captioning funded by cbs this is the "cbs morning news" for tuesday, december 17th, 2013. good morning, good to be with you. i'm anne-marie green. well, a federal judge has ruled that the national security agency's bulk collection of phone records of millions of americans is unconstitutional, it's a blistering attack on the program. the judge ordered the government to stop collecting data and then suspended his ruling because of national security interests. tara mergener has more from washington. good morning, tara. >> reporter: good morning, anne-marie. the judge says the nsa's methods may well violate the fourth amendment. now, this federal ruling carries so much weight because it's the first against the government spying program. a federal judge has ruled the national security agency should stop its full collection of american's phone records. saying it is likely unconstitutional.

under the nsa program, the government said, it collects and stores metadata on hundreds of millions of telephone calls in the hunt for potential terrorists. >> what number called, what number, what time, and what date, how many times, and how long, that's metadata. >> reporter: in a 68-page ruling, judge richard leon said the government surveillance program was almost orwellian. and said i have little doubt that the author of our constitution james madison would be aghast at what the judge said amounts to an unreasonable such. the justice department responded saying, we believe the program is constitutional as previous judges have found." president obama put together a commission to look into the nsa practices shortly after nsa contractor edward snowden leaked details of the program. >> our sources say that commission is going to recommend largely the same thing which is that the nsa stop keeping that massive database.

that it either lives somewhere else, maybe at the phone companies, and that they get an individual order for each case. >> reporter: the judge put his decision on hold pending a government appeal. and the government now has a chance to gather evidence showing the program is vital and does not violate the constitution. anne-marie. >> tara mergener in washington. thank you, tara. well, the senate is expected to hold a test vote on that bipartisan budget agreement. it appears the measure will be passed by week's end. at least seven republicans now say they will vote for the deal. it restores $63 billion in spending cuts known as sequestration. the united nations is asking for $6.5 billion in aid to help syrian refugees and the countries that have taken them in. the u.s. says nearly 9 million people have fled the civil war in syria. it's one of the worst humanitarian crises in decades. hundreds of thousands more refugees are expected. peace talks are scheduled to start in less than a month. and the 17-year-old girl

wounded in friday's shooting in colorado remains in a coma this morning. we are learning more about a possible motive for the attacks. rick salinger in centennial, colorado, spoke to students who knew the alleged gunman. >> reporter: it was a day of mourning and confusion. students trying to make sense of why an innocent girl was shot in the head. and why an 18-year-old debate star karl pierson fired recklessly into the school before taking his own life. katie snidely remembers that pierson wrote a speech in september that the speech and debate coach did not like. >> from what i knew, karl gave a speech that the speech coach didn't approve of and had inappropriate remarks. i think it was more in a humor kind of way but the teacher took it the wrong way. >> reporter: one student described pierson's speech as sexually perverse but in a humorous way. pierson did not take the rejection well. joel redmond was the co-captain of the debate team with pierson.

>> i told him, you know, your future is not what happens to you in high school and so much more than that. >> reporter: but he said pierson was removed from the speech and debate team after threatening the coach tracy murphy with his life. >> a lot of high schoolers, a lot of teenagers think their life is so immediate, so now. >> reporter: they never thought it would come to this. the students will be allowed to re-enter the school later this week, but that will be only for the purpose of retrieving their belongings. rick salinger, cbs news, centennial, colorado. a wildfire in central california has destroyed at least 15 homes. the big sur fire has burned about 500 acres in the los padres national forest. firefighters say they are making progress but the wind-driven fire is zero percent contained. one of the destroyed homes belongs to the big sur fire chief.

"the new york times" reports glaxo says it will stop paying doctors to promote its drugs. glaxo will also stop tying the salary of sales representatives to the number of prescriptions the doctors write. the drugmaker is under investigation in china. chinese officials say glaxo illegally paid doctors and government officials to raise drug sales. google's expansion into robotics continue. boston dynamic is a

here's another look at this morning's top stories. the government is considering its next move after a federal judge ruled on monday, the nsa's bulk collection of phone records is unconstitutional. judge richard leon said the program violates the constitution's ban on unreasonable searches. but he put his ruling on hold so that the government can file an appeal. and a wildfire in big sur, california, has destroyed at least 15 homes and forced the evacuation of about 100 residents. california is suffering the driest calendar year on record. while most of us consider cockroaches unwelcome creatures, they are not entirely useless. turns out the insects are big business. seth doane visited a place in china where roaches rule.

>> reporter: just off a freeway in china's shandong province, this is not exactly appeals, but then again, neither is what's inside. cockroaches, tens of millions of them. and chief admirer. he's part farmer. >> i've been interested in insects since i was 8 years old he told us. 16 years ago, he started farming these critters commercially, yes, there say market. business is very good, he told us, many pharmaceutical factories make products with them. almost all of his roaches are used in traditional chinese medicine. he claims they can cure what ails you from the heart, to the liver to the lungs. ground cockroaches have been used to treat wounds and even as an ingredient in toothpaste.
