on the team. kpix 5's anne makovec joins us. she is live in the newsroom. and tell us what charges he is facing. >> reporter: hit-and-run, dui and vandalism. and this is his third dui arrest since he became a 49er in 2011. and the 49er head coach just made the announcement a few minutes ago that they are releasing aldon smith from the team. he walked out of the santa clara county jail this morning after spending the night there. we caught up with him at that point. his bail was set at $26,000. and he said he is sorry. he also said at that point that this was not a dui. >> the situation that i had could have been handled differently and i apologize to everybody i let down and for how it played out. but, um, as far as being concerned it will work out how it's supposed to work out. that's all. >> reporter: here he is in court in 2014. he was arrested two years ago on drunk driving charges.

he missed five games after that and went into rehab. then he took a nine-game absence during the 2014 season for violations of the league's substance abuse and personal conduct policies. he was also arrested in april 2014 at the los angeles international airport the police said he was randomly selected for a secondary screening, he became uncooperative, told a tsa agent he was carrying a bomb. no charges there. and he faced felony assault, weapons charges and dui charges in 2012 which were reduced to misdemeanors. the coach said smith had been working hard to kick a number of problems he had. >> get the help. you don't have to walk alone. find it, it's there. >> and although aldon will not be playing football here, we will be supporting him. >> while he is now being released from the team it was just two days ago the 49ers general manager said the team would like to keep smith beyond this season but obviously, things have changed. live in the newsroom, anne makevoc, kpix 5. >> here's a stat 49ers are not proud of. they lead the league in arrests since 2012 with 12 and smith is responsible for five of that dozen. a lot of people chiming in on social media today about this one, as well. a refridgation leak caused an evacuation at the danville costco this morning. fire crews are cleaning up the scene. they got the call about hazardous materials around 9 a.m. no one was hurt. atherton police are telling

people to be on alert for a prowler. a suspect was spotted outside a home on stockbridge avenue early this morning. a woman was sleeping on the couch when she saw him lurking at the window. he was wearing a winter hat and dark clothing. santa rosa police home this image from surveillance video leads them to two robbers who hit a clerk in the head before stuffing a backpack full of money. the pair hit the quick-pik market and deli on corporate center parkway on thursday night. one had a baseball bat. the other hit the clerk with a gun before ordering him to empty the register. and hundreds of people in the clearlake area can go home now that crews are getting a grip on the "rocky fire." a thick haze replaced flames in the county. the "rocky fire" is 45% contained. but the 800 evacuees to go home could find them in very bad shape. so far, 43 homes have been destroyed. golden gate park has been getting a makeover all week and

senate version says he is concerned about the flow of illegal immigrants. the president threatens to veto. a street in san jose known for potholes is getting fixed. kiet do with an update on the repaving of foxworthy avenue, where he is all too familiar with the bumpy ride. >> reporter: never thought i would center to say this, but there is -- never thought i would have to say this but there is nothing like the sound of a jackhammer in the early- morning hours. for years, foxworthy avenue has been a pain in the asphalt. crews are repaving the road that has been the poster child of neglect. it's rough. >> foxworthy is pretty rough. >> reporter: it's supposed to be a quiet neighborhood street. instead it has battle scars. i have driven on this road for seven years dodging potholes like a race car driver on a

absolutely come course. someone put up a sign last year that said pothole mine field ahead. we didn't know whether to laugh or cry. >> it's kind of sad. >> reporter: is there an easy answer when people ask what took so long? >> the short answer is money. >> reporter: mayor sam liccardo says during the great recession police and fire services took priority over the road. all the while, small cheaper cracks grew into gaping expensive holes. the good news? the improving economy means san jose has dramatically increased the repair budget this year to $24 million. the bad news, the repair backlog is a half billion dollars. >> so the bill's coming due and when you put it off it means the bill gets a lot larger, a lot quicker. so we have to make the investment now. >> my car has received so much damage just from the road. we clang when we go down the road. >> reporter: stephanie lives on one of the worst sections of foxworthy. after years of waiting, she can't believe it's finally

happening. you're smiling. >> yes. i'm -- i'm happy about it. i can't wait until we don't have to deal with the potholes anymore, they're huge! >> reporter: and the mayor says they will be working with lawmakers in sacramento to find more funding for road maintenance and also voters should expect a ballot measure come november. in san jose, kiet do, kpix 5. well, a santa clara police department just wrapped up a news conference about the arrest of 49er linebacker aldon smith. our mark sayre is there. he joins us with the latest. mark. >> reporter: we have a few new details. this happened about 8:45 last night in the 500 block of more land way apparently either an apartment complex or condo complex near levi's stadium where the santa clara police indicated they believe that aldon smith may live. apparently there was some sort of collision between aldon smith's vehicle and another vehicle either in a parking lot or in garage. aldon smith's door was opened as he was backing out. he crashed his door into the door of another car. and then according to santa

clara police he actually left the scene apparently on foot. and the police were called. when they came back, aldon smith came back on his own met with the police officers, agreed to take a field sobriety test which i officers said he failed, and he was arrested. one of the charges is leaving the scene of an accident and the collision with the car. that is described by the santa clara police department just a few minutes ago. >> he was in close proximity attempting to park his vehicle and while doing that he collided with another vehicle next to it. i don't know the distances. >> a few feet? >> i don't know the distance. i'll be speculating if i gave an answer. >> again, how is that hit-and- run? >> he left the scene, did not identify himself at all. and it was not until the officers returned to the scene he came back down and contacted the officers. >> reporter: aldon smith was taken to the santa clara county detention center where he was booked. he did bail out this morning.

concerned. i have to tell you, i have a couple of dogs and i have noticed some mysterious bumps on mu dog, too. >> i brought mac in because mac has a little mass right here where my fingers are. it's not too big maybe .25" in diameter. the thing is masses can be anything, a tumor, either benign or malignant. it can be a cyst. it could be a foreign body like a little foxtail or splinter that got in there. sometimes it can be a little abscess which is an infection. so whenever you find something like that on your pet you should definitely notify your veterinarian right away. i wanted to talk about the difference between doing a fine needle asperait. they tolerate it well. a little needle we try to draw out cells. a biopsy is actually more definitive. if we take a little tiny piece of tissue, we can see exactly what we're dealing with. >> you don't need to go to the

big event a little weather, a little jazz. only how roberta can do it. i think she is there now. ro, take it away. >> reporter: yes, hi, guys. we are here at satisfy sar chavez plaza. behind mere is the circle of palms and what you're looking at now is the main stage for the san jose jazz summerfestively. we are going to talk more about that. but we have some business first. a skyline view of the city of san jose where currently it is 75 degrees, otherwise we have temperatures pretty much in the 60s lining the rim of the bay into the 70s inland except livermore now at 80 degrees. now, let's get down to our pacific satellite imagery because you remember yesterday at this time we had the area of low pressure offshore? now it's onshore. it's exiting to the east. high pressure is building in. then we have the return of a vigorous onshore flow, the marine layer will return in earnest beginning tonight.

how does tha affect us? temperatures today nice and comfortable even slightly below average for this time of the year approaching 70 degrees in pacifica. 60s and 70s around the bay. 80s around the peninsula. up to 86 degrees in the warmest spots of our inland areas. a wet sea breeze up to 15 miles per hour. now, let's take a look at that extended forecast because what we're calling for is each and every day slightly warmer weather. the warmest day will be sunday. then by monday, we'll have slightly cooler temperatures as far as our typical averages are concerned. again, we are here in san jose where it is the annual san jose summer jazz fest. the executive director of san jose jazz festival is with me. tell me, we have done this every year. what makes this so special this year? >> hi, roberta. you this for being here. this year is fun. every 7-years the calendar happens on the first friday on our annual second weekend of august so we are taking over south first street as part of the south first street market
