>> let's talk about traffic. we have roadwork to contend with this morning eastbound 237 connector to 880 is closed until 5:00. westbound okay. no major snags or accidents but it is dry on the road. hopefully a nicer commute. >> temperatures outside right now not too bad. pretty mild. milder than we have seen the past few days anyway. mostly upper 30s to 40s across the bay area. there is some fog especially in the north bay valleys. so napa, santa rosa, so watch out for that. otherwise we are staying dry. will it ever rain again? we'll tell you coming up. >> good look for you. >> hard to get it all together at 4:30.

>> no worries. >> we'll all get it together by 7:00 when we're done. developing news from the east bay. a college student shot to death while sitting in a car with his sister. gil diaz is in richmond now with more. reporter: good morning. it happened around 7:00 last night. and we were there to check out the scene but yeah, the brother and sister sitting in their car heading to college class at contra costa college. here's a map. this is the 2100 block of nevin avenue and they were sitting in their car. we were there this morning to check it out. the police are gone. but there's candles lit on that scene to commemorate that brother. now, they didn't make it to class and the brother died at the scene. they were sitting in the car when all of a sudden a car rounded the corner behind them

heading west on nevin avenue with a shooter following them. that shooter stopped chasing after that moving car and turned to the siblings in their car and started firing at them. the sister must have been driving because she gunned it from that scene. she rounded the block and went to an abandoned parking lot where she discovered that her brother had been shot and killed. the police haven't given us more details about the incident. we are trying to find identifications and clues about the shooter but if anyone was in the 2100 block of nevin avenue around 7 p.m. last night, please contact police. >> gil, does it appear to be random or was there a connection? do they have any idea between the shooter and the brother and sister? >> yeah. we haven't been told yet. you know, it looks like right now that it was random. the brother and sister were just sitting in their car, just

about to head to class when suddenly it car rounded the corner behind them accelerating at a high-speed. so they may not have known what happened and maybe that shooter just didn't want any witnesses from that shooting that he had done. so we'll have to see. >> still very early. thank you, gil diaz live for us in richmond. a pair of senior centers and child care center were quarantined recently because of 73 people getting the norovirus in corte madera in san rafael. 16 children and adults have gotten sick at an unidentified preschool. the quarantine could be lived as early as today. the source of the outbreak is under investigation.

the pleasanton school district will decide whether to deploy drug-sniffing dogs to create drug-free campuses. lisa washington has more on what's being considered today. >> reporter: we are at foothill high school. already this school year, they have had 29 drug-related suspensions, more than 3 more than they had in all of last year. they would be used to search parking lots and locker rooms at all three pleasanton high schools including foothill while the students are in class. the number of drug-related suspensions has increased at the high schools, in some occasions nearly doubling. one board member voiced concerns over the intent of the dog. school officials, pleasanton police and some parents believe using the dogs would cut down on the amount of drugs on

campus. >> any way you can find out is good. if you are not the kid doing drugs, why would you care? >> reporter: now, if this plan is approve, the pleasanton police k-9s would cut these searches at no cost to the district. there are a few other bay area school districts that already use the k-9s for the searches, those being dublin, castro valley and livermore. some have seen a decrease in the number of drug-related suspensions. back to you >> thank you. there are new allegations of domestic violence against san francisco sheriff ross mirkarimi. a southern california woman said she dated him in 2007 and 2008, filed a report with san francisco police over the weekend. she claims mirkarimi was verbally abusive during their relationship and one time she says that he got physical. christina marie flores tells

cbs 5 that mirkarimi never punched or hit her but she does say that he grabbed her arm and pushed her against the wall yelling and she said it left a bruise on her arm. meanwhile, mayor ed lee would like the sheriff to take a leave of absence until the distraction of his trial is over. >> i know he is taking it seriously but as public officials, i repeat that it's really incumbent upon us to make sure our responsibilities are served. >> the mayor hopes to meet personally with mirkarimi. the sheriff is due back in court thursday to get permission to see his wife and son. oakland city leaders are proposing to lay off 100 people and consolidate several departments in the city to fill the $28 million bucket gap

following ross of redevelopment funds. the mayor -- following the loss of redevelopments funds. the mayor will meet with leaders today. san jose will take steps to eliminate pension plans for the mayor and city council. it's been a hot button issue. costs have ballooned into the hundreds of millions of dollars. and new this morning, san jose voters might be asked in november to set a higher minimum wage. the "mercury news" reports some san jose state university students have applied to circulate petitions to put the issue on the ballot. their proposal is for a $10 minimum wage. san jose already has a living wage policy that sets minimum up 13.59 an hour for businesses contracting with the city. president obama gives the state of the union address tonight. he is expected to call for higher taxes on the wealthy and offer his plans for the housing crisis and unemployment. congresswoman gabrielle giffords will be there on one

of her final duties in office. giffords is resigning this week to concentrate on her recovery from last year's shooting. the republican candidates running for president crashed in the debate in tampa, florida, with finances, the hot topic. this morning, mitt romney released tax returns for 2010 and estimated returns for 2011. now, they show that he made more than $40 million in the past two years. in 2010, he paid a tax rate of just 14% since most of his money came from investments. last night romney attached newt gingrich's work for freddie mac. >> freddie mac was paying speaker gingrich $1,600,000 and at the same time freddie mac was costing people of florida millions. >> gingrich didn't dispute that amount but said he never did any lobbying on behalf of clients. 4:39 now. let's check traffic and

boulders on telegrap one person is out of his home following a rockslide right here in san francisco. boulders on telegraph hill, look at the mess, all giving way yesterday crushing a car down below. people that were living in nearby condos evacuated for a couple of hours. city inspectors have concluded the hillside was stable enough to allow those tenants all but one to come back home. look at the rocks especially that one big bolder. tonight, san francisco city leaders will make a big decision for a jack-in-the-box restaurant in the richmond district. the own we're like to stay open around the clock 24 hours but a hit-and-run attack on thanksgiving drew attention to the restaurant's late night operations. city officials discovered the restaurant had been operating for two years without the proper paperwork to stay open all night. they will talk about it tonight. 4:44 now. we are getting some new video of a clash between san francisco police and "occupy" demonstrators. a protestor shot a run-in with police during last week's

financial district protest. the video shows an officer on a dirt bike ramming a woman as she tries to block police and just after that you see another officer using a baton to push protestors back. in all 18 people were arrested. $3 million, that's how much the city of oakland spent so far to deal with "occupy." that's about $50,000 a week. most of that for extra police presence. money they don't have, too. 4:45 now. police in san francisco say they arrested more than two dozen people at sunday's big nfc championship game between the giants and the 49ers. all but 29 people were booked, 16 outside the stadium, 13 arrested inside. most were alcohol-related and some included resisting arrest. police also ejected another 110 people out of the game. that compares to 57 at the previous weekend play-off game against the saints. this time, police adopted a

zero tolerance policy. tension between 49's and giants fans turned violent in san jose after the 9ers lost. a fan captured a street brawl downtown that showed a group of 9ers punching, kicking and knocking others to the ground. they had been watching the game at a pizza store along with a small group of giants fans. >> a large group of 49ers fans was on their tail and was yelling at them, saying, screw the new york giants, this and that, "f" in and that and that's how it all started. >> by the time the police arrived, the crowd dispersed. no one was hurt. but officers are sti investigating that incident. you see restaurants and shops inside airports but how about yoga? >> the zen like experience coming to sfo soon. a dramatic rescue seconds

washington. a snowmobiler caught in an avalanche was saved by friends. watch as the snow breaks free here and in just seconds the man is buried alive. his friends saw right where he was buried and here's what they had to say. >> they knew where i went in the snow. and that was the saving grace is knowing exactly where i went in the snow and they started digging that area. >> once they got his head out of the snow, he said he was relieved, just a matter of getting him out after that. everyone made it out safely. a rockslide has closed a main highway into yosemite. the slide caused major damage to highway 120, the main route from the bay area. it happened sunday night. no one was hurt. the road will be closed for at least two weeks. this morning oakland international airport will announce expanded service from a particular airline.

officials aren't saying which airline involved. half dozen destinations will mean more jobs at the airport. this week a yoga room will open at san francisco international airport in terminal 2. it will give people a chance to relax and enjoy the experience if they so desire. frank, in namaste. >> it's zen on the freeways, as well. we start off with some new metering lights that get turned on in the south bay this morning. caltrans plans to start using the controls this morning on two on-ramps to westbound 237. they are in milpitas at calaveras boulevard and mccarthy boulevard. the lights have been on green since last tuesday but today they will add the red lights. the ramps will be metered

monday through friday between 6 a.m. and 10 a.m. to relieve congestion in the area. there is construction now eastbound 237 connecting to 880. so far not too many delays. you can see the westbound 237 connector not doing too badly. as folks adjust, things will slow down. northbound 280 problem-free just a few cars out on the road. nice and dry this morning so no major snags as you work your way through the south bay. here's live look at the bay bridge toll plaza. metering lights are off, 19 minutes from the carquinez bridge to the maze. no delays. you're clear across the upper deck into san francisco. lower deck, roadwork gets under way at 7 a.m. until 2 p.m. starting at the skyway to treasure island. various lanes blocked. this is an ongoing project that they have been doing so we're seeing delays in the afternoon but overall not too bad. roadwork wrapped up southbound at 7th on 880.

880 not too bad. northbound clear into the maze. southbound no delays towards 92 and into the south bay. and checking the san mateo bridge if you are making that connect they are morning, westbound clear into foster city. no delays. 14 minutes between 880 and 101. we'll check mass transit next. cloudy and foggy inland especially the north bay so napa, santa rosa, those areas. and temperatures definitely not as chilly as we have been seeing, in the 40s. 49 at the coast. this afternoon warming up, relatively mild temperatures in the 50s and low 60s inland. so partly cloudy skies a mix of sun and clouds. high pressure is building. so that low has left us now that brought us al those rain showers the past few days. it's moved southeast so high pressure is the name of the

game. this is a flat ridge though so it's bringing us a few high clouds into our forecast, as well. that's why we're calling for partly cloudy skies by this afternoon. and valley fog just for the morning and then it should be burning off and then temperatures should improve and the skies should clear a bit but we are keeping some clouds in our forecast. pinpoint forecast your temperatures later on today check them out. 62 in mountain view and redwood city. 59 hayward. 58 pittsburg. 59 concord. 60 san ramon and danville. 60 petaluma. 59 mill valley. so for the next few days, looks like we're staying high and dry. no low pressure systems moving in anytime soon. so high pressure is the big story. we could see a little bit of valley fog in the night and morning that could be an issue over the next seven days. so check out the temperatures. friday and saturday, we're calling for mostly sunny skies and those temperatures are
