welcome to "cbs this morning." white house officials just revealed a short time ago that defense secretary chuck hagel is resigning. the former republican senator led the pentagon for less than two years. >> president obama's expected to make an announcement in about one hour. bill plante has been speaking to his white house sources. bill, good morning. >> good morning. the white house portrays this as not a firing but by mutual consent. they say the president and secretary hagel have been talking about this since october. the fact of the matter is hagel never really did fit in here. he came on board to help the drawndown of forces in afghanistan to basically end the war. and now the united states is busy fighting another war, like it or not, and hagel is not very comfortable with the way things are working. he doesn't have access as much as he would like to the white house team here. he feels as he has told others that he's fed up with the micromanagement that's going on.

and he is not comfortable and they're not comfortable with him. so you're going to have this announcement of a mutual departure. and no successor to date. we expect the successor, the white house says, in short order. it's likely to be one of the people who were mentioned when hagel was nominated like moishl flonio a former deputy of defense, ashton cart another deputy, or maybe senator jack reid who has combat experience democratic senator from rhode island. the fact of the matter is is this ends a chapter which was not very productive for either the white house or the pentagon. >> bill thanks. >> n an interview last week we asked hagel if he had the confidence of the president. >> then there are these stories, that the president wants to change his national security team. he's looking at his last two

years. maybe he wants to change his national security advise his secretary of defense. maybe he wants to change other elements. is that true? >> well, you'd have to ask the president. but -- >> do you concern yourself with it? >> no, first of all, i serve at the pleasure of the president. i am immensely grateful for the opportunities i've had in the last two years to work every day for the country and for the men and women who serve this country. i don't get up in the morning worried about my job. it's not unusual, by the way, to change teams at different times. >> so you would expect things to change? >> i didn't say that. i didn't say i expect things to change. what i'm saying is it wouldn't be unusual to do that first of all, historically. second, i've got to stay focused on my job. and i do. and i am very fortunate i have some of the best people in the world to work with.

seneca. this is expected to reach flood stage later this evening. that could cause dangerous flooding for some neighborhoods. after a series of crippling snow storms pounded the buffalo area last week, western new yorkers still recovering from nearly seven feet of snow are now facing the second phase, the flooding. with temperatures expected to hit 60 degrees today and rain in the forecast, communities along lake erie are turning their attention from snow removal to flood warnings. >> people say, well my home doesn't flood. i know. but there's always a first time. and we're seeing first times all the time now. pack a bag, have your important papers, and be ready to leave the house. >> reporter: the national guard is ready to deploy where necessary. they have pumps, generators, water rescue teams, sandbags, and boats.

>> we hope it doesn't flood our house or anybody else's for that matter. we don't want nobody to get flooded. >> reporter: despite the threat of rising waters buffalo mayor brown is encouraged by the response so far. >> it's amazing that in recent days over six feet of snow fell on this community and we're 100% of streets open. >> reporter: but western new york is not out of the threat just yet. >> we still have not recovered. we still see this as an emergency. so we are preparing for the worst and hoping for the best. >> reporter: not only are people concerned about the potential for flooding and watching creeks like this closely, winds are expected to gust up to 60 miles an hour. that could create conditions for downed trees and even power lines. >> jericka, thanks. spent part of the weekend stuck in the snow. it shut down interstate i-90 at

snoqualmie pass. drivers who tried to get through without chains found themselves spinning out. meteorologist danielle niles of cbs station wbz is tracking a stormy week ahead that could affect the holiday travel. danielle, oh, no good morning. >> good morning, and good morning to our viewers in the west. a lot going on across the country today. a threat for thunderstorms in the southeast. rain and snow from the midwest to new england. fairly quiet on the west coast now. we get another store, another piece of energy coming in. that will mean the increased threat for rain for today. showers will turn to steady rain. heavier downpours between seattle and portland changing to snow across the northern mountain, the plains. this will continue through the day tomorrow. gradually tapering off tomorrow night into wednesday in terms of the heaviest rain before another storm comes in to end the week. rainfall amounts will generally be an inch or two. amounts greater than that are likely just east of seattle.

daniel isson is the missouri public security safety director. >> what we're trying to do is have areas that are designated that people can protest and express themselves but we want it to be isolated. >> reporter: they have formed a security plan that involves local police, straight troop state troopers and the national guard. >> i have a feeling that things will go well, they'll be peaceful and orderly. >> reporter: the grand jury made up of seven men and five women must decide whether to charge ferguson police officer darren wilson for the fatal shooting of michael brown. the jurors could also decide not to charge him at all. this weekend michael brown sr. handed out donated thanksgiving turkeys to needy families. >> this is a tough time for me. and just to give back it's a good feeling. >> reporter: brown has pleaded for demonstrators to be peaceful, regardless of what the grand jury decides. >> if it isthe decision comes today

investigation near cupertino good morning, everyone, it's 7:56. a home invasion is under investigation near cupertino. investigators say two people entered a home near garden gate and glenco drive this morning and demanded money. the robbers are still on the run. this man bypassed security at san jose airport yesterday. officials say he spotted him where he shouldn't be and stole a maintenance truck. he drove around for a while um he was arrested. it appears the panda is headed to boston. pablo sandoval has agreed to a deal with the red sox. the deal is reportedly worth almost $100 million over five years. stay with us. traffic and weather in just a moment.

it was a joint decision by the two men. he is the first to leave since the mid-term election. >> the former senator plans to stay at the pentagon until a replacement is confirmed. you can see the white house announcement shortly at cbsnews.com. >> anticipation is mounting over what the grand jury in the michael brown shooting case will decide. the 12-member panel meets again today to consider possible charges for officer darren wilson. he shot and killed the unarmed teenager in august. cbs news legal analyst rikki klieman is here. good morning. >> good morning. >> i think the general expectation is we would have a decision over the weekend. are you surprised this lasted until today? >> i am surprised. certainly the anticipation with all the evidence would be closed on friday and the grand jury would then vote. what happens usually in a grand jury is that it simply is a question of probable cause. was there reason to believe that the crime was committed? and it's a yes or no vote.

how many people in the usual grand jury of 23 say yay there should be a charge? how many say nay? here in missouri and i cannot stress it enough it is a grand jury of 12 people. nine must vote. that's a very difficult vote to get. does it disturb you that it seems they're deliberating? >> i think the the idea of deliberation in a case like this might be warranted by the amount of evidence they've heard. they've heard as much as a trial jury would ordinarily hear. they've heard all of the evidence by the prosecution. all the evidence from the defense. however, this idea of deliberation is what we expect from a trial jury not a grand jury. remember, the trial jury looks at is it proof beyond reasonable doubt. in a case like this, if it should go to indictment that could take days upon days. in a case of indictment we're looking at a low standard of probable cause. remember this, however, there is

also the question of the missouri law of a police officer's right to use self defense and to use defense as an extraordinary power of the police. much stronger than in other states. >> ferguson has been described as a city on edge. over the weekend we kept hearing it looks like the grand jury will dietindict. what do you make of all these leaks? >> i don't think there are leaks. i think there are no leaks. i think what has happened is unfortunately there are reporters who get information that they then jump to the conclusion that there are leaks. yopg anyone knows what is happening within that grand jury room, and the the unfortunate part of certain members of the media as well as outside agitators is the ginning it up factor. we have no idea what is going on in there beyond deliberations. >> we asked several questions because we really don't know. >> we don't know. but there are a variety of charges, charlie. >> indeed. and what is the significance of

the fact that the prosecuting attorney, mr. mccullough has promised to seek a court order if officer wilson is notindict ed ed? >> well, i find that extraordinary. the reason they're secret is to protect the identity of withins in all of the process. it's always been that way. on the other side of this h, what he's saying is if there's no indictment i want to show the community how fair i was. that's why he's doing it. the court, however says this. we're not necessarily going to give you this idea that you can give these out. >> does the jury know that people are watching? do you think they feel pressure at this point? >> how could they not? they live in the community. there's pressure all over the country. >> they're not sequestered, though. >> they're not. this morning planning is under way for official ceremonies to offer marion barry, the man elected four

times to washington, d.c. died on sunday. bill plante shows us the career of the the mayor who dominated city politics and overcame infamous duress. >> so help me god. >> so help me god. >> congratulations. >> a hero to his constituents was considered divisive by many others. marion barry was one of the most charismatic politicians in washington, d.c. history. his legacy is forever tainted by one night, when he was famously caught on a hidden camera by the fbi lighting a crack pipe at a downtown washington hotel room. during the the arrest, he referred to a younger woman in the room with an expletive, saying she set me up. he served six months in prison on a misdemeanor drug charge. but in an interview shortly before his death, barry continueded to maintain his innocence. >> misinformation.

about what was in that pipe. >> born in mississippi in 1936 barry was a part of the civil rights movement of the '60s. he move to washington in 1965 as the leader of the student nonviolent coordinating committee. barry believeded leadership could help those most in need. and in washington those he helpeded always supported them. >> he came for the people. the people came for him. at the most vulnerable point in his life, put him right back where he belonged. >> his return to the mayor's office in 1995 earned him the title mayor for life. he's credited with lifting entire generations of low-income residents into the middle class. cbs affiliate wusa's bruce johnson has reported on barry for decades. >> an old man in southeast washington was explaining to another politician who wanted marion barry's job why he couldn't have marion barry's job.
