angeles. i'll have that story coming up. what eliana lopez wants to testify in the sheriff's domestic violence case. showers falling in the bay area. more rain in the forecast. we'll tell you when coming up. and we have a high wind advisory in effect for the bay bridge, and chain requirements. we'll tell you where coming up. good morning, it's monday, february 13. i'm frank mallicoat. >> i'm grace lee. it's 4:30. it could be weeks before investigators determine what caused the death of pop singer whitney houston. elizabeth sanchez joins us with more. good morning. >> reporter: good morning. the music industry's top names came here last night for a celebration but the show turned into a tribute, remembering one of their own. the grammys paid tribute to whitney houston as investigators worked to figure

out exactly how she died. ♪ and i >> reporter: jennifer hudson sang one of houston's most well- known songs. ♪ i will always love you >> reporter: "i will always love you" and the night began with a star studied audience bowing their heads in prayer. >> truly blessed to have been touched by her beautiful spirit. >> reporter: houston died in the bathtub of her fourth floor hotel room at the beverly hilton on the eve of the grammys. nominees and fellow artists on the red carpet say she was an inspiration. >> you fantasize about being something like her someday. >> she was such a great voice, such a great soul. we lost her way too early. >> reporter: many of music's biggest stars say whitney houston's death casts a dark shadow over the awards here at the staples center. it could be weeks before investigators can answer questions with what caused her death. >> no visible signs of trauma. foul play not suspected at this time. >> reporter: houston's autopsy was completed sunday. but officials are waiting for

the 48-year-old's toxicology test results. the grammy award winner's career started to fade after reports of drug use. investigators haven't said if they found any illegal drugs inside houston's hotel room saturday. houston made her last known public appearance thursday in hollywood. some say the pop sensation was poised for a comeback. she just wrapped filming of a new musical drama due out this summer. the beverly hills police department has put a hold on the coroner's report meaning they don't want any more details released until the beverly hills police department completes their investigation. reporting live from los angeles, elizabeth sanchez, cbs 5 news. >> elizabeth what do we know about houston's 18-year-old daughter? she had to be taken to the hospital? >> right. she did have to be taken to the

hospital yesterday. she was treated and released, for stress and anxiety. her father bobby brown is skipping his tour and is back in los angeles arrived here last night to be by his daughter's side. >> elizabeth, i know it's early but how about a funeral or memorial plans, anything planned yet? >> reporter: right now we're not hearing about that yet. we're just, you know, obviously waiting for the toxicology reports but those could take six to eight weeks so obviously some sort of memorial funeral will be planned. we're not hearing it now. >> thank you. we'll have live reports throughout the morning from los angeles. you can always find the latest information on our website, cbssf.com. check on news. 4:33. she isn't talking to investigators but eliana lopez plans to testify at her husband's trial. sheriff ross mirkarimi is facing domestic violence charges. prosecutors say that he left a large bruise on his wife's arm during a fight on new year's

eve. lopez's attorney says she will testify only if the d.a. grants her immunity because she could be charged with child endangerment if the child saw it. an attack on nadia lockyer allegedly happened in a hotel this month. police haven't identified the victim but the state treasurer says it was his wife. lockyer was treated at a hospital and released. the ex-boyfriend was supposed to be arrested but police cannot find him. this morning investigators will continue digging for human remains on a farm east of stockton. they found in more remains yesterday near linden after finding remains in calaveras county foothills near san andreas, as well. the digging began after a bounty hunter paid a death row inmate $30,000 for information to help authorities find as many as 15 murder victims. wesley shermantine drew maps that led to the searches.

that is expected to continue for the next several days. >> they are going through on their hand and knees and combing through the dirt with their fingers and removing the large bones and shoes and other items that they find. it's gruesome, a horrible scene. it makes you want to cry. >> remains found last week in calaveras county were those of this woman, a 25-year-old who disappeared in 1988. did you feel it? a small earthquake rattled the earth bay. 4.3 quake hit 90 miles north of san francisco. there are no reports of damage or injuries. hundreds of people reported feeling the quake some as far away as here in san francisco. >> scary. 4:35. kind of rainy and cold. >> and windy, too. i spent the night in the east bay, came over the bridge early. >> had to put my ski coat on. >> the earthquake? i thought that was my wife

[ laughter ] >> hey, folks. around the bay area this morning, showers continue on and off just some scattered showers and some breezy conditions around the bay area right now. hi-def doppler picking up on that as you can see those showers into the south bay and also some continuing to the north and some of that moisture going to slowly drop into the bay area. see the core low up to the north, that's going to be sliding down into our skies throughout day today so we'll keep those showers in the forecast throughout the day today and then looks like things beginning to settle down into tomorrow. still the temperatures are going to be cool and breezy outside. today highs only in the low to upper 50s in the warmest parts of the bay area and colder than that over the mountaintops. next couple of days i think we dry out on tuesday. wednesday we have a few more clouds coming our way but thursday and friday look okay. but by next weekend clouds roll in, chance of showers returning to the bay area. elizabeth? >> all right. thank you, lawrence. and we're going to head outside show you what it looks like in some of our live traffic

cameras. you can see from our camera it's slick on the roads so lawrence mentioned be extra careful today for the start of the morning commute. there is a high wind advisory at the bay bridge so caltrans has the warning signs. you will see that approaching the metering lights. planning a trip out of town? grab your chains. there are chain requirements for the sierra on 80, 50 and 88. so watch out for that. in the meantime you can see how breezy it is out there because our san mateo bridge camera is jostling around. no official wind advisory issued by the chp for the san mateo bridge but this is going to be a two hands on the steering while kind of day. coming up, a check on mass transit. back to you. >> thank you. burglars brutally beat two dogs and then stole their nursing puppies. but it gets even worse. the suspect then called the dog's owners to sell the puppies back to her. the home on cameron way in san francisco's bayview district was robbed last week.

a laptop, tv and these doberman and beagle puppies were taken. call the bayview police station with information. and san jose police are trying to find the suspects who attacked a man and killed his dog. this happened near winchester boulevard and colonial way on saturday afternoon. the "mercury news" reports that a 32-year-old man was jumped by three men who asked if he was in a gang. the dog was killed during the attack. an officer-involved shooting in vallejo under investigation now. the solano county sheriff's office says a man got shot after he tried to steal the deputy's gun. authorities tried to serve a warrant at the time. at some point a round went off hitting the man in the upper body. he drove away, later was caught. the extent of his injuries is unknown. the united nations today is expected to discuss the growing violence in syria. the u.n. says more than 5400 people have been killed during the 11 month uprising.

today an activist group says rebels have defended themselves against government tanks in a city held by the rebels since late january. and clean-up under way in greece after a night of rioting at central athens. more than 120 people were injured. 45 buildings were burned. it began as a protest against harsh economic measures just approved by lawmakers there. the bailout creditors have said those measures are not necessary to save the nation from bankruptcy. coming up, nowhere to go at a bay area high school. the reason behind dozens of locked bathrooms. 21, adele. >> and boy, was it a big grammy night for adele. sweeping the top three categories, what the singer says she will never do again. a federal appeals panel will hear arguments today on

some high school students in concord are demanding more restrooms. it's happening at mount diablo high school. some students are putting signs that say, quote, why is the bathroom locked? on doors of restrooms closed since last year. the principal won't say why she closed most restrooms on campus but the "contra costa times" reports that it may be because of graffiti. today a federal court revisits a california issue that's been decided more than a decade ago. lisa washington joins with us more on prop 209. >> reporter: good morning. california voters approved the ban on california admissions in regards to affirmative action 16 years ago. now, a group the coalition to defend affirmative action

challenged that ban and today, a federal appeals panel will hear the arguments in this case. 46 minority students joined the coalition in 2010. they say the measure has caused a sharp drop in the number of black, hispanic and native american students who are admitted to uc campuses. last year a district judge in san francisco dismissed the coalition's lawsuit. their challenge today is the coalition's appeal to that decision. a three-judge panel will hear the argument today. it's expected to take the court under advisement and issue the ruling later. the coalition is only challenging the part of the measure that bars affirmative action for minority students who want to attend uc schools. it's important also to note that this measure is going to be defended by ward connolly who many people know as a former uc regent and the chief sponsor of prop 209. frank, those oral arguments are scheduled to begin at 9:00 this

morning. but before that, here very federal courthouse there's expected to be a lot of activity with several students from uc schools coming here. there's also going to be some activity prior to the arguments at the uc-berkeley campus. >> okay. lisa washington live for us in san jose, thank you. and more san joseians appearing to giving serious thoughts to a sales tax increase. a new poll commissioned by the city shows that 65% of san jose voters would support a quarter cent sales tax measure, 5% higher than a year ago. but when it comes to preferred ways to reduce the budget deficit, 48% answered cuts in workers' combination 28% said their top choice to was raising taxes. and only 13% preferred more cuts in services. the city council will discuss the poll at a budget session today. 4:44. a ballot over same-sex marriage -- a ballot over same-sex marriage is heating up in new jersey. the states democratically controlled legislature is expected to vote on a bill to legalize gay marriage this

week. lawmakers believe they have enough votes to pass that bill. and the state's governor has vowed that he will veto the measure if it reaches his desk. this year marks a quarter century for san francisco's aids quilt in honor of those who died of aids. 10,000 names are stitched on the quilt. each person lost to the disease that started taking its toll in 1980. >> it was devastating. it felt for those of us who were living it at the time it was like an avalanche. you know? we had never heard of this thing and all of a sudden everyone was dying. by november of 1985, we had lost 1,000 people in this immediate neighborhood. >> 35 sections of the quilt will be displayed at a former tower records space in san francisco. 4:45. a cold snap so bad hundreds of people are dying. >> russia's warning during its worst cold spell in decades. plus the president sitting out his 2013 budget today.

a pennsylvania judge could rule today whether former penn state assist football coach jerry sandusky will have to stay indoors during house arrest. he is accused of molesting 10 boys.

he wants his bail conditions eased so he can see his grand children and have friends over. neighbors say that sandusky has been watching children from his back porch. cutting spending and taxes on the wealthy, how president obama plans to reduce the deficit. he is sending the 2013 budget plan to congress today. the proposal will cut the deficit by $4 trillion over the next decade. he wants to boost spending on transportation and education. republicans plan to fight over obama's tax hikes. it has been a month since that cruise ship disaster off the coast of italy and this morning the first major salvage operation has begun. crews are working around the clock to pump 2300 tons of fuel from the wrecked ship. bad weather delayed the operation for some time. care is being taken to make

sure none of the fuel spills in the water. 17 people died when the ship hit rocks and tipped over. 15 people are missing and presumed dead. a subaru driver in australia got caught in a flooding creek. she got out and grabbed a tree but was there for two hours until rescuers were able to get her to safety. 4:50. hundreds of people in europe are dead victims of the worst february cold spell there in decades. it's so cold, some of the waterfalls as you can see completely frozen. this is in russia where souvenir sellers near the falls are struggling to stay warm. temperatures could go to 17 below zero this week. and i'm complaining about a little drizzle and what not here. >> i know. >> crazy. >> i had my seat warmers on.

[ laughter ] >> weatherman... >> it's going to be cooler than normal around the bay area at a. we have the showers out there now, folks, if you are headed out the door. scattered showers showing up now, hit and miss as the main cold front moved through but you can see showers coming down from the north and spreading to the north bay. that's where we're going to see the core of the low sweeping southward today. chance of showers today, cool, breezy around the bay area. looks like a cool afternoon with a chance of a few more showers, as well. and then looks like drier weather returns tuesday. cold front moving through and now the core of the low dropping down the coastline. and may just spin a few more showers into the bay area so be prepared for rainfall heading out today. then breezy, as well. high pressure coming in, next system bringing clouds wednesday. scattered showers today and then looks like things continuing into the afternoon hours today but then settling down overnight tonight and into tomorrow. looks like we'll start to dry

out nice lie. temperatures cool around the bay area. bundle up. 50s at the coast, mid-50s livermore and 57 in santa rosa. next couple of days we are going to dry out on tuesday and by wednesday, partly cloudy skies next system drops on through thursday and friday look okay and maybe more showers toward next weekend. that's a look at weather. here's elizabeth with traffic. >> thanks, lawrence. wet and windy so here's what it looks like across the nimitz. you will see the camera moving back and forth quite a bit so chp has one wind advisory out there now, it is for the bay bridge. so be extra careful. a lot of wind. it's a two hands on the steering wheel kind of morning. still slick in spots in the bay area. drive time 14 minutes from hayward towards the other side of the span, towards the peninsula. otherwise traffic off the high- rise moving fine. once again at the bay bridge, this is where you will notice

that caltrain has their warning sign up letting you know of a high wind advisory across the span. drive time looks okay 18 minutes from the carquinez bridge to the maze. but it is a little windy and you'll really notice it on the san francisco side. roadwork. eastbound highway 4 they have the left lane closed according to caltrans until about 1:00 this afternoon right there approaching bailey road so you can see some slowing on our sensors just behind it. you can get through. it's not a full freeway closure. crews will be working until early afternoon. elsewhere the altamont pass drive this is not too bad. still in the green. it looks great actually all the way on westbound 580 all the way towards the dublin interchange. and, of course, grab your chains if you are heading up towards the sierra on interstate 80, highway 50 and highway 88. you will need them wherever you go this morning and mass transit continues to run on time. >> that's good. because she's with the man of her dreams. >> she was on "60 minutes" last night talking about that song and said, you know, i don't even like the guy that i wrote it about but i'm so glad we broke out because it worked out perfectly. other winners last night at the grammys shown here on cbs 5, foo fighters wasting light won for rock album. year and chris brown won r&b album for 2011 for fame and lady antebellum one of my favorites won the top country award last night, as well. so fearless fashion or faux pas? some of the music industry's best and worst on display at the grammys red carpet. i don't know who was little red riding hood. >> nicki minaj. everyone's talking about it. it's a little red riding hood meets nun habit. it was big. the date for the evening took dressing in the sunday best to a whole new level dressed as the pope inspired ensemble and then that was --
