car says he never saw him. >> reporter: that 12-year-old boy is in the hospital this afternoon. he is expected to survive. >> honestly, i didn't see him. >> reporter: he had just dropped off his granddaughter at dublin high school and made a right turn out of this parking lot when he hit a 12- year-old boy riding a red bike on the sidewalk. >> it's an accident. it was not intentional. >> reporter: you can see the marks on the road where the boy was dragged under cat for 50 feet while other students tried to -- under the car for 50 feet while other students tried to flag down the driver. >> i saw him. >> reporter: the boy that was biking to nearby wells middle school has broken bones will you is expected to be okay. >> he was conscious and talking to the first responders as they were on scene. >> reporter: the fire department lifted the car off of him and he was airlifted to children's hospital as police continue their investigation. >> it is a scary feeling, of course. >> reporter: the school district is making counselors

available today to any student who may have been traumatized by what they saw here this morning. dublin interchange kpix 5. some windy conditions in parts of the bay area this noon hour. the flags are blowing around in san francisco and the bay waters, well, they very choppy. roberta gonzales has more on the strong gusts and a wet evening commute, as well. roberta. >> reporter: it's been so windy today that we have two-hour and thirty-two -minute delays at sfo because of wind. these are the wind speeds now sustained at sfo at 23. 26 fremont. 23 oakland. 24 berkeley. you get the idea. it is very breezy to downright windy and this is what's in the forecast during the afternoon. you'll notice like in the concord area the winds barely differ up to about 25, 27 miles per hour. this is why the national weather service has issued a wind advisory until about 7:00 tonight with some of the southerly winds to 30 miles per hour. the other side of the coin, the

approaching front. you can see it just offshore in the eureka area and by the time it makes tracks into the bay area it will affect the evening commute. right now clouds gathering around the bay area. coming up i'll tell you how much rain to expect. it's a battle between the fbi and cupertino-based apple. the rift is all about an iphone that belonged to one of the shooters in san bernardino. as kiet do reports, apple is defying a court order to decode the device. >> reporter: it's been about 12 hours since tim cook posted the letter to the website saying that the company will not build a back door to the iphone. and now the public debate is raging! the first to chime in, new york mayor bill de blasio. >> look! these are private companies. they are profit making companies. if they put their desire to make profits ahead of the safety and security of the american people, there's something wrong. >> reporter: it started shortly after the san bernardino attack when syed farook and his wife

shot up at christmas party in december. authorities found his iphone in the car. investigators think it might have important information on the couple's whereabouts leading up to the attack on the who helped them. >> we have one of those killers' phones that we haven't been able to open. it's been over two months. we are still working on it. >> reporter: a federal judge ordered apple to help the fbi hack into the encrypted iphone. last night tim cook posted an open letter to customers saying, the u.s. government has asked us for something we simply do not have. something we consider too dangerous to create. they have asked us to build a back door to it the iphone. apple engineers would have to create a new version of the operating system written just for the iphone in question that would allow the fbi to hack the phone's code by entering in millions of combinations. tim cook said on a recent episode of "60 minutes" it's a pandora's box. >> if you put a back door in, that's for everybody, for good guys and bad guys. >> these companies, whether they mean to or not, are unfortunately making it easier

for terrorists to do their devilish acts and it must be stopped. >> reporter: here's more from that letter that says, quote, while we believe the fbi's intentions are good, it would be wrong for the government to force to us build a back door into our product. ultimately, we fear that this demand would undermine the very freedoms and liberties our government is meant to protect. in cupertino, kiet do, kpix 5. >> that federal court order says apple has a week to appeal which the company plans to do setting a lengthy court battle up. the man accused of killing a richmond police officer will be arraigned. police say 30-year-old robert vega shot augustine gus vegas last week during a domestic dispute as vegas' home in vallejo. the suspect is the father of the man's grandchild. police paid their respects in richmond last year.

uniformed pallbearers carried the casket into a chapel. the funeral is 10 a.m. friday at the richmond memorial auditorium. and police are releasing few new details about who shot and wounded three teens in berkeley. investigators say two victims are being treated for critical injuries. police have not revealed any possible motives but say the shooting does not appear to be random. teens were shot about 7:30 was night near parker street and san pablo avenue. tonight, santa clara city council holds an emergency meeting to choose their next mayor. this comes after mayor jamie matthews quit unexpectedly the day after the super bowl with two years left on his term. yesterday city lead, decided it's better to appoint a replacement than to hold an election. councilwoman lisa gillmor reportedly is the likely choice. and in danville the town council voted to ban short term home rentals like on airbnb and home-away. the proposal sparked a battle between homeowners who make

money on the rentals and those who don't like the idea of having strangers in their neighborhoods. >> almost everyone in our neighborhood has children. and you can't do a megan's law check on an overnight guest. >> my husband has been out of work for over a year and a half. and this is one way for me to stay in danville. found this really interesting. 61 degrees. that's frank keenan one of our weather owners novato and he says we feel like we are on the verge of rain. we're picking up the rain to the north of us right now. that's moderate rainfall but as i zip on in, just received a report from one of my weather watchers kathy munch in sebastopol a little bit of light raindrops on the rooftops. this is the story all morning. we are picking up south winds to 21 miles per hour at mineta international airport. but the gusts are up to 41. gusts over 30 at sfo where we have airport delays two hours and 32 minutes or some arriving flights. because of the wind chill speeds we have the wind advisory in effect until clock tonight because of the wind speeds. look at the cloud cover. we have layers and layers of clouds and everybody is talking about how balmy it feels

outside in the 60s. temperatures steady. low pressure breaking down the high pressure system that kept us dry for nearly three full weeks so that area of low pressure has a big job to do. it has to bust through all that dry air mass and it's going to do so. here's the front. the bulk of the rain entering the central bay for the evening commute. and then you will see the hit- and-miss scattered showers. thursday showers in the forecast. another front moves into the bay area on friday into the evening commute with minimal amounts of rainfall associated with it. we should see up to an inch of rain here in the bay area. 67 degrees in sacramento today. the greater lake tahoe area, it's rain and then snow. two feet of snow with that winter storm warning in effect. the tahoe report squaw valley more snow coming two feet there. sugar bowl same. again, the sun-up and the sundown, we are probably not going to see it today. 60s across the board. here's your extended forecast with the rain.
