coming up. meantime, our top story this morning, the domestic violence case against san francisco's new sheriff is moving forward. the new sheriff says he has no plans of stepping down, after he was booked into jail yesterday that he physically abused his wife on new year's eve. after charges were handed down, he and his wife both vowed to fight them. if convicted, mirkarimi could face a year in prison. yesterday . >> i believe these charges are very unfounded and we will fight these charges. and i'm confident that in the end that we will succeed in showing the truth. >> i want to say this is unbelievable. how i say this now, i don't have

any complaint against my husband. we are together and we are fighting this. >> not above the law like anybody else. >> if convicted, mick renie could face a year in prison. yesterday he posted bail of $35,000. he is scheduled to be arraigned on tuesday. district attorney george gaston will rely on evidence, including a neighbor's cell phone picture of mick reamy's wife alleged injuries, plus messages from her. a protective order has been requested forcing mirkarimi to stay away from his wife and son. >> we have domestic violence battery involving physical, the physical assault and battery. we have a child endangering in that we have evidence that indicates the young child was present during the incident. >> the da says he will not push for mirkarimi to quit as sheriff, but the situation leaves mayor ed lee in a

difficult spot. in a statement, lee says as mayor, i must now review the facts and options available to me under the city charter. the city charter does give the mayor the authority to replace elected officials who have engaged in misconduct. but he also needs the approval of the ethics commission and three quarters of the board of supervisors. crews are investigating a pipeline explosion in solano county right now. this happened yesterday near highway 12 and 160. it was in a field with no homes nearby. vintage productions, the company that owns the gas line, was able to shut it down. in less than two hours from now, authorities will update us on a five-alarm structure fire in fairfield. the fire started at a commercial building on empire street. that is home to several businesses, including the american cancer society office. no injuries were reported. governor brown and the obama administration are teaming up to put more taxpayer money into renewable energy. they are hoping to create new jobs in the clean energy field.

the governor is determined to make more progress on this issue. >> reporter: with a signature and handshake, governor brown commits california to an extended federal partnership, advancing renewable energy goals and creating clean jobs. >> this template that we have here in california is the best template that we have all across america. >> reporter: touring an elk grove solar farm, along with governor brown, secretary of the interior ken salazar applauded california for taking the lead, setting an example for other states. >> the model, working relationship, cutting through red tape, getting projects permitted and constructed. >> reporter: over the last two years, the federal and state partnership pushed through a dozen solar energy projects and 130 renewable power projects. but critics continue questioning their sustainability and the expense. >> it's not easy. there are going to be screw-ups. there are going to be bankruptcies. there will be indictments. and there will be deaths.

[ applause ] >> any time you have a lot of change, have you people worried about the change. >> reporter: recurrent energy ceo, the developer of four local solar farms, says his industry will continue engaging with the skeptics to prove solar power can help the state. a luxury cruise . 7:05 now. it was like something out of the titanic movie, developing news overnight. that is what survivors say about a luxury cruise ship that tipped over near the coast of tuscany. water poured through a 160-foot gash in the hull of the ship, forcing a chaotic evacuation of around 4200 people. at least three people are confirmed dead. 30 people were injured. 69 people are still unaccounted

for. the italian coastguard continues its search. u.s. military officials say american vessels are being harassed by high speed iranian boats in the straits of homez and the persian gulf. this video shows the boats hot dogging near a u.s. transport ship. this comes as iran threatens to shut down the strait, which is a major route for oil transportation. 49ers fans are gearing up to see their team in its first playoff game in nearly a decade. candlestick security is cracking down hours before the big game. they will be thoroughly checking out all vehicles entering the lots, including sweeping trunks and searching underneath vehicles with mirrors. authorities want to avoid the possibility of fighting or gunfire, similar to what happened during a niners and raiders game, you may remember, last summer. we'll have a live report coming up later on in the broadcast. also, your weather forecast is coming up next.

. welcome back. 9 minutes after 7:00, and governor brown pushing to close down the state's troubled juvenile prison system for good. but some bay area counties are already taking matters into their own hands and dealing with juvenile offenders before they become violent repeat criminals. allen martin has a closer look at the south bay teenagers being sentenced by a jury of their peers. >> all rise. >> reporter: two words that silence a courtroom when a defendant faces a jury of his peers. >> juror 10? >> reporter: in this case, it's a teenager who really is facing his peers. >> the superior court of santa clara county in session. >> reporter: in this court, volunteers stand before teenager

defendants who must explain what they did and why. >> almost like a mock trial, but exactly how they would have done it had they been doing it live. kids in the jury box, kids forming the role of prosecutor, defender, even bailiff. >> reporter: county supervisor says the need for a new approach to dealing with juvenile crime in the county was apparent, beginning a couple of years ago. >> good evening, ladies and gentlemen of the jury -- >> reporter: this peer court is only a couple months old, but it's modeled after similar programs in other bay area cities. >> what do you think a good sentence would be? it's very interesting. how would you make amending for this? clean graffiti, do community service? >> reporter: to get here, defendants have pleaded guilty to nonviolent crime, such as underage drinking and graffiti. most are first time offenders. >> most the time they are kind of intimidated us, since we are up there, and we are in a way slightly looking down on them from where we are. i think when we give them their sentencing to community service

hours, we realize what they are going through. >> reporter: backers of the program say that is arguably the most important lesson from this court. the hope is it reduces repeat offenders as much as 97%. >> members of the jury -- >> reporter: adults who volunteer their time as well believe the program reaches beyond the kids who are already in trouble. >> juvenile court is an opportunity court t shouldn't be seen as a punishment court. it's an opportunity to take kids who have had a slight transgression. we've all had these things happen to us in our childhood, but we were able to bounce back and lead productive lives. >> reporter: or maybe get kids to ask questions of themselves before they end up here. >> it kind of changes your way of thinking, like, what you do in everyday life, too. like, when you're hanging out with your friends, is this right? would this get me in trouble? >> reporter: we purposely did not show any of the defendants' faces. everyone you saw was a volunteer member of the court. supervisor cortez says they have found the peer court works best with first time offenders. if you have a story idea, log

onto cbs 5, click connect, scroll down to closer look, send me an e-mail. allen martin, cbs 5. it is a clear and cool morning here in the bay area. looks like it's going to be a lovely day. jim bernard with more details on what we can expect and the big 49ers forecast today. >> looks like another great day around the bay. we're getting used to these temperatures here, and lovely dry, warm days continuing into mid-january. there's a change on the horizon, but it's not till next week. so we will enjoy again lovely weather this weekend. as we look outside, mostly clear skies, a bit of haze and patchy fog right at the coast. otherwise, clearer throughout the bay and cool this morning. again, we see low 30s and upper 20s out across the interior. a little patchy frost out there, warms up quickly. coming back to the bay, mid to low 40s for most locations. still pretty cool over at the beach, 36 in pacifica. we'll look for conditions to continue to warm through the day, warm and mild all day long,

increasing fog for tomorrow with a much cooler air mass moving into the area by late tomorrow, into monday. temperatures will drop into the low 50s. chance of rain is back in the forecast and looks like a pretty good chance of some rain showing up by wednesday, continuing through the end of the week. rainfall amounts at this point are still pretty sketchy, but it does look like we will see the potential for moisture to finally move into the picture here as we proceed into next weekend. taking a look right now at -- whatever we can get moving here, if we can get this garage clicker working, which it does not want to seem to do -- there we go. this afternoon again, mostly sunny across the interior. warm conditions into the mid to upper 60s for the bay and the interior, with patchy fog continuing. a slight onshore breeze at the beach, which will increase here through the day as we see the high pressure system finally pushing off to the north and east. here comes the cooler air mass for sunday. not a lot of moisture associated

with it, but it will be with us into the beginning of the week. we'll stay warm and mild today with light winds and then look for increasing fog and cooler temperatures headed our way here through the day on sunday. today again, we'll top out in the mid-60s for most locations. across the interior, cooler around the bay. mid to low 60s. and we'll continue that trend through the weekend, with the rain arriving late next week. big game today, temperatures in the low 60s, mostly sunny, as we continue this dry and mild pattern for the playoffs. couldn't be much better. postcard weather here for the game here this afternoon, and we'll look again for that chance of showers to show up by the end of next week. there you go, ann. back to you. >> all right. we love it. thanks, jim. gadget fans still buzzing from all the cool toys revealed in las vegas at the consumer electronics show. privacy concerns were raised by the new technology.

jim steyer joining us live this morning with common sense media. thanks for being here. >> good to be here. talk about ces, things that you came away with, exciting things and concerns. >> ces is the show that basically says, here's all the gadgets, here are the things that are tv sets and new -- everything but apple, because apple doesn't go for ces. apple's too cool! >> apple's too cool! >> everybody's trying to copy apple on the tablet, the ipad. >> true. >> the big thing is this. they are building tv's and gadgets that collect your data. if there's one thing i would like to say to the viewers out there, today, the machines are so smart that they collect your information. they know it, they track you. what's the issue? privacy. and from a kid standpoint, it's really a big deal, because now that means that your tv set may be collecting information about you. >> what kind of information are we talking about? simply what you're watching, right? >> no, no, no, no.

i mean, it also could be all the personal information that you decide to upload. remember, sometimes those questions they ask you can be for your address, your phone number, could be data, they could look at your consumer habits and stuff like that. >> right, and the consumer, you're talking, too, about all the information that goes into your phone and you give some application permission to read your texts and whatnot. everything is in that one place. >> exactly. the reason this happens is because advertisers, which is the medium that funds broadcast television. that's called targeted advertising. these are the same privacy concerns with facebook and serious privacy concerns around social networking. the more data that people have about you, one, they can target you with ads. you may not care about that or jim bernard might not, and i might not, but my kids who are 13 and 14 may say dumb stuff and reveal stuff.

secondly, it's increasingly controversial. google plus announced this week they will use your personal information on google plus as part of search data. so, you know, ann posts a picture up there, you have your little picture or 80,000 pictures or whatever, and that becomes part of your google profile. so here's the issue. more and more information is being made public without often times your knowledge. and in some cases, your permission. big issue for 12, 13, 14, 15-year-old kids. the white house will be vorvetiond i can tell you, with quite a degree of assurance. the federal trait commission will be. that was the biggest single story. this is the year, 2012, not just of fancy gadgets and micro thin television sets. this is the year of privacy and the issue of how privacy affects all of our lives and whether or not we want large tech companies gathering our information, or certainly our kids' and teens'

data and information and giving it out. okay. before the lawmakers get it done and put a lot more privacy laws into effect, what can parents do? >> the biggest thing, number one, what the industry would argue, well, you have privacy settings. indeed, as a consumer, you need to know your privacy settings. you definitely need to know that. you don't need to let them share location or a lot of other personal information so that you can limit the amount of information people have. you don't have to give your teen's information away. when we say advertisers bait, we mean online questionnaires, free give-aways and contests like that. because they scrape your information or your kid's information that way. also, opt-out buttons is the current way to go. they take this unless you opt out, so you should be opting out. long run, we want to change that to opt in, meaning you don't give your information unless you agree to. >> right. >> this is going to be a very big issue for me and you, ann, for jim bernard, and most of all, for our kids and teens. 2012 will be the year of major

. now we're going to make this dish from morocco, correct?

>> yes. >> and this chef is from morocco. it's a chicken dish with a lot of flavor, lot of fun. get started by putting the chicken, skin side down, in a pan heated with olive oil. it gets nice and brown and you release some of the fat into the oil. once that cooks, he puts in pearl onions. the chicken is flipped. when the skin gets that beautiful golden color, add wild mushrooms and pitted olives. to really add spark to this dish, the chef adds a splash of grand view, then dark chicken stock. finish the chicken in about a 450-degree oven for about 20 minutes. and chile it's cooking, heat another pan with olive oil and finger ling potatoes. once they brown, add shallots and parsley and give it all a good toss. now everything is ready to be plated. look at how beautifully all these ingredients have come together. top it off with golden

shooting range. >> that will work. >> reporter: earlier, the texas governor took aim at washington insiders. >> i, again, am the outsider who is willing to go to washington, to step on some toes, to completely overhaul how washington works. [ applause ] >> reporter: in miami, supporters gave newt gingrich a warm welcome at a cuban restaurant. he's looking ahead to the florida primary and predicting a win in south carolina. >> if you look at the most recent polls that romney is sliding in south carolina every morning, because people realize he was not a conservative in massachusetts. >> reporter: gingrich is calling on a political action committee that supports him to remove inaccuracies in a film that attacks mitt romney. the frontrunner has his own new ad. it portrays him as a job-creating conservative and defends his work for the bain investment firm. >> mr. romney's gop opponents are embarrassing themselves -- >> reporter: rick santorum says romney has a bigger problem. >> he is a massachusetts moderate to liberal governor,

who has changed his opinion on just about every issue that's out there. >> reporter: and romney's challengers have an issue of their own. a federal judge ruled that santorum, gingrich, rick perry, and jon huntsman will not appear on the virginia ballot, because they failed to get enough qualifying signatures. only romney and ron paul qualified in every state. manuel gallegos, cbs news. some state lawmakers are trying to extend the life of community redevelopment agencies. governor brown wants to eliminate them to save the state money in the california supreme court recently ruled in his favor. but a bipartisan measure introduced yesterday would extend the deadline from closing those agencies from february 1 to april 15. lawmakers are hoping to allow local agencies time to figure out how to continue existing projects. sales force.com is providing a preview of its new campus to be built near at&t park in san francisco. the online sales software

company plans eight buildings, sporting shades of pink, orange and purple, across 14 acres. thousands of workers would be strolling through offices, shops, restaurants and child care sites. sales force hopes to start construction this year. they are calling it a close call in santa barbara county, after a family car plunges off a cliff. a mom and her two kids can thank navy seabees for saving them after this accident. it happened on a twisting, turning canyon road 25 miles north of santa barbara. the group of seabees were transporting equipment, including a forklift, which helped firefighters safely reach the victims and pull them out. candlestick park will be packed with niners fans today, but maybe none more faithful than 80-year-old irwin heartly. he was honored at a game back in september. >> the unusual part, when i left the game to go up there, people recognized me and knew about the ticket, because they had my

>> reporter: it doesn't take an artist's eye to see beautiful changes are in the making at marin specialty care, but it took an artist to make it happen. >> you don't want to look too consistent. >> reporter: for the past year, nancy ballard has been transforming cancer treatment rooms, one by one, to bring beauty where it's truly appreciated. >>it's a very important time of your life when you sit on these chairs. >> reporter: cancer patient came corrine spent time in this room. she asked the artist if she could bring her magic here. >> to have a nice quiet environment around you it's, you know, you're thinking a lot when you have chemo, you know, sitting there. very important to me. >> reporter: so on this day, nancy and her volunteers repaint the space from a cold hospital blue to warm earth tones. stencils of leaves and birds bring the outdoors inside. >> corrine, i think this looks good here. >> reporter: last year, nancy

started rooms that rock for chemo, a nonprofit that recruits designers and volunteers to donate time and materials to create unique, one-of-a-kind medical environments. nancy does all the coordination and fund-raising. >> this is the venetian room. >> reporter: her first project was at dr. hovered's office. after a nurse described the rooms as depressing, nancy donated a picture, but saw a bigger need. now patients can choose to receive treatments in a venetian-inspired room, with golden plastered walls, or the dragonfly room with its cottage furniture and low lights. or even the soothing water room, surrounded by hand-painted koi. >> the whole experience is better for the patients. >> they know there are people out there that are thinking about them and care about them even if they don't know them. >> looking even more beautiful than i thought. >> reporter: for organizing fellow artists and decorators to transform bland rooms into

vibrant healing spaces, this week's jefferson award in the bay area goes to nancy ballard. kate kelly, cbs 5. >> wonderful. it is now 7:41. and the all-important weather forecast today, game day. another gorgeous weekend around here, jim? >> it's getting kind of old, huh? tired of this weather? it's lovely. >> sounds like we're getting a little rain, huh? >> some on the horizon. it will be arriving late in the week. we continue with yet another gorgeous weekend across the bay. sunny skies, warm temperatures, minimal fog as we enjoy that offshore breeze, keeping skies mostly clear. we see a bit of haze around the bay this morning, but a gorgeous sunrise out there. temperatures cool in the north and east bay, into the upper 20s to low 30s. a little patchy frost out there, moving back to the water, things warming up quickly. mid to low 40s for most locations. still some upper 30s scattered around the south bay, even back at the beach, we're looking at

37 over pacifica. we'll see a bit more of an onshore flow develop over the next few days, bringing the fog back in here late tonight, into tomorrow. we'll also see a cooler sunday here, as temperatures cool off into the beginning of the week due to cold air mass dropping south out of the gulf of alaska. not much rain associated with that, but the pattern is changing and looks like we've got a chance of rain in the forecast wednesday night, into thursday and through the end of the week. we should be looking at some measurable rainfall for the bay area. a little patchy fog at the beach this morning. otherwise, sunny and warm throughout, with temperatures in the mid to upper 60s for the warmer locations. back at the bay, we'll look for mid to low 60s, all the way back to the beach. you see the effects of that high pressure system, as we've got clouds moving up from the south, a bit of shower activity down in the southland. for us, mostly clear, just patchy fog at the beach here this morning. and again, that will maintain through the day, as that high pressure system continues to be our major weather influence. here comes the cold air dropping

out of the gulf of alaska. not much in the way of moisture with that. we'll stay warm and mild, with light winds today. slightly cooler here tomorrow, as this system moves into the area. more of an onshore breeze, which means increasing fog and a cooler sunday, as well as the rest of next week. we'll be cooler, too. we'll see temperatures back into the 50s, which would be our seasonal norms. as we play hide and seek with a fog bank here through the late night, early morning hours, all the way into tuesday, again, the rain doesn't appear until late wednesday, into the end of the week. then we should be talking about our first measurable rain in sometime. here's a look at your temperatures around the bay today. mid to low 60s for most locations. at the stick, 60 or 61 by this afternoon. we continue cooling into and through midweek and then the rain arrives by late wednesday, into thursday and continues on and off into the weekend. doesn't look like a big gulley washer at this point, but some rain will be a welcome relief, as things have been very dry

author j.j. capecso joins us. bon journo! you live in san francisco, but you're fascinated with rome. >> absolutely. i spent over 10 years living in rome and it was there that i couldn't believe what was happening. the facts were coming into my arena from the kaleidoscope of the italian network of power. i thought, my golly, this is sizzling facts. i've got to start writing a book. and what should we know about that? can you give us a teaser? >> well, yes. suddenly, i discovered the corruption that was happening with the five components of the italian network of power. the mafia, the masons, the judiciary, the cia, and the vatican. and i said, well, that's extraordinary. but also the beauty of italy is extraordinary, in art and culture, so that all meshed

together and that's what really inspired the book. what a setting for a political scandal. >> absolutely. so connections between rome and san francisco, obviously everybody knows of north beach, our little italy. is that a fair representation? >> i, i think it's extraordinary. italians are passionate. let's begin there. and passion begins with food for the italians, not just love. and so we have the oldest italian restaurant in the united states. we also have an unbroken record of harvest since 1919, and of course genimi who let the immigrants -- everything was the italian way. handshake, they looked at each other in the eye. and all those immigrants that he bet on, they repaid their debts. so when the earthquake came, he was flushed with money and he could give it back to these people to rebuild and that's how bank of america started. so we have that.

we have luciati, our great conductor with the opera, marvelous from tuscany. and medusa is here for a short time. i think i saw her picture before. >> yes, yes. there she, is right there. >> oh, yes. tell us, you mentioned food and restaurants in north beach. we have one of the oldest italian restaurants. but it's so easy to get caught up in these little tourist traps that are fake italian restaurants, you might say. >> yes. what do you recommend? where should we go? >> i think it's very important that people understand the cuisine of italy. for example, f'er italia, originally from san ramos, the north of italy, right on the coast coming down, starting the italian riviera, which you read about in my book, terrifying. and then of course you have so many different cuisines. you have the sicilian cuisine.

sicilian wine is hard to get here, and it's fabulous when we do. we have the bolan nace sauce. for people who don't have a lot of money, our best delicatessen in town, get some of their food and try it out at home. and before you invest in the restaurant, go and get something from your own table. >> i like that idea. tell us about your book signing coming up. >> oh, gosh, very exciting. i just had a wonderful lecture at the legion of honor, where medusa is, speaking about that naughty boy bernini, who we always thought was an angel, until i did some research. and you know what? he's quite a devil, like most italian men. >> wednesday at 6:30, you'll be signing. public is invited. >> yes, indeed. >> thank you for joining us this morning. we'll be right back.
