camera has a lot of people talking this afternoon. kpix 5's cate cauguiran spoke to police who tell us their side of the story. >> reporter: this video has been viewed tens of thousands of times you can see san francisco police officers holding down a man near civic center plaza. >> oh my god. >> what are you doing? >> reporter: the woman who recorded the video says it's what officer -- it went 30 minutes and claimed this was police harassment. we checked in with san francisco police and officers say they didn't take him down but that the man fell. >> he was waving sticks around. and the 911 caller was concerned for the person's safety as well as the safety of others. >> reporter: the man had one prosthetic leg and claimed the sticks were his crutches. but police say they were in fact sticks but couldn't show them to us. >> he ran into traffic. and said he did not care whether or not he was going to be hit by a car. based on his actions we believed the sunt was under altered mental state and detained him. >> reporter: why were there 14

officers to detain one man? we asked police and they say the extra officers were there to keep the crowds back. >> you see in the video that he does attempt to bite and kick officers both of which are crimes. however, we thought it would be best again to take him to the hospital instead of arresting him for a crime. >> reporter: but the chief isn't taking this lightly. the department says they are investigating this incident and will request the full 30 minute video from the person who captured this as well as any other video that the public may have. in san francisco, cate cauguiran, kpix 5. >> the woman who shot the video was not immediately available for comment. but we will hear more from her on kpix 5 news at 5:00 and at 6:00. right now, crews are at the scene of a smoky two alarm fire in france's sunset -- san francisco's sunset district. the great highway market between 46 and 47th avenue caught fire just after 10:00 this morning. it's disrupted the muni line after sunset boulevard. muni is running bus shuttles in its place and no word on the

cause of that fire. new at noon, the family of a hostage shot and killed by stockton police last year is suing the department. the lawsuit filed today says stockton police officers used unreasonable force firing more than 700 times at the suv carrying the bank robbery suspects and hostage misty holt- singh. she was hit by ten bullets fired by police in the july 2014 shootout. a review of the incident also found police used excessive force in their response. for the first time in nearly a decade, u.s. soldiers are helping fight more than a dozen wildfires in the western u.s.. danielle nottingham reports from one of the largest fires in chelan, washington. >> reporter: firefighters released this video showing the ferocity of the washington fire hours after it sparked from a lightning strike on friday. at least 40 homes have been destroyed and that number is expected to rise as the officials survey additional

areas. still too dangerous to explore. this is the area along the lake that was hit the hardest. you can see what is left behind of these homes. the fire even reached the docks and boats. about 1,000 firefighters are working to keep the flames from spreading. but they are spread thin themselves. the washington national guard joined local fire crews sunday night. but for some homeowners, it was too late. >> and what room was that? >> reporter: the high school teacher rod cool lost his home of 14 years. >> all the kids that i've had and all my friends that were firemen, every one of them tried to come down here and put this out but they couldn't get here, the smoke was too thick and you know they all tried. >> reporter: conditions are so extreme across the west, some fires are creating their own weather. including this fire in idaho which sent flames shooting 100 feet into the air. for the first time since 2006 the pentagon is sending 200 active duty soldiers to assist

with western wildfires. danielle nottingham, cbs news, chelan, washington. >> and here in the bay area, the jerusalem fire in lake and napa counties is nearing full containment but there are 19 other wildfires burning in the state. san jose police say the man they shot and killed last night was a suspect in a murder and there's another suspect on the run. kpix 5's kiet do with a message police have for the wanted man. >> reporter: crime scene technicians were out here in east san jose all night long, police finally wrapped it up here after spending fennel hours at the scene. we pick up this story with some dispatch audio recorded last night about a police chase. >> okay we have shots fired. suspect has a female occupant in the vehicle, per our last information -- [ inaudible ] i'm at 37th -- third haven court. got shots fired and one suspect down. >> reporter: and of course 187 is police code for homicide. now investigators believe the man they shot dead last night was about to kill the woman who was in the car with him.

s.w.a.t. officers have been following the man for some time and he had a warrant for his arrest. and in connection with a grisly homicide last week. the police say the man realized he was being followed by police and led them on a chase back to his home on kirk haven court where he crashed his car. investigators say he jumped out of the car and took off running. when the man appeared to reach for his waistband the officer opened fire and killed him. >> the officer is chasing the suspect and the suspect reaches for their waistband area. the officer fires his weapon. shoots the suspect. and he was pronounced dead at the scene. >> reporter: that was last night around 7:00 p.m. the day before on sunday night, police have shot and killed another suspect who they say was an accomplice in last week's homicide on lundy avenue. now san jose police say they have surveillance video of the incident on lundy avenue that shows three gunmen terrorizing the victim before killing him and they say that video is horrific. that means a third and final suspect is still on the loose.

san jose police have a message for that man -- they say call a lawyer. call family or friends. even call the media. but get it done and turn yourself in. in east san jose, kiet do, kpix 5. more charges could be coming for the man police say was driving drunk in el sobrante sunday night and caused a crash, justin gardener was speeding when he sideswiped another car on san pablo dam road. his camaro burst into flames after slamming shoo a tree. he was thrown from the car: he survived and his three passengers one man and two women all in their 20s died at the scene. well, turns out yesterday's 4.0 quake did cause damage in the bay area. east bay mud says the tremor broke nearly a dozen water lines and half of the broken cast iron pipes are year the -- near the quake's epicenter. crews made repairs overnight. that quake hit just before 7:00 a.m. yesterday. tonight, family and friends and the community will gather

75,000 views on youtube. and by the way, if you want to know that seal got away. ford is recalling thousands of its trucks because of faulty seat belts. ford says the front passenger and center seat belts may not be anchored in the correct spot and that could increase the risk of injury in a crash. the recall covers f 650 and f 750 pickups from 2011, 2013 and 2015 model years built in mexico from february 2011 through april 2015. the company says so far, there have not been any reports of crashes or injuries because of the problem. the fda is deciding whether to approve a pill being called the female viagra. it would be the world's first drug designed to boost a woman's sexual desire but the pill is not without risk. >> have some tea? >> reporter: sherry mike is happily married with children. but the 34-year-old says she has no desire to be sexually intimate with her husband.

and then as the night goes on, the clouds just go deeper and deeper all the way into the central valley before retreating to the shoreline later in the day. so to sum it up as we look live over san jose, and you can see some of that cirrus up there. up top. you can send in the clouds on this forecast. cool to the upper 80s inland. and continue mild right through the weekend. hey the a's are taking on the dodgers tonight. the forecast is for mostly cloudy skies with the low clouds coming back in. and game time temp of 66 degrees. sunset's tonight at 7:at p.m. and comes up tomorrow at 6:29. temperatures come down but still very pleasant. 70 degrees in san francisco. 76 at oakland and 85 degrees in san jose. and down in the south bay, look for numbers to be mostly in the low to mid-80s. 83 for san jose and 86 for morgan hill today and 83 at los altos. inland, we manage only 87 degrees. at pittsburg. 87 for fairfield and north bay
