steinle's brother shares his grief and the need for change. good afternoon, i'm maria medina. >> and hi everyone, i'm frank mallicoat. the family announces plans to sue. kpix 5's cate cauguiran live at city hall with more on who they're holding responsible for their daughter's death. cate? >> reporter: well, frank, they're holding pretty much everyone responsible in the death of kate steinle. the family really unwavering in their fight to make sure what happened to kate does not happen again. together the family stood on the steps of san francisco city hall and hand in hand as they announced plans to file a lawsuit against who they believe is responsible for the death of kate steinle. that includes san francisco sheriff ross mirkarimi. the bureau of land management, her brother brad said he and his family felt that the system had failed his sister. and that no one has taken responsibility. >> we're here to make sure that a change is made so nobody has

to endure pain that my mom and dad and i go through on a daily basis. because this system failed our sister. and at this point, nobody has taken responsibility. accountability, and nothing has changed. >> reporter: kate was shot and killed july 1st walking down pier 14 with her father. undocumented immigrant francisco sanchez was behind the trigger. the family was up here and kept stressing they were tired of everyone pointing fingers at one another and it's about time that someone took responsibility. reporting live from san francisco's city hall,carecare, kpix 5 -- cate cauguiran, kpix 5. >> thank you for that and so far no comment from the sheriff about the suit. and an early morning fire in san jose damaged a garage but now more than a dozen people are are looking for a temporary place to live. kpix 5's kiet do explains why

there were so many tenants in one home. >> reporter: if you want to set a against -- get a sense of how bad the housing situation is in the bay area, then look no further than 502 drive in east san jose. around 5:00 this morning, a fire broke out in the garage. the smoke alarm wept off and everybody got out okay. all 13 people. are you seeing multiple families living inside one house? >> it happens quite often. i don't know -- the statistics and i can't speak to that but yes it happens quite often. >> reporter: the house has a couple of bedrooms for the extra tenants and a family of seven, a second family of three, and a couple more individuals some of whom are elderly. >> sure i would say it's typical for like our community. our beautiful community where we need all the people to -- for a place to stay coming from you know, our friends, family. et cetera. >> reporter: the red cross will help tia lee find a temporary home for the next few days.

>> get the hotel and we don't know yet. >> reporter: how a though tell? >> maybe. -- hotel? >> maybe. >> reporter: growing up i can tell you this kind of living arrangement not unusual at all. and given how expense i it has goen to live here -- gotten to live here, the type of arrangement is becoming more common. in fact the owner of the house tells me she charged the other family $600 a month to live here. the homeowner says her husband died a few years ago and now she helps out fellow vietnamese families by giving them a place to live that's affordable. >> i'm not -- i get a lot of money from things like that. and i just want to share. i don't want to like -- business. not that business. >> reporter: you're not trying to make money. >> no. >> reporter: in east san jose, kiet do, kpix 5. >> firefighters were able to put the fire out within 40 minutes and no one was hurt. a uc berkeley student has been diagnosed with measles. prompting concerns others may have been exposed to that

disease. university and the city of berkeley are trying to identify and test anyone who may have had contact with that infected student. that student is now in isolation but attended classes last week and also rode the ac transit 25 bus line on monday of last week. health experts say the measles virus can live for up to two hours in a space where the infected person coughed or sneezed. >> that does not sound good. buses are pretty small spaces. i hope no one else gets sick. >> the symptoms include rashes and fever and they can develop one to three weeks after the exposure. well, some bay area kids just got a head start on saving for college. congresswoman pelosi and city leaders visited san francisco's monroe elementary school this morning. they announced that every kindergarten student in san francisco's public schools will get a savings account with $50 already deposited. the program is called the kindergarten to college program. >> it's more than just a $50

start. because when people enroll in school lunch program, they get another matching incentive. when they, the parents, put money into the account, there's another incentive. >> mayor lee says it has proven its success. families have saved more than $1.3 million as part of the program. students have returned to classes at a school damaged by a fire. a los gatos teen is confessing to setting the fire at the loma prieta elementary school but he says he did it it was an accident. the 17-year-old tome think and some friends went to the school late sunday night to smoke pot and they lit a cardboard box to keep warm. he put the ashes in a trash can which caught fire and spread to the school. damage estimated at $1 million. no word if the teen will face any charges. and investigators are looking whoo caused a fire that damaged three homes in san francisco. started around 8:30 last night on clayton street. the fire department says five people were at home at the time. one man was brought to the

hospital. his injuries unclear but he was able to walk out on his own. san jose police are investigating a stabbing that left one man dead. the victim was found last night near center and story roads. s a at the former homeless encampment known as the jungle. the man's name hasn't yet been released. at this point, there's no word of any suspects or a motive. the cameraman gunned down on live tv in virginia was laid to rest today. hundreds attended the funeral in roanoke this morning for adam ward. his brother and sister told mourners while the death is devastating. they've laughed more than cried about their brother's memory. a gunman shot and killed ward and wdbj reporter alison parker last week during a live interview. the woman being interviewed was also shot. she remains in the hospital. finding an affordable plus to live can be a -- place to live can be an impossible task here in the bay area. today the san jose city council will consider a plan to help out renters. among the ideas for their proposed apartment rent

ordinance, they would reduce allowable rent increases to 4% a year. city is also looking at a good cause eviction rule to protect the tenants. rising rent has forced many to move out of san jose and into outlying areas with long commutes and landlords and property owners argued the money is use for maintenance and upkeep. current city ordinance doesn't allow rent control on any buildings built after 1979. >> we are not doing enough to make sure there's affordable housing for everyone, our homeless population is far too large. >> city council will be voting on a city staff report. if it passes staff will start running the numbers to see if it will work for everyone and some kind of change to the law could come as early as december of this year. today's meeting by the way begins at 1:30. you still can't legally get a lyft or uber ride from mineta international airport: starting today they can pick up passengers only if they agree to rules similar to cab

the atlantic city air show was set to begin in new jersey tomorrow despite a string of deadly air show accidents, a couple of days ago a plane crashed in austria killing the pilot. and last week a pilot crashed and died while practicing for the new york air show. the organizers of this year's new jersey air show says fan safety is the most important part of every event. prepare for plenty of traffic this labor day weekend. the lowest gas prices in more than ten years are expected to put more people on the road. a little angry too. aaa estimates 35 million americans will get behind the wheel to celebrate the long holiday and don't forget here in the bay area the transbay tube is closed from midnight friday to 4:00 a.m. tuesday. >> how about the weather that weekend? it's going to be hot and hot the rest of the beak i guess huh? showily. we cool down today. and we'll have some cooler temperatures midweek but as you were alluding to frank, we have a warmup just in time for the

holiday. weather watchers, they're out there on this lunch hour checking in with us. it looks like we have a temperature span of about 75 to 82 degrees at this time. in fact, it's 82 for the warm spot at this hour in san ramon in the east bay according to brian. all these folks that are joins us for this lunch hour have been reporting we have nothing but clear skies out there. picking up a bit of a breeze this afternoon. and antioch jerry says winds are up to about 8 miles per hour. and in fact as we take a look at the golden gate bridge at this hour, the flag has been on the fly. can you see it there? just top of the corner of the tv screen. we have some lingering clouds all centered with the deepening marine layer. low clouds bill of lading, even -- patchy fog, even a little bit of drizzle early this morning. temperature in san francisco at this lunchtime in the mid 60s. there you have the enhanced marine layer. it's going to take a while to push away from the immediate seashore. meanwhile, we have an area of low pressure to the north of us and that's bringing us some cooler air mass aloft. this is the scene with that cooler air mass.

you have visibility unlimited at lick objects tour in the santa clara valley. -- lick observatory at santa clara valley. this is the view from -- the university of california and berkeley. gorgeous scene today. breezy sea breeze later this afternoon. out of the west 10 to 20 miles per hour. here's the low pulling down that cooler air mass and enhassing that -- enhancing that marine layer. therefore west wind at 15 and meanwhile you can see the hurricane action out over the eastern pacific. we will have high pressure building in diverting any kind of clouds for the weekend but speaking of the pacific, boy we made history this weekend when we had three category 4 hurricanes very powerful on a scale of 1 to 5. out over the eastern pacific lined up at the same time. now the hawaiian islands are buying a break today with ignacio veering away from the islands still brushing it with some gusty winds to the east and the south of the island. meanwhile it should be out of here within the next day. making the path for jimena and we'll watch that closely.

couples. >> under whose authority? >> god's authority. >> reporter: davis says she will not go against her religious beliefs. >> you do not understand what you're doing to people. >> reporter: engaged couple david and david were denied a license tuesday morning. this is the fourth time davis has turned them away. >> we're talking about the law now. this isn't about belief anymore. i have beliefs too but i would never impose my belief on someone else's right. >> reporter: outside davis' supporters cheered her on. >> god's law -- man's law. >> reporter: monday evening, the supreme court declined to intervene in the case. >> does kim davis have any legal ground to deny licenses? >> it's still an emotional issue but there's no legal issue involved once the supreme court has spoken. >> reporter: kim davis could face jail time for refusing to comply with the law. davis says she is aware of the consequences. craig boswell, cbs news, the supreme court. u.s. district judge bunting who has ordered davis to issue the licenses has scheduled a meeting with her attorneys

later today. he will also talk with the attorneys for the couples who are now suing davis. pope francis made a major change in the way that catholic church treats women who have had an abortion. the vatican announced today roman catholic priests will be allowed to absolve women who've had abortions if they seek forgiveness during the upcoming holy year of mercy which is next year. until now a woman who's had an abortion and those who have helped with abortions were excommunicated by the catholic church. professor obama? it could happen at the president's alma mater after he steps down in 2017. columbia university's president says he would welcome back mr. obama and reporter who covers the obamas says a return makes sense. >> new york retains a warm spot for president obama and if t first lady -- the first lady. they see themselves teaching perhaps together at columbia university. >> we shall see. the white house right now is trying to tamp down speculation
