of richmond. a man was shot in his legs near some train tracks there. the victim says he saw a laser pointed at him and then heard gunshots. we have a crew gathering more details and stay right here with cbs 5 for updates. the martin luther king, jr. a freedom train will travel from san jose to san francisco. it's to commemorate the civil rights march from selma to montgomery, alabama in 1965. lisa washington is at the stay diridon station where the train departs later this morning. good morning. >> reporter: good morning. reporter: the first caltrain train just left the station within the last two minutes but the freedom train ride that we're talking about today was started 28 years ago. it was dr. king's wife coretta scott king who initially started the train ride after

her husband's assassination in 1968. california's caltrain freedom train ride from the south bay to san francisco commemorates as you said the 1965 march from selma to montgomery. that distance 54 miles. the freedom train ride is approximately the same distance. now, the train ride is a reduced fare only $10 roundtrip. it will make four stops departing san jose at 9:30 this morning, sunnyvale at 9:45, palo alto at 9:59 and san mateo at 10:22. now, it is important to note that the freedom train ride tickets are not available for purchase at any of those stations. you will need to get them from brown paper tickets. if they are sold out you may purchase a regular caltrain ticket and ride a train up to san francisco to be part of all the dr. martin luther king, jr. activities in the city today. >> a train will be left. that one part of the holiday,

just for commuters? >> right. it was a train that i guess left around 4:30 or so many we were so surprised that a train was leaving this early in the morning. i think there were about five passengers. >> gee, i thought you and i were the only ones that worked at this hour. >> exactly. >> stay warm out there. we'll check in later. since today is a federal holiday, there are a number of closures you should know about. they include federal and state courts and offices, city and county offices, all the banks, all the schools, of course the kids love that. they are closed. bart and muni running on a saturday schedule. a.c. transit will run on a sunday schedule. vta and samtrans are on regular schedules today. this is the first martin luther king, jr. day since the opening of the mlk memorial on the national mall on washington. but there are already plans to make a change to the new landmark. reporter: for the first time, martin luther king, jr. day will be celebrated with a memorial in his honor. >> it's beautiful. it's absolutely beautiful.

>> awesome. >> breathtaking. >> reporter: the 30-foot-tall statue was unveiled last year in the nation's capital. it was the centerpiece of celebrations to mark the civil rights leader's birthday yesterday. >> ♪ happy birthday to you >> reporter: but the memorial will not stay as it is now. the national park service says it will change. a quote on the side of the statue after poet maya angelou said it made king appear to be arrogant. >> we don't want it as a distraction. we want it to be correct so we're working with the park service to see what will happen. >> reporter: king would have been 83 had he lived. he was assassinated in memphis in 1968 leaving a legacy of service and a dream of equality. >> he brought beautiful things to our country, what was needed at the time, what we needed to break away from what this stereotypes and from injustice. >> reporter: king's son says his father had unfinished business when he was shot and killed. he had only just begun his poor

people's campaign to demand economic justice. >> he did not live to see that come to fruition. and so some 45, 44 years later, we are still challenging our nation. >> reporter: the first family attended church yesterday to mark the civil rights leader's birthday. today they will do community service to honor his life's work. i'm greg black reporting. it is 4:36. now to a developing story. the search for a person wanted for sexual assault. he is 14. oakland police cannot show us a picture of the sexual assault suspect because of his young age but they are putting out his name and hoping for a little help in finding him. he is 14-year-old [ indiscernible ] wanted for two sexual assaults on a 28-year- old woman in west oakland this month n both cases the women were walking alone when they were attacked. >> crime starts off as a

robbery. once he obtained whatever item he wants from the victim, then moves into the sexual assault. he has the victim go to an isolated area and that's where the sexual assault takes place. >> oakland police need your help in finding that young suspect. he is black, black hair, brown eyes. he is considered armed and dangerous. a man is accused of shooting two football fans who cheered for the 49ers in georgia. he is accused of shooting the victims in the parking lot in an applebee's on saturday. one man is hospitalized. they said they took offense when they cheered at the saints game this weekend. a santa clara police officer is on administrative

leave after shooting and killing a man. he pulled over an alleged drunk driver saturday night. witnesses say the driver was told reputedly to put his hands above his head but the man refused to cooperate, reached for a gun and police say the officers were forced to fire, according to officials. >> one presents a firearm in your presence and, you know, the next plausible thing to think of is, you know, they are going to use it against you so you want to defend yourself. he acted in self-defense. >> the officer will be on paid administrative leave as the investigation continues. today the ceo of the company that owns that cruise ship that ran aground off the coast of italy blamed human error by the captain. the death toll from the accident off tuscany is six and 15 people are still missing. the company's ceo says the ship's captain made an unauthorized deviation from the ship's preprogrammed course. the ship was heading north when it struck some rocks just off

the coast. one crew member says it may have been fortunate that it happened so close to shore. >> it was the best decision made because people in lifeboat reaching soon the shore. >> this is some amateur video showing the confusion as the ship hit and began to take on water. divers recovered the black box to tell investigators more about what was going on at the time of the accident. the captain facing charges of multiple manslaughter. it is a holiday which means it's light out there. i came in from the east bay. i counseled 17 cars. >> hopefully they will stay like that for most of the morning. this holiday we'll keep it quiet. you can see here live at the bay bridge toll plaza not a lot of cars on road, no metering lights, clear across the eastshore freeway coming away from the carquinez bridge. so we have wind advisories in effect so a bit windy when you

latest. gil, what can you tell us? >> reporter: hi, frank. good morning. well, i just spoke with richmond police a few minutes ago and they confirmed a man was shot around 3:15 this morning. along the tracks, not these particular tracks behind me but less than a quarter a mile away from where i'm standing where the tracks cross west ohio avenue. now, the freight train conductor actually spotted the man laying by the side of the tracks. the man claims that he was walking along those tracks with his bicycle when he saw a laser beam pointed at him from one of the nearby building's rooftops. after seeing that laser beam, he says that heard a gunshot go off. well, that man was shot in both legs. he was transported to a local hospital. police say he is going to make it but during the search the train was detained while they searched for the possible sniper. they didn't find anyone and the train continued on. it originated from oakland pulling into richmond but a

very bizarre story, a shooting here i oakland. the victim is a man in his 40s, not known where he is from and he is expected to survive. >> where was the sniper, on a building or something? do they have any idea? was it a high-powered rifle or what? >> reporter: we are still trying to find details. according to the victim he saw it pointed from one of the rooftops in the 400 block of west ohio avenue. he didn't get a good look at the shooter but he saw a laser beam from one of the rooftops. when police looked at the rooftops they didn't find anyone. >> no shell casings, no nothing, all right. gil diaz live for us in richmond this morning, thank you. it is 4:45 now. san francisco sheriff ross mirkarimi will be arraigned tomorrow on three misdemeanor charges. they include domestic violence battery, child endangerment and dissuading a witness. he was arrested friday booked into his own county jail accused of causing abruise on

his wife's arm that happened on new year's eve. the mayor is not commenting. >> they are serious allegations and i'm going to refrain from making any comments. >> if he is charged, should he step aside? >> no comment. >> mirkarimi and his wife say they will fight the charges against him of the since his arrest, mirkarimi has been ordered to stay away from his wife and their young son. jon huntsman's ticket to ride will stop short of a south carolina primary. sources say a former utah governor will announce this morning that he is dropping out of the gop presidential race. and tara mergener reports, huntsman is also expected to make an endorsement. reporter: jon huntsman plans to drop out of the gop race this morning and throw his support behind front runner mitt romney. the former utah governor will make it official in south carolina nearly a week after he finished third in new hampshire's primary. >> i want to beat expectations, you know, like we did in new

hampshire. >> reporter: huntsman gave no sign he was planning to back out earlier this weekend telling reporters it's too soon to predict how he will do in saturday's primary. >> let's not draw too many confusing until we get to the 24-48-hour mark. >> reporter: he always admitted expectations in south carolina were low. a recent poll showed him with only 4% support putting him behind even comedian stephen colbert. but his endorsement may not help romney among social and evangelical christians. santorum is going after that vote. he got a boost over the weekend when some decided to back him as a romney alternative. newt gingrich was their second choice ahead of rick perry. >> i ask you to think about the kind of leader you want to preside over our nation. who will be faithful to your

values? >> reporter: the candidates face off in the latest debate tonight. tara mergener for cbs news, washington. well, if he is behind comedian stephen colbert, probably a good idea. word is that huntsman's decision came on the same day that he received an endorsement from south carolina's largest newspaper today. the announcement coming out later today. you won't have to wait long for the old ipad 3. it's coming out soon. the apple gadget expected to go on sale in march. there are reports it will have a hi-def screen, run a faster processor and work with next generation wireless networks. the tablet will use a quad core chip which lets users jump more quickly between applications. the ipad is the second biggest seller behind the iphone. 4:48. snap, crackle murder. how one california man tried to poison his wife's cereal. plus the golden globes goes to the biggest winners last night. and the favorites to win the

looking into the behavior of a hat prompted a federal investigators are looking into the behavior of a couple from germany that prompted a pilot to divert a delta airlines flight. the man and woman were flying first class on an atlanta-to- costa rica flight last night. the airline says the couple began acting unruly demanding food and champagne and refusing to sit down. the flight was eventually diverted into florida into tampa. the couple denies misbehaving. so far no charges have been filed. a southern california man is in jail for allegedly poisoning his wife's cereal. police arrested fernando porros during the weekend. they say he put a chemical of

something in a bowl of rice krispies. the woman said the cereal smelled and tasted awful. cops became suspicious when the husband ran away as they tried to question him. his wife, by the way, is doing okay. winter weather hitting both sides of the country now. they have winter weather advisories from pennsylvania all the way to massachusetts tonight and tomorrow. and in the northwest, a surprise snowstorm hitting the seattle area yesterday. it was a traffic nightmare. it was several spinouts and crashes. a lot of slippery roads out there, too. they had to shut down some freeway on-ramps to downtown seattle, as well. time for traffic. >> we are not having those kind of traffic problems. traffic light this morning. here's a live look at 101 near mckee in san jose and you can see, just a couple of cars on the roads. so a nice ride. let's head to our maps and show you the rest of the south bay. accident-free. not a lot of roadwork due to

the holiday so quiet on 880/237. no delays on 280 and again quiet on 101. 880 through oakland in both directions no problems. clear towards the maze. a little windy. you can see the camera shaking around. we have wind advisories for the bay bridge as well as the san mateo bridge this morning. now, they did have one issued for the benicia bridge but it's been lifted so some windy conditions. use caution as you work your way across the span. here's a live look at the golden gate bridge. we are seeing one lonely car head down there towards the toll plaza but still quiet out of marin county and travel times this morning, northbound 101 from 92 to the 80 split no delays. 280 clear both directions. clear north- and southbound into the south bay. that's traffic. elizabeth, cold and windy today. >> overnight we saw some windy conditions, some wind gusts reaching up to 30 miles per hour and we have some wind advisories for bridges. no national weather service

wind advisory but chp issued that for the bay bridge. so temperatures outside mostly in the 30s on the 40s. this afternoon, temperatures bumping up. still cool. we have been seeing mild weather conditions here lately so these are going to feel chilly. temperatures though about average. mostly in the low 50s across the bay area. plenty of sunshine to go around. for later on tonight, it's going to be a different story late tonight into tomorrow morning. they actually issued a freeze warning for many of our interior valleys as well as the urban corridor portions of san francisco and san jose. temperatures are expected to reach the mid-20s to low 30s. the winds have been keeping our temperatures today mostly on the more mild side but again the winds are going to die down and that's why they have forecasted that freeze warning in effect for tonight into tomorrow morning. now, high pressure remains the name of the game for right now. no rain in our forecast. so that is going to change by

later on this week. we'll talk about that in just a second. in the meantime around northern california, mostly sunny skies, 40s and 50s. 46 in redding. you see 50 there as well so in the bay area mostly in the low 50s. 51 in san francisco. 52 in oakland. so big changes by later on this week. looks like rain is expected to reach mainly the north bay on wednesday and then it is going to move farther south by thursday on into friday. so this could actually be a relatively significant rainmaker by the end of next week and it's been so quiet with our weather patterns lately. we need this rain so again it could move on through saturday through the beginning of the weekend . back to you. >> thank you. a silent film in black and white is among the big winners at the golden globes last night.
