>> a bay area church vandalized. religious symbols defaced. it's a hate crime. how about that sunshine yesterday. gorgeous weather around the bay area. will it continue today? we'll talk about that coming up. we just saw them do a lane change across the golden gate bridge. plus we have roadwork overnight on the upper and lower decks of the bay bridge. full look at your morning commute in minutes. good morning. it is thursday, it's february 23rd. good to have you with us. i'm frank mallicoat. >> and i'm grace lee. it is 4:30. we are going to start with breaking news out of santa clara county. a two-alarm fire at a sunnyvale home overnight. firefighters are cleaning up at the home. it took them two hours to contain the flames. the fire started around 1:00 this morning. a lot of heavy smoke filling the neighborhood. neither a dozen people were on the scene watching the firefight. the cause of the fire is under investigation. we'll have a report coming up later in our broadcast about that, as well. also new this morning a

shooting near san francisco's fisherman's wharf put a man in the hospital. police have two men in custody and there may be a third suspect who got away. investigators say that some people were arguing in the 300 block of jefferson street last night when one of them pulled a gun and shot another. that victim is in stable condition. and a hate crime investigation is under way in the east bay after a church was vandalized there. people going to saint ann's catholic church on ash wednesday found satanic symbols and messages spray-painted on the building. one message is six feet high written in latin and it says "seize the night." a statue was also damaged and a monument knocked over. the church doesn't want to clean up the mess yet. >> father wants to leave it up because he wants the community to see what has happened to our church and also to be a reminder of how much hatred and racism that we have here in our community and throughout the

world. >> police are investigating if the vandals targeted the church specifically because it was ash wednesday. families in oakley being warned about norovirus outbreak at the laurel elementary school there. the school is being thoroughly cleaned and students are urged to wash their hands to prevent any spread of the infection. anyone showing signs of the virus asked to stay home for at least a couple of days after the symptoms go away. thousands of student applications are on hold at san jose state university. the cal state system struggles with severe budget cuts. tomorrow cal state leaders will figure out if the campus will have to turn away some 1400 south bay applicants. this may be the first time that sjsu will not be allowed to give preference to santa clara county residents. cal state system may face another $200 million in cut if voters reject the tax proposal this year. there is a series of

recent robberies at the carquinez bridge toll plaza. a driver got out of his vehicle at the plaza and demanded money from an attendant. that attendant gave him cash. there is no description of the car but chp is asking drivers to report any suspicious activity. it is 4:33. a little under the weather yesterday but if you were going to take a day off -- >> sure you wereunderr the weather. greg andersonwhat are you doing back today! high pressure still in control, offshore winds blowing, gusty winds especially over the north and east bay hills. outside now quiet over the waters. it's going to be spectacular as far as temperatures are concerned. 40s and 50s right now so mild to begin the day. there is a wind advisory in the north and east bay hills extending into the central valley. could see some winds sustained at 20 to 30 miles per hour.

that's usually up about 1,000 feet and above. could see some gusts to 50 but down below look at the temperatures. 74 degrees san jose. 76 in santa rosa and 70 degrees in san francisco. elizabeth, why did you come to work? >> i have no idea. but i may not tomorrow. but tomorrow's supposed to be cooler, right? i missed out. thanks, lawrence. outside live towards the bay bridge, the only thing going on is roadwork to slow you down but no major hotspots out there and it is of course pretty early this morning and everything looks great heading towards the pay gates at the bay bridge. past the metering lights you will notice they are doing roadwork in the area so they have it down to two lanes and then they extend it to three lanes on the upper deck heading into san francisco. lower deck work on the decline. all the approaches to the bay bridge with fine. because of the question mark you see there, they just picked up roadwork on north- and southbound 680 through the san ramon valley. coming up a check of mass transit. back to you. >> thank you. we'll get back to our breaking news off the top of

the hour in santa clara countiful a two-alarm fire charring a sunnyvale home overnight. >> gil diaz is on scene where fire crews are still cleaning uple damage. >> reporter: good morning. this is a 700 block of dunker dean and this house behind me was burning around 1:00 and by the time for a rescue got here they got it out within an hour. to tell us more about what happened is the battalion chief. good morning. thank you for joining us. >> good morning. >> reporter: when you got here, what was the house like by the time the first responders arrived? >> the house was fully engulfed in flames. >> it's a single-family home. no one was home at the time? >> we were unable to find the residents at the home so we at this time are unsure where they are. >> reporter: despite the fact that i see a couple of cars in their driveway, there's still no one home. is that suspicious to you? >> i don't know if it would be

suspicious. obviously, we had some concerns early on in the fire that maybe the residents were home and that there might be a rescue involved but at this point in time we haven't found any indication that they were in fact in the residence at the time. >> reporter: you guys put it out within an hour when you arrived around 2:00. but you're still here. what are some of the challenges and some of the things that you have to do still? >> well, one of the initial challenges was that in the backyard there was an electrical wire down that was arcing presenting significant challenges for us in working around live wires. we had to cordon off that area and not allow any firefighters to work there. >> reporter: mite the live wire have been a cause of the fire -- might the live wire have been a cause of the fire? >> at this time i can't speculate on the cause of the fire. i can tell you because the fire was burning in that area, that may have been a cause of the wires being down. at this point it's too early to provide any speculation.

>> reporter: thank you, battalion chief plecque. they are trying to locate the homeowners of the property. we'll get more details as the morning progresses. in the meantime, two americans have been shot to death in apparent anger over the burning of the copies of the koran at a u.s. military base. an afghan official says it was an afghan soldier who turned his gun on the allies. four other troops were wounded. violent anti-u.s. demonstrations have erupted across the country after coalition soldiers burned the books on monday night. it is 4:37 now. a sickening case of animal cruelty in the san joaquin valley. tens of thousands of chickens were found starving to death at a ranch near turlock in stanislaus county. chopper 5 overhead as county and state crews loaded thousands of dead hens into a dumpster. the birds had starved to death. others are in such poor condition they were euthanized.

stanislaus county animal control received an anonymous call about the farm on tuesday. >> there were 50,000 estimated birds that are gone without any kind of food or water. >> how long does it appear that they have been unfed? >> it appears based upon estimations from the vet approximately two weeks. >> there are five large buildings on the farm operated by a & l poultry. the owner has declined to comment on the case but he could be facing animal cruelty charges. a man wounded in a confrontation with oakland police is actually a relative of oscar grant. that's according to an attorney for 24-year-old tony jones. he was shot after he ran from a van that police had stopped earlier this week. an attorney for grant's family confirmed that the two are related but they don't actually know each other. there are ongoing investigations into the jones shooting and you might remember, grant was fatally shot by a bart police officer in 2009. some key evidence could be thrown out against san francisco' new sheriff.

ross mirkarimi goes on trial tomorrow for domestic violence charges. his lawyer has filed a motion claiming the sheriff's wife was not that upset when she talked with her neighbor. the motion says the sheriff's wife didn't become agitated until she started talking about her marriage. the lawyer wants it tossed out as hearsay. a bankruptcy court will decide whether an injured giants fan can suit los angeles dodgers. bryan stow sued the dodgers after he was beaten in the dodger stadium last march but the case was on hold because the team filed for bankruptcy. "the examiner" reports so's bankruptcy. the san jose earthquakes have final approval for a brand- new soccer stadium. quake fans at city hall last night after the planning commission gave the green light for the long-awaited project. a lot of people on hand.

violence today in police and security forces are the apparent targets of violence today in iraq. at least 50 people have been killed in baghdad and 10 other cities. the attacks happened over a 2.5- hour span. security patrols, government offices, restaurants and a school have all been hit. al qaeda militants are believed to be responsible for the attacks. also, deadly violence is intensifying in syria. activists say syrian forces have resumed shelling opposition forces in homs. 70 people were killed yesterday. the united states will take part in an international conference to find ways to stop the violence. officials could be investigated for crimes against humanity. several members of congress have received threatening letters and investigators say more are on the way. the letters were addressed to the lawmakers' district offices including speaker of the house john boehner's. investigators say that the letters contained a powdery

substance but it was actually harmless. but one sent to jon stewart and stephen colbert. they say every letter may contain poison to all congressmen. presidential candidates in their final scheduled debate. the foursome gathered in mesa, arizona, yesterday, criticizing each other on various issues. the main target was rick santorum who is leading in the national polls. >> this idea of being fiscally conservative now that we're running for office and we're going to repeal something that we did before... i mean, it lose correct. >> while i was fighting to save the olympics were you fighting to save the bridge to nowhere. >> newt gingrich focused on the president calling the auto industry bailout a violation of bankruptcy law. arizona and michigan primaries

are just five days away. the obama administration is calling for stronger privacy protections for consumers now that mobile? >> ga and internet services can easily keep track of where you go and what you have done. the white house plans to issue a report today. the proposed consumer privacy bill of rights calls for tech companies, consumer groups and others to work together on new protections. apple, google and amazon are among six tech giants who cut a deal with california to protect your mobile privacy. now app users will see something they have never seen before, the company's privacy policy before they download. what this agreement will do is require those who collect personal information to let people know what they're doing with that information. >> attorney general kamala harris says that the privacy policy for apps is needed and she says most of the top apps don't even have them. and the new policy will protect consumers. app makers are now on notice

owner back at 4:48 now. this morning three burglary suspects are behind bars after a huge manhunt in fremont. investigators say a homeowner came across the suspect in his home yesterday. he said one of the suspects had a gun and after a scuffle, the burglars finally fled. police locked down three nearby schools and canvassed the area but they say it was neighbors who helped catch the suspects. >> we had three or four calls from people along the path of the suspects who said, you know, somebody just ran through my yard or they're out in the street. >> a helicopter helped in the chase, as well. police caught all three suspects in three different locations. the city of oakland is expected to give a final tally today on a last round of job cuts. at least 80 job cuts were supposed to take effect yesterday. oakland managed to save some by shuffling workers into empty positions. some had to take paycuts. last week city leaders estimated up to 40 people would be losing their jobs. oakland used redevelopment funds to cover the workers. it cost $35 million when the

state closed the agencies. a big name missing from sunday night's academy awards. kodak. the kodak theater has been the home of the oscars since it signed a $74 million deal for naming rights in 2000. so yesterday, it all came to an end. kodak got court approval to end its sponsorship deal with the theater as it goes through bankruptcy. during the oscars telecast it will be called the hotel and highland center theater for its location. the court ruling isn't stopping workers from rolling out the red carpet. it's being covered in plastic until sunday so it doesn't get ruined. have to keep it perfect for the stars. plenty of oscar work has been done in the last few days. crews have set up bleachers and press stands for the event. it will be a zoo. kodak won't the only thing missing. actor sacha baron cohen is forebed infrom being on the red carpet. his ticket was removed.

organizers thought he would show up in full costume as the character for his upcoming movie the dictator. the unusual movie comes after rumors circumstance laid that cohen would violate the decorum of the awards show with that publicity stunt. >> i can see him doing it. >> he is a wild man. if you have seen him in "hugo," there he is. borat. goodness, lawrence, i can see you liking some of these movies. >> a lot of people dress up in costume for these things, right? >> what about the grammys is it. >> just like me. [ laughter ] if you are heading outside today we have sunshine and temperatures going to be heating up again around the bay area. very similar to yesterday. mostly clear skies out there now, temperatures in the 40s and 50s. by the afternoon, again these numbers running well above average. mid-60s out at the coastline, 70s inside the bay, mid-70s as you make your way inland, windy over the hilltops. high pressure remains in control. this is probably the last real strong day of the ridge. it will start to weaken as early as tomorrow. breezy conditions especially in the north and east bay hills. we have a wind advisory up in

the areas. but staying warm for now and then we begin to cool things down. more of a sea breeze kicking in as early as tomorrow. if you plan to travel around the state, 60s and 70s in the central valley but watch out for winds. those are expected to gust up to 45 to 50 miles per hour continuing through the central valley. around the bay, looking good. those temperatures running up into the mid-70s into san jose. 75 in santa clara. about 67 degrees in pacifica. east bay temperatures up into the 70s, as well. just going to be a gorgeous afternoon. and as you find your way inside the bay, 74 oakland, 70 san francisco, 76 santa rosa. next couple of days temperatures will start to come down. sea breeze kicking in a little more fog at the coast for tomorrow but cooler temperatures for everyone. cool and breezy throughout the weekend. those temperatures staying down right through the middle of next week. all right. elizabeth, how are the roads? >> the roads are great. no major issues out there right now. in fact, here's a live look as you cross the san mateo bridge. the right side of your screen, that is westbound 92.

you can see from the green drive time there, 13 minutes out of hayward towards the high- rise in foster city so yeah, not too much incidents on the roads right now. in fact, all your bridges pretty much moving up to speed this morning including this live look across the carquinez bridge. so so far, so good all the way down westbound 80. should be about an 18-minute drive time or so from the carquinez bridge to the maze. coming down the eastshore freeway. now, if you are heading towards the bay bridge toll plaza, there is roadwork kind of a lot of it. they have squeezed cars together towards about two lanes just past the metering lights and then three lanes are open on the rest of the upper deck heading into san francisco. there was some eastbound 80 roadwork as well heading towards oakland. again all that's scheduled to wrap up between now and 6:00. elsewhere, highway 4 not too bad. so far all in the green. everything looks great across that stretch from antioch towards the pittsburg-bay point area. towards the south bay, coming out of downtown san jose, here's a leave look just a couple of headlights like we usually see at this time of the morning so not much going on

there. there is some roadwork, though, on northbound 101 as you approach coyote creek drive. they have actually got two lanes blocked off because of some construction in that area. so caltrans crews are hard at work. they should be wrapping up that pretty shortly. otherwise, your drive times for the east bay as you can see, all in the green. i'm not really finding much slowing anywhere. so coming out of the altamont pass, usually one of our first spots to back up, no issues there. no brake lights. and coming down the eastshore freeway, everything looks good and then once again the nimitz and westbound 24 out of walnut creek, everything is quiet. >> did you get outside and read a book in the sunshine like you planned? >> what did i do yesterday? >> i'm sorry, i shouldn't have asked. >> what did i do?! i took a nap. that's according to a new study by a hospital. researchers found female patients with migraines are 40% more likely to suffer depression. they hope the data will encourage doctors to speak to migraine patients about the risk of depression and ways to prevent it. the first new prescription drug in more than a decade has cleared a hurdle. we told you about qnexa developed by a mountain view company. one of the drugs kills your appetite and the other makes you feel full, the two drugs in combination. problems are heart defects and birth defects. the benefits outweigh the risks according to a committee and the fda has until april 17 to decide whether to approve it. today marks 150 years in business for the oldest restaurant still in its original location in san francisco. the old clam house restaurant on bayshore boulevard. the owner says it's located on what used to be the waterfront where people once actually dug for clams.

>> this restaurant actually survived the 1906 earthquake. the debris was used to fill in the marshy lands around the restaurant. >> the restaurant was built when abraham lincoln was being inaugurated. they are celebrating today 150 years strong. "sports illustrated" has been in publication since 1954 and never has a new york athlete been on a cover in back- to-back weeks, not mantle, mays, not namath until now. pride of the bay area, jeremy lin on the current issue of the magazine. since 1990, only 12 athletes have gone on back-to-back covers. palo alto native helped the knicks, of course, win a number of games. they are 9-2 under his helm. they beat atlanta yesterday. he had 17 points, 9 assists. there's only one athlete back- to-back-to-back cost twice. who is that? >> chicago bulls michael jordan. >> really? >> he has been on 57 covers.
