tomorrow night. a young boy has died from that fact san jose fire that killed his mother on tuesday. firefighters had rescued the six year-old from their bedroom. the boy's father remains in the hospital in critical condition. other family members were also hospitalized. the family started in the parking garage directly below their bedroom >> in san jose school administrator is under arrest accused of sexual assault on a minor. he was arrested at the school on wednesday. investigators say he had sexual contact with the victim of school property in september of 2011. a troubled east bay schools slated for closure at the end of the year might be shut down early. the chronicle reports that wells fargo is threatening to close the school in two weeks. parents raise about $1 million to keep the school from

immediate foreclosure but the bank says that the private school has violated the settlement agreement. >> lawyers for barry bonds are asking a federal appeals court to toss out the slugger's conviction for obstruction of justice. a brief filed yesterday says the conviction was based on rambling and irrelevant but truthful answers to a grand jury question. he was asked if his trainer ever provided him of an injectable substance and he declined to answer the question directly. yahoo! is in admitting that is a new ceo claim to have a degree that he does not actually have. there launching a review of the embarrassing disclosure. scot thompson's resume claimed he had a bachelor's in computer science. yahoo! now says that he only has an accounting degree. >> about one hour from now we will get the latest numbers on jobs in america.

shot the suspect. a man who works nearby says the store has been targeted before. >> someone came in and tried to rob a store about one year ago. i talked to the owner after it happened and he said he got off to shots then he thinks one of them might have hit him but they never found the guy. >> authorities have not release the name of the man shot in yesterday's incident. >> state and federal investigators are investigating the death of a researcher who was studying the bacteria that killed him. 25 year-old richard dent got six it friday night. he died the next day. he was most likely expose to the bacteria at work last week. >> if he was exposed in the lab means it was in his throat and it went from his throat to his bloodstream. usually the incubation period is 3-5 days. >> dozens of people who had been

>> drive times are clear this morning including a cross milpitas. >> hello everybody, it is nearly 5:00 now and we begin with a heavy police presence in downtown san jose because of cinco de mayo. >> this comes just as gang violence in the city has been growing. >> they have traditionally had a big festival and parade here in downtown san jose but not since 2010. still, a lot of people decided to congregate in the downtown area which is why police are stepping up patrols from today through sunday. there also traditionally a lot of arrests that going on during these holiday festivities. people come from all over the area. local leaders are concerned about a spike in violence combined with a holiday.
