morning just one of the downpours in some bay area cities. the north bay rain caused several accidents including this one on calistoga. the driver spun out on wet pavement, history the hillside and flipped her van. two people had minor injuries. in some parts of the bay area, clouds but not much rain. san francisco looking like rain but nothing on the ground. we can expect high surf at the coast for the next 24 hours. there are beach hazard statements. stay out of the ocean where there are no lifeguards on duty. this is what it looked like last night. light steady showers falling in san jose. almost a tenths of an inch of rain fell just enough to wet the pavement. roberta is looking hard for rain on doppler. >> we still have some rain in the vicinity. good afternoon, everybody. this first is our life weather camera. newscast just how stormy how gloomy it appears over the mount vaca area.

this is our life hi-def doppler radar. -- this is our live hi-def doppler radar. we have seen individual rain cells in the area towards mount vaca. at this particular time we are actually picking up bona fide rain showers in the eastern portion of our bay area near union city. how much rain has accumulated so far today? anyone from .01" in san jose to .06" in dublin and then .2" in the calistoga area. it's not over yet. we have something else another hazard to talk about that's coming up later on in this newscast. new at noon a bizarre shooting at a south bay apartment complex sends a sleeping child and another person to the hospital. kpix 5 reporter len ramirez life in san jose with the latest on that investigation. len. >> reporter: frank, you can only imagine the shock and the fear that must have gone through everyone in the apartment complex when everyone was sleeping this shot potentially deadly shot rings

out. the 9-year-old boy was asleep in his bed at this apartment complex on almaden road directly above him at 5:45 a man handling a loaded rifle the muzzle pointed down. the gun went off sending a round through the ceiling of the boy's room. >> we found the 9-year-old, um, boy who had been shot in the leg with a nonfatal injury. >> reporter: the shooting sent two people to the hospital. the man had literally shot himself in the foot. both victims are expected to survive. >> we need to determine the intent, whether this was accidental or if there was something reason that the person was firing the weapon. >> reporter: the bullet pieced the foot and wood floor of the apartment building. >> i can't believe it's happening. >> the shock of the shooting brought neighbors to tears. a friend of the mother of the boy who was shot said there have been incidents between the neighbors in that upstairs apartment in the past but nothing like this. >> so i don't know if one thing led to another and then all of

a sudden there's a gun. now someone is hurt because of that. >> reporter: the boy is still being treated at the hospital. he has a serious but non-life- threatening injury as well as the shooter himself. he is being treat at the hospital himself. police are running the serial number to determine whether or not the rifle was kept legally. life in san jose, len ramirez, kpix 5. we are learning the man wanted for a bay area deadly shooting is actually wanted for three separate killings in northern california. jason brown is suspected of ambushing two people in a car outside a livermore strip mall last saturday. one person was killed, the second critically wounded. he also is wanted for murders in fresno and sacramento last month. the man wanted in a string of car burglaries is behind bars this noon. san francisco police arresting 24-year-old sean gibson who was picked up last week. investigators say evidence has linked him to 22 auto burglaries in san francisco. some new developments in that classroom confrontation caught on camera in south

carolina. the school officer seen pulling a student from her desk has been fired. the incident was caught from several angles including one that shows the man sitting on the student in front of the class. reporter omar villafranca tells us this was not the deputy's first altercation with a student. >> reporter: the south carolina he was deputy seen scuffling with a high school student in a cell phone video is fired. the chef said ben fields had his right to remove the student from the classroom but went too far. >> deputy fields did not follow proper training, did not follow proper procedure when he threw the student across the room. >> reporter: fields' action is outraged many in the community including parents. about a dozen voiced their opinions at a town hall meeting. >> you are responsible for these people. >> reporter: clays mates say the confrontation began when the teacher and school administrator repeatedly asked her to put away her cell phone during class.

one student who asked that his face and voice be concealed said others kids in the class tried to defuse the situation. >> she was even told by the students to just get up and leave when the administrator came in. >> i thought that's the same guy. >> reporter: wendy johnson said her son was in a struggle with deputy fields when he was a freshman. she took these photos of her son after the altercation. his shirt torn and marks on his arms and shoulders. >> the people that are supposed to be protecting my children i have to worry if they are being hurt by those people. >> reporter: fields is still the target of a federal investigation that could take several weeks. omar villafranca, cbs news, columbia, south carolina. >> the u.s. justice department says it's opening a civil rights investigation into that incident. a violent lunchtime brawl escalated when a sacramento principal got body slammed in the school's cafeteria. he was trying to break up a fight between students at florin high school. three students were arrested

for their involvement in the fight. a home burglary caught on camera ends with a resident getting shot and now andria borba says, police are looking for help in identifying the suspects. >> reporter: in the course of two minutes, thursday morning, the blue honda buzzed by a home on the 300 block of green park way twice. san jose police say this is how three guys cased the home before breaking in and shooting the man. two minutes after the blue honda drives by at 9:50 a.m., a young guy in black glasses rings the doorbell several times, then leaves. 5 minutes tick by. that's when the guy walks past the pool and into the garage. he makes a call, begins pacing in front of the power tools, and a few minutes later is joined back at the front door by a second heavy set man. they pick the lock and break in. during that time, the son of the homeowner walked in on the burglary in progress, tried to stop it and was shot. 12 minutes later, the pair leaves. the hev set guy with the gun -- heavy set guy with the gun

drawn is walking across the lawn in broad daylight with the weapon out. the original suspect follows him with a bag of stolen property slung over his shoulder. they both saunter across the street to the blue honda and their waiting getaway driver. andria borba, kpix 5. two fresno men were arrested for allegedly breaking into a car at a cemetery and stealing cashes. mourners were nearby. one witness snapped a photo of the pickup truck and called police. they were arrested a short time later. and more shaking going on in san ramon. the latest earthquake at 2.2 at 10:18 this morning. eight minor quakes overnight. that's on top of 25 yesterday. this quake swarm started two weeks ago. there have been more than 400 of them. the largest a 3.6 on october 19. some other bay area headlines now. a third lawsuit has been filed against a san jose restaurant at the center of that shigella outbreak that sickened 188 people in six counties. the latest plaintiff claims he fell ill after eating a shrimp

cocktail at marisco's san juan restaurant. it's been closed whale health inspectors look for the source of the bacteria. san jose has passed tough new penalties for illegal dumping and the fines are big now at $2,500 for one violation and $10,000 for a third. illegal dumping is dumped 75% on private property, 50% on public property in the past three years. the president of ireland will attend a tree planting ceremony in berkeley today. it will serve as a memorial to the five irish students who died in a balcony collapse near the uc campus in june. president michael higgins will also attend a private reception for those who were the first responders during the tragedy. well, the nba champion warriors are back on the court and the summer of fun didn't hurt their game. the ws picked up where they left off starting with a 16- point winner over the new orleans pelicans. steph curry had 40 points. and prior to the game, a ceremony was held to celebrate last season's first championship in 40 years.

space. astronaut scott kelly took his first spacewalk this morning. he and a fellow astronaut were taking care of maintenance on the international space station's robotic arm and electrical cables. early tomorrow morning, walker will officially set a record for the longest stay in space for an american more than 7 months. he is not due home until next march. and right now, six russian female astronauts are headed to the moon, sort of. it's only a simulated eight-day trip as a test to see how they do in space. they were locked into a spacecraft this morning and will be monitored as they perform experiments and interact in confined spaces. let's bring it back to earth and find out how much rain we'll get today. here's roberta. >> we have already seen up to .2" of rain in calistoga. weather watcher so says dana and it is raining there. this was sent to us by weather watcher robert sanford. he said this is at the tam junction. see all that water there? that's from the king tides.

can break and collapse leading to injury and death for the driver or passenger behind the seat. in today's jobs report, jill schlesinger has advice for holiday season job seekers. reporter: we haven't celebrated halloween yet but retailers are already looking ahead to christmas. and holiday hiring is in full swing. if you are looking to earn a little extra cash this season, you're in luck. labor experts say that with a low unemployment rate of 6.1% in california, it's harder for companies to find seasonal workers. that puts you in the driver's seat maybe literally. u.p.s. plans to hire up to 95,000 people this season with drivers earning as much as $30 an hour, but the workers most in demand are those who staff warehouses and other fulfillment centers where online purchases are packed and shipped. in order to fill these jobs, companies are raising starting wages. you can expect to earn between $11 and $13.50 an hour. walmart's holiday hiring plans are stagnant from last year at about 60,000 people and toys 'r us will hire 40,000 temp
