police have not reopen the roadway. the man who was killed, his mother was here at the scene and she gave us this picture of him. she has identified him as 36 year-old tyrone perhaps well. she said that tyrones' father was in some sort of argument here at around midnight and that his father and then called tyrone and when tyrone got to the scene he was shot and killed. he is the father of three children, he is also taking care of a fourth child that was not his biologically but basically, for dependents at that point. basically, the police are saying that it looks like a father who was in the initial argument did not know the person that did the shooting so again, the investigation continues in oakland. >> there were quite a few witnesses? >> yes, and right after the

shooting, tyrone sister was year as well as his mother to we had spoken with earlier, so a lot of people were here at the scene and police are talking with people >> parents and teachers in the east bay are taking a cue from the occupied movement to save five oakland schools from the chopping block. according to the group, a handful of adults are in the school chambers this hour because they want the board members to reverse their decision to lease a san jose elementary school to the emeryville school district and they are upset with plans of turning another school into a charter school. >> all the schools threatened with closure, to santa fe, marshall, to all of the schools, come out, the fight has

just begun to keep the schools open >> board members say the destruction forced them to adjourn the meeting early. the plan on finishing been meeting at another meeting. several schools are set to close there's adores this coming june >> a suspect in a san francisco mass murder is due in court this morning for a second straight day. bihn thai luc is charged with five counts of murder and special circumstances including robbery and burglary. the circumstances make a man eligible for the death penalty although prosecutors are not expected to pursue that sentence. he was arrested two days after the victims were found dead in a home. there're still no official cause is but court documents say blunt instrument was used. he had previously served eight years in prison for a robbery conviction >> he is a hard-working man in the construction trades, family

find the bus driver who is a woman in downtown san francisco. the woman is in the hospital with serious injuries and police say the bus left the scene and is possible the driver didn't realize someone was hit. muni tells us they found a bus parked in the muni bus yard. sounding off in oakland about long response times to 911 calls >> people in the oakland hills are concerned about an alarming spiked in crime there. one person video tape what he described as a vehicle that is casing some of the homes. the alleged burglars came to the door with masks but when they dialed 911 it took more than 20 minutes for the police to arrive and the chief says that is about average. >> it is it correct that response time is approximately 90 minutes? >> yes, for certain calls it is higher than i would like to beat

oakland and 64 in san francisco. there's kind of a break from the stormy weather but that will change overnight into saturday. another winter storm will drop down into the bay area and make it the first part of the weekend pretty wet. >> traffic is not too bad out there, we do have some areas of road work. i'm having a hard time talking. southdown 101 looks pretty good all the way into san francisco. the drive along the peninsula is nice and clear. here is a live look at the san mateo bridge, the right side is west down 92 heading towards the peninsula so we do have some road work there and usually it takes awhile to wrap things up. southbound 680 will find various on and off ramps blocked as well as eastbound

the '60s and '70s today. it looks like around the bay area, 70 degrees in san jose. 67 degrees in fremont. looking pretty good as you get inside the day, 66 degrees in oakland. the next couple of days, we will enjoy a brief break. a better chance of showers developing in parts of the north bay by late in the day tomorrow and then friday night into saturday more gusty wind crops into the bay area. at least it will be a 50-50 weekend. dry on sunday with partly cloudy skies. not a total washout for the weekend. >> how about traffic on this
