pacifica where people are still moving out of yellow-tagged apartments that are in danger of falling down the cliff. anne? >> reporter: the meeting with congressman jackie speier way a disappointment. she said that pacifica is eligible for $30 million in federal money and that's to shore up city infrastructure like the pier that we see here behind us that's been pounded by heavy waves. the city has already declared a local, state of emergency but it looks like renters won't be eligible for federal or state assistance but so far 40 people for them the future is unclear. it's a reluctant moving day on esplanade avenue for the people living in 20 apartments that are now yellow-tagged. michael mcenery is one of the tenants only allowed into his apartment to pick up his stuff. >> without notice or warning, i have had to basically turn my

whole life upside-down. >> reporter: the homes were yellow-tagged on monday after huge chunks of the cliff fell into the ocean. the apartment is getting closer to the brink. >> enough to push anybody over the edge. >> reporter: this is the third apartment building on esplanade avenue to be deemed uninhabitable because of the eroding cliff. as the moving trucks load up many of the people who live here don't know where they are headed. >> any communication from the people who supposed to care about my safety i have had to force out of them. >> reporter: the county is offering them temporary help like deposit on a new apartment but first they have to find one. congressman speier spoke this morning about how the entire coastline is at risk. >> this is a state and national problem. highway 1 is in jeopardy and we need to take steps to protect it. >> reporter: as far as action, though, she says she is still

apple's plans to move into an 86-acre lot on first street and component drive. if you have ever been by here you know an empty lot of this size in such a prime location is rare in sillicon valley. as part of the agreement, apple can grow and develop the site for the next 15 years and if it hits that number of 4.15 million square feet that will make it bigger than it's current headquarters in cupertino. now, as part of the deal apple will also pay millions in fees to ease traffic congestion. >> traffic is always a downside of every bit of good news. we recognize and there's going to be impacted, apple will pay millions in fees to mitigate the traffic. they will be paying tens of millions of dollars in property taxes that will help us as we build out infrastructure to support transit like bart like light rail. >> reporter: there are several existing buildings already on the lot. that means as many as 1,000 apple employees could be moving in here within just a couple of months. about 5% of apple's workforce already lives in san jose. that's why the company says

this project for them is ideal. in north san jose, kiet do, kpix 5. apple's stock is getting slammed today in the wake of a dismal sales forecast. right now it's down nearly 5%. a renovated park is set to re-open in san francisco today. the southern portion of dolores park was supposed to have a grand re-opening a couple of weeks ago but it was rained out. so it's rescheduled for this afternoon. glow sticks are forbidden because if they break the leaking chemical could kill the grass. the city of berkeley planning to crackdown on wild frat parties. [ screaming ] >> too many have gotten out of hand near the campus. the city council gave initial approval to an ordinance to limit the size of parties, hours and underaged drinking.

>> we wanted to be sure they are done properly. >> it was approved last night and could go into effect after a second reading. berkeley has voted to crackdown on teen smoking. the city council approved raising the smoking age to 21. it also raised the age to purchase tobacco products. santa clara recently approved a similar measure. the new law in berkeley starts next january. in bay area headlines, steve hlebo heads to court today charged with killing his san jose coworker kyle myrick. police continue the search for the body today. police aren't saying what evidence they have but say there's enough to charge hlebo with murder. the warriors are showing off a new jersey in honor of the chinese new year. klay thompson modeled it in chinatown. it has a special patch on the sleeve for the year of the monkey. and somebody in oakland is trying to help the city with its pothole problem. they have been filling the holes with bricks. the city wants the "helper" to leave the repairs to

professionals. they had to come back and fix this grand avenue pothole. news on the armed occupation at an oregon wildlife refuge. police arrested several members of the group and shot one dead. but reporter carter evans says there are still questions about what happened and whether the standoff has ended. >> reporter: this video shows fbi agents and police intercepting militant leader ammon bundy and several other members on an oregon highway not far from where they have occupied federal land since the start of the year. shots were fired. bundy was arrested and his brother ryan was shot but has nonlife-threatening injuries. >> this is about your freedom to move about this country. >> reporter: lavoy finicum a spokesman for the protestors was killed in the shootout according to ammon bundy's father, who spoke with cbs station koin. >> ryan bundy had been shot in the air.

it's just been announced th british actor joseph fiennes will play entertainer micha jack hollywood is in hot water again. it's just been announced that british actor joseph fines will play michael jackson this year. the entertainment industry is already under fire for failing to nominate black actors for oscars and now a white actor has been hired to play a black man. the movie is called elizabeth, michael and marlon and chronicles the rumored road trip following september 11th. jackson blamed his white skin on vitiligo that causes a loss of skin pigmentation. he died in 2009 of a drug overdose. a florida woman was frightened this week.

she woke up to find a strange creature sleeping on her chest. she screamed and the monkey- like creature fled into her attic. it turned out to be a [ indiscernible ] from the south american rain forest. someone had it as a pet and planned to retrieve it. we all know an apple a day is a healthy choice and our fresh grocer tony tantillo has a tasty one to recommend. >> reporter: well, today's tip of the day is going to be is going to be with apples. you know, this time of year is so many different varieties of apples. a few years ago there was only a few varieties now there's dozens. the pacific grove apple is beautiful. it looks like beautiful. it tastes great. and out of hand it's one of the best apples to enjoy. make sure it has a beautiful dark pink color all the way around. nice and tight. the skin has to be nice and tight and shiny. they have to feel so firm. when you bring them home, i know they will look beautiful on the counter in the bowl. i say this all the time because apples do look beautiful. put them in the refrigerator it's huge. get these apples at room temperature.
