your realtime captioner is linda marie macdonald. the russian river is open to swimmers this warm labor day weekend. but there's a danger in the water. good evening, i'm brian hackney. >> i'm juliette goodrich. it's toxic blue-green algae and warning signs are up for people to keep their pets out of the water after a dog died. but as mark kelly tells us, the slime can also be unhealthy for children. >> reporter: no toxic algae is going to keep these boys from swimming on a holiday weekend. you guys know about the blue- green algae. >> oh, yeah. but we just -- it's okay. >> i read about it and, like, people told me it's mainly

about dogs and stuff. i don't know. i didn't really read about it. >> reporter: health officials started posting these signs up and down the russian river. they are most concerned about kids and pets because they are more likely to unknowingly swim in the toxic algae blooms and drink the dangerous water. and, in fact, this 3-year-old golden retriever died last weekend after a swim here. >> an animal that's affected by this toxin will start to be a little bit uncoordinated. the muscles won't work so well. >> reporter: the deputy health officer, karen holbrook, says the river is safe to adults. but with a few key rules. don't drink it. and stay out of the shallow standing water where toxic algae likes to grow. >> but moving water that's clear, we feel is safe and people can be there. >> reporter: so what's making this toxic algae? it's a combination of the drought and the hot summer heat. >> definitely the pre- conditions that set up blue- green algae growth.

>> reporter: these guys say they are careful, have been swimming in this water for weeks and never got sick. but others more reluctant to take a dip. tell me this, would you swim in that river? >> no! >> reporter: in healdsburg, mark kelly, kpix 5. >> this is the first time blue- green algae has shown up in the russian river. well, once again, the transbay tube is closed to commuters this weekend. it's the second and final closure for a bart repair project. crews are replacing a key section of aging tracks near west oakland. it's the same work they started back in august. crews will also be grinding the track inside the tube to make the ride quieter and smoother. no trains will travel between san francisco and the east bay the entire holiday weekend. but bart is providing free bus rides to and from san francisco. commuters we talked to say it sure takes the stress out of things. >> it's great. i'm glad you guys are doing this because it makes it that much easier to get a little exercise in as you park and

walk. and it don't hurt that it don't cost. so that's great, too. >> buses will be running all the way through the closure, which ends tuesday morning at 4 a.m. well, adding to traffic complications, tonight billy joel is playing a concert at at&t park. the show begins at 8:00. the san francisco bay ferry is adding a service to help get concert-goers there. ferries go from alameda main street and oakland jack london square terminals. another traffic alert for san francisco commuters. van ness avenue between geary and post is closed all holiday weekend. crews will finish up construction on a tunnel for a new hospital. the street was closed a few times in april when the work first started. there will be detours for drivers and buses will still be allowed in the area. a humanitarian crisis is reaching epic proportions in europe. tens of thousands of refugees are fleeing the conflict in syria, iraq and afghanistan for safer ground.

many walk for miles carrying children. the situation chaotic. it's even been deadly. countries in europe are facing a major challenge as they try to figure out how to manage the mass influx. today thousands finally reached their dream destination of western europe after austria and germany agreed to accept them but as wendy gillette tells us many more are still on the way. >> reporter: hundreds of refugees in hungary are walking to a new home in austria or germany. >> hungarian government doesn't let us to get the train or buses or anything. we walk to austria, then maybe germany. >> reporter: one woman making the journey held a sign that said, we apologize. luckier refugees arrived in munich by train and headed to temporary shelters. thousands have been trapped in hungary as the country tries to deal with a crisis of migrants pouring over the country's southern border with serbia. hungary's anti-immigration prime minister says he wants to

security border to stop the flow. [ non-english language ] >> reporter: he said he thinks europe is underestimating the size of the crisis. there was no violence saturday. only some pushing in budapest as migrants got on a train to vienna and scuffles on the island of lesbos in greece while those are being held in a gated area. >> i left everything behind, my family, my home, my mother, my sister. just i want to live my life in peace. >> reporter: austria and germany have agreed to take in the refugees from hungary but government officials say hungary needs to do more to make sure the migrants apply for asylum there before traveling to other countries. wendy gillette for cbs news. >> the image of a syrian boy who drowned and washed ashore sparked outrage. the boy his brother and mother drowned when the boat they were in capsized during an attempt to flee turkey. today that boy's aunt says she hopes to bring the rest of her

family safely to canada. kim davis the county clerk in kentucky who refused to issue marriage licenses to same- sex couples will spend the rest of her labor day weekend in jail. but as don champion shows us, hundreds are coming to her defense saying, let her out. >> we love, sister kim! if you can hear us in there! >> reporter: protestors carried signs, prayed and sang outside of the jail where rowan county clerk kim davis is being held as an inmate. a federal judge sent davis to jail thursday for contempt of court for repeatedly defying his orders to issue marriage licenses to same-sex couples. she believes gay marriage is a sin. >> judges don't make law. so there's nothing for them to enforce by keeping kim davis in jail! >> reporter: her defenders like john traveled from several states to show their support. >> she is standing up for what she believes. she knows as a christian she is to uphold her oath and

responsible first to god. >> reporter: two men received a marriage license friday from one of davis' deputy clerks. >> i would just hope that she will have a change of heart and realize that she can love people and treat people equally and that our rights do not, um, infringe upon her beliefs. >> reporter: davis' lawyer says the clerk will spend the holiday weekend in isolation reading the bible. don champion, cbs news. >> and davis' lawyer also said davis has a clear conscience and is prepared to stay in jail. still ahead, a warning for parents whose kids are back in school. why they should be a little worried about head lice. >> also new information tonight in the hillary clinton email drama. tonight we learned who set up,,,

word has probably reached you that it costs a lot to buy a house in california. that's apparently why a lot of californians have been moving to other places like portland looking for cheaper houses. it's no secret oregonians don't like it. oregon realtor says that somebody has been putting these stickers on sales signs all overtown, a california silhouette with a red slash through it. not very welcoming. it's the old story. portlanders are apparently upset that out of state buyers

are swooping in and, yes, driving up housing costs. tonight, the drama surrounding hillary clinton and her emails from when she was secretary of state has reached another level. andy rose tells us the new information out today about who set up the server and who paid for it. >> the facts are the facts. >> reporter: the clinton campaign says the democratic presidential candidate and her husband former president bill clinton personally paid a state department staffer to install their private email server. clinton told reporters in new hampshire saturday -- >> we obviously paid for those services. and we did so because during a period of time, we continued to need his technical assistance. >> reporter: hillary clinton used the server to communicate while she was secretary of state. she is facing growing criticism that using a private server to send official emails was improper. >> that's something that no reasonable person in government does particularly in a job where you're dealing with a lot of confidential information.

>> reporter: according to clinton's campaign, brian pagliano set up the serve your under an arrangement that no taxpayer dollars would be used to install it. he was also retained by the clintons to manage the system once it was in place. clinton says she is sorry for all the confusion the arrangement caused. friday she told msnbc. >> my personal email use was fully above board. it was allowed by the state department as they have confirmed. um, but in retrospect, it certainly would have been better, i take responsibility, i should have had two accounts. >> reporter: both congress and the justice department are investigating whether classified information was emai through the server. clinton's political rivals are using the issue to dig in. >> by reading the kind of information you know that it has to be classified. >> reporter: i'm andy rose reporting. >> emails of sent through clinton's personal server have retroactively been determined to contain classified information but it's not clear if those emails were known to be classified at the time they

a health warning for parents, your children could be bringing home head lice. the bugs this year are not responding to over-the-counter treatments including the common treatment. people are already noticing a change. one woman owns a lice removal

salon. >> i found a luose on her. it's big. >> they naturally develop a resistance. >> doctors stress lice are not dangerous and do not transmit diseases. they advise parents to remind your kids not to share hats, combs or brushes. there's no sign tonight of a blue whale spotted tangled in a fishing net off the southern california coast. the massive 80-foot-long creature was spotted near santa catalina island yesterday swimming and spouting. but if it doesn't get freed there's a chance it could die. searchers have been looking but haven't seen it. they think it went south toward baja "the late show" with stephen colbert kicks off tuesday night right here on kpix 5. our own ken bastida sat down with him in los angeles to get some insight as to how they put the show together. >> we make each other laugh and then at the end of the day i have the privilege and responsibility of translating that over a television screen

as a result there's a rip current hazard so high surf and sneak sneaker waves especially along west and southwest facing beaches. so be careful. the numbers mostly in the 80s inland. 85 degrees still at concord. 78 at san jose. 82 in santa rosa. here in the city right now 70 degrees. high pressure builds in from the pacific northwest. that low pressure gets booted out so we increased about 8 degrees today in some spots over yesterday's readings and it will be even warmer tomorrow. so midweek temperatures will be near 100 inland by tuesday and wednesday, things will be warming up in the bay area. futurecast shows not much in the way of clouds. a few high clouds will sneak into the top part of the frame or to the north bay and the bay area by 7:00 tomorrow morning and that's about it. there's not a whisper of low clouds out by the shoreline so not a bad beach weekend. here's proof. as we look from high atop the cliff house south along ocean beach, warming trend will continue, highs near 100 inland by midweek and it will be warm

through next weekend. all right. a few things happening around the bay area. if you are going to the billy joel concert 66 degrees tonight at 8:00 . sausalito art festival all weekend through monday 80 degrees there. the millbrae art and wine festival would be fun this weekend downtown millbrae 79 degrees for tomorrow. heading out of the bay area though, down 99 to fresno, 93 degrees there. 78 at yosemite and 76 at lake tahoe. 95 for redding. here's the numbers in the bay area. we'll look a little above average tomorrow. but that's just one step toward a much warmer direction as we head toward midweek. tomorrow santa clara 86 degrees. still pleasant in san jose at 87. morgan hill is getting dangerously close to 90. 5 at milpitas. -- 85 at milpitas. 87 brentwood tomorrow. 91 livermore. 90 pleasanton. 90 concord, pittsburg, danville. 83 vallejo. up in the north bay tomorrow plenty of sunshine not a bad day to head to stinson beach
