting, no driving, no bluetooth. california's cell phone law could get even stricter. and federal experts are calling for a nationwide ban on cell phones in the car. gil diaz joins us from south san francisco to explain. what's going on, gil? >> reporter: hi, good morning, frank and grace. yeah, this is a very strict law proposed by the national transportation safety board. this is definitely a topic for the water cooler. it is the strict proposal. ntsb doesn't want you to text or talk while driving even with a bluetooth or other hands-free

device. you won't be able to do that. now, the ntsb has no authority to enforce such a nationwide ban but it hopes that lawmakers will catch on. the ntsb says any type of distracted driving is dangerous. it did a study and discovered that on any given time of the day, 13.5 million drivers are on some sort of hands-free device. last year, nearly 3100 fatal accidents involved distracted driving. now, one member of the ntsb said that distracted driving is becoming the new dui. it's becoming an epidemic. >> many times, the distraction that is there is not just one that's about manipulation of something or a visual distraction. it's about acog anyive distraction. it's about not being engaged in the task at hand. >> reporter: state senator joe simitian of palo alto who wrote california's cell phone law says he doubts lawmakers will pass a stricter ban because of

strong opposition from the phone companies. now, currently, 35 states ban texting while driving. 10 states ban all use of cell phones while driving. and frank and grace, even though it sounds strict, if it does ever pass it does not apply to those hands-free systems installed in the cars. >> it will be interesting to see how people react to this. i mean, i would imagine a lot of people would not be happy. >> i know. when i drive, i love to blab and where i used to work i had a 50-mile commute either way so i was on the phone all the time and in massachusetts, you can put it to up your ear and here of course you can't. but it does tend to take away some of the time so i imagine there's going to be a lot of people who aren't too happy about it. >> reporter: we haven't been able to talk to any people yet but i haven't seen anyone on their cell phones yet but there was a time, frank and grace, where we didn't have cell phones and people just had to resort to wait until they get home. >> really ?! [ laughter ] >> reporter: had to resort to talk to someone from home.

so i know it's technology and this is the 21st century. but maybe this is definitely a change for the better for some drivers. >> certainly safety-wise it certainly would be. gil diaz live for us in south san francisco. thanks, gil. the future of the bay bridge may soon be brighter. >> it's part of a plan to turn the span into an enormous light sculpture. artist leo villa real has proposed installing 25,000 l.e.d. lights to the western spar support cables. the bulbs will then flicker to mimic the motions of san francisco bay. via real still needs caltrain's approval and $7,000 in private donations to get it done. >> don't use your cell phone and don't look at the lights. >> a lot of things going on. the u.s. reaches the home stretch in iraq. the president's special thanks to troops today. >> and a christmas gift from the metermaid of all people. how bay area drivers are getting cut some slack with parking tickets.

e nine-year back now at 4:43. president obama will be in fort bragg, north carolina today to thank service members who served during the nine-year war in iraq. that war will officially end when this year ends in less than three weeks. all u.s. combat troops are supposed to be out of iraq by then. at the height of the war in 2007, about 170,000 u.s. servicemembers were in that country. republican-controlled house has passed a bill to extend a social security payroll tax cuts through next year. president obama and other democrats wanted that but there is a catch. the bill also includes a requirement that an oil pipeline be built from canada to the gulf of mexico. now, democrats strongly oppose that. so it could face trouble in the senate or presidential veto programs. the legislation would also renew jobless benefits for the long-term unemployed.

teachers in alameda are accusing their superintendent of being a grinch. they rallied outside the school board meeting with bags of charcoal for superintendent kirsten vatal. teachers accuse her of increasing class sizes and forcing furlough days while accepting a pay raise to nearly $205,000. with benefits and bonuses, they claim she could make more than a million dollars in the next three years. teachers have not had a raise since 2008. >> they keep saying they have no money to negotiate anything but they have given the superintendent a sizable raise and her executive cabinet and continue to say there's no money for anyone else. >> teachers are calling the superintendent's salary exorbitant but cbs 5 did some fact checking and found at least four east bay school districts of similar size pay for their superintendent about that much if not more. 4:44 now. today paying for parking will become a lot easier at least in one part of san francisco. this morning is the launch for

the city's new pay by phone parking service. that's in the castro district. drivers will now be able to pay meters with mobile devices and receive text message warnings when their time is about to expire. the program is a big hit. it will be expanded to some of the other neighborhoods, as well. oakland's finance committee has approved a pilot program giving people a five-minute grace period once their meter runs out. drivers will get the chance to feed the meter if they find a parking enforcement agent writing them a ticket. that happened to me. no such luck! [ laughter ] >> the city will reevaluate the program in six months. please, i'm right here! >> poor frank. it takes five minutes just to put enough quarters in there. >> i still had some time on but i was in a tow area. he said, i already wrote the ticket. but they did pull my car off the tow truck, five minutes after it expired. that's the story for another day. those holiday road trips planned for next week may come cheaper than expected. >> a triple a report reveals

the university's sex abuse scandal. tim curley and gary schult two penn state administrators face a preliminary hearing tomorrow in connection with the university's sexual abuse scandal. tim curly and gary schultz are accused of failing to properly report suspected abuse as well as lying to a grand jury. the man accused of abusing several young boys jerry sandusky waived his preliminary hearing yesterday and that clears the way for prosecutors to put him on trial. in other headlines around the bay area on this wednesday, three suspects in a black friday shooting in the east bay are due back in court today. they could enter pleas in connection with the attacks in that parking lot of a san leandro walmart the morning after thanksgiving. the three are accused of trying to rob three shoppers. the suspected shooter is 29- year-old detwone watson. he is from oakland. sharp park golf course in pacifica could be transferred

to federal control. san francisco supervisors voted 6-5 to transfer management of the course to the national park service but mayor lee may veto the plan. environmentalists want the golf course closed to protect a threatened frog and snake endangered species there. >> lawrence has the weather. >> i wrote this down. >> pets, pipes and people. >> don't forget about the plants. >> and the plants! the four ps frank! >> i never heard that. >> that's right. and we have freezing fog. we don't see that every day but we have some very cold temperatures around the bay area of course. the north bay looking at freezing temperatures. into the south bay, yup, it is chilly there, too. some of those temperatures dipping down not 40s right now. of course, that's the nasdaq. we are still waiting for that to open up. 42 in san jose.

elsewhere cold temperatures outside. numbers dropping down to the freezing point into the 20s in parts of the north bay. we are seeing some fog into napa and santa rosa. and with temperatures in the 20s, you're looking at freezing fog so what that means is you're driving along through the fog, and that fog is literally going to stick to your window making driving tough so be careful in the north bay. through the morning hours, temperatures warm up but a chilly start to the day. by the afternoon, hazy sunshine again. and temperatures running up into the 50s and a couple of low 60s. looks like we'll keep things fair throughout the afternoon. but it is a "spare the air" day with those cold temperatures. but there is a cold front developing in the gulf of alaska likely to drop down in toward the bay area late tonight and into tomorrow morning. going to bring with it at least a chance of rain by tomorrow. so some changes ahead should be dry today out the door. computer models picking up on it. patchy fog this morning. et ber part of the day hazy sunshine. here -- better part of the day

bay. a traffic alert because of this accident on the guadalupe parkway. so if you have a flight to catch, be aware of this. you don't want to get there at the last minute. apparently two of three lanes are blocked on the connector from northbound 87 to northbound 101. so again, right there by san jose mineta there are lanes blocked and no estimated time of opening. but this was an overturn accident. so likely injuries involved and usually those take a while to clear. that accident actually has been out there since about 4:15 this morning. all right. outside, here's a live look at the bay bridge toll plaza. not much going on here except for some roadwork overnight. those two right lanes are coned off for some overnight roadwork until 5 a.m. on the upper deck. once you get past the metering lights all the way up towards the incline. mass transit continues to move on time. so mass transit check everything looks good through there. 880 the nimitz through oakland looking live and looking good as you pass the coliseum and all the way towards downtown oakland. drive time still about 15 minutes so that's green. that's pretty much no delay from 238 all the way down

towards the maze. southbound traffic looks good, as well. and again the rest of the south bay except for that accident on the guadalupe parkway looks good including coming out of downtown san jose. and i just covered up my musical note i made but jay-z is performing at the pavilion. >> so hip, elizabeth. the u.s. postal service will delay closing some of its facilities until next spring. 200 mail processing centers and almost 4,000 post offices will be saved until mid-may. the hope is that the delay will allow congress time to develop a plan to save that struggling agency. southwest is make a major investment in lowering its long- term costs. the discount airline is ordering 208 models of boeing 737 aircraft. it's supposed to be more fuel- efficient than the current models that southwest has so the airline's $19 billion order

is project to bring down the soaring fuel costs starting in 2017 it is 4:55 now. when american astronauts fly into outer space again, they are going to do so on vehicles developed by private companies not by nasa and one of them doesn't even need a launch pad. paul allen billionaire cofounder of microsoft has a plan to build the world's largest airplane and use it to launch rocket ships into earth orbit. the craft will be powered by 6 boeing 747 engines and have a wingspan of 385 feet nearly double of that a 747. >> the wingspan of those planes is greater than the length of a football field. just think about that for a second. >> that is a little mind- boggling. in 2004, allen and his designer built a spaceshipone, similar but smaller system that became the first privately funded spacecraft to fly outside the

earth's atmosphere. allen won't say how much he plans to spend on the stratolauncher but said it should eventually make money carrying payloads for nasa and launching private satellites. it's a piece of the silicon valley history worth $1.6 million. that's how much the highest bidder paid for the 1976 document that was the founding partnership agreement for a company called apple computer. they have done well. the document previously belong to ronald wayne who founded the cupertino company with steve wozniak and the late steve jobs, of course, but wayne later gave up his share of the company and my guess is he is probably scratching his head right now. they say a diamond is a girl's best friend. >> well, elizabeth taylor had a lot of them because her diamonds raked in a lot of cash. decades worth of her fashion and jewels were up for auction last night at christie's in new york. this emerald and diamond necklace was a gift from richard burton. that brought in $6 million.
