>> announcer: this morning's "eye opener" is presented by toyota. welcome to cbs "this morning." key sections of the patriot act expired overnight after the senate failed to act before a midnight deadline. senators were not able to pass a bill extending the government's authority to collect bulk phone information, track lone wolf threats and follow suspects who change their phones. republican senator and presidential candidate rand paul blocked a final senate vote during a very unusual sunday session. nancy cordes is on capitol hill where the senate is now moving to plan "b." nancy, good morning. >> reporter: good morning. this is not a deadline that snuck up on anyone. they have known about this for years but the senate pushed off their vote until the last minute, and that gave senator paul the opening he's been waiting for. >> i'm not going to take it anymore. i don't think the american people are going to take it anymore. >> reporter: the senate's most ardent privacy advocate made good on his threat sunday forcing a halt of the national security agency's bulk collection of u.s. phone

unilaterally as our enemies grow more sophisticated and aggressive. and we certainly should not be doing so based on a campaign of demagoguery and disinformation. >> reporter: in a statement late sunday night, the white house urged the senate to "ensure this irresponsible lapse in authorities is as short lived as possible." but paul argued the threat is not as great as the president claims. >> people here in town think i'm making a huge mistake. some of them i think, secretly want there to be an attack on the united states so they can blame it on me. >> reporter: the house passed a bill three weeks ago that would reform the metadata program, moving the collection of phone records from the nsa to the phone companies themselves. the senate started moving in that direction last night but because of the way the senate works, a vote won't come until tuesday or wednesday at the earliest, which means, gail gayle, that the nsa program will remain in limbo until then.

>> all right nancy, thank you. this morning, we're waiting for word on funeral arrangements for vice president joe biden's oldest son. beau biden was delaware's former attorney general planning to run for governor. the 46-year-old father of two died saturday of brain cancer. major garrett is at the white house with this latest tragedy to hit the biden family. major, good morning. >> reporter: good morning. unlike many of his younger political contemporaries, vice president joe biden has a genuine ear for poetry. he uses it frequently and by far his favorite is the irish poem william buttler yates. he wrote a manu being irish he had a sense of tragedy which sustained him through periods of joy. joe biden has known genuine tragedy and yet found plenty of joy. yet in a way maybe a poet can understand, a sense of tragedy has returned. there was poetry in vice president biden's relationship with his son beau whose real name was the same as his

father's and grandfather's, joseph biden. >> as your parents will understand, my dad's definition of success is when you look at your son and daughter and realize they turn out better than you. >> reporter: beau biden was already attorney general when he addressed the democratic national convention in 2008. >> i'm beau biden and joe biden is my dad. >> reporter: he and his brother hunter were seriously injured in an accident in delaware that killed biden's wife and daughter. biden, aged 30 had just been elected to the senate and agonized of his choice -- a life in the nation's capital or being a single father. he decided to be both. >> he was sworn in in the hospital at my bedside. as a single parent he decided to be there, to put us to bed, throb when we woke up from a bad dream, to make us breakfast. >> i came to realize that a child can hold an important

thought, something they want to say to their mom and dad maybe for 12 to 24 hours and then it's gone. and when it's gone it's gone. >> reporter: in 2012, the vice president discussed the heartache of losing a child. >> for the first time in my life i understood how someone could consciously decide to commit suicide. not because they were deranged not because they were nuts because they've been to the top of the mountain and they just knew in their heart they'd never get there again. parents never expect to have a child predecease them. never. >> reporter: in that speech, the vice president said "the day eventually comes when painful loss will yield a smile of memory before it brings a tear of grief." the vice president and his wife jill are on that journey now. president obama and the first lady lent their hands sunday spending about 30 minutes with them at vice president's residence.

gregory welch very lucky today. they brought dropped their daughter off for work seconds before the accident. debris started falling on the top of their car when they were still inside. one piece crashed the backseat where their daughter had been sitting. both had minor injuries. italian investigators are trying to figure out what caused a deadly collision at an air show sunday. amateur video shows two planes flying into formation when they slam into each other then plummet towards the adriatic sea. one plane crashes into the water killing the pilot. the second pilot pulls up and guides his plane to the beach where he flips over he reportedly suffered only minor injuries. >> china has put a smoking ban in place for all indoor public spaces. square dancers helped usher in the ban which begins today. they performed under no smoking

colorado police are asking drivers to be vigilant. they're very worried about a possible serial shooter who has already killed one cyclist. plus a top radio executive discovers the wrath of a popular female artist. he said stations should limit female artists to boost ratings. later we'll show you lambert's unfiltered remarks for what are called sexist remarks. they're marking themselves as water savers in today's drought. the industry did a study that found a standard pool plus decking uses one-third of the water as an irrigated lawn after an initial fill. >> "usa today" says all eight women trying to become the first female army rangers failed to meet the requirements to move on to the next phase of the grueling course. david martin told us back in april about the job at ft. benning. the army says three women will
