bay area communities in the line of fire. tonight, how the wildfires in the west are putting a strain on resources here at home. good evening, i'm juliette goodrich. >> i'm brian hackney. kpix 5's christian hartnett is live in san leandro where the alameda county fire department has been busy this summer. >> reporter: they are one of the many local agencies with firefighters and fire engines out in northern california near fresno battling fires away from home and it isn't even considered peak fire season right now. but cal fire says this summer has proven to be one of the more difficult summers across the state when it comes to wildfires. a lot of help has been called. as of yesterday, 12,000 firefighters were battling 17 wildfires in california. half called in from fire districts across the state. alameda county fire says it's all hands on deck during these times. >> so we're daily evaluating

our capability, we're going to take care of our homes, communities and the state of california. sometimes we have maxed the department and we have to protect here and take care of our personnel. >> reporter: many agencies have limits on the amount of resources they can send out. alameda county fire, for example, has about 17 firefighters dispatched across the state to help fight wildfires right now. and their limit is somewhere around less than 30 firefighters. plus agencies and firefighters from out of the country are even helping battle fires across the western united states right now. firefighters from australia and new zealand have even been called by the u.s. forest service to help. live in san leandro, christian hartnett, kpix 5. the "tesla fire" east of livermore is 85% contained tonight. it's burned 2700 acres since wednesday. and the "jerusalem fire" in lake and napa counties is 98%

contained. that 25,000-acre fire destroyed 6 homes. all evacuations have been lifted. a sacramento man who tackled a shooter on a crowded train is out of the hospital tonight. spokespersons stone an off-duty -- spencer stone an off-duty serviceman was slashed on the hand and back. president obama called him today to comment him for his courage along with the two buddies he was traveling with. one is a fellow service member from oregon. the other is a student from sacramento. meanwhile, mark kelly shows us we are getting a clearer picture tonight of how the terrifying events unfolded on the train. reporter: these are the moments just after passengers scared for their lives took down the suspected gunman before he could kill. take a look. the suspect face down on the train, hands and feet tied. >> he went unconscious, i think. >> reporter: these three men tonight heroes, helped stop the shooter from left to right americans anthony sadler from pittsburg and now a senior at sacramento state.

alek skarlatos who served in afghanistan plus british businessman chris norman who jumped in to help american spencer stone tie down the gunman. >> he cut spencer behind the neck. he nearly cut his thumb off. spencer held him and we eventually got him under control. >> reporter: stone, an air force serviceman also from sacramento, was seen here leaving the hospital for a hand injury having been the first to risk his life and tackle the gunman. >> reporter: if anybody would have gotten shot it would have been spencer. >> reporter: the three americans, friends, were enjoying a summer trip in europe when a gunshot rang out on their train ride from amsterdam to paris. spencer tackled the suspect and alek wrestled the gun away. the mothers are grateful their sons will be coming home alive. >> when i talked to spencer, he said, i would have been killed if it wasn't for alek. >> i talked to alek and he said the same thing. if it wasn't for spencer i'd be dead.

>> reporter: french investigators have not confirmed investigators haven't confirmed the suspect identity but he is believed to be a 26-year-old moroccan with ties to radical islam. french officials can hold him for the next 96 hours. mark kelly, kpix 5. >> a facebook page is set up to pay tribute to the three americans. the person who created it said this page is about these three guys restoring my faith in humanity. the page picked up over 1,000 likes in just a few hours. san jose police are looking for a driver who hit and killed a man and took o the victim a man in his 60s was found dead this morning near king and story roads and nobody saw the car that hit him. meanwhile, police in petaluma say look at these two. they are suspected of using a stolen credit card to buy $15,000 worth of gift cards at the target store on kennilworth drive yesterday. police say that they may be driving a black suv.

and the city of san francisco is taking a new approach to fighting graffiti. suing the vandals to cover the costs. they are starting with a woman who calls herself cozy terry. she is accused of defacing city property all over town. the city says as the property owner it should be allowed to seek damages, in this case $54,000. a judge will have the final say on whether the case can proceed. school leaders in san jose state are making sure students return to a healthy environment. all tobacco products and ecigarettes are banned from campus. the change comes after a big push from students in a referendum last year. 80% of the students said they supported the ban. campus police are issues warnings to offenders this semester. after that, they will face a fine. excitement and jitters high today on the cal campus in berkeley as thousands of freshmen moved in. classes begin this coming wednesday. carts were loaded with all the

donald trump has a new target in his battle over immigration. facebook's ceo mark zuckerberg. trump wants to curb the work visa program that has helped bring thousands of engineers to silicon valley. zuckerberg is part of a group of executives who want to increase the number of work permits. florida senator marco rubio who is also running for the gop nomination is pushing a bill to do just that prompting trump to refer to him as zuckerberg's personal senator.

zuckerberg's pro immigration advocacy group released a statement calling trump's proposals absurd. many bay area cities have been trying to figure out how to handle short-term rentals like "airbnb." sharon chin tells us one town is handling "airbnb" by saying, no. >> reporter: if you are planning to rent a place in tiburon you have fewer options starting in the fall. the town council voted 3-2 to amends an ordinance and ban people from renting out their property for less than 31 days. that's good news for cliff and nancy, who aren't happy with the growing number of vacation rentals over popular websites like "airbnb" and others. >> i just think that this type of neighborhood, this community, that it is kind of private. >> reporter: in tiburon, 5 homeowners are registered to rent their properties short term. three more homeowners applied for permits but neighbors objected with complaints like these. >> just have a lot of traffic in and out and often it adds to

the traffic problem they already have in tiburon and belvidere. >> more bedrooms you have, the more couples come in, the more people come in the individual parties come in. >> reporter: but matt shakes his head. >> just to get short sided -- i just think it's short sighted from people that are -- don't understand how the "airbnb" rental community works. >> reporter: matt rents his two- bedroom houseboat in sausalito when he is out of town. with sausalito and now tiburon passing rental restrictions, matt says the county is closing its doors on a great opportunity. >> i think there's people that come here from all over the world to see marin county because it's beautiful. >> reporter: the ordinance banning short-term rentals will take effect in october. in tiburon, sharon chin, kpix 5. >> well, business is booming at the port of oakland. in fact, it's so busy, some shippers want to start working weekends to help clear the growing backlog. at least four shippers want to open the gates to truckers on

saturdays. that would require approval from the federal maritime commission. and terminal operators need to make sure they have enough hands on deck to make it happen. if it all works out, saturday hours could begin later this year. the dallas cowboys are headed to the bay area to play the 49ers tomorrow but some of their stars, cowboys, not the 49ers, may opt not to take the field. it's the latest issue in a series of turf troubles at the new stadium. the turf was replaced -- why are we seeing taylor swift? it was replaced after her concert last week. the cowboys will test it out buffalo game. jerry jones suggested some starters will sit out if it's not safe. kpix 5 is your preseason home for 49er football. our coverage starts tomorrow at 4:30 with the 49ers preview and kickoff is at 5:00. it is 15 feet tall and comes with its own missile launcher. the bay area robot gearing up for an epic battle across the

with a robot from japan. this is no joke. one arm is a missile launcher. the other is a cannon. the creators want to eventually build a whole league of gladiator robots. >> we just want to have a giant fighting robot sports league. we want to realize that vision of huge robots battling each other. on top of that, we do want to prove to people that this can be done. >> the mark 2 weighs 12,000 pounds and costs about $200,000 to build. the battle with the japanese robot is supposed to happen next year. >> the battle of the titans as we go outside in the bay area today. a lot of people went outside in palo alto a fine day to hit the festival of the arts in palo alto. they do that annually. it attracts about 150,000 people with 300 different arts and crafts, booths, and you couldn't ask for finer weather. it's so much fun. and then after awards, at the
