their eyes on. lots of sunshine yesterday, what a day it's going to be today. we'll have more on your weather coming up. >> no accidents but roadwork may slow you down. i'll tell you where. good morning. it's wednesday, february 2. i'm elizabeth wenger, frank is off. >> i'm grace lee. breaking news out of san francisco that's happening right now. we have a transformer that blew out on duboce street and set a power pole on fire. >> no word on injuries or damages in the area, but we have a crew heading to the scene right now. in the east bay, gil diaz is on the scene of a residential fire in gilroy. >> reporter: on page street between fourth and fifth streets, as you can see behind me, firefighters are still at the scene here. the fire is out. they are just mopping up after

it. the property is one of those work space-living spaces for artists. the fire broke out around 3:00. the area is called gate 13 gallery. one of the residents says he was woken up in the middle of the night by someone ringing the bell. when he got up and he looked out the window, there were flames shooting on the east side of the property. it turns out the fire was burning through a large studio that contained some of the art projects and works in progress. the owner that i talked to briefly says he may have lost about 30 paintings in that fire and this morning, four people are displaced. we're not sure if american red cross is coming to help them out. but none of them was hurt. but we're told that one of the firefighters or maybe a couple of the firefighters suffered minor injuries when one of the residents dogs bit them. this is a live look. it's that red structure right

[ closing bell ] >> the dow crossed the 13,000 mark yesterday for the first

time since 2008. but it ended up closing at 12,965. now investors are setting their sites on 14,164, the all-time high setback in october of 2007. but with gas prices soaring, most traders believe that landmark is a ways off. there is a hearing today on solyndra's request to give bonuses to some of the workers who are still on staff there. the bankrupt fremont company says it needs to pay bonuses to keep the employees from leaving. solyndra had wanted to spend $500,000 on bonuses but the washington times reports the company has scaled that back to about 360,000. fired employees are opposing the bonus plan. the sheriff of san francisco is due in court today for a pretrial conference in the domestic violence case against him. ross mirkarimi is accused of mistreating his wife in the presence of their toddler son. in an incident that left her arm bruised. he has pleaded not guilty to all charges in the case. that trial is at the time to

begin on friday. the suspect in saturday's murder in berkeley is scheduled to be arraigned today. 60-year-old peter sue core was beaten to death outside his home. the murder weapon was a large ceramic pot. a berkeley city council member wants an investigation into the police response to that case. berkeley police say they got a nonemergency call about a suspicious person about 8457 saturday night. they did not respond at that time as officers were busy with a protest march. then about 9:02, the man's wife called 911 about the assault and that got police rolling. and the first officer arrived within five minutes. other officers were there soon after that. and by 9:22, the suspect was in custody. a woman accused of driving the getaway for her 15-year-old son who is suspected of stabbing another teen. margaret suazo was arrested on suspicion of attempted murder and her son taken into custody as a juvenile.

last thursday, she allegedly drove her son to glen furth drive on the city's east drive to look for a 13-year-old boy. they spotted him and they exchanged gang-related words. the son then got out of the car, tackled the 13-year-old and stabbed him. >> she knew what was going on. she was partly responsible. she might not have had the knife in her hand. she put him in close proximity where he could stab somebody. >> the victim's wounds are not life-threatening. police are be looking into the possibility of a second juvenile suspect. a small earthquake shook the north bay this morning. the epicenter it was between santa rosa and healdsburg in sonoma county. that quake hit at 2:35 this morning with a magnitude 2.7. it was felt nearby but there have been no reports of any damage or injuries. okay. we're going to go to lawrence now with a check on our weather. we're hoping for a pretty day

today. >> turned out nice. >> today is going to be better. we'll see a lot of sunshine around the bay area, temperatures going to be warming up very nicely, fairly mild outside right now. numbers mainly in the 50s and 40s at this hour, still reports of patchy, dense fog in the napa area and at the coastline, too, maybe a lull fog but not for long. it is going to be gone under the strong ridge of high pressure and those offshore winds cranking up around the bay area. that means we're in for a fantastic day ahead. these temperatures will be something else by the afternoon. 75 degrees in livermore. about 75 in concord. 74 in san jose. almost 70 in san francisco. and about 75 degrees in santa rosa. looks like we'll repeat this one more time as we head in toward tomorrow and then begin to cool things off a little bit into friday. much cooler temperatures expected toward the weekend. let's check the roads now with gianna. >> reporter: thank you. we're going to jump over to 880. we have some roadwork this morning on the southbound side of 880 but i just checked in with caltrans and the good news is they just wrapped things up a few minutes early.

they were hoping to have things cleared on southbound 880 right at alameda. but again, everything is now wrapped up, lots of green in the area. also, roadwork still in effect northbound 101 at coyote creek golf drive. the right lane closed until 5 a.m. antioch bridge alternating lanes there so sluggish. roadwork on the eastbound side, the question mark popped up, that indicates caltrans has wrapped that up so both directions of 4 problem-free. we'll check the golden gate bridge next. right now, back to you guys. >> thank you. dna results are now in for the first two sets of remains found in the search for victims of the "speed freak" killers. those tests confirmed the remains belong to two people killed by wesley shermantine. chevy wheeler and cyndi vanderheiden. meanwhile, bounty hunter leonard padilla and his investigators say they have received information about another pair of wells in linden that wesley shermantine says contain even more murder victims. >> this is just the tip of the iceburg and you need to check

both of these wells. >> shermantine alleges there are at least a dozen bodies in one of those wells. he says there's one body in a third well near a tv tower. 4:38. the reward is more than $22,000 to find the vandals though trashed a richmond school. congressman george miller toured nystrom elementary school yesterday. it's being cleaned up after it suffered a million dollars in damage earlier this month. the building was just about ready to open to students. now that's not going to happen for several more weeks. >> this is a tragedy and it's a crime against the children in this community and it's a crime against our community. >> this is what the building looked like just a couple of weeks ago right after the vandals trashed the place. it was the second time in recent weeks that the school had been targeted. the fresno county sheriff's department is offering a $100,000 reward in hopes of finding the arsonist behind a fire at harris ranch. the state's biggest beef processor lost an estimated $2 million of equipment in last month's fire that destroyed 14

big rig tractors and several trailers. animal rights activists claim responsibility for the fire through an anonymous email. but investigators say they have not yet identified any suspects. it looks like pacific gas & electric will pay a $3 million settlement concerning the san bruno pipeline explosion in 2010. the utility and state regulators had agreed last year on the settlement for pg&e's failure to produce pipeline safety records. they couldn't find them. the fine had been challenged. but now the "chronicle" reports it has been revived. the san francisco d.a. satisfies the bart police officer acted in self defense after killing a man. show the and killed a homeless -- he shot and killed a homeless man who threw a knife at him last july. the d.a. says the officer acted lawfully. the death of charles hill set off a number of demonstrations against bart police. we have the battle over prop 8. why it could take even

same court that just struck it down. welcome back. it is 4:42. backers of california's same- sex marriage ban are taking the case back to the same court that just struck it down. in a split decision earlier this month, a three-judge panel from the federal appeals court ruled prop 8 unconstitutionally singled out a minority group for unequal treatment. they are now asking the entire ninth circuit court to review the ruling. it means same-sex marriages will be on hold until the court decides whether it will revitt of the case. the four republican con tepidders will gather tonight

for a cnn presidential debate. as susan mcginnis reports, the focus of this one will likely be different with polls showing rick santorum as the new front- runner. reporter: rick santorum predicted his next big win campaigning in phoenix, arizona with his family. >> we're here to win arizona. >> reporter: santorum trails mitt romney in the polls there but has surged ahead nationally. along with his new front-runner status comes more scrutiny. this week several online publications released audio of santorum talking about a spiritual war where satan attacks the united states. >> and the father of lies has his sights on what you would think the father of lies, satan, would have his sights on, a good, decent, powerful, influential country, the united states of america. >> reporter: santorum made that speech at ave maria university in florida in 2008. tuesday he responded saying, if they want to dig up old speeches of me talking to religious groups, they can go ahead and do so. but i'm going to stay on

message. santorum goes on to say, i'm going to talk about things that americans want to talk about, which is creating jobs and making our country more secure. santorum will likely have to respond to those remarks and recent comments he made about president obama's energy policy tonight. that's when all four candidates debate in arizona. it's the last time they will meet before the next round of primaries. mitt romney is in a battle for his home state of michigan. the latest poll shows him five points behind santorum but romney says he is not deterred. newt gingrich says he won't compete in michigan so he can focus on the 10 states up for grabs on super tuesday next month. susan mcginnis, cbs news, washington. the obama administration plan to cut corporate taxes will be unveiled by the treasury secretary today. the rate is currently 35%. under the new plan it would be cut to 28 and 25% for

welcome back. turning now to some breaking news in san francisco, fire crews are working on a transformer fire. anne makovec is on scene in san francisco with the very latest. anne. >> reporter: right now, they are dead in the water. i'm here on duboce and valencia. there is that small fire on top of that power pole behind me

right now. they have duboce shut down and the firefighters are waiting for pg&e to turn off all the power in this area before they are able to fight that fire. and over here, you can see pg&e hard at work there on that line to shut off all of the power in the area. some is off now. more of it will go out before firefighters are able to move in and put that fire out. they do say though that there is no risk to any of the structures around the area. it's going to be contained to that pole. that's where the damage has been done. >> thank you, anne makovec. foreclosure auctions happen every day on courthouse steps but rarely do they end up in a melee. 50 demonstrators showed up to the alameda county courthouse to protest the auction yesterday. county leaders tried to move the auction inside. that's when they say the protestors rushed a metal detector. >> at some point during that protest, somebody threw something at one of the deputies and when that deputy

went to go arrest that person, others interfered with that arrest and then they too were arrested. >> they took a boy with dredlocks and grabbed him by his hair, swung him around on the sidewalk, hit him in the face with a club so his lip is bleeding all down his face. >> deputies arrested at least five people. 4:50. we have a girl scout cookie delivery that turned into a rescue mission. a mother and her kids got stuck in a sinkhole while driving inlafayette yesterday. the hole was 2 feet deep. everyone is fine. the break that caused the sinkhole has been capped. a bridge was demolished in dramatic fashion in ohio. they were supposed to set up the bridge crashing it into the river in the matter of seconds. the demolition happened without any problems. the 83-year-old bridge was closed down two years ago ago because of bad conditions. you hear people cheering in the

background. >> amazing video. that's why we like to show it again and again! lawrence, what's going on weather-wise? >> we have lots of sunshine coming our way the next couple of days, the nicees days of the week. patchy fog out there this morning and high clouds but temperatures relatively mild in the 40s and the 50s right now. by the afternoon it's going to be one of those gorgeous days all the way to the coastline. some mid-60s even at the beaches. 70s inside the bay, mid-70s in some of the valleys. and these temperatures well above the average for this time of the year. strong winds of high pressure overhead, offshore winds are blowing meaning we are seeing great conditions into the afternoon. skies will clear out nicely for today. the heat will be cranked up toward the afternoon. numbers a good 8 to 13 degrees above average for this time of the year. check out the numbers into the san jose area. you are look at 74 this afternoon, 76 in morgan hill, 71 in redwood city and 66 in half moon bay. east bay temperatures popping up into the mid-70s in most

spots there. 76 in pleasant hill. 75 in walnut creek and 73 in vallejo. down slope winds cranking the temperatures up into the mid- 70s and mid-60s at the beaches. beautiful day today another gorgeous one for tomorrow. looks like that weather will start to cool off a little bit into friday with the return of some low clouds and fog out at the coast. much cooler over the weekend with a few more clouds. temperatures staying down through monday and tuesday, as well. all right. let's check the roads with gianna. >> reporter: good morning, let's start off with a look at the south bay. we have our photographer edgar standing by at 101 and mckee and you can see there's a few cars on the road but overall no major delays. most of the south bay, san jose, all checking in problem- free. in fact, we'll get a look at conditions on 280 as we jump over the map. lots of green no delays. live look at 280 things cruising along northbound through downtown san jose. wells where if you are headed north 101 at coyote creek golf drive we have roadwork in effect. the right lane is closed at

least until about 5:00 this morning. so just about 10 more minutes until they wrap up this construction closure but still some green on our sensors so not too many problems this morning. marin county, you can see 101 southbound no delays to report. you're clear as you work your way out of marin county into san francisco. once you get to the golden gate bridge, no problems. lane changes just a few minutes ago and traffic is free- flowing. 14 minutes to go southbound 101 from 580 to the golden gate bridge toll plaza. elsewhere 101 peninsula commute nice and easy this morning. northbound no delays. if you are headed to sfo, everything looks good. southbound 101 clear into the south bay. also, 280 both directions checking in problem-free. nothing really to report as you head northbound through daly city and southbound if you are work your way off the san bruno. we did have some early-morning roadwork on 880 on that southbound side right around broadway. now, caltrans wrapped that up early this morning. so things along 880 look good. you can see northbound just a few cars working their way towards the maze. no delays southbound towards the hayward area. remember kcbs once you do hit

the roads. they're our radio partners. and you can find them at 740-am and 106.9-fm. that's a look at traffic. back to you. >> thank you. well, a man born with half a left arm has filed a discrimination lawsuit against starbucks. that's after a san diego cafe rejected his application to be a barista. the manager told the job applicant that the coffee syrups were placed too high for him to reach the the man used to be a bartender and he said he didn't get a chance to explain his capabilities. starbucks says his application was considered and disputes his version of that interview. the san jose earthquakes could get a step closer to building their own soccer stadium near mineta international airport. the planning commission is expected to take a final vote on whether to approve the investment plan. the commission has to determine if the plan addresses noise, traffic and other concerns of nearby residents. team owner lew wolff hopes the stadium can open in time for the 2013 mls season. if there is one thing that
