>> reporter: but a letter he got has him worried. >> it's our understanding that you are the surface owner of all or a portion of the land included in a parcel in our competitive oil and gas lease sale. >> reporter: it tells him his private land is about to be leased off to an oil company. >> this could result in surface- disturbing activities on your land. if there is oil in, say, the next section over and they need to drill for it, so be it. i just wish they wouldn't attempt to do it around my house. >> reporter: it's actually a common situation. you may own the surface rights to your property, but you may not own what's underneath, the mineral rights. many of those belong to uncle sam. >> we are required to put those up for lease periodically. >> reporter: the blm's rick cooper says his agent has a mandate to auction off mineral rights whenever there's an

interest. and right now, there's a lot. the auction is coming up in december. and 82% of those 17,000 acres are on private land. >> we asked the lessee if they would contact the private landowner and begin to have a -- hopefully a cooperative relationship with the landowner. >> reporter: jacobson says he's already talked to the blm and got some reassurances. >> as a homeowner, landowner, you do have rights. they can't just come in and destroy the place. >> reporter: but environmentalists say that is exactly what can happen. >> the contamination, with methane, benzene, has been documented around the country. >> reporter: because drilling for oil around jacobson's ranch would require a technique called hydraulic fracturing, or fracking. and it has caused groundwater contamination in other parts of

the country. but the blm says... >> 30% of the wells in california that are drilled are -- have hydraulic fracturing, and at this point, i'm not aware of any issues associated with hydraulic fracturing. >> they have not disclosed the dangers to the environment and to the public of this activity before putting these lands up for sale. >> reporter: kas >> reporter: casey with the center for biological diversity filed a 60-day intent to sue. >> these beautiful areas that people use for getting out in nature are at great risk of being transformed overnight from the shale oil rush. >> reporter: jacobson says he's not too wared about the fracking. >> they know they'll get sued if they screw up somebody's well water or surface water. >> reporter: but just in case, he has a backup plan. when the auction comes up, he says he might just bid on his own mineral rights and buy them

election. and the presidential candidates hit the battleground states today. mitt romney was in florida, which began early voting today. he held rallies in three florida cities, and told supporters it's time for a change. >> the supporters of the president have this chance. they do four more years, four more years. i like ten days a lot better. >> ten days and you'll be stepping into a voting booth and making a defining choice about the future of our country. >> with hurricane sandy heading toward the east coast, both campaigns have been forced to change their travel schedules. romney scrapped a trip to virginia and instead he'll head to ohio. the president planned to head to florida but pushed his trip to sunday night to beat the

storm. the california ballot features proposition 30 and proposition 38. today, state democrats held a day of action calling voters and urging them to support proposition 30, governor jerry brown's plan. lisa showed us it needs all the help it can get. >> reporter: just ten days until election day, and support for proposition 30 is plunging. only 46% now support it, a 9% drop over the past month. 42% are against it. the governor has been traveling throughout the state, fighting for this ballot measure. >> may i speak to you? >> reporter: they called other registered democrats, asking them to vote yes. prop 30 would raise income taxes on the wealthy and hike the sales tax by a quarter%. >> if proposition 30 does not

pass it will have a devastating effect on education in california. >> reporter: one of the largest supporters, the california teachers association. meanwhile, the small business action committee has raised more than $7 million to fight it. and rival proposition 38 would raise taxes for all californians with money going to schools. chairman of the california republican party tells me he's confident 30 will fail. >> raising taxes even higher in california will drive away more jobs and will collect less money over time if this passed than more. >> i think it's going to be a tough battle. the governor certainly is out there stumping for the measure. i think you're going to start to see support climb. >> reporter: prop 32 meanwhile, would ban unions from using payroll-deducted funds for political purposes. the democrats were urging voters to vote no on that today and its approval currently sits at just 39%. a check on bay area

headlines. two 14-year-old boys have been injured after being hit by a car in a crosswalk. it happened in front of an elementary school. police say the driver is a 92- year-old man. one boy was taken to the hospital with a possible skull fracture. the other was treated for cuts. the driver was cited for failing to yield and was referred to the dmv to reexamine his driver's license. a water main break on treasure island last night left the entire island without water for 12 hours. even after the pipe was repaired, officials warn people who live on the island to boil tap water before drinking it. the city is testing the water to find out if it's contaminated. results won't be available until monday. giants' gloves all over the place in detroit. we've got highlights, with game 4 looming tomorrow. also looming, frankenstorm, the latest track on the hurricane. it promises to make a total

superstorm heads closer to . several governors along the east coast are declaring states of emergency as the superstorm

heads closer to land. hurricane sandy is expected to merge with two wintry weather systems. and it's being dubbed frankenstorm. hurricane sandy is expected to come ashore early tuesday, somewhere around delaware. roberta is keeping an eye on that, as well as a tsunami warning. >> it's just amazing, because all of this has been developing and changing minute by minute. in hawaii, there's a tsunami warning. they're not taking it lightly. you have to remember in 2011 when a tsunami caused a considerable amount of damage throughout the hawaii island. this was all caused because there was a 7.7 earthquake in a rural area of canada. but nevertheless, it triggered the tsunami warning in hawaii. and we now have a tsunami advisory. 80 miles to the northwest of san francisco. it does encompass point arena

and fort bragg. the advisory basically means monitor the conditions, stay out of the water. there could be some very large waves. there could also be some very large currents. this again is a developing situation, so we'll keep a watchful eye on that. meanwhile, on the other side of the country, we have hurricane sandy, encompassing a whole lot of real estate. it's end, 450 miles. that's how far it extends. anticipated landfall is about this time tomorrow night or early monday morning. it's actual point of landfall is still not known, but it should be anywhere from maryland to new england. the bottom line, what we do know, up to a foot of rain is expected. this has such gusty winds associated with it, we will certainly see downed power lines and outages, this just a week before the presidential election. and there will be a lot of beach erosion as all of this coincides with the full moon and higher tide. now, back home, clear skies in

san jose. today's high was 76 degrees. currently it is 60 there. highs across the bay area averaged 11 degrees above normal. tonight, dipping into the 50's with a few passing high clouds. that's about it. otherwise, this is an area of low pressure. it is remaining to the north of the bay area, as it bangs up against the pacific northwest. it's being diverted because of this huge, strong ridge of high pressure that is now causing an offshore flow and very dry conditions. that's why we had clear conditions at the coast, all the way into the inland areas. tomorrow will pan out to be even a warmer day. check this out, futurecast. not even a cloud in the sky. then as the afternoon wears on, we start to see the development of that marine layer in the form of low clouds. and that means by monday morning, for that commute, we'll wake up with gray skies. how is all of this, as far as

the offshore flow is concerned, going to affect our air quality? you're going to notice a little bit of deterioration tomorrow, haze in the atmosphere, never a good thing when you can see the air that you breathe. unhealthy levels of ozone in the atmosphere. meanwhile, tomorrows highs go up to 60's at the beaches, 60's, 70's around the peninsula, jumping up into the low 80's across the santa clara valley. 85 for the outside number. brentwood and discovery bay. central bay numbers into the 70's. there you have it. we have a slight cool-down on monday. tuesday, clouds up. by wednesday, we see rain. yes. with everything else going on, rain on halloween beginning in the north bay, ending up in the south bay by the evening commute. looks like we do have a chance of a lingering shower on thursday. by the way, detroit, motown city, down to the 40's's at
