good afternoon, i'm michelle griego. frank is off this afternoon. anne makovec is live in marin county where a key hearing in the case was put off. what happened? >> reporter: the defense was not ready to enter a plea in the case. all three suspects entered the courtroom in handcuffs with their heads shaved. they said nothing as their arraignment was postponed. >> we plan to mount a defense for our young client morrison lampley. >> reporter: lampley seen in the middle is the only suspect who had a lawyer today. he is accused of pulling the trigger but all three are being charged with murder in the shooting death of audrey carey and steve carter. >> we have two murders. that's a serious situation. so we are going to proceed very carefully. >> reporter: marin county is handling the prosecution for both cases, although audrey was murdered in san francisco's golden gate park. steve on a hiking trail near

fairfax. the three suspects, sean angold on the left, lampley in the middle and lila allgood on the right, were seen gassing up steve's car on the way to portland where they were arrested at a soup kitchen audrey's things in their car. now attorneys need to be appointed to the other two defendants. >> she turned 18 in july. this is overwhelming to her. >> reporter: so this interim lawyer and court advocate gave her advice. >> i told her that i would be getting an attorney for her and just to take a deep breath when she was anxious and just we'll get somebody to help her. >> reporter: the three suspects will be back in court on october 26. >> we do ask everyone to remember that media coverage is not evidence and all three defendants are still entitled to the presumption of innocence. >> reporter: and prosecutors have not said yet if they will seek the death penalty. live in san rafael, anne makovec, kpix 5. over 20 small earthquakes have rattled san ramon in the

last 24 hours. the strongest 3.0 hit at 8 a.m. and seismologist say it's not over yet. >> it may continue on for several days. it may end later today. we saw that sort of after about 8 a.m. after that 3.0 we haven't had any events since then. >> experts say the earthquakes have all struck along the calaveras fault. three teens are dead and another is in the hospital after a horrific crash in san jose. this is one of the victims. 18-year-old oscar gonzalez. another victim has been identified as a teenaged girl. police tell kiet do they may have been racing. reporter: next to where the crash happened and there is debris everywhere. for a family who came here to the scene to see for themselves, it's been a tough morning. she had to see the site for

herself. her husband had to walk in the very spot where his son oscar died just hours ago. >> very sad. >> he was a good kid. that's all i can say, very good kid. >> reporter: san jose police say oscar gonzalez whose legal name was oscar toledo was racing in a stolen car on santa clara street at 22nd. the honda lost control, spun out and struck a light pole and sheared it off its base. that damage to the pole shows how fast they were going. the car flew in the air struck a tree. neighbors saw it and said it was carnage. >> the car was split in half, frame bent, it looked like he was airborne. his car was split and it just split down the middle. i mean, it was bad. >> reporter: oscar and a 15- year-old girl died at the scene. another boy died at the hospital. the fourth passenger another boy is in critical condition.

the other car took off. oscar's family doesn't know why he was riding in a stolen car. he graduated high school a year ago and was trying to go to college. >> it's not his character. i was like, you know, when we heard it was a stolen car we couldn't understand why, you know, what happened or who is at fault or anything. it's just, you know, probably teenagers being kids. i don't know. i mean, like i said he's a good kid. >> reporter: police are looking for the acura. if you have information, call them. kiet do, kpix 5. the owner of a southern nevada brothel says former nba star lamar odom had been partying for days before he was found unconscious yesterday. he was rushed by ambulance to a hospital in las vegas. at 6'10", he was too tall for the helicopter. there is no word on his condition. the brothel's owner says odom was drinking and had taken an

excessive amount of an herbal viagra-like supplement. >> lamar hung out for a few days. two of the girls went to check him and there he was unconscious. he was throwing up terrible. the girls of course were traumatized. >> odom won two nba championships with the l.a. lakers. he retired in 2013. he was married to reality star khloe kardashian for four years. democrats held their first debate in las vegas tuesday night and it was the leading candidates who shined the brightest on the big stage. craig boswell has highlights. >> reporter: hillary clinton was flush with excitement. >> we're going to win! >> reporter: they said she deflected attacks and added jabs of her own. >> is bernie sanders tough enough on guns? >> no. not at all. he voted five times against the brady bill.

[ laughter ] [ applause and cheers ] >> reporter: and while sanders proclaimed to be a socialist, clinton portrayed her as pragmatist who lives to get thinks done. >> reporter: sanders said she wasn't tough enough on big corporations. >> secretary clinton, you do not, congress does not regulate wall street. wall street regulates congress. >> whoo! >> and we have to break off this cycle. >> reporter: clinton and sanders overshadowed the three others in the room and the one potential candidate back in dc. >> i think it closes an avenue. today we are talking about her performance and not the huge vacuum in the race that needs to be filled by a white knight like joe biden. >> reporter: vice president joe biden watched the debate from his home while he decides whether or not he wants to enter the race. craig boswell, cbs news, the white house. firefighters are getting a handle on a 600 aircraft grass fire burning near hollister.

the fire is about 40% contained. cal fire says one person has been hurt in the fire. no official word on how it started. meanwhile, the state is dropping a plan that would have allowed some violent inmates to fight wildfires. that's after firefighter unions and other critics raised safety concerns. the state still plans to use certain nonviolent inmates on their firefighting crews. the u.s. forest service is hit with a lawsuit for allegedly allowing nestle to bottle california water without a permit saying they shouldn't allow it to draw water from a creek in the san bernardino mountains. they say nestle is using pair mitt that expired more than 25 years ago. nestle says they are operating under a valid permit and cooperating with the forest service. an app that lets users contest parking tickets has suspended services in san francisco, oakland and los angeles. fixed allows users to review tickets for errors but the company says the three cities

have blocked their access to important websites. fixed says they can't fax the san francisco municipal transit agency but the sfmta tells a different story. >> they can submit protests online and bring us hard copies and still work with us to do that. and they can still operate their business if they choose to do so. we didn't request the change from sear ross to blocks them. >> xerox is the company that operates the websites for san francisco, oakland and l.a. sfmta says it only asked for bulk email messages to be stopped. the nba champion golden state warriors are holding a season tip-off celebration today at san francisco's civic center plaza. take a look at the parade through downtown observations oakland back in june. right now, san francisco mayor ed she part of a ceremony recognizing the team's championship and later some players will hold basketball clinics for kids. the event runs until 4 p.m. still to come, uber is

kidnapped child. it's parterning with the uber is arming its drivers with a new tool that could help find a kidnapped child. it's partnering with the national center for missing and exploited children to send amber alerts directly to drivers' phones, including license numbers, last known

location and key information in each case. uber says more than 20,000 drivers in the bay area will participate in the partner partnership. twitter has named google's [ non-english language ] to chair its executive board. twitter ceo jack dorsey announced the news today. how else, of course, but in a tweet. dorsey called the man a proven and experienced leader who will help recruit the best people to twitter. he joined google in 1999 and currently serves as that company's chief business officer. the news comes a day after twitter announced plans to lay off up to 336 employees as part of its cost-cutting efforts. that's about 8% of its workforce. let's take a look and see how the markets are doing right now. you can see not too good of a day. the dow is down 150. today the u.s. supreme court will debate whether your electric bill will go up. the justices are looking at a federal program that pays consumers who reduce electricity consumption during peak house. the program is aimed at

reducing power use and preventing blackouts. those who participate could receive refunds. those who don't could end up paying more. soon the chicken in your local grocery store may have traveled halfway around the world and back to get there. the u.s. department of agriculture has agreed to let poultry processors send chicken to china for processing and back here for sale. for now it would include just frozen chicken nuggets and wings. it will save producers a lot of money on processing but experts say it creates some serious contamination concerns. >> the chinese system is in no way equivalent to ours and shouldn't be treated as such. >> the usda says it is establishing a three part system to ensure all chicken sent to china is handled safely. a shortage of air traffic controllers could put u.s. flights at risk for widespread delays. union officials say staffing hasn't been this low in nearly three decades. just since 2011, the number of qualified controllers who can

for giving me your current observations because i'm here in san francisco and i want to see what it's like in your neighborhood. this is the view outside my window right now where we have blue skies and i'm looking at the flag at the pier there. it's a little bit on the fly. noticing it's variable about 5 to 10 miles per hour. we'll rotate around to the west and increase to 10. temperatureses up to 87 degrees in livermore. that's down certainly from 101 yesterday. this is the scene from the lick observe -- from the lick observatory with cloudy skies. generally speaking, though, the coast is clear. this is the view from berkeley at the university of california at the lawrence hall of science. the satellite and radar imagery indicates this area of low pressure right here to the south, it's lifting up in a northerly direction bringing the cloud cover across the central coast in into the bay area. you can see right there. we also notice some rain bands associated with this area of low pressure just a slight

chance of a scattered shower here today. so the clouds will continue to increase during the afternoon hours. cloudy cooler and muggy today. mugginess remains with us on thursday and then another chance of showers on saturday. again, this is our satellite and radar. this is the area of low pressure that's taking any of its precipitation for the most part into the los angeles area and as the clouds shield increase across the bay area our temperatures are coming down but the humidity is going up. meanwhile upstream we go. we have this area of low pressure that comes very close to our area producing yet that other chance of rain showers. here's our futurecast. and you can see how it clouds up during the evening hours. we'll call it mostly cloudy tonight with our temperatures into the 50s and a few low 60s. this morning it only bottomed out at 68 degrees in the livermore area. so not a very comfortable night for sleeping. but you will be able to throw open those windows soon. i'll show that you seven-day forecast coming up. tonight sunset 6:35. sun right tomorrow 7:17. and by tomorrow morning, we

here in the bay area the average accountant earns about $86,000 a year and even better news, employers plan to boost starting salaries for staff accountants by 5.1% next year. you don't need to be a certified public accountant but it helps you earn 5% more but becoming a cpa requires at least 150 hours of education and a year's worth of accounting experience under your belt. you will also need to pass the rigorous cpa exam. the skills you learn are useful in any field which means you can pursue a position in practically any industry you choose. i'm jill schlesinger for kpix 5. ,,,,,,
