snow on mount tam, possibly the most it's ever had. well, tomorrow morning, it's expected to be even colder with frost and freeze advisories posted but no precipitation expected. frank, that's snow. >> it sure is. looks beautiful, too. get your skis out, huh? 4:31 now. california's budget deficit has dipped below $2 billion after years of double-digit gaps but the governor says now is not the time to step up spending. the spending plan he will unveil this morning includes more money for education, thanks to voter-approved tax hikes but he also stresses continued fiscal restraint just about everywhere else. that might not sit well with brown's fellow democrats, who are now fighting to restore many slashed state services. new this morning, a former death row inmate is back behind bars after he told police he killed his own mother. vallejo police say dennis stanworth showed them where to find the victim's body yesterday. we're expecting more details today on vallejo's first murder

of 2013. investigators believe she is the suspect's mother nelly stanworth. according to police, dennis stanworth was sentenced to death for sexually assaulting and killing two teenaged girls in 1966. his sentence was reversed later. in contra costa county, pittsburg police say there's much more to the story about a man who killed a suspected burglar inside his apartment. four people are now in custody accused of what began as an elaborate plot to scare the man. investigators say charmaine was having an extramarital affair and wanted to frighten her husband into moving out of the apartment that they shared on east leeland lane. >> they plotted a burglary with her current boyfriend in an effort to scare him him to leave the residence. >> police say they enlisted three other men to help out. it all unfolded tuesday morning. investigators say the husband got into a struggle with one of

the suspects robert earl lindsey and managed to stab lindsey to death in self- defense. the woman, her boyfriend and the two other suspects were arrested. they are eligible for murder charges accused of a felony that led to a death. the mom of a missing bay area girl is still searching for closure after learning a bone fragment is not that of her daughter. the bone was found in october in a san joaquin county well where several victims of the "speed freak" killers are buried. turns out, that bone belonged to a teenager, not michaela garecht. michaela was only 9 when she was kidnapped in hayward in 1988. the damage to the bay bridge by the tanker crash is costly. this shows the damage to the bridge and the ship. on the left of the screen, some of the wood from the support beam is still stuck to the ship. a closer look, damage to the

bridge is now estimated between $2 million and $3 million. an attorney for the pilot says speculation of pilot error is premature. he says, "there are many potentials causes such as menke cal failure, faulty navigational devices, unpredictable fog conditions, mechanical failure and other sources. the ferry that crashed in new york city had a new engine and propulsion something, something federal investigators will now be checking. one witness says the ferry employee told her operators were complaining about maneuvering problems with the refurbished vessel. yesterday morning's crash injured dozens of passengers, 11 seriously. 4:34 now. president obama is expected to nominate his new treasury secretary today. jack lew with replace geithner. he is currently the chief of staff. he previously served as budget director and was an executive

sales at gun shows, and through private dealers. >> it's critically important we act. >> reporter: today the vice president meets with representatives of gun owner groups including the national rifle association. the nra believes any restrictions on guns and ammo violate the constitution. >> i don't want any part of my freedom taken away. >> reporter: vice president joe biden says he believes new laws can make it through congress because the massacre in newtown, connecticut changed the political landscape here in washington. >> i don't think anything has touched the heart of the american people so profoundly as seeing those young children not only being shot but riddled with bullets. >> reporter: still, skeptics like the folks at sharpshooters says new gun laws won't prevent criminals from getting weapons. >> you can pass laws until you're blue in the face. it won't matter. >> reporter: but the vice president says he and president obama are determined to act.

susan mcginnis, cbs news, washington. the berkeley school district will hire consultants to reexamine safety procedures in the event of a gunman on campus. the move comes in the wake of the school shooting in newtown. the consultants will work with police and fire departments on a what to do plan not only for when a violent person comes on campus but also in the event of earthquakes and fires. jerry sandusky is expected back again inside a pennsylvania courtroom as has lawyers argue for a new trial. sandusky's a former penn state assistant coach convicted in a child abuse scandal there. defense attorneys complained they weren't given enough time to prepare for the trial because of all the material from the prosecution. the 68-year-old sandusky maintains his innocence. an executive for mountain have you-based google says -- for mountain view-based google says it needs to end its isolation. he says if they don't allow the country to use the internet it remain behind other nations.

until 5:00 this morning along the eastshore freeway. both directions between powell street and the maze various lanes blocked through the area and 380 connector to 101. you might see some construction there, as well. that should be wrapped up by 5:30. we'll have a look at the golden gate bridge in just a few minutes. frank. >> thank you. bay area headlines now on this thursday, east palo alto is scrambling to shore up its aging levee along the san francisquito creek after severe flooding last month. workers are placing thousands of sandbags to raise the levee wall as a short-term solution. a project to i had we end the creekbed is set -- to widen the creekbed is set to begin this summer. san francisco police believe this man may have killed a woman seen walking with him in this surveillance video. that's 46-year-old elia cruz. this is the last time cruz was seen alive. she was found dead in her tenderloin apartment a short time later. investigators have been searching for her killer since october. and some windows at san jose city hall have been damaged and it's going to be

little more aggressive causing great concern. >> i can only imagine. the owner was taken to jail on drug charges. mr. teeth by the way is being treated at the oakland zoo and veterinarians say he is very sick. they are trying to take care of him. california may be getting close to putting the great white shark on a protected species list. groups have specialed the state citing two studies that estimate only 338 great whites remaining off the west coast. a team of state officials is skeptical about that low number. but on monday, determined there is enough evidence to protect the species as threatened or endangered. the issue is now in the hands of the state fish & game commission for the first time since 1996, nobody was elected to baseball's hall of fame yesterday. the big reason of course is steroids. former san francisco giants slugger barry bonds did not come close to being voted in on the first ballot, only 36% of the baseball writers who voted saying that bonds belongs in the hall of fame.

that's far short of the 75% required. roger clemens, sammy sosa, also denied. i think clemens got 37%, sosa only got 12%. >> it's such a polarizing issue, something we debated yesterday in the newsroom, something that everyone i think is talking about. >> everyone was talking about it yesterday! and i think with time, these guys probably will get in. but -- >> we'll see. >> -- it's going to take time. >> we'll see. 4:46. let's check the weather. liz is in for lawrence today and quite the forecast. >> we have a little bit of everything going on today so we're working out our hi-def doppler. snow level dropped to 2,000 feet or lower. we could even see a dusting in some of the higher elevations. for most of us in the bay area we'll see scattered showers. so not a huge rainout but we have our hi-def doppler out. north bay clear, but off the coast some rain showers may move in. scattered showers over the south bay. and even some heavier cells. so when you see that yellow, moderate rain falling in saratoga out of sunnyvale towards san jose.

so again, this is hit-or-miss rain showers. you could be traveling on 280, see a few raindrops, maybe a windshield wiper and continue driving and then suddenly it's dry again. so the rain will slowly taper off throughout the morning and into the afternoon. and behind it are some really cold temperatures. in fact we have the advisories up for tomorrow morning. it is expected to drop below freezing. for now, it is definitely chilly. so grab that umbrella. heavy jacket before you head out and we'll see partly to mostly sunny skies by this afternoon. so once again, clearing but those temperatures are going to struggle to get out of the upper 40s to low 50s. so still that low pressure system still kind of hugging the bay area. high pressure bringing us dry skies for the next several days. forecasted highs by this afternoon chilly. 53 in oakland. 50 in fremont. and just a quick note, that cold weather alert in effect for tomorrow morning at this time for most of the bay area. temperatures again in the 20s to very low 30s. coming up, a check of your

seven-day forecast. in the meantime, i guess gianna already has a chp-issued wind advisory for the bay bridge. >> it's the only bridge with a wind advisory so be careful on the span this morning. no major delays at the bay bridge toll plaza. live look at the golden gate bridge. we saw some slight delays on that northbound side as they changed lanes but traffic is now cruising along, no troubles out of marin county. southbound clear into san francisco. the rest of the bay area checking in problem-free as far as accidents go. just a heads up there is roadwork still on the dumbarton bridge this morning so that may slow you down. both directions that should be wrapped up by 6:00. san mateo bridge a great alternate in the meantime. no delays to report there. also, westbound 4 brake lights through antioch. eastbound on the flip side reports of some roadwork near loveridge. also eastshore freeway both directions between powell and the maze. caltrans has various lanes blocked through there. that's expected to be cleared by 5:00. caltrans on 380 those connector roads to 101 might see delays

there because of construction. overall the peninsula commute no delays and the south bay looks good. everything clear 880, 237. we have chain requirements heading to the sierra for 80 and 50. we'll have a live look at that coming up. back to you. >> thank you. new this morning, a monterey county inmate is out of jail after he walked away from his work crew. deputies are searching for james rimbey assigned to a work crew in the county jail in salinas. a witness told authorities he was last seen yesterday running to the soccer field at nativadad park. he was serving a three-year sentence for burglary. deputies say he is not considered to be dangerous. 4:49. a bay area city hopes someone will return a stolen memorial plaque honoring those who died in combat. vietnam vets say they weren't shown much respect when they returned home in the '70s but the petaluma memorial was one of the first in the country to

honor the sacrifices of those veterans and that's why it's so important to them. >> the warrior went over to fight. he had to go. >> the city hopes whoever stolele plaque will return it with no questions asked but if not they plan to replace it with a new one, possibly made out of granite. those troubled boeing 787s have more problems of a potential brake problem canceled a dream liner flight in japan yesterday. that's three mechanical issues in just two days for the new 787s. and it's the latest in a string of glitches that have hit the high-profile airplane since its debut. the other problems this week, a fuel leak and electrical fire. the 787 dreamliner is scheduled to land at mineta international airport tomorrow part of the all nippon airways new nonstop service between san jose and tokyo. a sleek new airport amenity will greet the passengers in san jose. it's a spacious vip lounge

called the club at sjc. it's the third floor room with a runway view and a cost of 35 bucks a day. >> our airport until these recent changes has been a second class airport. it put us on the map. this type of amenity is what world class business travelers expect and demand. >> the city is still trying to get for flights and destinations back to the level it had 10 years ago. many carriers reduced flights after 9/11 during the recession and during the major construction project at sjc. some new rules are on the way aimed at making sure mortgage borrowers can afford to repay the loans they take out. the consumer financial protection bureau says the new rules will take effect next year including a requirement for lenders to verify and inspect borrowers' financial records and lenders will mostly be banned from saddling customers are loan payments that total more than 43% of the

borrower's annual income. and more layoffs coming to wall street. morgan stanley will have 16% of its workforce cut. the firm's investment banking division will take a big hit. last month citigroup announced it's laying off 11,000 workers. san francisco's tosca cafe got an angel. two time academy award winner sean penn has been a long-time patron of the north beach bar. it's been around 92 years but the owner has been having trouble paying rent and then was evicted. the bar was set to close in august. when penn heard it was going under, he got a group behind three popular new york restaurants to sign a ten-year lease on the property. >> it's neat that there's a, you know, there's a community out there that can help save this bar because it's rooted

san diego's love affair with pandas continues this morning with the public debut of the cub. the 18-pound cub waddled around. his mother is the oldest panda known to give birth. the little guy is a fan favorite in san diego. he already has a huge following online. too cute. the days could be numbered for the wheelbarrow, top hat or them bow. hasbro is about to replace one of the classic tokens in the board game monopoly. fans are invited to vote online for the token they want to see gone if they want to see any of them gone. thely includes the shoe, iron, battleship and scottie the dog. people can also vote for the new replacements token. those candidates include a diamond ring, guitar, toy robot, cat, and helicopter. my vote would be for the deemed ring. >> i kind of figure as much. >> i don't like to see the classics go.
