alvarado boulevard broke out around 1 a.m. over 50 firefighters were called out. one sustained a laceration to the back of his hand while fighting the fire. you can see the flames are intense. he was taken to the hospital. no other injuries were reported. an apartment building behind the shopping center was evacuated as a precaution. those people have been allowed back home. we'll have a live report with cate caugiran, who is just gettingon the scene this morning. we'll have the latest coming up in short order. and also, we are going to go on to our next story here... cate caugiran will give us an update on the fire in just a bit. so we're going on to the next story. sheriff. cbs 5 reporter anne makovec is at city hall where supervisors voted to save his job. >> reporter: seven of the 11 voters voted to remove mirkarimi from office permanently. but nine needed to do so for that to actually happen. so ross mirkarimi is coming back to work here at city hall this morning as sheriff of san francisco. >> i want to mend fences with all parties. i look forward to demonstrating why the people elected me as sheriff and look forward for me and my family to move in a place where we hopefully will achieve some normalcy. >> reporter: the marathon board of supervisors meeting lasted about nine hours yesterday and in the end, supervisors kim, olague, campos and avalos voted in favor of ross mirkarimi keeping his job despite pleading guilty to false

imprisonment days before he was sworn in, in january. the ethics commit recommended he be removed from office permanently. during a long public comment period yesterday we heard from both sides. >> we put him in office, and if we want him out, we'll take him out. >> you really need to ask yourself why mayor lee has come and taken our vote away. thank you. >> reporter: this has been a defeat for mayor lee who wanted mirkarimi removed from office. he sent out this statement last night saying, quote, the board's decision returns a convicted batterer to lead the sheriff's office and i am concerned about our city's nationally recognized domestic violence program. i will do everything in my power to ensure that abusers continue to be held accountable. so ross mirkarimi says he is going to talk with some of the high level officers in the sheriff's department this morning about exactly how he will transition back into power. some of the aspect of the city's charter is a little unclear about that.

make the play, yes, he did! >> all about the defense last night from both teams as the giants beat cincinnati 2-1 in 10 innings. this finally getting three hits but it worked. giants trail that series like the as 2-1 games. game 4 is today in cincinnati at 1:00 here in the bay area. let's take you out of this world this morning. this is a live look right now from the international space station. how cool is that. the dragon space capsule a privately built robotic spacecraft is on track upon an early-morning arrival there today. the dragon will deliver a half ton of supplies. this is the first commercial cargo delivery to the station. it's a billion-dollar deal with nasa and the private space flight company spacex. >> they had three astronauts up there. i hear they're a little hungry. >> they are getting some ice cream. >> they will love that. we are getting a little lightning and rain? it's kind of a crazy morning so

far, right, lawrence? >> is it that freeze dried ice cream stuff? it's not bad that space ice cream. we are seeing lightning strike around the bay area early on. we have some showers overnight into the san jose area. they had .09" of rainfall there as we see the first rains to fall in the san jose with welcome rain returning really just scattered. that's the way we'll play it for today. not everywhere is going to see rain. the best chance will be near the coastline. check out your high-def doppler radar. look at all the lightning strikes along the coastline, numerous strikes and we continue to see some of that toward half moon bay. these cells moving off the coastline back away. here's a good one with more lightning strikes. don't be surprised if you see heavy downpours this morning. that low continues to rotate around off of the coast slowly going to be sagging south but not before it keeps a chance of more rain in the bay area

today. temperatures by the afternoon still mid-70s possible inland 60s and 70s around the bay and 60s at the coast. better chance of rainfall into the south bay again, maybe some thunderstorms later on today into san jose area, santa cruz mountains. how about that, elizabeth? >> it actually rained a lot more than i thought. that video was impressive. yeah. lawrence getting excited. yeah! weather system moving through. you may still find some slick roads in the south bay. i didn't notice it as i was coming in but just a heads up especially on the south bay freeways, guadalupe parkway, 280 and 101. in the meantime we are just talk roadwork for much of the east bay. here's a live look at some of our traffic sensors. if your commute takes you through the san ramon valley both directions of 680 close to sycamore valley, various lanes blocked scheduled until about 6:00 this morning according to our friends at caltrans. otherwise eastbound lanes 4 closed for roadwork there. taking a look at the south bay, you can see our live drive time

sensors, so far pretty much moving at top speeds. you will notice some more roadwork southbound 880 near montague. so just a heads up there. elsewhere quick look outside. here's a live look at the golden gate bridge and pretty much all of our bridges fro and clear moving at the limit this morning. southbound 101 from 580 towards the toll plaza. 14 minutes. more "timesaver traffic" coming up. in the meantime, back to you guys. >> thank you. an 11-year-old boy, his mother and another woman are recovering after they were struck by a car outside an antioch school. it happened yesterday morning outside turner elementary school. police estimate the audi a3 wagon was going about 60 miles an hour on delta fair boulevard there. the two women managed to push the boy out of that car's path. >> all you heard was a car like going... [ noise ] and my mom started running towards me and pushed me out the way and then they both got hit. >> it happened on the boy's birthday. a man who claimed to be the audi's driver was later

arrested on suspicion of drunk driving. a teenager has life- threatening injuries after a stabbing in the mission district. the 17-year-old girl was stabbed multiple times near the corner of 21st and valencia streets about 7:00 last night. shortly before that, several people were involved in a fight in the same area. police are trying to determine if the fight and the stabbing were related. a san mateo man is due to enter a plea this afternoon concerning an abduction at parkside elementary school in san mateo. a 9-year-old girl was grabbed from a bathroom last month. today is the one year anniversaries of the "occupy" oakland movement. activists plan to make the occasion with a barbecue pot luck at snow park and some other events. san francisco is finally getting a target today. the store is at the metreon center called city target because it's a little different than most of the chain's outlets. it's smaller and doesn't sell big items that would be hard to

carry out of the store. some people were surprised the city allowed the store. i was really surprised that target was able to get in here. >> all the blow-back we would get when we started talking about target is we didn't get it here. >> the store opens today with a grand opening celebration this coming sunday. just in time for the holidays, walmart will begin testing its same-day delivery service. customers in select cities including san francisco, san jose, who buy popular items online will have them at their doorstep that very day. walmart is trying to compete with amazon.com which is also testing same-day delivery. christmas, 75 days away. >> oh, boy. on to the presidential race, mitt romney is back in the buckeye state today. romney supporters chanted, four more weeks for president obama during a rally in ohio last night. no republican has ever won the presidency without winning ohio.

the latest cnn poll shows the president's lead in the buckeye state is only 51-47%. >> i want you to go out there and find someone who voted for barack obama and get them to come join our team. >> we reinvented a dying auto industry that supports one in eight ohio jobs and has come roaring back to the top of the world. >> the president spoke at ohio state university yesterday. today he is back at work at the white house. meanwhile, romney says he has no plans for abortion legislation if elected president. that's what he told the des moines register during an interview with the iowa newspapers editorial board. during the primary season he told an ohio tv station that he was in favor of a pro-life policy. 4:40 now. today the u.s. supreme court is set to take on the issue of affirmative action at universities. the justices will hear arguments over a university of texas program that uses race as a factor in a quarter of its

canyon at the zion national park in utah. it's a wipeout. he made it across but not a perfect landing. believe it or not, he injured his knee, bruised heels and walked away and said he will do it again. >> he said a lot more than that. i heard a lot of beeping in that video. >> we had to beep it out. he is among the living which you know, he's lucky. >> i saw some kids riding around they all got the cameras on their helmets. thunderstorms in the bay area, hi-def doppler picking up on some of that. we have had some rain showers, that low continues to spin off the coastline. you can see all that moisture along the immediate coast. thunderstorms towards half moon bay with a lot of the activity moving away from the coastline as it moves around that low. to give a better look, you can see all that moisture rotating around and those thunderstorms

embedded. a lot of those thunderstorms down to the south so we're not done with this yet. some could still push into the bay area throughout the day today but generally the low is sagging to the south and eventually will carry all that moisture with it. heading out this morning, slight chance of some more thunderstorms as you approach the coastline. mostly cloudy inside the bay, partly cloudy into the valleys this afternoon. looks like the activity is going to shift further south. still that chance of some thunderstorms out toward the coastline. but then that activity may begin to rotate in toward the san jose area, the santa cruz mountains, be very careful there with the afternoon a little heating, we could see more thunderstorms erupt there is and some brief downpours so we're going to keep things unsettled but this low will drag further south taking the moisture with it. so the rain line will shift further south with that system. today not going it be to be not a bad day as far as the temperatures. san jose showers and thunderstorms this afternoon. 70 hayward, 63 pacifica. east bay temperatures maybe some mid-70s again. so you will see some partly

cloudy skies, a little sunshine peeking through. then some occasional showers approaching the coastline. 69 oakland, 62 daly city. next couple of days, things trying to settle down just a bit. and then as we get into friday and saturday, the good news is that storm system that looked like it might come through on friday looks like it will fall apart leaving us dry. the weekend looks warmer maybe a return to some 80s late in the day on sunday afternoon at least in some spots inland but hey some thunderstorms out there elizabeth. we don't get to see that very often. >> it's cool stuff. we are following a couple of different breaking news stories right now. fires burning right now including one in union city. i believe these are live pictures from the scene where you can see fire crews still on the scene of this earlier four- alarm strip mall fire. this is on alvarado boulevard. so obviously fire crews are still in the area. there may still be streets blocked off, as well. we know one firefighter was injured. we have a crew on the scene so we'll bring you live reports as needed throughout the morning.

in the meantime let's go to our maps. this sounds like a wood pellet fire in richmond. smoke and flames are visible from the eastshore freeway. 575 brookside drive. again we're just beginning to gather information about this. it's just west of i-80 at 575 brookside drive in richmond. 880 through oakland past the coliseum, so far looks great all the way towards downtown oakland. that drive time 16 minutes now on northbound 880 between 238 and the maze. so yeah, quiet commute on southbound 880 all the way down towards hayward. going out again towards the golden gate bridge, you may find some paving work still in lanes between sir francis drank and the waldo tunnel so a slightly slower drive time than typical. not too bad. usually that wraps up before 6 a.m. if not earlier. once again we have that full freeway closure in effect in

the eastbound lanes of highway 4 approaching loveridge. in the commute direction 4 looks good towards pittsburg- bay point area. and it continues on towards concord. southbound 680 if your commute takes you through the san ramon valley northbound or southbound 680, we are finding some roadwork in lanes various lanes blocked approaching sycamore valley. so yeah, be extra careful heading towards walnut creek. otherwise mass transit nothing to know. everything is on time for bart, ace, muni, caltrain and your ferries. that's a check of traffic and weather together every 10 minutes. back to you guys. a stanford university professor is one of two americans who won the nobel prize in chemistry just announced in sweden this morning. brian kobilka is a professor of molecular and cellular physiology at stanford university school of medicine. he and cowinner robert alefkowitz were honored for studies of proteins that let body cells respond from the

outside. half of all medications act on g protein couple receptors so they hope the research will lead to drug improvements. a republican led house committee will hold a hearing on diplomatic security in libya a month after the dead will attack at the university consulate in benghazi. california congressman darrell issa is chair of the government reform committee and says the state department ignored pleas from diplomats in libya to increase security prior to the attack. here's a look at the south american version of the running of the bulls. this amateur bullfight in colombia is known as [ speaking spanish ] alcohol infused fans are invited to jump into the ring and play matador. many participants is it died over the years but 2012 turned out to be a good one at least for the humans. 19 were injured though. >> that's a head shaker. jerry sandusky is expected to file an appeal within 10 days. the former penn state assistant coach was sentenced to at least

30 years in jail for child sexual abuse. the judge called the 68-year- old dangerous. sandusky denied the allegations in a statement he made prior to his sentencing yesterday. u.s. health officials now blame a dozen deaths on a fungal meningitis outbreak all linked to a tainted steroid injection. the latest was reported yesterday. a florida man whose death in july was just connected to the outbreak. the centers for disease control say up to 13,000 people might have received that steroid involved in the recall. a boston man faces charges after authorities at los angeles international airport discovered several hazardous and suspicious items inside his luggage. the items included a smoke agree grade, hatchet, gas mass, body bags and other items. >> i was upset they took my toothpaste from me at reno. i'm kind of glad they caught him here. >> investigators say the man was wearing a bulletproof vest and flame retardant pants

underneath his trench coat. he is charged with one count of transporting hazardous materials. >> never complain again. california gas prices still highest in the country but they may be peaking. prices jumped only a fraction of a cent overnight. nine days ago we were paying $4.17 on average for a gallon of regular and now it's $4.67. high gas prices mean booming sales for electric cars. sales for chevy's volt is up about 3 times the normal number of monthly sales. the volt actually has two motors, one electric, one gas. and the gas motor only kicks in when the electric power is running low. one volt owner says he feels like a genius right about now. >> i'm sure glad i bought this car. i bought it three weeks ago, 575 miles on the odometer and still no gas. >> compared to other popular hybrids and full gasoline cars, the volt is cheaper to drive over the long term, although it

does come with a pretty big price tag, $45,000. the u.s. government is suing wells fargo over allegations of mortgage fraud. the lawsuit accuses the bank of making reckless and fraudulent home mortgage loans for a decade costing the government $190 million. according to the complaint, the federal housing administration had to pay insurance claims on defaulted loans that were falsely certified by wells fargo. wells fargo denies the allegations. a group backed by the beverage industry is spending millions of dollars to denote a soda tax measure on the ballot in richmond. the no on n campaign has spent more than $2 million compared to just $25,000 spent by supporters of the tax. it would raise a tax on soft drinks and other beverages by a penny per ounce. a story we first brought you at noon yesterday was a rescue that was days in the making and this morning a sea lion is safe and recovering at

the marine mammal center. this is exclusive video of the rescue here. rescuers went out to pier 39 yesterday after they received calls about two sea lions with fishing lines caught around their necks. it's heartbreaking to watch that. but they shot a dart to sedate one of them, netted him and hauled him into a crate. >> we like to have them laying down. it took a while to get him down. we got him. that's the most important thing. >> the wire has been cut off and the sea lion is expected to be okay. the rescue of the second sea lion was more complicated. it apparently was scared by a tour boat and disappeared into the water. but at least that one sea lion -- >> they got the one. we were showing it at noon. it wasn't moving at all. it looked like it was in tough shape so it's good to see it moving around. time is 4:53. a major recall for toyota

bridge. problem-free. traffic and weather together every 10 minutes. >> elizabeth, thank you. a mexican zoo is celebrating four precious new additions. take a look. these bengal tiger cubs made their first public appearance yesterday since being born last month. the felines were born in captivity. the cubs are in good health. the birth of three males and one female is a huge accomplishment for the zoo. bengal tigers are an endangered species. they are looking a little sedated. >> did you see that paw? about a size 14 nike there. >> and teeth. >> they are cute though. honesty in sin city. a cab driver did the right thing although i'm sure he was tormented a little bit. a 42-year-old driver found a black laptop case back seat of his van in las vegas last month. so he opened it up. he found $221,000 cash inside. and he turned it all in. the owner of th money rewarded him with $2,000. >> he did the right thing.
