and will a locker room sucker punch send a new york jets' season down in flames? quarterback geno smith is sidelined for weeks after a teammate breaks his jaw. this is the "cbs morning news" for wednesday, august 12th, 2015. good morning and thanks for joining us. i'm alison harmelin in for anne-marie green. this morning republicans are jumping all over hillary clinton's decision to hand over the personal e-mail server she used while secretary of state. this is an about-face for clinton. it came on the same day u.s. intelligence officials informed congress that top-secret information was contained on her private e-mail system. and in a dramatic political about-face, senator bernie sanders surged ahead of clinton in a just-released poll of likely democratic primary voters in new hampshire. sanders leads clinton 44-37 in the franklin pierce

university/"boston herald" poll. if these numbers hold up, it would set up an embarrassing loss for clinton in the nation's first primary. hena zan daniels is here in new york with more. good morning, hena. >> reporter: good morning. the home e-mail server in question will be handed over to the fbi as her tenure as top diplomat. now, as federal investigators look into the security of her private system, an intelligence community inspector told a congressional committee that at least two e-mails that traveled through the private server did contain top-secret information. hillary clinton has directed her team to hand over her private e-mail server. along with a thumb drive to the justice department. the development comes amid an ongoing federal investigation into whether the democratic presidential front-runner sent or received classified information on an unsecured system during her time as secretary of state. something clinton has repeatedly denied. >> i did not e-mail any classified material. >> reporter: on tuesday, a top intelligence official revealed

two of the e-mails that went through the server should have been marked "top secret." in a statement, state department spokesperson john kirby says, quote, department employees circulated these e-mails on unclassified systems in 2009 and 2011 and ultimately some were forwarded to secretary clinton. they were not marked as classified. republican presidential front-runner donald trump pounced on the news during an appearance on fox. >> did she commit a crime? yes. will they prosecute it? perhaps no. >> reporter: a recent cbs poll shows the e-mail controversy may be taking a toll on clinton's campaign. >> nationally, the trustworthiness and honesty numbers for hillary clinton are going down. but let's point out among democrats, they still do find her trustworthy and honest. >> reporter: clinton's camp says she will cooperate with the government investigation. and clinton's lawyer reportedly has given the fbi three thumb drives containing roughly 30,000 e-mails after the agency determined he could not remain

in possession of that classified information. now, the state department had previously said it was comfortable with her attorney keeping the e-mails inside his washington law office. alison? >> hena daniels for us in new york. thank you, hena. the issue of whether government secrets goes beyond's clinton use of a private e-mail system. on last night's "cbs evening news," scott pelley asked secretary of state john kerry if he thought the russians and chinese were reading his e-mails. >> it is very likely. it is not without -- you know, outside the realm of possibility, and we know that they have attacked a number of american interests over the course of the last days. >> kerry says he takes into account his e-mails may be hacked as he's writing. a just-released poll of republican iowa caucus participants paints a bleak picture for former florida governor jeb bush. in the suffolk university poll, donald trump holds a five-point lead over scott walker. bush is in seventh place with just the support of 5% of caucusgoers. bush tried to get back on track

by going after hillary clinton. craig boswell reports. >> reporter: gop presidential candidate jeb bush went on the attack against democratic front-runner hillary clinton during his speech at the reagan presidential library tuesday night. partly blaming her for the rise of isis. >> isis grew while the united states disengaged from the middle east and ignored the threat. and where was the secretary of state? where was secretary of state clinton in all of this? >> reporter: clinton's campaign accused bush of rewriting history in iraq. billionaire businessman donald trump took the stage in michigan for his first post-debate appearance. the front-runner in two new polls in new hampshire and iowa attacked bush on china, women's issues, and immigration. >> i think that jeb's answer the other day on women's health issues is a disaster. >> reporter: despite leading in the polls, iowa republicans gave trump mixed reviews for his debate performance. but other gop candidates vying for the white house have enjoyed a boost since last week. that includes retired

neurosurgeon ben carson and business executive carly fiorina. >> she's a fresh voice onto the scene. she's eager to go take on hillary clinton. >> reporter: ben holler of heritage action for america says primary voters will eventually have to decide whether their candidate can build the money and momentum to take on the democratic nominee. craig boswell, cbs news, the white house. the japanese coast guard says an american military helicopter has crashed. it went down off the eastern coast of okinawa. japan's defense minister says there were five crew members on board. three were rescued. a search is under way for two missing. the texas police officer who killed an unarmed black teenager at a car dealership was fired and could face criminal charges. the arlington police chief said officer brad miller made mistakes when he shot the teen who had allegedly broken into the dealership. j.d. miles of our dallas-ft. worth station ktvt reports. >> there is a vehicle on that property that has been broken into.

where the windshield was smashed in. >> reporter: that just-released 911 call came from the dealership where witnesses saw and security cameras captured christian taylor jumping on cars on the night he was killed. a night full of mistakes by rookie police officer brad miller. according to arlington police chief will johnson. >> i have found several decisions made on scene to be troubling. >> reporter: the chief laid out a time line that shows at 1:15, officers found the dealership's gate busted open. at 1:17, taylor is spotted by the five officers on the scene. but at 1:18 when officers discussed setting up a perimeter, officer miller violates policy by separating from his training officer and goes into the showroom. the unarmed teen reportedly charged and cursed at the officer who fired four times while his training officer fired his taser. >> we've got shots fired. >> this fear and feeling of isolation was the result of his

poor decision to enter the building without assistance and without an arrest plan. >> reporter: the chief's decision to fire miller surprised attorney and former police officer pete schulte who thought it was premature. >> there may have been a rush to terminate the officer. we certainly don't have the toxicology results back from the deceased, and i think that would have been a tell-taling sign of what actually happened in this case. >> the arlington municipal patrolman's association issued a statement last night denouncing the decision to fire officer miller. it said miller deserves the right to be judged fairly and completely on facts instead of a snapshot developed in only days. it was quiet in ferguson overnight. demonstrations marking the death of michael brown were smaller and calmer than earlier this week. st. louis police released this video they say shows the 18-year-old suspect who was shot by police sunday fight. police say it shows tyrone harris grabbing a gun from his waistband. minutes before he fired at police. harris remains in critical condition. a wildfire in northern

california has now burned at least 22 square miles and prompted a second round of evacuations. the jerusalem fire is just 5% contained. it started sunday about 100 miles north of san francisco and almost doubled in size overnight. residents had to evacuate for the second time in as many weeks. so far no homes have been destroyed. two rivers in colorado and new mexico that were contaminated by a massive toxic waste spill are starting to recover. more than 3 million gallons of mine drainage was accidentally released by environmental protection agency workers. the head of the epa says her department takes full responsibility. the pollution has flowed some 100 miles. colorado's governor says the mistake is unacceptable. >> our goal here is to really focus on what we can do to make sure that those mines where we know that we have a serious problem, how can we accelerate the remediation and make sure something like this never happens again. >> the rivers will remain closed for drinking water and irrigation for at least another week.

a young mississippi couple charged with trying to join isis have been denied bail. jaelyn shaun young and dakhlalla were holding tickets for istanbul. young's parents attended yesterday's hearing. dakhlalla's high school teacher says he's shocked. >> you've never had one that was so promising and so bright and just such a wonderful young man to have ended up on such a far side of the law as this. it's really -- it's really disturbing. >> the couple left farewell letters for their families saying they would never return. and coming up on the "morning news," a reality check for kim kardashian. the tv star is under fire on social media for posts about promoting a drug. and no crying over spilled beer. a truck overturns on a florida highway. this is the "cbs morning news." highway. this is the "cbs morning news." my moderate to severe chronic plaque psoriasis

a huge bud light truck crashed in florida spilling hundreds of beer cans on the highway. the driver lost control of the vehicle tuesday because he was distracted by his dog in the cab. there were no injuries, but it took three hours to clean up the beer cans and get traffic moving again. the suspension of brian williams from nbc news is over according to "the wall street journal." the former "nbc nightly news" anchor was suspended in february for fabricating a story about being in a helicopter that came under fire in iraq and about other news stories. williams will reportedly play a role in the remake of msnbc as it moves from daytime political programming to hard news coverage. and on the "cbs moneywatch," china devalues its currency for a second day in a row and kim kardashian's social media mess. jill wagner's at the new york stock exchange with that and more. good morning, jill. >> reporter: good morning. the chinese currency hit a four-year low this morning. yesterday's surprising devaluation of the yuan followed a run of poor economic data.

today chinese central bank officials assured financial markets it was not beginning a steady depreciation. a cheaper yuan will help chinese exports by making them less expensive overseas. u.s. lawmakers say that gives china an unfair export advantage. the price of oil fell to a six-year low yesterday on news that opec was increasing production. and the price of stocks on wall street declined as well. the dow lost 212 points. the s&p finished down 20. the nasdaq lost 65 points. the securities and exchange commission filed criminal charges against nine men accused in a $100 million wall street hacking scheme. they're accused of hacking into business news wires which release public earnings announcements. in one instance, they used inside information about panera to make $1 million in one day. it is the biggest scheme of its kind ever prosecuted. the ftc filed civil complaints about 23 other individuals and

corporate entities. kim kardashian is in hot water with the food and drug administration. the fda warned kardashian about promoting a prescription pill to treat morning sickness on her social media accounts. the posts carry a link to the company website, but the fda says the posts violate drug promotion rules because they don't mention side effects. by yesterday afternoon, the posts no longer appeared on kardashian's accounts. and it's reported that the company owned by mary-kate and ashley olsen is being sued by a former intern. the "new york daily news" reports the intern worked 50 hours a week for the olsens from may to september 2012, but she wasn't paid. the lawsuit claims the interns were misclassified as exempt from minimum wage requirements. alison? >> jill wagner at the new york stock exchange, thank you. straight ahead, jawbreaker. jets quarterback geno smith suffers serious injuries after getting punched out by a teammate. and later, thousands of plastic balls are dumped into the los angeles reservoir. we'll tell you why. ll you why.

canceled the rest of her current north american tour. she suffered a hemorrhaged vocal cord. she instagramed that she also has bronchitis and has been coughing a lot and that pushed it over the edge. trainor was scheduled to have stops including nashville, atlanta and chicago. a new record for highwire walker nik wallenda. the daredevil completed a 1500-foot walk on a wire ten stories above the wisconsin state fair on tuesday. wallenda has famously crossed niagara falls and holds nine guinness world records, but this was his longest walk ever. a locker room dust-up has landed new york's jets' quarterback geno smith on the injured list for up to ten weeks. smith had his jaw broken when he was punched by second-year linebacker ikemefuna enemkpali. they were apparently in a dispute over $600. he was immediately released from the team. head coach todd bowles says

a walmart truck driver had not slept in 28 hours before the accident that injured actor tracy morgan. the driver failed to slow down despite posted warning signs and was responsible for the highway crash in new jersey last year that killed another comedian. the national transportation safety board says driver kevin roper had driven over 800 miles overnight from his georgia home to start work. >> this crash demonstrates the potential consequences of even one poor decision regarding fatigue. >> the driver now faces criminal charges in the crash. police in pembroke pines, florida, north of miami are investigating a heartless crime involving a pet dog. fox, the 7-pound pomeranian, was found dead saturday behind the family's condo.
