live from the cbs bay area studios this is kpix5 news. underwater. tonight: the whole bay area is getting a preview -- of what flooded roads, toppled trees and a town under water, tonight the whole bay area is getting a preview of what el nino could bring this winter. good evening. i'm juliette goodrich. >> i'm brian hackney as we look live toward the city, all is calm and bright after a stormy beginning to this sunday, the 13th of december. the kpix5 hi-def doppler shows it's mostly raining on the fish at this hour, but there will be a few showers over land tonight. next rain totals, more than an inch in the santa cruz mountains today, 3/4-inch in san francisco, up in the north bay about an inch in san rafael and .46 in napa.

next showers ending and chilly temperatures for monday, very different than this morning. >> this is what a lot of people around the bay area woke up to, sheets of rain and with it came the wind leaving plenty of damage behind. p the mess. storm drains working overtime ...y couldnt handle the overflowf rain ... l over town in san francisco tree limbs came crashing down on cars. the high winds also brought down some muni wires. crews spent most of the day cleaning up the mess. storm drains working overtime, many couldn't handle the overflow of rain. firefighters were all over town clearing away the leaves and other debris jamming the grates. one woman near golden and goff decided to pitch in and help. >> we need some help from the city to unclog the drains so the water won't flood the cars over here. >> reporter: in the east bay this huge tree in san pablo came down this morning crushing a car and damaging two homes

right next to lake elementary school and it was lights out in martinez where many people started their day without power. these wires came down on pacheco boulevard cutting the electricity to a good portion of the east side of the city. in mont rio the town crist mall tree toppled over leaving -- christmas tree toppled over leaving lights and ornaments all over the square. firefighters had to cut it down by about 6 feet so it won't blow over again. the same tree fell over in another storm just a few days ago. >> a couple nights ago the tree across the street came down and the power line came over. this morning during the windstorm it picked it up and brought it right out of the holder we made for it. >> reporter: the wind blew a big plexiglass panel off this bus shelter and falling tree limbs took down several utility lines around town. in oakland more tree branches toppled. luckily they fell into the

street and not on nearby houses. 70 miles north of san francisco the highway 1 town of jenner took a bath in all this rain. coastal flooding began a couple days ago actually thanks to several days of rain earlier in the week and today's wet weather added to all the totals. in some spots people are using kayaks to get around, good luck to getting to that post office to send off your play or christmas cards. >> we've kind of -- mail or christmas cards. >> we've kind of got a perfect storm here. the waves were as high as 25 feet. >> high surf sealed off the mouth of the russian river estuary trapping flood waters along the coast lines and in addition to the post office, there's flooding at the business center and several nearby businesses, no word yet exactly how much damage has been done up there. the weather may have played a role in a crash that killed a bay area couple and sent their two children to the hospital. joe vazquez on how investigators think it happened. >> reporter: just east of the

altamont pass highway 580 dips sharply. a half rain was pouring down causing water to pool in puddles on the freeway. >> so we can only guess that perhaps the vehicle hydroplaned and maybe the driver lost control. >> reporter: the car flipped over three times as it crashed down an embankment. 40-year-old levy bunn and his girl friend sophia fawn were killed instantly. rescue crew there's to cut them out of the wreckage. two young children survived. the 5-year-old boy in the back seat injured his head, but a brain scan found no serious trauma. the 6-year-old girl had minor injuries. she told authorities they were headed to stockland when they crashed. both families immigrated to the united states from cambodia and are well known in the community. levy's family set up a gofundme account asking for help with funeral expenses. >> it's absolutely traumatic and really our hearts go out to this family and the extended family members of these

children. >> reporter: the little boy is levy's. the girl is sophia's daughter. they're at uc davis medical center being treated. the family wanted to pass along that they really appreciate the outpouring of support from the public. along the altamont pass i'm joe vazquez, kpix5. this big rig crashed on 580 and livermore as well. the chp believes it was weather related. no one was hurt. the truck ended up with a punctured gas tank. several lanes were shut down so crews could clean up the mess. the roads are also treacherous in the sierra tonight where all this rain turned to snow. chains are required for all trucks and most cars. so if you're headed that way, be prepared. in southern california mudslides have shut down a 40- mile stretch of the grapevine tonight. traffic is backed up for several miles at cha stake as the ch -- castaic as the chp

routes people off interstate 5. there's no word whether any drivers are actually stuck in the mud. caltrans crews are trying to get at least a couple lanes open tonight. also down in los angeles -- also down in los angeles the shooting death of a young african american father by two l.a. county sheriff's deputies is raising new questions tonight about use of force. chris martinez reports on the deadly confrontation caught on camera. >> reporter: store surveillance video captured the moment two los angeles county sheriff's deputies fired multiple shots at nicholas robertson in the lynnwood neighborhood of los angeles. angry demonstratorred gathered at the shooting scene saturday night. pamela brown is robertson's mother-in-law. >> he left three kids behind, two daughters and a son. they could have tasered him or anything. >> reporter: investigators say the confrontation started when deputies responded to multiple 911 calls about a man firing shots into the air. the sheriff's department released this video showing

robertson minutes before his encounter with deputies walking down a busy street carrying a gun. >> he did not comply with their repeated requests to drop the weapon. >> reporter: the sheriff's department also released these images of robertson on his stomach during the confrontation. deputies fired 33 rounds. robertson was pronounced dead at the scene. community activist naji ali said the shooting is disturbing. >> it appears that this young man crawled to his death. he was shot again and again and again. >> reporter: local civil rights leaders have called for an independent investigation into robertson's death. chris martinez, cbs news, los angeles. meanwhile three investigations are now underway into this month's deadly sfpd shooting in the bayview. witness cell phone videos are analyzed frame by frame, but what you see in the intense confrontation between the officers and a knife wielding mario woods depends on who you

ask. >> that officer was preventing the suspect from escaping the scene and possibly endangering others out of view of the video. >> the idea that somehow he was charging, i don't see the video showing that. in fact, what we saw was that he was actually -- he had his hands down. >> police chief greg suhr insists woods was raising his arm approaching officers. he's renewing his call to arm officers with tasers as a less lethal option. after days of searching tonight the fbi says nothing related to the san bernardino mass shooting has been found in a local lake. divers have been trolling the murky water about three days now and have not uncovered anything, but the fbi plans to keep searching. they're especially interested finding a hard drive missing from the shooters' home. two los angeles mosques are the latest to be targeted in apparent hate crimes following the san bernardino shootings.

vandals scrawled references to jesus in both locations. a device that resembled a hand grenade was found, but it was a plastic replica. >> by itself it's not very dangerous, but we felt that the graffiti was a bit too much and with all the incidents going on. on friday police arrested a 23-year-old man for firebombing a mosque in coachella. no one was hurt. a major shakeup in the race for the white house tonight, reporter brian webb on why ted cruz is suddenly surging ahead in the polls. >> reporter: donald trump has a new political target beyond the epa, gun control and muslim immigrants taking aim at his newest republican rival ted cruz. >> you look at the way he's dealt with the senate where he goes in there frankly like a little bit of a maniac. you're never going to get things done that way. >> reporter: cruz is surging in three new polls pushed by

evangelical and tea party conservatives. in one poll cruz is 10 points ahead of trump in likely iowa caucusgoers and another poll shows cruz two points ahead. >> i believe gravity will bring both those campaigns down. i think the lion's share of their supporters come to us. >> reporter: the washington post reported last week that some party elders are considering ways to sidestep a possible trump nomination. trump had taken a pledge not to run as a independent, but hinted that may change. >> i signed a pledge, but the pledge was a double deal. it was supposed to be honorable. we'll find out. if it's that way, they're going to have problems. >> reporter: iowa caucuses are set for february 1st. >> the next gop debate is tuesday night in las vegas. still ahead there's something unusual bobbing off the bay area coast tonight, the major mishap involving a

people are dead after they became trapped in this burning home. the home was boarded up because nobody was supposed to be there. firefighters say neighbors heard people screaming for help and pounding on a window. there is no word how that fire started. rough seas are blamed for a bizarre accident off the bay area coast. about a dozen empty shipping containers slid off a cargo vessel headed from oakland to seattle. they went into the water late friday night as the ship ran into rough seas near the golden gate. some of the debris from those containers showed up on a beach in san francisco. it's those green trays scattered on the sand. as for the containers, they're likely at the bottom of the ocean by now. one of the tiniest houses in san francisco is on the market and it comes with a huge price tag. the so-called microunit in north beach is 264 square feet. it comes with a small kitchen and bath. it does have a rooftop deck with views all for $425,000.

registered their home as a business and even passed along hotel tax to the city, so it came a bit of a shock when they received this. >> there it was right in the front door and i was shocked because i had no idea we were in violation of this law. >> the issuance of that notice is what starts the penalty clock ticking if a property is in violation. >> reporter: kevin guy is the city's a ain't positived sheriff you might call him -- appointed sheriff you might call him for the city's short term rentals. >> it's a new set of rules. >> reporter: that check in with several years worth of political baggage. almost as soon as the city passed administrative code chapter 41a critics proposed even tougher rules with prop f often calling the existing code unenforceable, but suddenly the gears appear to be turning. >> so far we've issued around $400,000 in penalties in short term rental violations

involving around 37 dwelling units. >> reporter: now the city posted its latest batch of orange notices meaning 20 more properties across the city are officially under investigation for being unlawfully converted to tourist or transient use. >> i'm presuming there won't be any fines since we operated in good faith. >> reporter: of the 20 cases we're looking at i'm going to call you an honest mistake by a well meaning homeowner who resides in the residence. is that fair? >> i think that's absolutely fair. >> reporter: of the 20 cases betsy was the only owner who spoke with us on camera. off camera one owner flatly admitted they broke the rules, got caught and paid the fine while another tried to explain to us that they had absolutely no idea how their property had come to be listed as an online rental. now something most of these cases do have in common is that the property in question is not currently registered as the owner's permanent address. >> that's something that's not

eligible for the program. it's taking housing stock off the rental market. >> reporter: in fact, three of the properties belong to one single owner. >> those are problematic because by definition you can't be a resident of multiple properties across the city all at 1 time. >> reporter: when we visited the properties that appear to have absentee owners, we found plenty of lockboxes, keyless doors and neighbors who knew why we were there. >> somebody bought this place and almost instantly there was traffic in and out of it. >> reporter: and those neighbors are often thrilled to hear that the city is on the case. >> i am. i was hoping that you would be the one who would say yeah, that's what's happening. >> reporter: try to find those listings now and you'll see something like no longer available which really speaks to the difficulty of enforcement. the city is watching at least 5,000 moving targets. they're scanning websites and following up on complaints, all while trying to get more hosts officially registered. >> we have around 200

appointments scheduled through the end of the year. >> i have an appointment monday morning. >> reporter: now remember one of the main arguments against prop f was there. >> the short term rental law has been on the books only since february and we believe those laws need a chance to work. >> reporter: well, what qualifies as working is now open for debate and for anyone out there that might be breaking the law -- >> the enforcement might eventually catch up with them if they're not registered and doing this the way that they should. >> reporter: in san francisco wilson walker, cbs5. >> the numbers can be hard to pin down, but since the november vote the percentage of short term rental units in compliance with city law has climbed from less than 10% to perhaps 15%. a chilly night underway in the bay area with clearing skies and a nice day on tap for tomorrow but chilly. the winds are around with us tonight. as we look at the golden gate brim right now, it looks like a dry -- bridge right now, it looks like a dry bridge and

chilly, 40s, concord 46, livermore 43. the hi-def doppler is not showing much, a fairly dry northwesterly flow drying up the showers as they head down the shore line. so except for maybe a drop or two tonight, that's about it. low pressure spins inland and we'll begin to dry out the first part of the week and increase the clouds around thursday, friday, in that time frame. futurecast shows tomorrow a crackling clear start to monday, perfectly clear skies. one of the reasons is we've got a northwesterly wind setting up offshore. futurecast shows fairly strong winds out of northwest tonight and as the day goes on, the bright colors show you the stronger winds. those wind gusts will be around tomorrow evening, too, so a fairly windy day monday. low pressure gets kicked out of high pressure builds in,

a builder found the list while replacing a chimney. david halak wrote it about 70 years ago when he was 6 years old in. it he asks father christmas for a number of things including slippers and a silk tie. >> it's quite hard to read at first and had to read it back slowly to find out what was in it. it was really quite amazing actually. >> i can remember my mother bending down and putting it up the chimney. the chimney had sort of a wedge shape in it and waiting for the draft to take it up. hayl >> in the spirit of christmas the builder who found the letter returned it to halak along with all the gifts he had asked for. and we will be right back. ,,,,,,,,,,
