>> live, from the cbs bay area studios, this is kpix5 news. >> he was caught on camera kicking and punching a rival fan in a brutal brawl outside levi stadium. but tonight, the guy in the number 80 jersey says he was acting in self-defense. good evening, i'm juliette goodrich. >> and i'm brian hackney. only on 5, our sharon chin sat down with the suspect in a jailhouse interview today. >> reporter: when he saw himself in the interview, he says what was i thinking? but it doesn't show the whole story. in the video, eric martinez is wearing the number 80 niners jersey. he is seen kicking and punching the fan. >> i wasn't there to fight

anybody. i was trying to go home. that is then this incident took place. >> reporter: the 30-year-old san jose father says the video didn't show the man's aggressive behavior between two women, a child and himself moments before. >> one lady fell over the railing. >> because he hit her? >> he pushed her. there was a child there. you are trying to get to your car. but when you are getting swung at, a guy hits me in the face. he's a big guy. >> reporter: martinez says he had a few beers and should have walked away. >> i know i was wrong. i was at fault for it. >> do you think you were excessive? >> i was overexcessive, yes. >> reporter: he apologizes to the victims, the security who tried to break up the fight, the fans, and the nfl. >> this was one bad evening that turns to the worst. and i want to apologize. >> reporter: martinez says he didn't know the other suspects in the assault case. two men and an underage girl. he says monday's niner game at

levi stadium was his first as a fan. when the stadium opened he worked in the concessions stand. he is set to graduate as an emt in january, but now. >> my career, my life is in jeopardy now. >> what could you do if you did it over again? >> i would look for help. i just wasn't thinking. and i reacted instead of thinking. >> reporter: martinez says he wrote a letter apologizing to the victim and gave it to the police. live in the news room, sharon chin, kpix5. >> officers say the 35-year-old victim and the security guard will both be okay. the suspects are expected to be arraigned on monday on assault charges. two men are in the hospital tonight after gunfire erupted on a bay area freeway 4:30 this afternoon at the 280, 101 split in san francisco. it shut down the busy interchange for nearly two hours. drivers who got stuck could do nothing but wait.

police say two men in one car shot at two men in another car. one man was hit in the torso. the other, in the head and neck area. no word on their conditions tonight. the suspects took off down 101. police are still looking for them. here tonight, ambulances flooded the lafayette wine and art festival after people started dropping in the afternoon heat. the temperature around 100 degrees at the time. the wine festival goers had been drinking only made it worse. at least six people were taken to the hospital for heat exhaustion or heatstroke. it could be warmer tomorrow. temperatures around the bay area could easily reach 100 degrees. unhappy news for the firefighters at lake county. winds out of the southwest, crackling dry humidity l. is at least some good news for people displaced from their homes because of the fire. juliette goodrich has that.

>> more victims of the valley fire will be allowed to go home at hidden valley lake, jerusalem grade, grange road. meanwhile, middletown residents were allowed back then. christin ayers shows us not all of them had home to go back to. >> reporter: the waiting had been the hardest part, but at noon today, the evacuation order was lifted and the wait was finally over. >> this is going to allow you to drive within the community. leave that sticker on there. >> reporter: tanner kelly knew the home he grew up in was left in ruin. he was away at college when fire broke out and his father sent these picture. >> you can't believe it happened but it did. >> reporter: when he got there this afternoon. >> i never thought anything like this would ever happen. >> reporter: the shock set in. seeing what is left of his home for the first time was

something else entirely. >> it is worse than what i thought in the pictures. >> reporter: tanner's father didn't just lose his home. >> this was the garage. >> he lost his livelihood. he is a mechanic and his auto body shop also burned. the family a grieving. >> we are going to try to rebuild. >> reporter: all they can do is pick up the pieces. >> there is no point in staying devastated about it. that won't help. you have to move on and keep ongoing. >> reporter: christin ayers, kpix5. >> meanwhile, a lot of evacuees are still waiting at the napa county fairgrounds in calistoga where they have been since last weekend for word on when they will be allowed to go home. lake county officials are working on long term shelter plans for fire victims who lost their homes. they are working on opening up a new center at twin pine casino in middletown. no word on how long that will take. the latest numbers on the valley fire, it is 50% contained. 75,000 acres have burned in lake, napa, and sonoma counties

since it broke out a week ago. 585 homes and other structures have been destroyed. >> when you factor in the big fire burning in the sierra foothills, more than a thousand homes have been lost in the past ten days. investigators say 511 homes were destroyed in the butte fire. it has burned more than 70,000 acres in amador and calaveras county. but tonight, it is 67% contained and most evacuees have headed home. >> it is still here. yeah. thank god. >> it feels wonder. i was so happy knowing we got through. because we have been trying for a few days. >> but just because evacuation orders have been lifted doesn't mean the burnt area is safe. firefighters are warning returning homeowner to be on the lookout for unstable trees, power lines, and loose rocks. >> the last thing you want to hear tonight, a couple of new fires burning in monterrey

county. the 100-acre lawyers fire. it is now 70% contained. and the tasahara fire is only 5% contained at this hour. so far, it has not damaged any homes. pope francis is in havana tonight on the first leg of a historic visit. the pope wants the recent peace between cuba and the u.s. to last. >> reporter: cheering fans and a military band greeted pope francis as he arrived in cuba. the bishop and castro were on hand to welcome him. this is a chance to show goodwill, for the vatican, this is a mission of peace. francis helped mediate diplomatic ties between cuba and the u.s. i urge political

>> thousands of gallons of water down the drain when a pickup truck rolled over a fire hydrant in vallejo. the geyser shot 50 feet in the air at 3,000 gallons a minute. this was the scene this afternoon. the driver told police he thought he had put his truck in park, but for some reason, it just kept ongoing. took workers about 30 minutes to cap that leak. a suspected drunk driver is casing manslaughter charges tonight after hitting and killing a caltrans worker in oakland. happened on westbound 580 near lake merritt. the car drove into a closed construction area. hit a wall and spun into the work zone. the worker died at the scene. an oakland as minor leaguer is in critical condition outnight after a drive by shooting in new york.

mike nolan was shot outside a burger king in yongkers. so far, police have made no arrests. the as drafted nolan last year and sent him to their farm team in phoenix. the suspect in a string of sniper style shootings along an arizona freeway told the judge it wasn't him. leslie merritt jr. was arrested at a phoenix wal-mart. the shootings have terrified drivers for three weeks. at least 11 vehicles were targeted. one girl was hurt by flying glass. merritt says he couldn't have been the shoot every because he had pawned his gun. >> i'm the wrong guy. i tried telling the detective that. my gun has been in the pawnshop the last two months. >> authorities traced the gun to a local pawnshop that matched the make, the caliber, and the casings found at the crime scene and that it was owned by merritt. an airplane ran into problems at the jfk

international before the flight got off the ground. the wing tip of a virgin atlantic flight hit a fence has it pushed back from the gate. you can see the damage to the wing. no one on board was hurt, but it took workers a while to free the plane. passengers were bussed back to the terminal, rescreened and put on at plane. we are getting a look at what the new lucas museum will look like in chicago. take a look at the designs. the museum is surrounded by acres of park like landscape. the lucas museum of art will feature a unique collection featuring digital art. the museum is going to be 300,000 square feet and it is expected to open in 2019. superbowl 50 is just over four months away. to celebrate the golden anniversary, the niners and the raiders are taking their eight combined title trophies on the road, our frank mallicoat caught up with the 50 tour today in santa clara. ♪ [ music ]

in the bay area. in san francisco, 70 degrees. it is weird when the temperature in livermore is the same in san francisco. concord, 71. oakland 69. santa rosa 65. here is what is happening. high pressure over the eastern pacific is moving into california. and we have near record highs sunday. not as warm next week. there is the potential for a few showers in the south land. won't affect us. shouldn't. temperatures will really begin to come down by tuesday. tomorrow, we have to deal with it. it will be a little warmer tomorrow than today. here is how it looks in the future cast. low clouds along the shoreline are really not going to cool things down. it will not have any sort of effect inland with the numbers still near 100 degrees tomorrow. so, even warmer tomorrow, slight cooling on monday. then we will really cool it off by tuesday. harvest festival in pleasanton.
