very light. i think a lot of people may still be on vacation this week, a few -- yeah. i was on vacation earlier. i came back for a friday. why did i do that? i don't know. trying to save my vacation days. i love the viewers. that's right. [ laughter ] >> we have much more on roads all across the bay area including updating you on construction that's still going on. in the meantime, let's check your forecast. >> i am so ready for friday today. >> good things it's friday. >> it is indeed. great day, temperatures cooling off a little more. we have some patchy fog outside around the bay area today. 50s and 60s though by the afternoon, mostly sunny. a little foggy at the coast. but that's about it. the weekend is looking fantastic! high pressure popping in, offshore winds blowing outside, that's right, looking good through sunday. then we start to cool off on monday and tuesday. [ laughter ] >> how's the weekend looking again? >> fantastic!! >> because he cheated death on the way to work today.

>> dangerous on the highways. >> thank you. there is a shooting and it shut down part of a san francisco freeway overnight. >> it did. a number of surface streets were closed. anne makovec is in san francisco's south of market neighborhood where police are now holding two suspects. anne, good morning. reporter: good morning. several shootings actually but nobody as injured. that's the good news. and all clear this morning here in soma, all the streets have been reopened and that's after two men are accused of shooting gunned off several rooftops on this block here at 9th and bryant, jumping from rooftop to rooftop. they finally came down off of a fire escape. that's after this all started at around 11 p.m. let's go back to that point, when police and s.w.a.t. teams moved in after reports of gunfire. and then officers heard more shots with their own ears. they closed down several blocks here in the area as well as north 101, the central freeway,

from octavia to eastbound 80. officers staked out the building, guns drawn, for about two hours as people in nearby buildings nervously waited. >> just walked out of the store tonight and some shots were fired off. i heard about three shots. and then kept walking a little further, heard about four more rounds go off and then the cops drove up and told me to go back inside the store. >> reporter: firefighters even joined in the effort to take the gunman down bringing a ladder truck to help police clear the building. but the suspects did end up leaving off of the fire escape. we're still waiting to hear more about these suspects this morning and why they might have been firing the guns but again, nobody was injured. back to you. >> thank you. san jose police are looking into the city's first homicide of the year. a man was shot last night off alexander avenue, a residential street on the east side. police say that the victim was

rushed to regional medical center where he died. so far there are no suspects and no clear motive. investigators say that this could be gang-related. also this morning, the woman accused of killing nursing student michelle le is scheduled to enter a plea. a grand jury indicted 27-year- old giselle esteban from union city last month. esteban was apparently convinced that her ex-boyfriend was having an affair with le. transcripts including threats esteban allegedly made against her former boyfriend and against le. 4:34 now. a 5-year-old boy shot and killed in oakland will be buried today. the funeral for gabriel martinez, jr., scheduled this morning at saint elizabeth's. the boy was shot last week at his father's taco truck. no arrests have been made. no motive yet. a funeral also scheduled today for fremont mayor bob wasserman. the 77-year-old passed away last week from health problems. wasserman served the people of fremont since 1976, when he was appointed chief of police.

he had been mayor for the past 7 years. this only on cbs 5. the story of a marin county shootout from the victim's perspective. 90-year-old jay leone explains what he had to do to outsmart the man who broke into his house on wednesday. he says the intruder held him at gunpoint but he was able to convince that man to let him go to the bathroom. he had a gun hidden there. but before he could fire, the intruder shot him in the face. shot me, looked him straight in the eye. dent kill me, don't kill me, he says, i got a daughter. i said you [ bleep ]. pow, pow, pow, pow, pow. >> the intruder was hit three times. but it wasn't over. the intruder got his gun and shot at his head but leone had already fired all bullets. then he ran out. both men are recovering. the california budget deficit is shrinking but cuts

to education could grow. the governor's new budget plan projects a $9 billion deficit for the upcoming fiscal year lower than the $26 billion hole lawmakers predicted but the plan depends on voter approval of the governor's proposed sales and income tax hikes. if they don't, public education would automatically be cut by nearly $5 billion. the governor's plan also calls for the elimination of merger of state agencies. the cambridge child development center in concord is kennedy about the concerned about the future. daycare is free and without the help parents couldn't afford it. >> many will end up back on welfare. some of the children may end up

in dangerous settings being left home alone. well of 50,000 families will be in chaos. >> the proposal would also result in about 3,000 state jobs being cut. the state budget crisis means less money going to local governments and that is prompting cutbacks on the city and county levels. san mateo county will consider shutting down a long-term care facility. the burlingame long-term care center has been caring for indigent patients for nearly half a century. the county leases the building which needs major safety upgrades. if it is closed, about 200 nurses and other workers could be laid off and patients would have to be moved elsewhere. it is all about the jobs market for investors today. the government will release the december unemployment report in just about two hours from now. and economists predict that employers added 150,000 jobs and that the unemployment rate inched up to 8.7%. 4:37. ford motor company is about to open a research lab in the

silicon valley. the lab will investigate ways to better integrate phones and other personal devices in their cars. ford also wants to develop safety systems that alert drivers when they are approaching another car. new research office near stanford will open in the first few months of the year initially employing a few dozen people. 4:38. she is here for her friday debut! >> not bad, a one-day workweek. i could handle that! [ laughter ] let's hit the roads. if you have a one-day workweek heading to work this morning, outside foggy start especially across the golden gate bridge. i just checked. no official fog advisories or anything like that. obviously traffic is still light across the deck but just a heads up you may find visibility to be an issue in some parts of the bay area this morning. we have roadwork still in the eastbound lanes of highway 4 at loveridge. all lanes blocked for another hour so traffic using the on- and off-ramps to get by there. westbound 4 out of antioch looks fine. drive out of the altamont pass, you can see we are free and

clear 14 minutes is your drive time all the way through livermore towards pleasanton. and we'll take you back live, this is a live look at the san mateo bridge where it should be about a 13-minute commute in either direction. that is traffic. lawrence, very foggy out there this morning. >> yeah, foggy in spots. reports of fog in santa rosa and livermore seeing patchy fog at the coast. and that's probably going to dissipate throughout the middle of the morning or so and that's going away but the temperatures will be cooler today as another weak system makes its way in toward the bay area. any chance of rain heading to the north but a weak system will drop over the top of the ridge. once it does, then we'll see high pressure build in, offshore flow is going to start once again. still chilly in spots, below freezing in santa rosa, 30 and fog. 40 in san jose. 46 in san francisco. and 45 in livermore. by the afternoon, those temperatures popping up into the 60s all around the bay area at least inside the bay. and many of the valleys. at the coast we'll see patchy fog and that will keep those temperatures cooler. still, as we look toward the weekend looking great as that ridge begins to build in.

ldier was killed back now at 4:42. roadside bombs killed five nato troops in afghanistan today. four died in a single bombing and another was killed in a separate blast. nato says both incidents occurred in southern afghanistan but it's not saying which country the troops came from. so far, nine members of the coalition troops have died in the first week of this year. the pentagon is investigating if the defense department leaked secrets for the osama bin laden movie. the decision comes after a lawmaker raised questions about a "new york times" article that claimed that filmmakers were given access to classified information about bin laden's takedown. the movie is expected to be released next december. most of the republican presidential candidates are now focused on next tuesday's new hampshire primary. but as drew levinson reports, there is still talk about this week's iowa caucuses and some

new questions about the vote count. >> reporter: rick santorum is gaining ground in new hampshire. >> don't defer to pundits who will tell how can win or who is the best candidate. >> reporter: santorum finished just eight votes behind mitt romney in iowa. but a man who says he helped count the votes questions the result. edward true told kcci his district gave romney 20 more votes than he actually received. >> when mitt romney won iowa by 8 votes, i have a 20-vote discrepancy here, this is huge! >> reporter: but iowa election officials do not believe the outcome of tuesday's contest will change. and when the votes are certified, santorum believes romney will still have more votes. all of the candidates are focused on new hampshire, where the primary is now just four days away. and many are going after romney, who is leading in the polls. >> conservative leadership. >> reporter: newt gingrich is hitting the air waves with a new attack ad. >> romney's economic plan, timid. >> reporter: gingrich is trying

to gain ground in new hampshire but he may have taken a step back thursday when he talked about african-american neighborhoods. >> so i'm prepared if naacp invites me, i'll go to their convention and talk about why the african-american community should demand paychecks and not be satisfied with food stamps. >> reporter: gingrich is calling president obama a food stamp president. he will soon find out if his comments have an effect on how people in new hampshire vote. drew levinson, cbs news, washington. gop presidential hopeful jon huntsman has been endorsed by the "boston globe." the paper said he offers the republican party an opportunity to, quote, renew itself. the globe is published in the same state where mitt romney was governor for four years. as you may know, mitt romney was recently endorsed by john mccain. >> he was. just a few days ago. but the arizona senator had a little slip of the tongue on the campaign trail. listen to this. >> i am confident with the leadership and the backing of the american people president

reunited today. the 15-year-old was missing for more than a year after she ran away from home. she was finally found in colombia. u.s. immigration and customs officials deported her to colombia after she gave them the name of a colombian woman who was born in 1990. her mother just can't believe she did that by herself. >> there has to be adults involved. no 14-year-old can change their name and get to colombia on their own. >> this week the u.s. embassy in colombia turned over the paperwork to bring the girl back home here to the states. it's not clear if she will be charged when she returns for falsifying her identification. 4:49 now. long beach police are questioning a man who brought a loaded gun to the airport. the tsa says that he had a ticket to board a delta flight to salt lake city but he was taken into custody for the .38- caliber handgun and the ammunition inside his bag. it's unclearly why he had the

weapon. now, this arrest comes just one day after a state assemblyman also had a gun at a california airport. a delta airlines passenger is facing charges for attacking a flight attendant. cell phone video shows that the man being dragged off the flight at l.a.x. on wednesday -- other passengers applauded when he was off the plane. witnesses say the passenger was drunk when he assaulted the flight attendant. the fbi says alcohol was a factor in this disturbance. there is at applause right there. >> get him off the plane. >> all right. here's a ploy for driving in the carpool lane. this is serious. a man in washington state put a fake skeleton in the passenger seat. at first glance you might think it was with a sweatshirt and seatbelt is from someone who sat in traffic maybe a little too long. but it's just the case of a driver trying to fool the cops. the state trooper discovered the ruse after he pulled over the driver for speeding, unsafe lane changes. this is clearly a guy that doesn't like to commute by

[ laughter ] >> i don't think i have ever seen anything like that. that's unbelievable. >> i have seen stories where they put a mannequin to get in the carpool lane. but put a dead guy next to you? i mean, come on. >> whatever works. we don't get traffic stories like that around here. quiet start to our morning, unfortunately. no major accidents. that is the good news. no major accidents or stalls. we have a little bit of roadwork out there. we'll tell you more about that coming up in just a little bit. eastshore freeway still about 14 minutes or so from the carquinez bridge to the maze. elsewhere, let's go out towards the san mateo bridge. everything is moving fine this morning in the commute direction. westbound 92, this is the commute direction heading out towards the high-rise towards foster city and the peninsula. it's still nice and quiet. you will find some areas of fog out there. lawrence has much more on that coming up. but you will find that. we can't even show you some of

our cameras including the one near the dublin interchange near westbound 580 and 680 so we'll show you live traffic sensors. so far your drive time not impacted. 14 minutes through livermore all the way towards pleasanton and through dublin in those westbound lanes. to the south bay, coming out of downtown san jose, 280 traffic, you can see a few headlights here on 280 and it continues to move well on the peninsula. 101 fine. eastbound 4 at loveridge a full road closure until about 5:30. this is ongoing roadwork they are doing in this area. so use the on- and off-ramps to get by. westbound 4, that looks great. all green on our sensors meaning speeds over 40 miles per hour all the way towards concord. and mass transit if you want to ditch the roads this friday morning, everything looks good so far for bart, ace, muni and caltrain and your ferries. that is traffic. let's get an update on this foggy forecast. >> elizabeth, after your long

[ laughter ] >> folks, around the bay area we have some patchy fog early on this morning. it looks like that is going to be lift through the middle of the morning and we'll warm up a bit around the bay area but cooler than it's been over the past couple of days. outside today we have some patchy, dense fog in the valleys in santa rosa and livermore. this week, lots of sunshine, breezy, especially over the mountaintops and cooler temperatures headed our way as we move in toward the middle of this next week. outside not bad over the bay. couple of clouds out there, as well. temperatures chilly in spots. 30 in santa rosa with fog. 40 in san jose. 46 in san francisco. about 45 degrees in livermore. if you are traveling around the state looking good, sunshine in the central valley about 61 in sacramento, 63 in lake tahoe, 65 redding, 59 in the monterey bay. high pressure building in right behind this next system that's moving through the bay area for today so yeah, it will be a little cool the other side

today but as this ridge builds in behind it we'll see offshore winds kicking in and it looks warmer. watch out near the beaches. big-time surf. be careful there. they have the mavericks surf competition kicking into gear and they are probably going to be 17.5 footers at half moon bay. temperatures around the bay looking at some 60s into the south bay as high as 64 in morgan hill, 60 in hayward, east bay temperatures up into the 60s in most spots. mostly sunny by the afternoon. couple of patches of fog at the coastline, 50s at the beaches, 60s inside the bay and north bay. next couple of days, weekend planned, looking good. do it outside looking fantastic, lots of sunshine and those offshore winds will continue into sunday, maybe cooling down a little bit into monday and tuesday. >> 13 to 16-footers are small. >> i usually like 20-plus what i go for. >> the big kahuna days, yeah. >> how do you learn to surf a 17-footer. >> you start on much smaller waves. you don't go out there on those.
