announced a short while ago the 15-year-old suspects could face life in prison if found guilty of murder. kpix 5's kiet do is in santa cruz with more on this morning's press conference. >> reporter: the question was whether or not the d.a. would name the suspect. he did saying there's a chance that this boy could spend the rest of his life behind bars. >> i'm here to tell you that today charges have been filed against adrian jerry gonzalez and that those charges have been filed as an adult. we have filed charges of murder including circumstances of lying in wait and committed during the course of a sexual assault and kidnapping. >> reporter: police say less than an hour after surveillance cameras spot maddy on her scooter she was lured to her death. by the time her mother reported her missing she was already dead. >> as for the motive? >> i can tell you this. people do things for lots of reasons. sometimes we understand them,

sometimes we don't. the specifics of this case i'm not prepared to discuss. >> reporter: police say he killed her in the apartment, carried the body down three flights of stairs and threw it in this recycling dumpster. a detective found the body after a more thorough search monday night. cops say the boy stood nearby and likely watched. as for charging gonzalez as an adult, the d.a. says he did not take it lightly. >> you look at the nature of the crimes, you look at how the crimes were committed, you look at the age of the offender, and you look at criminal record if any. those are typically the factors that are used to balance. >> reporter: instagram users have known for days gonzalez was the suspects. ♪[ music ]♪ -- was the suspect. >> reporter: gonzalez posted this video on sunday the same day maddy was killed. the song is called, mad world, and he posted the lyrics the dreams in which i'm dying are the best i have ever had. thousands of comments have been posted nearly all of it has been vicious. you're disgusting! straight ticket to hell and delete your life. >> we're confident that charges

will be filed. justice demands the charges that we filed and we filed them appropriately. >> reporter: because he is a minor, he is not eligible for the death penalty. live in santa cruz, kiet do, kpix 5. >> thank you. gonzalez will be arraigned tomorrow in superior court. the hayward police sergeant killed in the line of duty will be laid to rest tomorrow. a police motorcade will escort sergeant scott lunger's body to the oracle arena in oakland for funeral services and buried in a private ceremony in the afternoon. tonight be there will be a public viewing for the sergeant at the chapel of the chimes in hayward. he was shot and killed during an early-morning traffic stop a week ago. stay with us for full coverage of the funeral to remember starting at 10 a.m. tomorrow starting at 10 a.m. the willow fire is 30%

contained after burning 2,000 acres. at night the winds reverse course and push the smoke down. in lafayette this morning a fire broke out on the hillside near highway 24 near the pleasant hill road exit. those flames started just after 4 a.m. ten acres of dry grass were scorched before firefighters were able to gain control. and for the "wragg fire," a sudden burst of flames forced another round of evacuations. firefighters say winds are better today but the sheet making it difficult. -- but the heat is making it difficult. kpix 5's anne makovec with the latest. >> reporter: a fire that's been burning for more than a week near lake berryessa continued to grow overnight. the "wragg fire" is now 7100 acres and 8 every 80% contained. >> the terrain is awful. i mean, we have had to helicopter crews in just to get to some areas because we can't reach them with vehicles. >> reporter: the smoke is hanging heavy in the hills near vacaville, visible from i-80. it's been advancing closer to

136 homes under mandatory evacuation orders today. we thought this fire was almost out? >> so did we. it wasn't until we looked out about noontime and saw the smoke and everything and realized it was getting worse. obviously, we're very concerned about it. >> reporter: this is a time lapse video of yesterday's flare-up which caused the second mandatory evacuation for about 200 people around wild horse canyon in less than a week. the red cross reopened its emergency evacuation center here at the vacaville community center. but last night, only 4 people had to stay here. the rest of the evacuees are staying with family and friends. more than 1400 firefighters are focused on keeping the fire within its containment lines but the progress depends heavily on the weather. >> whenever the temperature gets into triple digits and the humidity gets into single digits, everything is just ready to burn. >> reporter: in vacaville, anne makovec, kpix 5. let's get to roberta now. it's already hot. >> it is in many of our inland locations.

good afternoon, everybody. we have an alert you need to know about and it is the "spare the air" alert. this is the second consecutive day when in many locations around the bay area you can actually see the air that you breathe, and that's not a good thing. that's the particulate matter that's trapped close to the ground. usually we see that after we have a lot of people on the roads. it's our car exhaust. this is an encouraging sign. check out the golden gate bridge. we are socked in with areas of low clouds and fog and the temperatures at 65 degrees in san francisco while livermore is at 96 degrees. it's hotter at this hour than just 24 hours ago. the humidity is at 20%. i'm going to talk about the big change you need know about and it's going to happen as early as tomorrow. maria, we'll have that later. early-morning commuters were stuck on interstate 880 after a deadly accident this morning. one person died in a three-car crash after a couple of the cars caught fire southbound 880 at 29th avenue. traffic was backed up well into downtown oakland. investigators closed several

lanes as they tried to piece together what caused that accident. three people are now charged in connection with a double homicide in antioch. yesterday, a contra costa county prosecutor filed charges including murder against these three people: teresa o'sullivan faces accessory to murder charges. three people were shot to death and another wounded last month. a national football league executive is meeting in oakland today with local government and raiders officials about the team's future. the issue is the proposed coliseum city complex that would include a new football stadium. many have concerns about how the project would be financed. oakland is one of three cities in danger of losing its nfl teams to the l.a. area. the others are san diego and st. louis. today a group of bicyclists plans to protest a crackdown on cyclists who run stop signs in san francisco. the group known as the whig party plans to have a lot of

cyclists ride along market street in san francisco. the idea is to have them all stop at all stop signs to show it could worsen traffic. the protest is set to begin at 5:30 this afternoon. some los altos residents are advised to boil their drinking water for a day. hundreds of customers of cal water were put on notice after a test showed the e. coli bacteria in the water. that order has been lifted for most homes. but there are a few homes on 7 acres lane and west fremont road that need to boil water or drink bottled water. new at noon caltrans was showing off its new bay bridge maintenance complex today. the $55 million facility is located on the oakland side of the bridge. and it will consolidate all maintenance crews into one building. it will created a more efficient response time for any problems on the bay bridge. it is official, san francisco has a new $8.9

the backlash isn't stopping over the killing of cecil the lion by an american dentist. cecil was a protected lion living in a sanctuary in zimbabwe. earlier this wisconsin dentist walter james palmer paid about $50,000 to hunt and kill it. palmer has been getting ridiculed ever since social media and the yelp account for his practice have been swarmed with furious messages. palmer said he didn't know the

lion was protected. tom brady is fighting back. the patriots quarterback once again says he had nothing to do with the "deflate-gate" scandal. reporter kenneth craig with how he fired back on social media. >> reporter: tom brady says he did nothing wrong. on facebook the patriots quarterback responded to the nfl's claim that he deliberately destroyed his cell phone wiping out text messages connected to "deflate-gate." he said he replaced his broken phone, after my attorneys made it clear to the nfl that my actual phone device would not be subjected to investigation. he said, we even contacted the phone company to see if there was any way to retrieve any or all the messages. patriots owner robert kraft says he expected the nfl to reduce braid giants dugout's suspects and now regrets not fighting the million-dollar fine, he expected the nfl to reduce brady's suspension and now regrets not fighting the

fog! and so dana, i got to tell ya, your wish is my command. we'll share with you an optimistic view of the bay area but right now, what you need to know is it's a "spare the air" day. we have a lot of pollution inland. but dana, check that out. there you have the return of the marine layer albeit shallow. roughly about 1,000 feet deep keeping some of the coast cooler today by a few degrees but not affecting inland areas. look at livermore. at this hour yesterday, it was 94. right now it's 96. humidity is down to 12%. that's dangerously low. that heightens fire danger around the bay area. there you have the return of the marine layer up the coast, salinas totally socked in this morning and you see that subtropical moisture right there, that's pushing in. i'm welcoming in the cooler temperatures. 107 in sacramento today. 80 in the high sierra going up to 85. 78 in monterey. sunset tonight at 8:21 and by then, we are hoping to start
