dispatcher: 911 call from that location. hysterical female stating two persons inside fighting. a mention of a gun. the phone's been disconnected. deputy anthony jensen: what we have is a gal calling up at the beginning of the shift saying her boyfriend beat her up. of course tonight her dad and her brother go to the boyfriend's house to confront him. (garbled radio transmission) my girlfriend's brother and her dad came walking in and asked for me and i told them, "yeah i'm here" they came rushing in yelling at me and stuff. and then he threw a beer bottle at me. and he said, "come on
4:02 am
outside, come on outside." and i was like, "all right, fine, i'll walk outside." i went in my room and i got my gun and i says, "i want you all to leave now because you guys don't come rushing in my house threatening me, telling me you're going to kick my ass and kill me," and all this ( bleep ) yeah. ok. they left and then they came back they had a baseball bat and all that they came rushing in and all kind of ( bleep ) was happening. ok, you didn't have the gun with you when they came outside to talk? no, no. when did all this happen? umm...during the commotion... i was watching tv and all of a sudden he rushes in and starts... with a bat and everything... and says "come outside." he pulled the ( bleep ) out of my hair. did they leave the bat anywhere? yeah, here's their bat. they brought this in. if they come back tonight don't confront them. don't let them in if you can help it. if they come in you do what you got to do to protect yourselves. get on the phone right away with us.
4:03 am
does that mean if they come in my house i can shoot them dead? i didn't say that. i said you do what you need to do to protect yourself. yeah, they're going to come here with a gun. ok, well... i already know that. they already said that. well whatever it takes to protect yourself from that you have the right to do. i got a 30 round clip. i will protect my son. ok. this may be them right there. that's them right there. 276 county. the suspect's just returned. woman: county 276. who's returned? the other party in this domestic. you want to bring your hand out of there where i can see it? tell me what's going on. just look at me sir and tell me what's going on. i came over here... anybody else in the car? no. just me. ok. hold on. just let me talk to them, all right? are you armed? i'm clean, guy. where's your
4:04 am
son at? where's your son? he's home. he's at home? yeah. ok. you come over here. sure. you can look around in there all you want. i just want to make sure your son's not in the truck. no. you're going to keep that out here. now you're going to talk to me. what happened here tonight? i came here to find out why he beat my daughter and my grandson up. 276 county, the beeper. it's no problem. they haven't done nothing to him. she's got a restraining order on him. that's why i came here. he pulled a gun on us. ok. but he says you broke into his house and came at him with a baseball bat. no, no, no, no, no. ok, he got in a fight with your daughter. right? yeah. ok. just hold on a minute. let me tell my side, too. all right. how'd you get knot on your head? he hit me with a ( bleep ) gun. he hit you with a gun? yes. what did the gun look like? it's a rifle. they got two of them. jensen: his daughter was at the precinct when i came on to file a report. i remember
4:05 am
talking to her. she had marks... she was beat pretty good by him? by him. but it was this morning. so when i explained to her-- it was already 6 or 7 hours after the fact-- so i explained to her she needed to have a report taken or we couldn't go arrest this guy for that. i took an ashtray and flung it behind me 'cause i was right in front of the table. i flung the ashtray behind me and hit her in the leg and i felt really bad. when i talked to her she had a black eye and a pretty good scrape on her arm. and her legs were scraped up. i don't know nothing about that. all's i know is i hit her in the leg with an ashtray. and i felt really bad about it. really bad. yeah, i'm sure you did. i did because i didn't even mean to hit her. and i came up to her and i said, "i'm sorry." and she just kept pushing me away saying, "leave me alone." why would she say you did all the other damage? i don't know. do you think she would blacken her own eye? no. then what do you think happened? i don't know. it could have been when i flung the door
4:06 am
back at her. oh you flung the door back at her? well yeah, because she slammed it and i hit it back with my arm like that. this is the son that was here originally. yeah. this your son there? yeah. did he drive the truck over? is he sober? yeah, he's sober. ok, we'll want to talk to him, too. david? yeah? why don't you tell me why you're here and what happened. we came over here. we wanted to talk to him and we said, "come outside, we don't want to create no problems in the house." he goes in the bedroom comes out with a loaded shotgun and points it right at my face. about 5 feet away. and the old man runs after him and grabs the gun and takes the gun and slams him in the head with it. and he's telling me, "grab the gun, grab the gun he's going to shoot you." and we're sitting there trying to wrestle around with the gun while the other people in there are kicking us and beating the ( bleep ) out of us. but you come in here and go into their house-- uninvited, getting your dad hurt. that ain't right. i didn't...no he took... he was going to take the bullet
4:07 am
for me. that remains to be seen whether he would've been shot. yeah, but what do you say after he's already shot? guys, i'm sorry to have bothered you. jensen: he'd been drinking he'd come into the house thrown a bottle and carrying a baseball bat. they really don't have any business going over to the house uninvited and basically looking for a fight. the got the fight and the short end of the stick. probably later down the road when they go to the prosecutor they'll get even the shorter end of the stick. how can you get back pain relief that lasts up to 16 hours? with thermacare heatwraps. thermacare works differently. it's the only wrap with patented heat cells that penetrate deep to relax, soothe and unlock tight muscles. for up to 16 hours of relief... try thermacare.

it doesn't sound life threatening the fire department is already headed over there so since we're in the area we'll take a run by and see if they need any help. ah, there it is. radio sam 9 we'll be 23 with the fire department we got smoke showing. man, do we ever. we'll just park up here and try to do a little traffic control for them. we'll go see if they need any help. whew! 298 sam 9. fire fighter: ok get your air packs open number one priority. i got a fully involved stretcher fire here.
4:11 am
ok it's not in gear yet. you guys need anything? move the traffic for me. we'll have to do some traffic control. we got a friend working on the van. the van caught fire. right as i pulled up i saw smoke. mike came running out. i ran over with a fire extinguisher. and it was on fire enough where i couldn't get it out. ok, do you know who the friend is that owns the van? mike. he's over here. mike? mike? hey, mike. you ok? no. ok. what's your last name? my name's joe. what's your last name? ( bleep ) can you tell me what happened over there? how this thing got started? yes. ok. first of all are you hurt
4:12 am
at all? you just need to get calmed down? i'm the one who caused it. ok. it's probably an accident. so let's not worry about it. it's stupidity. well these things happen. why don't you tell me what happened, ok? sit down and relax, ok? ok, just calm down. just take it easy. is there anybody else over there? no. just me. well you got out ok. i wish i were in it. well that's not going to solve anything. sure it would. i wouldn't be here and the cause of this. well that's what your friend's got insurance for. what happened? you were working on the van... the firemen have to have some idea so they know what they're dealing with over there. i was working on the van. there was a gas leak and i knew there was a gas leak. and i went to correct the gas leak. so i went to pull two plugs out to get gas out of an area that shouldn't have been there then
4:13 am
( bleep ) i forgot to disconnect the coil wire. ok. so when i hit the ignition to spin the engine over, whack! ok. asinine. ok. just calm down. i know better than that. it's ok. no it isn't. my best friend's house is going up. ok. that's what insurance is for. so let's not worry about that. just calm down, ok? just calm down. i'm going to call his wife. ok, that's fine, yeah. ok. you didn't get any smoke or anything like that? are you hurt? i wouldn't care. well, what we found out is the gentleman was working on his van this is his friend's house. and he had a gas leak in his van forgot what he was doing
4:14 am
took a phone call, was talking to his wife went in started it up saw a spark from the ignition ignited the fumes that started the fire. he was the only person in there. the medics are looking at him now he's really wound up pretty tight. i don't know if that's from what happened or if he's got some other problems but, we'll let the medical people take a look at him make sure he's ok, we'll take care of the traffic control for them and when they get ready to talk to the witnesses and him then we'll get out of here. looks like an accidental fire. we'll just make sure nobody else gets hurt while they're putting it out.
4:17 am
]ñ deputy bill cassio: neighbors have been calling in complaining that there are some folks living here they've got five or six kids living in this house they're concerned that the living conditions aren't suitable for these children. they say there's rotting food on the floors and the place is just an absolute pig sty.
4:18 am
we're going to go out now to make sure the kids are ok. that the conditions aren't such that puts them in danger. ( knocking on door ) hi. how ya doing? i need to come in and talk to you a minute. sure. ok. thank you. we had a call that concerns the welfare of your children. when we get a call like this we have to come out and actually physically take a look around and make sure there's nothing dangerous as far as the kids are concerned. we just had dinner and the dishes are dirty. hey, dirty dishes don't bother me. do you live here by yourself with the kids? yeah. well i know that can be tough. well, if you don't mind let's take a look around you can come with me and we'll see how things are here. check behind the door? what's behind the door? um, there's a broken door. oh, yeah. broken. okay. that's why i keep it open. your wife...uh... does she have all their clothes?
4:19 am
most of them, yes. okay. she's supposed to bring them back tomorrow. that's my room! ok. other than what they have on? uh...no i've got some of their clothes. how many kids do you have here? five. i'll have six by tomorrow. they're all your kids? yes. oops...careful. kevin...christopher... careful. well, we found the clothes anyways, huh? do you have the food stamps here? no i don't. she's got them. how do intend to get some food for them? well, they already had supper tonight. uh-huh. she'll be here first thing in the morning. and she's the same one who took all the stuff? she's slowly bringing it back now. deputy brett ferrar: why don't you round up your brothers and sisters and watch them for us for a minute, ok? why do you want to take my dad for? are you going to take him? we're not going to take your dad away. he's ok. uh...basically...both me and my partner feel that it's real
4:20 am
borderline. you're dependent on your wife who obviously is spiteful toward you and is having some problems. well, she isn't spiteful anymore. that's why she's giving me the kids you're depending on her to bring these food stamps. christopher's shoes on the floor... ah...what...? when...? first? second? uh...one of the reasons why she brought them over here is because she was afraid that if the state went over there and saw six kids in a trailer, they would take them that's why she brought them here. tell you what let's do. i'm going to come back in an hour. let's see what you can get done in an hour as far as... do they have diapers? yes. there's a whole case right there. okay you've got some diapers get some clothes on them at least to where they're... thank you. pick the stuff up around on the floor. i know you can't work miracles in an hour. but let's see if we can make it a little safer for them. i can do miracles in this place in an hour. ok, let's try that and i'll come
4:21 am
back in about an hour. okay. don't...whatever you do, don't leave. no, i'm not going to leave. i'm going to be too busy getting this place together. kids: bye! bye-bye. our last option in my mind is to take the kids out of the home. and separate that family. they don't understand why. they don't understand why they're being separated from their parents and it's pretty scary, so i like to leave that as a very last resort. here have a cart. there you go. one cart ought to do it. some eggs... a couple breads... ...seven of them living there. yeah. get a dozen and i'll get a dozen nectarines. staples of life here. eggs. got some eggs? yeah. that'll get them by for a couple of days. yeah.
4:22 am
yeah...how come i don't believe that? deputy bill cassio: brett and i both have kids of our own. and i know that probably one of the hardest things i could go through in life is having my kids taken away from me. and again that's a lot of trauma for the kids. that i don't feel like putting them through if the dad is willing to go the extra effort to make sure that they're cared for. hi! we cleaned it fast. you guys been busy? yeah. we cleaned it fast. ( laughing ) the kids are wiped out. it's looking good. they'll sleep good tonight. oh yeah. so will i. well, you sound out of breath, partner. looks good. it looks 100% better, partner. it really does. boy: we cleaned the bathroom cleaned the rooms. cleaned
4:23 am
up the bathroom... good. let's go back out in front here we brought you some stuff, too to help you out hi, sweet pea. hi. can you help me? yeah. who wants to carry something? me. me. you? ok. let's see. you're the big one so you can... here you go. can you carry that? is it too...? here, can you carry that? it's cold. i don't want to carry it. oh, can you hold it by the handle, maybe? got it? all right! look at that! uh-oh. you guys been real good? yeah, they've been working hard. hey look at this. mmmmmm. that's up to dad. he makes the decisions. now, do you want this or you want ice cream? i want this. here's a snack, guys. you guys are going to bed and i don't need you bouncing off the walls. that's not a bad idea. have an apple. alex? ( laughing ) you really did
4:24 am
impress me. you all really pulled together and i know you want to stay together. the reason why we brought you this stuff is we want to make sure that the kids were... i want to be a policeman. you want to be a policeman? yes. uh. we want to make sure that we could leave the kids here and they would have some food. we didn't have any problem with the fact that you cared for your children, loved them, and don't want them to leave. yeah. we could understand that and could see that. we need to just check back and make sure everything's going okay. anytime you want to come over. bye, guys. hey, thanks for coming. we really appreciate it. see you guys later. hope it helps out. oh, it definitely does. okay, good luck. you help dad, okay? all right, now. don't work too hard. i expected it to be a little better, but that was a lot better and i was really happy about it. i feel like we made the right decision. one hour wasn't enough to give them to finish the whole thing, but he

showers today. how long is this going to last? >> maybe just the morning but spring has sprung. there is not a lot but we will take anything we can get. mainly in the morning, here is sal. good morning traffic looks good but it is wet out there and it might cause some traffic or even some collisions if you are not careful so give yourself a little extra time. it looks good as you approach the 80 split, let's go back to the desk. we begin with breaking news of a large fire which has been burning since 2:30 a.m. this morning. claudine wong is live to explain why firefighters have had such a hard time putting this fire out.
4:28 am
good morning, claudine. >> reporter: good morning pam. you can see their putting a lot of water on this structure and this is the second structure to burn. you can see the glow of the flames are still up there from the front and from the back and the battalion chief said this is going to be a stubborn fire. no residents were hurt. we don't think his injuries are serious but the focus is getting this fire out. we want to show you what made it more difficult. if you can take a look at the power pole, it took pg&e 90 minutes to get here and as the winds begin to shift we certainly are getting more smoke in our line of sight which tells us about the fire
4:29 am
which is still burning. there are no hydrants so head to bring water tenders out here and that certainly changed the way this fire is being fought. take a look at this structure, this is apparently where the fire started. it building is gone. we don't know anything like that but as we can tell you 230 this morning, the fight continues and we are still trying to get more information and we are just getting a handle on everything that has been happening and we are right in front of this burning home and the water which is being dumped on this burning home, there are no hydrants and firefighters say we are going to talk to the battalion
