right into an open restaurant at 65 m.p.h.. >> here come the clouds and now there's a chance of rain in the forecast. we'll have details coming up >> we have an accident already along the peninsula near menlo park. >> good morning everyone, the weekend is approaching, it is may 3rd. >> the timeout is 430. new this morning police are searching for the driver of this car that crashed into a restaurant in east oakland around midnight at simpson's sole food. officers say the car was going about 65 mi. per hour when it lost control and slammed into the building. the driver took off in a silver honda civic. >> police are having trouble finding witnesses to the murder of an eighth grade boy. his father had just dropped off his son at the park when the

boy was attacked. police say he was punched and kicked so badly that it became a homicide investigation immediately. he was hospitalized and died monday afternoon. >> we want the public to understand the brutal nature of this crime and the fact that we need their help to find who did it >> police say gang members attacked the 14 year-old boy in they're still trying to learn whether he was involved in gang activity. >> the man charged with five murders in san francisco is due back in court this morning. bihn thai luc as a preliminary hearing. last month he pleaded not guilty to killing five people in late march. prosecutors say use a blunt instrument as the murder weapon. is bail is $25 million. the public is invited to a prayer vigil tonight to remember the seven people killed at oikos university.

it will be at diablo valley college in pleasant hill starting at 8:00 tonight. >> the san francisco man arrested for throwing bricks into a crowd during the may day protests apparently has a history of throwing things. one of the bricks hit a protester. police arrested him on charges with assault with a deadly weapon and vandalism. we have learned the was the same demonstrator arrested last november for throwing a bottle at a city employee. cbs five has obtained some other video from san francisco police showing rioters attacking a police station. police say they were all part of a group of 150 people who had splintered from a peaceful march. people say police did not do enough and they admit they may not have been prepared >> did you have enough cops?

>> no, we didn't have near enough >> 1 not? >> because we were geared to deal with a peaceful movement. >> it only took people 15 minutes to cause all whole lot of damage. there's no estimate on total cost of repairs but one person tell us that they caused at least $5,000 worth of damage to our store >> budget cuts forcing agencies to do more with less but caltrans is taking up a plan to get more trains. >> they are looking to add six new trains which means happier commuters this morning and it was actually a different story one year ago when caltrans was considering some big budget cuts to address a $30 million shortfall but now caltrans is saying they're looking at a balanced budget thanks to funding from regional and state sources. they're looking to increase the

daily total from 86-92 trains. it will be splitting the added service between morning and evening commute and the total cost will be about $375,000. they hope that these trains will address overcrowding. the $375,000 is part of a budget that caltrans will be discussing later today it and like we said, they could mean happier commuters especially at the millbrae station which could mean an easier time, shorter waits, a lot of people will be looking forward to that. >> are we getting rain today so i can figure out what to say? and he said i don't know. >> i don't know whether to be happy or sad today. happy because we're getting rain but sad because this could be the last storm of the season. we have some clouds gathering

outside right now and it looks like we have a chance of showers, especially as we head in towards the afternoon. we will see the trailing edge of the system rolling through later today and that will bring a chance of a couple of showers. skies are mostly cloudy around the bay area. temperatures are fairly mild with '40's and 50's. by the afternoon the clouds begin to thicken up and there's a chance of temperature's running much below the average. warmer temperatures are coming our way though. >> out towards the peninsula by marsh road we have an accident already blocking the left lane. no major slowing but they have been doing some road work there so just a heads up. we also have a couple of high wind advisories issued by chp including one for the san mateo bridge. and at the bay bridge so it will be two hands on the

steering wheel. much more traffic coming up. >> the search for more victims of the speed freak killers is focused on a new site. an investigation led them to excavate private property yesterday in london. they did not find any human remains. in february remains were found at a well at another site. there believe to be victims of the speed freak killers >> an autopsy is planned today as part of an investigation into a former nfl star. the girlfriend of junior seau found the former linebacker's body, he had been shot in the chest and there was a gun near his body. his mother was very emotional when she told reporters she had recently talked with her son >> he was talking with me and joking to me and he called me his home girl.

campuses. a san diego college student is suing the d a four $20 million after he was left in a holding cell for four days with no food or water. the dea has apologize. it began when he was caught in a drug search. he told reporters he drank his own urine to survive. he said his treatment amounts to torture. >> the new jersey mother accused of trying to suntan her daughter has pled not guilty. she allegedly stalked her five year-old daughter into a tendon but if while sun tanning with mommy. she maintains that her daughter was burned outside on a warm day. she faces up to 10 years in prison if convicted. >> the people of martina's won't have to look at life setting

pawing at a boy in the oregon zoo has gone far world. the little boy barely noticed the animal. his mother says she was not worried about the child's safety. >> we thought it was hilarious. >> you were not concerned all because of the glass? >> no, not really. some people were like move him out of there but he was not scared. if he was scared i would have picked him up. we didn't even notice the look like a zebra until someone told us that on facebook. he looked like a tasty baby zebra. >> the zoo workers say the cats often interact with guests. >> ddc him open his mouth? >> thank goodness for that glass. >> at the san francisco zoo they have plexiglas right in front of

the grizzly bears. you never know. a lot of clouds around the sky this morning, no change yet but that would change through the day. a lot of clouds now, 40's and '50's at this hour. this afternoon i think the chance of rain is on the increase. temperatures will be cooler than normal in the '50s and '60s and that is all we will get for today. this could be the last cold front of the season making its way through so carry your umbrella with you. the commute home could be on the west side. it does not look like a big system. we start to see some showers in the north bay and by the afternoon it spreads across the rest of the bay. we will not see a lot of rain from the system. maybe a few drops were just enough to get the ground wet.

temperatures will be way down. members mainly in the '60s in the south bay. inside the bay, '50s and '60s. a cool day outside and maybe a bit wet. much warmer weather over the weekend and as we head into the latter part of the weekend, '70s and '80s. >> we will take you outside where conditions are doing okay across the golden gate bridge. overnight we had a couple of lanes open in the southbound direction. into an overnight road work of three that stretch. it is scheduled to wrap up in the next 5-10 minutes. right now is good to go. southbound 101 at marsh road, an early morning accident has already been cleared. it actually looks like a pretty smooth ride all the way down to san jose. we did have some high wind

advisories, one from the san mateo bridge was just canceled. there is still one in effect for the bay bridge. maybe a little bit breezy especially across the upper deck but so far the traffic is nice and polite. speaking of san francisco, we have a giants game later on tonight so they are closing the eastbound lanes of king street around 7:00 tonight. if you are using this area he might want to avoid that northbound king street exit. 101 and 280 look pretty good heading to san francisco. that is traffic, back to you guys >> how about some baseball? the giants took on the miami marlins last night but the home crowd was not too thrilled, the giants
