makovec. frank and maria are off today. kpix 5 reporter lisa chan live in martinez where emotions are running high. >> reporter: the contra costa county sheriff's department just held a news conference and they said that they are devastated by the loss of one of their own. yesterday carlos francis spent the afternoon with his friends on el dorado beach in south lake tahoe. all four why in the lake more than 100 yards offshore when his sister fell off the kayak. a friend helped her back to the kayak. as the friend swam back to his kayak, deputy franceies thought his friend was drowning. he jumped into the water to help the friend when his body went into shock and he drowned. ♪[ music ] >> the mood, um, around this agency we're all devastated.

we have lost one of our family members. he was well liked, well respected, hard working. and we are in close contact with the family to get through this. >> deputy francies was our colleague and friend. he was an outstanding person and professional. we are proud to say he was a contra costa county deputy sheriff and he will be missed. >> reporter: the flags are lowered in honor of the deputy. he has been with the contra costa county sheriff's department for 3 1/2 years. the sheriff's department says they have been in close contact with deputy francies' family and they plan to hold a memorial sometime soon. live in martinez, lisa chan, kpix 5. >> you can find out more on the life and death of deputy carlos francies on cbssf.com. a fire in oakland chased more than a dozen people from their homes overnight. it started at around 2:30 on international boulevard and 8th street just east of lake

merritt. everybody got out safely including two pet guinea pigs whom firefighters were able to rescue. when firefighters got there, they found flames shooting from that building and soon the fire jumped to another building. a charred staircase and soot covered debris is all that remains of the first building. four families, 17 people, were left homeless. one man said his story of waking up to see that fire and frantically alerting his family. >> i was sleeping and fire was burning around 2:20 or something. all of a sudden i had to wake up and i go to the window i thought i was dreaming. i went to the window, i saw, uhm, arrange flame like shooting up from my window. >> the red cross says it is now having a hard time finding hotels in the east bay for all those families. if the red cross can't find hotels to accommodate them, it says it will open a shelter. tragedy in yosemite national park where two children were killed by an oak tree. park rangers report the tree

fell on their tent while they were sleeping. the u.s. and cuba took a step toward normal relation this morning. the u.s. reopened its embassy in havana. an historic moment three marines raising the american flag standing next to the three marines who lowered it over 50 years ago. despite the new policies, there are some differences between the two countries. cbs reporter craig boswell explains from washington there is plenty of opposition to the obama administration's attitudes towards cuba here at home. >> reporter: not since 1961 has the u.s. flag flown over an embassy in havana. >> whoo! ♪[ music ] >> reporter: that changed today. >> for more than half a century, u.s. cuban relations have been suspended in the amber of cold war politics. >> reporter: secretary of state john kerry says the move makes it easier for the two governments to engage with one another. >> the leaders in havana and

the cuban people should also know that the united states will always remain a champion of democratic principles and reforms. >> reporter: cuban diplomats in washington have their own message from the american government: lift the trade embargos restricting tourism and business between the two countries. >> there cannot be normal relations between two countries when there are sanctions, economic sanctions, that damage the cuban people and damage even the interests of the american people. >> reporter: kerry said that the obama administration is in favor of lifting the embargo. but only congress can take that action and many there oppose it. >> he has made the argument that if the embargo hasn't worked for 50 years, why shouldn't we try something new? my question is, why hasn't he made a similar argument to the castros. >> reporter: senator rubio and others vow to block any move to lift the trade embargo as long as cuba continues to repress its people. craig boswell, cbs news, washington. >> and it could be sometime before the u.s. sends an

ambassador to its new embassy in cuba. congress also vowing to block the nomination of whoever president obama picks to fill the post. hot temperatures and winds are forecast for firefighters batting the "jerusalem fire" this weekend. it's now burned more than 24,000 acres in lake and napa counties. firefighters have made significant progress overnight. that fire is now 52% contained. 50 buildings though still considered threatened. loud noises coming from the tesla plant in fremont this morning. police got several phone calls about an evacuation alarm coming from the factory. tesla says a crane accidentally crashed into a power line there. pg&e fixed the problem and known was injured. tesla says most of their employees were moved to their palo alto offices for the day. now, in the meantime, tesla is offering its upcoming stock at $242 per share. the company says it needs that cash to help with the development of its model 3, which is due out in 2017.

police have made an arrest in a hit-and-run in santa clara where the car was also stolen. this is in the rivermark area on the north side of the city. police say just before 8:00 this morning, a car was stolen and the suspects tried to flee but they crashed. a monumental lawsuit filed in burlingame this week. a law firm there is suing the obama administration on behalf of 21 children across the u.s. saying the federal government violated their rights by causing climate change. >> these children believe that they have the constitutional right to a safe climate and that this government as well as prior governments have gone about to destroy the climate. >> the lawsuit wants the president to create a national plan to decrease concentrations of carbon dioxide to save levels by the year 2100. local law enforcement ramps

and your friend. >> this is kialana, my lab. and about a month ago, i sent out a shoutout to all the other nine siblings for their birthday and i got some grief about not mentioning her by name. so here she is. >> the question comes from one of our viewers who has an older dog who has some health ailments, doesn't go out very often. do pets at age 17-plus, need a rabies vaccine? i have two dogs arthritic, they rarely leave the house but their licenses are due soon. what do you think? >> in california, it's actually the law that all dogs are rabies vaccinated. there's no discussion. we as veterinarians can determine whether or not we can void that. sometimes for example young puppies are traveling from one state to another and they are under 4 months of age until we can say no vaccine but older dogs like this one that she is talking about as long as they are healthy and there's no reason not to vaccinate they

trafficking. >> reporter: technology is driving the boom. there's now a whole new generation of websites. sty viking, eros, lovings and slicksa with features like ratings, search filters and reputation management. >> one gets taken down another pops up. they are usually always ahead of the game. >> reporter: the most popular by far is backpage.com with tens of thousands of sex ads a day all over the world. but backpage is in the crosshairs of cook county sheriff tom dart in illinois who is trying to shut down the site saying backpage is enabling underaged prostitution and human trafficking. the company's attorney sent kpix 5 court documents saying it's a first amendment issue. quote, the constitution does not allow censorship by vigilante with a badge seeking to impose his views of what is or is not permissible speech. back here in santa clara county, the d.a. says they work with website operators to discourage human trafficking. >> sites that have not been willing to work with us are simply cites that we give more attention to them.
