nothing short of a debacle. >> in written testimony cgi federal, the main contractor for the project, takes partial blame for the problems, but it says the ultimate responsibility is with the obama administration. >> it's our job to hold them accountable, and when it comes to obama care, clearly there's an awful lot that needs to be held accountable. >> even supporters of the president's health care law are upset. >> i absolutely believe someone should be held accountable. >> minnesota congressman rick nolan went a step further. he said the president needs to man up, find out who was responsible, and fire them. >> the frustration that lawmakers who supported the affordable care act feel over the fact that a portion of it is not functioning at the level we want it to function is frustration shared first and foremost by the president. >> some democrats including senator joe manchin are calling for a one-year delay of the $500

fine for not buying health insurance, saying americans shouldn't be punished for the government's faulty website. and on that point the white house says the change and the sign-up time line is under way. anne-marie? >> tara mergener in washington, thank you, tara. well, there's been more fallout concerning operations. germany says the u.s. may have targeted angela merkel's cell phone. merkel complained to president obama during a phone call yesterday. she said if true, that would be a serious breach of trust. the white house denies the u.s. is currently listening in on merkel's phone, but the white house did not say merkel's communications had not been monitored in the past. and this morning in massachusetts, a 14-year-old student is being held without bail charged in the murder of a belonged young teacher. 24-year-old colleen ritzer taught at danvers high school.

today counselors will be at the school to help students. reports indicate ritzer knew the student but it's not clear what their relationship was. jericka duncan has the report. >> reporter: philip chism didn't say a word during his arraignment yesterday. >> it's alleged on october 13, philip chism did assault and beat colleen ritzer. >> reporter: the popular math teacher's body was found in the woods behind danvers high school wednesday. ritzer's friends reported her missing late tuesday. >> as a result of that report, danvers police initiated a search for the teacher and discovered blood in the second floor bathroom at danvers high school. >> reporter: chism was also reported missing tuesday. police found him walking along the road wednesday morning. he was arrested based on his statements to police and school surveillance video. he moved from tennessee to this year. his friends say he was kind and soft-spoken.

his uncle can't believe what's happened. >> this is the furthest thing from reality for me to believe that philip could get entangled in something like this. >> reporter: ritzer lived with her family. she was respected and well liked. she had one ambition in life, to be a math teacher. >> she was happy to teach, so passionate. always wanted to be a math teacher. she made it fun for us to go to math class. >> reporter: a candlelight vigil was held last night. many who attended wore pink, ritzer's favorite color. and a moment of silence was held before last night's world series game. ritzer used twitter to post homework assignments and post inspiring quotes. ritzer twig ge twigged twittered "no matter what happens in life, be good to people. being good to people is a wonderful legacy to leave behind." chism is due back in court october 22nd.

police have not discussed a motive, and even though he is 14 years old, grand jury could decide that he be tried as an adult. anne-marie? >> jericka duncan here in new york. thank you, jericka. well, kennedy's cousin michael skakel is getting a new trial in the murder of 1995. michael skakel is the nephew of robert kennedy's widow ethyl kennedy. he's getting a new trial saying that his attorneys failed to fairly represent him. a 13 yurld a 13-year-old was carrying a pellet gun that officers mick took for a high-powered rifle. bigad shaban reports. >> reporter: two california sheriffs deputies say they believed 13-year-old anthony lopes was carrying an assault rifle when one of the deputies shot and killed him but his parents say he was carrying a toy on his way to play with a friend. >> he's not alive anymore because of a mistake.

>> reporter: police held up lopez's fake rifle alongside an ak-47 during a news conference. they say they repeatedly told the middle schooler to drop the weapon. they say when the boy didn't, they shot lopez several times. >> one of the deputies described that as the suspect was turned toward him, the barrel of the rifle was rising up and turning in his direction. >> reporter: he also had a gun in his waistband. the teen was a popular student who played the trumpet in the school band. the two deputies are now on administrative leave which is standard protocol and the santa rosa police department are leading the investigation. those who know the teen are shocked. >> he was a really good friend of mine. knowing that now he's gone, it's really hard. >> reporter: a few of lopez's friends are remembering him with a makeshift memorial as police and the community now search for answers. bigad shaban, cbs news. well, in southern california

goes on the auction block. gigi stone is at the new york stock exchange with that and more. good morning, gigi. >> good morning, anne-marie. now, bank of america has been found liable for mortgage fraud. a new york jury returned its verdict yesterday after a month-long civil trial. at issue mortgages the government said were sold without regard to quality. they were sold by a division of the bank called countrywide financial. bank of america denied there was any fraud. and more trouble for the nation's largest bank. federal officials plan to take action against jpmorgan chase over the bernard madoff ponzi scheme. jpmorgan was madoff's main bank for two decades. federal officials claim jpmorgan failed to do due diligence or report suspicious activity. jpmorgan says there's no evidence that anyone knew about madoff's illegal dealings. asian markets were mixed after china's money markets shot up. tock owe's nikkei added half a percent.

hong kong's hang seng lost half a percent. some corporate earnings sent the stock lower on wall street. the dow lost 54 point, the nasdaq fell 22 points. apparently billionaire carl icahn is putting pressure on am's ceo tim cook. he wants him to do more to raise the price of apple stock. icahn tweeted that he sent cook a letter yesterday. he lobbied that he spent $100 million to buy back apple shares. icahn has about $2 billion invested in apple. apple's stock closed at about $535 yesterday. the irs isn't known for flexibility when it comes to back taxes yet the irs inspector general says 700 of the agency's own contractors owe more than $5 million. most are in violation of irs rules. employees and contract workers are required to comply with federal tax laws. and a wedding ring will be sold today that was owned by lee harvey oswald. he's the man who shot president kennedy nearly 50 years ago. oswald left the ring at home the

atlanta, sunshine as well. partly sunny in st. louis and nothing but sunshine in denver and seattle today. now, in april a 3-year-old deaf boy in north carolina became the first in the country to have a micro chip planted in his brain stem. it's allowed him to hear sound for the first time. dr. jon lapook has an update on his progress. >> reporter: this is 3-year-old grayson clamp hearing the voice of his father len for the very first time. >> daddy loves you. daddy loves you. >> reporter: grayson was born without the nerve that helps connect the ear to the hearing center in the brain. in april he became the first child in the u.s. to receive an auditory brain stem implant as part of an fda-approved clinical trial. the device in his ear collects and transmits sound through wires threaded through his skull. the wires connect to an implanted electrode that sits in the brain stem. this is grayson now with his mother nicole.

five months have gone by since the operation. can you describe what's hatched? what grayson's development has been like? >> it's like a little miracle every time he hears something to me, but he's starting to develop speech. >> reporter: the clamps became grayson's foster parents when he was 7 weeks old. about a year later they learned he was completely deaf. shortly after hearing the news, the clamps were given the option of adoption. >> reporter: when you heard he was going deaf, did you have any question? >> no. we talked about what a deaf child needs. do they need to be with deaf parents? do they need to be with hearing parents? what's the best situation for him. we decided he should stay with us. >> reporter: sounds like grayson worked his way into your hearts. >> yeah, he did.

>> reporter: grayson's teacher says he says spontaneous words like "up," "go," and "bye-bye." he also learned one new word. >> ball. i know that because i told him to get the ball and he got it. >> reporter: despite his progress, grayson has a lot of catching up to do. since he was a toddler, he's been communicating with hand gestures. >> you want to make him go up. >> reporter: now he has to link sounds with their meaning one word at a time. dr. craig buckman of the university of north carolina performed the surgery. for somebody as young as grayson where do you see him in terms of maybe in the future if everything goes right? >> you know, i don't know honestly. we'll have to see where he goes. i'm really hopeful he'll develop meaningful spoken language. >> reporter: you want him to be a normal kid like every other kid. >> i don't want him to be a new normal. i want him to be extraordinary. >> reporter: to anyone who's met grayson, he already is.

the decision by pope francis to remove a german bishop is being praised by catholics in germany and around the world. on wednesday francis forced out franz-peter tell bart van-elst. he's been nicknamed the bishop of bling. he's been widely criticized for spending $42 million on a new residence. it includes a $20,000 bathtub. and the cost of college isn't getting any less expensive. the average cost of college tuitions rose to just over $30,000. some universities are bucking the trend. dean reynolds reports. >> the first question many

studented and parents ask are what's the cost. >> reporter: the college decided a couple of years ago to cut tu igs 24%. why did the school decide that tuition needed to be cut? >> the school like any other school has seen some declining enrollment and we were wanting to compete for students. and on the other side it was a pretty tough economic time and we knew students and family were struggling with the cost of college. >> reporter: here tuition dropped from $23,000 to $17,500. brad williams is a sophomore. >> the tuition really helped a lot because my dad helps pay for my college and i take out loans as well. >> reporter: across the country at least ten schools have cut or plan to cut their tuition significantly. this year, for example, concordia university in st. paul, minnesota, cut tuition by $10,000. next year converse college in south carolina announced it will reduce its tuition by 43%.
