weekend coming up. that looks spectacular. >> you left for a week and now you have the voice of regis! >> it's that three hours of sleepy got. for the second time this week the san francisco sheriff is heading to court. anne makovec is in san francisco, where ross mirkarimi has a new lawyer. good morning. reporter: the new lawyer is lydia siglich from berkeley after he ditched robert was gone wagoner. today's hearing is all about asking the judge to lift a protective order that's forcing mirkarimi to stay away from his family. mirkarimi has only been san francisco sheriff since january 8. he is charged with three misdemeanor counts, domestic violence battery, child endangerment and dissuading an incident from an incident on new year's eve when he is accused of bruising their wife's arm in front of their 2- year-old son. he had to turn in his guns but despite public and political

pressure, he is planning to stay on as sheriff although he says won't collect any pay during trial days, which is set to start on february 24. >> he won't be thrown out as sheriff in the political process because it's too complicated. the mayor would have to have a trial of him before the board of supervisors. >> my son and me -- >> reporter: that list of witnesses for the trial came out yesterday including mirkarimi's wife eliana lopez. she so far denied the charges. mirkarimi's ex-girlfriend is also expected at the stand christina flores with a similar accusation of abuse and ivory madison the nine brought the dies police after she -- the neighbor who brought the case to police after she says eliana lopez came to her house asking her to photograph the alleged bruise. also a domestic violence expert and several investigators. today's hearing about the protective order starts at 2:30

p.m. >> thank you. testimony will continue today in a high-profile murder trial in san francisco. andrew bologna broke down in tears yesterday as he testified against the alleged gunman who shot and killed his father and two brothers. bologna said he saw edwin ramos open fire on their father's car as he drove home from a family outing in 2008. prosecutors suspected the ms-13 gang member mistook them for rival gang members. new this morning oakland police want help finding the gunman responsible for the city's first homicide. they have a million-dollar warrant out for this man, 36- year-old mcdaniel accused of killing 19-year-old isaac white of east oakland on january 4. police say member of the communities helped identify mcdaniel as the suspect and say he may have changed his hair since the murder. another budget proposal may save jobs and programs from budget cuts. protestors and union workers crashed the special oakland

city council meeting. protestors were so loud the council president larry reid had to call for a recess. city administrators will update the council tomorrow about a proposal to hold on to $7.5 billion. the current proposal consolidates departments, cuts some programs, and adding up to 81 layoffs. that's far fewer than expected. >> i think this is an opportunity for the council to hear the proposal, to ask questions and the plan is that next week on the 31st, the council will act. >> oakland will lose $28 million due to the end of the redevelopment funds from the state. hundreds of those agencies will close wednesday. two men are charged with beating uc-berkeley students. he was attacked outside a home in san diego last month. doctors didn't expect him to survive but he is now in rehab and improving. the suspects are charged with the attack on richmond and a

number of other people that same night. bart is hit with a wrongful death suit for a police killing last summer. bart police killed 45-year-old charles hill at the civic center station in san francisco july 3. they say he was shot after threatening officers with a knife and bottle. now the "contra costa times" reports hill's brother is suing the transit agency for unspecified damages. voters could decide the fate of california's high-speed rail project. the secretary of state approved an initiative for signature gathering to begin on a voter referendum. that would eliminate the $98 billion project to connect passengers from san francisco to los angeles. more than 800,000 signatures need to be submitted by june 21 just to qualify for the state ballot. the head of the state's public utilities commission has tapped himself to lead the legal investigation into the san bruno pipeline explosion. michael peavy has led the commission since 2003. federal and state reviews

faulted the commission's oversight in the past. pg&e could face millions of dollars in fines for violating safety rules tied to the 2010 last. later today -- blast. later today pg&e and commission representatives will discuss reforms made in response to explosions, today in palo alto. both groups will detail steps taken to improve safety since the disaster that left those 8 people dead and destroyed dozens of homes in san bruno. representatives are expected to take questions from the public. earthquake felt in monterey bay area last night. the biggest one was a magnitude 3.4. its epicenter was a few miles east of watsonville. hundreds of people reported feeling it around 6:20 last night. a minute later a magnitude 2.8 quake struck east morgan hill also felt around monterey bay. this just into the newsroom. word from iranian president mahmoud ahmadinejad is that he is ready for nuclear talks with

the world powers. iran is facing tougher sanctions in a move to get it to scale back its nuclear program. ahmadinejad said sanctions will not force iran to give in to western demands. a team is expected to visit iran this weekend. two buildings several stories high come crashing down in brazil. this happened last night in rio de janiero. one of the commercial buildings was 20 stories high, the other 10. two people are feared dead at this time. witnesses heard a loud explosion before the collapse which could have been caused by a natural gas leak. the mayor of the city says the buildings collapsed because of structural damages not an earthquake. the american rescued by an elite navy seal team from her captors in somalia will reunite with her family today. jessica buchanan and another aid worker were captured by somali pirates in october. seal team 6, the same special operations unit that killed osama bin laden, freed the

this shot slightly around but that's right there near the coliseum. the high street on- and off- ramps to northbound 880 will be closed for another 20 minutes for caltrans roadwork. that's traffic. for an update of the forecast, we have foggy conditions. >> 4:39. this day is flying by already! >> where does the time go? mostly cloudy skies out there right now. we have areas of patchy, dense fog. watch out for that this morning also some drizzle at the coastline. over the bay a live shot for you looking good right now, nice and calm. going to stay calm all day long a little afternoon breeze but not bad, 55 degrees in concord, 57 in oakland. and 55 degrees in san jose. so these temperatures all staying very mild because of that cloud cover. you can see most of the moisture from the system heading well to the north of the bay area. it will stay there for the most part. we are just going to see a lot of passing clouds moving across our skies so temperatures are likely to suffer a little bit. they will come down a few degrees but still running above the average for this time of year. plan on 63 degrees in san jose, 64 santa clara, numbers in the east bea up into the 60s and as

over 450 bailed out companies. california trying to clear the air with cleaner cars. the state's air resources board will vote on new rules to require automakers to build cars and trucks by 2025 that emit about three-quarters less smog-producing pollutants and also mandate that one of every seven new cars sold in the state be a zero emission or hybrid vehicle. they accidentally shot a cannonball in an east bay home. this morning a bizarre request from the show "mythbusters." >> :given time i'll solve it. >> a bay area teen named a finalist in a prominent science competition. his complex project that could end up paying for his education. >> and why one man might be the clumsiest robber ever coming up. >> high pressure overhead clouds filled our skies even some dense fog. what does that mean for the rest of the day? we'll talk about that coming up.

today to remember its late football coach, joe paterno. they're calling it "a memorial penn state university has another event to remember the late football coach joe paterno a memorial for joe. this is a live look from state college pennsylvania and arena on campus expected to be filled to the brim for those paying tribute to the late joe paterno. he was buried yesterday. he died of lung cancer on sunday. he was 85. he was penn state's head football coach for 46 years. you have to see this. some frightening moments caught on tape of a roof collapsing on an ice rink. it happened in slovakia. a youth hockey team ran to safely as the ceiling collapsed from snow weight. no one was hurt even though they were on the ice rink just moments before that. a robbery gone clumsy in brazil. security cameras captured a thief who accidentally, right there, shoots himself in the

foot. he has two guns. did you see that? he left the bank limping. he ends up getting arrested the same night when he asked for treatment at a nearby -- hello, there he goes. ouch [ laughter ] >> dumb. >> not a mensah candidate. there is a loose cannon in the cockpit that delayed the flight for hours. that's ripples. the 10-year-old short hayward tabby escaped from his crate yesterday morning after someone forgot to snap the latches shut. >> he went under the captain's feet. they didn't see him run in from first class. >> ground control was called in to remove some electrical panels in the cockpit and finally, mr. ripples was discovered. his owner says this was his first and last trip on a plane.

[ laughter ] they don't have the best track record, huh? all right. let's go out towards the golden gate bridge where as you can see it is very foggy out there especially across the span. it is like pea soup so visibility is definitely going

to be an issue this morning from marin to san francisco. so far not causing any incidents but take it slow. roadwork, dumbarton bridge looks like it is not wrapped up yet even though this question mark is there meaning that usually lanes reopened but we'll let you know what's going on. overnight they closed various lanes of west and eastbound 84 across the span. otherwise the san mateo bridge this is fine problem-free and delay-free. has been all morning long, looks good in all directions across the span. same thing coming out of the altamont pass. so far no delay to traffic at all on westbound 580 through livermore all the way through pleasanton and the dublin interchange. we have been checking in with mass transit as well and so far everything is on time for bart, ace, muni and caltrain and your ferries. remember kcbs once you do hit the roads. they're our radio partners. and you can find them at 740-am and 106.9-fm. that is traffic, for an update on your foggy forecast, here's lawrence. >> we had temperatures in 60s

and 70s in monterey bay, today probably not as night. overnight thick fog and drizzle at the coast. temperatures staying very mild right now. toward the afternoon we'll see sunshine in between some of those clouds but a little thicker outside today so temperatures cooler. 50s and mid-60s on the high-end and that's about it. high pressure beginning to flatten out somewhat. looks like most of that rain is going to stay north of the bay area. you may see a few drops making their way into northern sonoma county but that's it. the rain line staying to the north so we'll be dry here. that means we're look at a decent day around the state. 60s in the central valley. dense fog in sacramento and fresno early on but after that we should clear out in the middle of the morning. rain in far northern california the locally we'll keep those temperatures in the 60s by the afternoon with partly cloudy skies. couple of 50s toward the coastline, a lot of 60s showing up in much. east bay. then as you make your way inside the bay, those temperatures running up in the 50s and 60s, looking very good. the next few days we are going to see an offshore wind kicking
