the supreme court expected to deliver landmark rulings today that will determine the future of same-sex marriage in the united states, one day after justices strike down a key provision of the voting rights act. edward snowden remains in hiding as russian officials refuse a u.s. request to hand over the man who spilled government surveillance secrets. captioning funded by cbs this is the "cbs morning news" for wednesday, june 26, 2013. good morning. good to be with you. i'm anne-marie green. this is the final day of the current supreme court term, and the court is expected to rule on two high-profile cases involving same-sex marriage. one involves federal law, the other the california state law that bans it. 12 states recognize same-sex

marriage. more than 30 have laws prohibiting it. tara mergener is at the supreme court. good morning, tara. >> good morning, anne-marie. well, the waiting is almost over, and today's announcement by the high court will have national implications. believe it or not, this was an issue that barely existed just a decade ago. >> what do we want? >> equality. >> protesters and supporters of same-sex marriages have been stationed outside the supreme court anticipating rulings on two cases involved those rulings. first involves a state-wide ban on same-sex marriages that california voters approved in 2008. >> it affects over 7 million voters in california who want to protect marriage. >> it could impact up to 35 states which have approved similar bans, but during oral arguments in march some of the judges hinted they may not be interested in issuing a ruling with such widespread implications.

>> is there any way to decide this case in a principled manner that is limited to california only? >> the second case involves the 1997 case involving the defensive marriage act or doma. it defines marriage as a union between a woman and a man. it was argued that doma violated the constitution's equal protection laws because it treats same-sex couples differently from heterosexual marriages. >> there are two kinds of marriages, the full marriage and some skim milk marriages. >> even supporters believe the supreme court will strike down the law. >> i have no doubt that doma, the defensive marriage act under the federal rule is doomed. >> and both cases come amid growing support from the public on same-sex marriage, but divisions among the 50 states. anne-marie? >> tara mergener at the supreme

court. thank you, tara. well, president obama says he is deeply disappointed by yesterday's supreme court decision that struck down a key provision of the voting rights act. the 5-4 ruling ends federal oversight of states' voting laws based on their voting rights record. the ruling allows nine states, mostly in the south, to change their voting laws without federal approval. almost immediately following the ruling, texas announced a voter identification law that can go into effect. and congress wants to pass a new law passing voter. unless it does, a slew of state and local laws undermining reg station can go into effect. and this morning the man who leak details on national security programs remains holed up at a moscow airport. russian president vladimir putin refuses to hand over snowden to the united states. snowden flew to moscow sunday,

and it's unclear where he plans to go next. bob orr has our report. >> reporter: in a clear swipe at washington, president vladimir putin says snowden has not violated any law in russia so he will not be expelled. snowden is a free person, putin said, in a newscast. he added, the sooner he chooses his final destination, the better it is for him and russia, but there is no outward signs snowden is preparing to leave moscow and his future travel plans are unknown. >> i'm no different from anybody else. >> while snowden is carrying some of america's most sensitive intelligence files, putin says his security services are not working with the former nsa contractor, but the u.s. is suspect. the countries have swapped prisoners and suspects before. again, the white house asks snowden be returned to face criminal charges. in a statement, a national security council spokeswoman

said there is a clear legal basis to turn him over. we're asking the russian government to take action to expel mr. snowden without delay, and u.s. secretary of state john kerry says not to damage their relationship with russia. >> i would ask for a period of calm and reasonableness in a moment where we don't need to raise the level of confrontation as something that's, frankly, basic and normal as this. >> but the u.s. prosecution is no more closer to getting the man. there's a growing concern that one spokesperson said we probably had a better shot when he was in hong kong. bob orr, cbs news, washington. well, former south african president nelson mandela remains in critical condition this morning. family members have gathered at his rural hometown in eastern south africa as the 94-year-old anti-apartied leader battles a lung infection. allen pizzey is outside the

pretoria hospital where mandela is being treated. allen, good morning. >> reporter: good morning, anne-marie. well, there's been no official word on mandela's condition other than one which was issued a couple of days ago that he remains in critical condition. this is his 19th day in the hospital. among those who were allowed in to visit him -- we don't know if they actually saw him -- was the archbishop of cape town, and afterward he posted a message on his facebook page. he said everyone should pray for manatee mandiba, and wish for a peaceful end. family members, including grandchildren and tribal elders gathered in his home village yesterday. they did not speak to the press, but it is understand that the median discussions about the family graveyard and his ancestors' bones.

that has to be resolved before they get around to burying mandela. there's been a bit of in-fighting within the family and it's a bit ugly, so it's a good thing it's not being reported. well hch wishers showed up and pinned messages on a wall and released doves and do something that's very traditional of south africa. they sing and dance. some might think it's disrespectful, but it's a way of paying homage to a man everything reveres. >> congressman ed markey has been elected senator of massachusetts. markey, a democrat, easily defeated gabriel gomez in a seat previously held by john kerry. markey won 55% of yesterday's vote. kerry resigned to become secretary of state. and coming up on the "morning news" an anti-abortion

you can't change color like we do. valspar has the love your color guarantee. if i don't love it, i get another color free. i'm thinking more this. yowza! valspar signature, look for it only at lowe's. lawmakers in texas in the lawmakers in texas in the senate there failed to pass a pill that would have forced nearly every abortion clinic in the state to close. state senators cast their vote late last night after a ruckus session in which one democratic state senator staged a ten-hour filibuster, but the vote on the abortion bill came after midnight, too late to pass. the bill would ban abortions after 20 weeks of pregnancy and requires procedures to take place in a surgical center. governor rick perry may now have to call a special session. in florida a police officer testifying in george zimmerman's murder trial recounted his desperate attempt to save trayvon martin's life.

jurors also saw pictures of martin's body the night he was killed. susan mcginnis reports. >> reporter: a neighbor who witnessed part of the confrontation between george zimmerman and trayvon martin testified about what she heard and saw the night martin was killed. >> it sounded like "no" or "ugh." i saw figures and arms flailing. they tried to discredit her by saying she supported a facebook page that demanded justice for trayvon martin. earlier the jurors were shown crime scene photos from the night trayvon martin was killed. trayvon martin's mother listened to one of the first officers on the scene describe how he tried to revive her son. >> were you able to get a pulse? >> no, sir, i was not. >> prosecutors are trying to convince jurors the neighborhood watchman went too far when he decided to follow the teenager.

zimmerman phoned authorities that night. >> are you following him? >> yeah. >> okay. we don't need you to do that. >> reporter: it was not the first time zimmerman contacted the police. he made about 50 nonemergency calls over eight years. some of those calls are at the center of a legal fight inside the courtroom. prosecutors want the jury to hear several call to the dispatcher in which zimmerman describes black individuals he considered suspicious. the defense objects to the calls arguing they're irrelevant to this case. judge deborah nelson says she will make a ruling at a future date. susan mcginnis, cbs news, sanford, florida. well, straight ahead, president obama makes a new push to protect the environment. and soon you won't see plastic bags anymore in some california stores. details in "moneywatch." details in "moneywatch." they weren't looking at me. ♪

republican opposition on capitol hill. president obama announced his new environmental initiatives under a hot sun on the campus of georgetown, university. he issued a warning about climbing temperatures, rising sea levels, and melting ice caps and said that as president, a father, and an american, it's time for action to counteract climate change. >> i refuse to conemn your generation and future generations to a planet that's beyond fixing. >> and he declared it's all but over on a debate whether humans caused global warming. >> we don't have time for a flattering society. >> the president is proposing to renew a number of energy plans and set a goal to power the equivalent of 6 million homes with wind and solar power by the year 2020, but the most controversial part of his announcement is an executive order that would limit carbon

dioxide emissions from coal-fired power plants. >> it should send a strong signal to the world that america plans to take bolda against carbon pollution. >> power plants account for 40% of the nation's carbon dioxide emissions, but reducing the emissions will be costly for energy companies. the companies called president obama's initiative a war on coal and on jobs. >> this is a huge step in the wrong direction, particularly in the middle of a most tepid recovery after a deep recession in anyone's memory. >> now, the president also commented on the proposed keystone xl pipeline project. he said the texas pipeline he said the canada-to-texas pipeline should only be built if it does not worsen carbon dioxide pollution. now on "cbs moneywatch," a plastic bag ban in southern california, and your tweets could cost you a job. ashley morrison is here in new york with that and more. good morning, ashley. >> and good morning to you, anne-marie. well, asian markets were mixed on continued worry about china's banking system.

tock owe's nikkei jumped nearly 1% while hong kong's hang seng jumped more than 2%. wall street rebounded on encouraging news on the housing recovery, rising consumer confidence, and improved factory orders. the dow gained 100 points while the nasdaq added 27 points. >> microsoft's preview version of its flag ship operating system comes out today after customer complaints over windows 8 led the company to make some changes. windows 8.1 addresses some of the gripes, most notably the removal of the familiar start button. it will be available for download today for free. the city council voted 9-1 last night to outlaw plastic bags at supermarkets and convenience stores, leaving shoppers the option of bringing their own tote or buying paper bags at 10 cents each. l.a. says it spends about $2 million a year cleaning up plastic bag litter. just five days ago mickey

arison, who owns the miami heat, celebrated the team's victory in the nba finals, but this morning he's out of a job. cruise carnival announced they're replacing him as ceo, a position he's held since 1979. it comes after a series of high-profile mishaps involving carnival ships. and it seems like common sense for job seekers, but a survey by careerbuilders finds that applicants are sharing way too much of their social networking sites. 43% of employers say they decided not to hire a candidate because of something they posted on their content. some of the most, posting provocative photos, drinking or drug use, badmouthing former employers, or making discriminating comments. >> i've got to say it probably

here's a look at today's forecast in some cities around the country. washington, d.c., evening thunderstorms today. atlanta, afternoon thunderstorms. st. louis, morning thunderstorms. denver will be sunny. and showers in seattle. well, a suspect wanted on drug charges kept police at bay for hours by refusing to come out of the ocean. john michael white ran into the surf late sunday near san diego when police tried to arrest him. he spent the night wading in the ocean and swimming away from officers. nearly eight hours later a police dive team arrived and was able to subdue him. and workers at one of the

world's most popular monuments are on strike. staff at the eiffel tower went on strike yesterday over working conditions and poor maintenance of the iconic structure. a union rep says maintenance work that started years ago still hasn't finished. 7 million people visit the eiffel tower each year. in sports, baseball's fiercest west coast rivalry is rekindled. the los angeles dodgers hosting the san francisco giants. in the sixth inning hanley ramirez gives the team a 4-1 lead when he rip as two-run homer off the pole. with two outs matt kemp makes a diving catch in center field to seal the win for the dodgers. 6-5, the final score. and check out this catch by a young fan at the brewers/cubs game in milwaukee. the girl is so polite that she actually thinks she needs to return the foul ball. how sweet. of course, she was allowed to keep it.

challenge whether an irs supplying adviser properly imevoked her rights in a hearing last month. that was part of the investigation into the agency targeting political groups that were seeking tax-exempt status. now the irs is involved in a new scandal. this time an irs contractor is accused of winning questionable bids worth up to half billion dollars. nancy cordes has more on the investigation. >> reporter: braulio castillo began winning hundreds of millions of dollars with the irs within months of founding his technology company, strong kals, castle in earl 2012.

>> we have found the kind of wrongdoing that should have caused this contract to be canceled. >> reporter: republican darrell issa chairs the house committee. they found that just before opening strong castle castillo filed for a disability rating with the veterans administration citing a foot injury he suffered in 1984, 27 years ago, while playing sports at a military prep school. that rating enabled castillo to register strong castle as a service disabled veteran-owned small business, eligible for preferential treatment in bidsibid bidding contracts. >> understand, never served a day of duty, went to a school that was at taxpayer expense. >> reporter: castillo also chose carefully where to locate strong castle, in the heart of chinatown, washington, d.c., says his company website, a formerly blighted area now bursting with shots and restaurants. but chinatown is still

designated a government hub zone, which meant castillo's company qualified for even more priority in bidding. yet when investigators visited castillo's strong castle offices, though one was there. investigators say it appears castillo's wife manipulated employees' time sheets to make it appear workers spent more time there, all of which castillo deny, telling cbs ne b s new s in a statement, throughout our work with the irs we have never asked for preferential treatment and competed fairly with contracts that we received. officials warned it would be too disruptive to cancel a contract with castillo. he and officials have been called to testify on capitol hill today. nancy cordes, cbs news, capitol hill. coming up after your local news on "cbs this morning," a preview of today's supreme court rulings on same-sex marriage.
