university/"boston herald" poll. if these numbers hold up, it would set up an embarrassing loss for clinton in the nation's first primary. hena zan daniels is here in new york with more. good morning, hena. >> reporter: good morning. the home e-mail server in question will be handed over to the fbi as her tenure as top diplomat. now, as federal investigators look into the security of her private system, an intelligence community inspector told a congressional committee that at least two e-mails that traveled through the private server did contain top-secret information. hillary clinton has directed her team to hand over her private e-mail server. along with a thumb drive to the justice department. the development comes amid an ongoing federal investigation into whether the democratic presidential front-runner sent or received classified information on an unsecured system during her time as secretary of state. something clinton has repeatedly denied. >> i did not e-mail any classified material. >> reporter: on tuesday, a top intelligence official revealed

two of the e-mails that went through the server should have been marked "top secret." in a statement, state department spokesperson john kirby says, quote, department employees circulated these e-mails on unclassified systems in 2009 and 2011 and ultimately some were forwarded to secretary clinton. they were not marked as classified. republican presidential front-runner donald trump pounced on the news during an appearance on fox. >> did she commit a crime? yes. will they prosecute it? perhaps no. >> reporter: a recent cbs poll shows the e-mail controversy may be taking a toll on clinton's campaign. >> nationally, the trustworthiness and honesty numbers for hillary clinton are going down. but let's point out among democrats, they still do find her trustworthy and honest. >> reporter: clinton's camp says she will cooperate with the government investigation. and clinton's lawyer reportedly has given the fbi three thumb drives containing roughly 30,000 e-mails after the agency determined he could not remain

where the windshield was smashed in. >> reporter: that just-released 911 call came from the dealership where witnesses saw and security cameras captured christian taylor jumping on cars on the night he was killed. a night full of mistakes by rookie police officer brad miller. according to arlington police chief will johnson. >> i have found several decisions made on scene to be troubling. >> reporter: the chief laid out a time line that shows at 1:15, officers found the dealership's gate busted open. at 1:17, taylor is spotted by the five officers on the scene. but at 1:18 when officers discussed setting up a perimeter, officer miller violates policy by separating from his training officer and goes into the showroom. the unarmed teen reportedly charged and cursed at the officer who fired four times while his training officer fired his taser. >> we've got shots fired. >> this fear and feeling of isolation was the result of his

poor decision to enter the building without assistance and without an arrest plan. >> reporter: the chief's decision to fire miller surprised attorney and former police officer pete schulte who thought it was premature. >> there may have been a rush to terminate the officer. we certainly don't have the toxicology results back from the deceased, and i think that would have been a tell-taling sign of what actually happened in this case. >> the arlington municipal patrolman's association issued a statement last night denouncing the decision to fire officer miller. it said miller deserves the right to be judged fairly and completely on facts instead of a snapshot developed in only days. it was quiet in ferguson overnight. demonstrations marking the death of michael brown were smaller and calmer than earlier this week. st. louis police released this video they say shows the 18-year-old suspect who was shot by police sunday fight. police say it shows tyrone harris grabbing a gun from his waistband. minutes before he fired at police. harris remains in critical condition. a wildfire in northern

california has now burned at least 22 square miles and prompted a second round of evacuations. the jerusalem fire is just 5% contained. it started sunday about 100 miles north of san francisco and almost doubled in size overnight. residents had to evacuate for the second time in as many weeks. so far no homes have been destroyed. two rivers in colorado and new mexico that were contaminated by a massive toxic waste spill are starting to recover. more than 3 million gallons of mine drainage was accidentally released by environmental protection agency workers. the head of the epa says her department takes full responsibility. the pollution has flowed some 100 miles. colorado's governor says the mistake is unacceptable. >> our goal here is to really focus on what we can do to make sure that those mines where we know that we have a serious problem, how can we accelerate the remediation and make sure something like this never happens again. >> the rivers will remain closed for drinking water and irrigation for at least another week.

today chinese central bank officials assured financial markets it was not beginning a steady depreciation. a cheaper yuan will help chinese exports by making them less expensive overseas. u.s. lawmakers say that gives china an unfair export advantage. the price of oil fell to a six-year low yesterday on news that opec was increasing production. and the price of stocks on wall street declined as well. the dow lost 212 points. the s&p finished down 20. the nasdaq lost 65 points. the securities and exchange commission filed criminal charges against nine men accused in a $100 million wall street hacking scheme. they're accused of hacking into business news wires which release public earnings announcements. in one instance, they used inside information about panera to make $1 million in one day. it is the biggest scheme of its kind ever prosecuted. the ftc filed civil complaints about 23 other individuals and
