station -- right across the street. it's a bold crime. a man is shot to death in a busy mcdonald's parking lot with the police station right across the street. good evening. i'm juliette goodrich. brian is off tonight. it happened this afternoon on golden gate avenue and fillmore street. a police station sits right across the street. joe vazquez with what witnesses heard out there. >> reporter: when gunfire blasted through the middle of the crowded mcdonald's parking lot, officers heard it inside the northern district police station across the street and rushed to the scene. tj said he also heard the shots. >> what did it sound like with those gunshots? >> first i heard a pound. then i heard pow, pow, pow, pow, and i got out of the way. >> reporter: a driver and passenger were in this white car in line at the drive-thru. there were cars in front of and behind it. then a man came up and fired at

close range at the passenger's side door. >> both the driver and the passenger got out of the vehicle and the driver was unharmed but the passenger was transported to the hospital. we got the confirmation from the hospital that the victim expired. >> kind of bold to do this right across the street from the police department. >> it is, in the middle of the afternoon. a lot of pedestrian traffic and motorcycle vehicle traffic. so it was very braissen. >> reporter: at this point the motive is unknown. police are not sure if this was a random shooting or the victim was targeted. police say the gunman got away, went down golden gate, and possibly got in another car. in san francisco, joe vazquez, kpix 5. >> police are checking to see if there's any surveillance video of the shooting. a tragic end in the search for a missing hayward woman. they found the body of stacy --

of stacey aguilar yesterday. police plan to release more information about the homicide investigation tomorrow. san jose police say this man is responsible for a deadly stabbing near a san jose shopping center. anthony tafolla is being held without bail. the stabbing happened at the evergreen shopping center on south white road a little before 1 a.m. yesterday. it's still not clear what led to it. police say the only businesses open at the time are a bar and a taco bell. we now know the alleged gunman behind the deadly shooting rampage in michigan was an uber driver. six people were killed. kenneth craig is in kalamazoo where people are in mourning tonight. >> reporter: music and prayer brought hundreds of grieving kalamazoo residents together sunday night at a church service to honor the victims killed in a deadly shooting rampage. >> this kind of tragedy happens

in california or new york city or overseas. it doesn't happen here. >> reporter: authorities say 45-year-old jason dalton's spree began when he wounded a woman around 6:00 saturday night outside of an apartment complex. a few hours later a father and son were killed at this car dealership. then dalton killed four women at a restaurant. a 14-year-old girl was seriously injured. investigators say the women were in two vehicles here at this crackle barrel parking lot. authorities are still searching for a motive. >> reporter: cbs news confirmed dalton was working as an uber driver and passed the company's background check. he was dalton's passenger less than two hours before the rampage. >> we were kind of driving through medians, driving through the lawn, speeding along, then finally once he came to a stop, i jumped out of the car and ran away. >> reporter: melon's fianci posted on facebook to warn other

passengers to stay away. authorities believe dalton would have continued his shooting spree if he wasn't stopped. >> investigators say the suspect had no prior criminal record and they don't think the shooting spree was a terrorist act. dalton is scheduled to be arraigned tomorrow. uber sent out this statement about the shooting. quote, we're horrified and heart broken. we have reached out to the police to help in their investigation in any way we can. tonight the fbi director is making an impassioned plea in the fight between apple and the fbi. at the center of it all, the iphone of one of the san bernardino attackers. new word that the victims' families are now getting involved. >> reporter: an escalation in words as both sides in the iphone debate make their rounds and make their case. sunday fbi director james comey posted a message on the law fair blog reading in part, quote, the fbi can't look survivors in the

eye or ourselves in the mirror if we don't follow this lead. apple's attorney is firing back. appearing on abc's this week, ted olson argued there is no limit to what the government could require apple to do if it wins this case. >> apple has helped the fbi in this investigation and in every way the law required but it has to draw the line at recreating code, changing its iphone, putting its engineers and creative talents to destroy the iphone as it exists. >> reporter: at issue is a cell phone tied to terrorist syed farook. it belongs to san bernardino county where he worked. the fbi believes the iphone 5c could contain critical communications around the time of the mass shooting. agents got a warrant but don't have the pass code and can't buy pass apple's encryption technology without risking erasing what's on it. a judge has ordered apple to

help the fbi unlock the phone. the fbi director said, quote, we don't want to break anyone's encryption or set a master key loose on the land. but apple says it will appeal, arguing it would swing open the door to more demands the company violate the privacy of other apple users. now comes word all this real wrangling could have been avoided. san bernardino county paid for but never installed software known as mobile device management. at a cost of $4 a month, the service would have allowed the county to remotely unlock the phone. >> tonight reuters is reporting some of the san bernardino survivors are planning to file a legal brief in support of the government. apple has until friday to file an appeal to the federal order. on to campaign 2016. hillary clinton is wasting no time after her big win in the nevada caucuses. she came to the bay area to raise money. kpix 5's maria medina talked to people who paid big bucks to see the presidential hopeful.

>> reporter: robin reese just one of many who paid hundreds, if not thousands of dollars to see clinton in person today. >> how much was your ticket? >> $1,000. >> wow, and was it worth it? >> oh, yeah, for sure. >> reporter: the fundraiser was held at the home of the ceo of san francisco-based joyous. >> i think it's a really important election, there are a lot of issues she stands behind as a women. >> reporter: the line of clinton supporters went through tight security. our cameras spotted san francisco mayor ed lee just before the event. peter watkins loved across the home and said his street is no stranger to political events. >> at the end of this particular street bill clinton was doing a fundraising when he was still president. >> reporter: not everyone extended a warm welcome to the presidential hopeful today. a small group of protesters held signs feet from the line of supporters. >> i think she's not necessarily

a trustworthy candidate. >> reporter: despite her win in the nevada caucuses, clinton acknowledged she has work to do to per swaud -- persuade voters to trust her. >> i think it was a once-in-a-lifetime opportunity. you got this great feeling that she's completely confident that she'll get the nomination and be the next president. >> people paid between $500 to $27,000 to see clinton. she was about an hour late. but when she finally arrived, she spoke for 45 minutes. she also made a fundraising stop in piedmont. bernie sanders has been a strong opponent to clinton but kpix 5 political analyst melissa cane says the race could be in for a shakeup. >> her theory the whole time has been once i get in to a state that looks more like america, a

state that's more diverse, then i'm going to do really well. and that's exactly what nev -- what nevada just showed up. she'll outperform bernie sanders in those places and it looks really good for her heading in to south carolina and super tuesday after that. >> the democratic primary in south carolina is next saturday. senator sanders enlisted some hollywood star power today to help his campaign. >> you can feel the burn. don't you feel the burn? >> actor and san francisco native danny glover made an appearance at a rally in south carolina. glover had already endorsed sanders. this was their first time on stage together. as for opponents, sanders seems more concerned about who will be on the republican side in november. >> we have the momentum not only in the democratic primary process, if you look at national polls and you want a candidate who is going to defeat donald trump, you're looking at that

candidate. >> while he may be confident, polls show sanders well behind clinton in south carolina. the republicans are now focusing on nevada. the caucuses there happen on tuesday. the gop field has narrowed. it's now looking like a three-man race for the nomination. marco rubio is targeting the democrats. donald trump knows the race is far from over. and ted cruz believes he's the man that can defeat the billionaire. >> the democrats do not want to run against me but i cannot wait to run against them. >> dealing with very, very talented people, smart people, good people. i think they'll be competing. >> it's becoming clearer and clearer that we're the one campaign that can beat donald trump. indeed we're the only campaign that has beaten donald trump. >> rubio picked up another endorsement today. nevada senator dean heller is backing him. dramatic new images of a mega bus that caught fire near chicago. the bus was headed to

minneapolis when it suddenly went up in flames. all 40 passengers and the driver made it out okay. one of the passengers managed to record the fire. he says about an hour in to the trip they heard a loud noise in the back of the bus. >> higher and higher flames all over the place. it was pretty messy honestly. >> the fire destroyed the bus. it's not clear what started it. and tonight new insight in to this helicopter crash caught on camera in hawaii. the aircraft made a splash landing in to pearl harbor last week. the pilot and family of four survived thanks to good samaritans and chris martinez has the hero's story. >> reporter: this video captures the moment a tourist helicopter plunged from the sky. what it doesn't show is the daring rescue that came after sean winrich put down his camera. >> a bunch of people jumped in the water and we tried to help them. >> reporter: 57-year-old navy

veteran juan nevario. he and his family were planning to visit the pearl harbor memorial. when he witnessed the crash, an instinct took over. >> ran out in all my clothes and swam out as fast as i could to the helicopter. >> reporter: he found a woman. as he swam with her to shore -- >> the lady started yelling please help my son. he's only 15 years old. he's stuck in the helicopter. please get him out. >> reporter: he says that teen was still strapped in his seat as the helicopter began sinking. it took rescuers nearly 10 minutes to free the boy and bring him to shore where his wife, alisia, a critical care nurse, was waiting. >> we need to do what we can to this young boy. >> we were all strangers to each other but everybody collectively was able to work really well with one another. >> reporter: the pilot and family of four canadian tourists all survived. as for valerio's family, they never made it to the pearl harbor memorial but their two sons got a valuable lesson about

bravery and courage. >> it makes me feel very proud that i know they can do that, i can do that. anything could happen. any second is precious. >> reporter: chris martinez, cbs news los angeles. a redwood city man was also among the rescuers who helped the family. max burner was walking near the beach when the helicopter came down. he ran in to the water and helped pull the victims out. a billboard in walnut creek is sparking conversation about israel. some are calling it a political message. but kpix 5 john ramos reports the group behind it says it's just the facts. >> reporter: even on a sunday, interstate 680 through walnut creek gets a good deal of traffic. that's why businesses advertise on billboards here. but there's one sign that's designed to sell something very different. >> i hope it accomplishes awareness and a debate. >> reporter: the message is actually very simple. it points out the amount this country gives to israel each day for military spending and

support. allison weir is executive director of the internet-based group that paid for the billboard. >> we feel american citizens should be aware of this fact that this is a large proportion of our money. it's far more than we've given to other countries around the world. >> reporter: dan la porte, president of the synagogue, says while the words may seem merely factual, there's an agenda behind them. >> i think the message is we shouldn't be sending that money to israel and should be using it for other things. >> reporter: weir says the message on the billboard is undisputable. >> do you think you're being provocative with this? >> we're just telling people how much of our money goes to a country. >> i don't think it's an attack. what i do think is when it's presented in one sided fashion,

it really ends up being a little bit unfair. >> reporter: but soon the other side will have its say. today is the last day of the billboard's run. and it will be replaced by one from a pro-israel group. the billboard debate will continue. but how many minds are changed is anybody's guess. in walnut creek, john ramos, kpix 5. the billionaire co-founder of sun micro systems is still trying to keep people off half moon bay beach. he's asking the state for $30 million in exchange for access to martins beach. the billionaire bought a beach front property in the area in 2008 and closed access two years later. the state has been negotiating to purchase a public right of way but negotiators say at least $30 million, it's just too expensive. while homelessness has been making headlines in san francisco in recent weeks, a north bay community might face an even bigger challenge.

the small reserve front town has a homeless rate four times that of san francisco's and that isn't the only issue. wilson walker shows us what's happening to the water. >> it's a beautiful amazing place. we have thousands and thousands of visitors come here from all over the world each year. all we want is this to be healthy, clean, and safe for everybody. >> reporter: in the normally quiet town of guerneville, the debate over homelessness has gotten down right loud. >> there are lots of people who are angry about it. >> reporter: because where this town ends, another community begins. >> absolutely. you're just seeing a grain of sand here. if you trek along the riverways you're going to find more encampments. they're everywhere. >> this is what everyone is talking about. you're looking at one of the homeless encampments along the russian river. but while there's a real sharp and often bitter division in this community over what caused the problem and how to resolve it, there's one area of

consensus. >> it's about the river and taking care of the river and keeping the stuff from going out in to the river and out in to the ocean because it's the environment that's getting impacted. >> reporter: the trash comes in all shapes and sizes, from simple litter to electronic waste. and a single rainstorm can send any of this in to the reserve and ultimately the pacific ocean. as for the human wast, the environmental protection agency cites these camps as one source of bacterial contamination and a potential health threat to anyone in the river, including the homeless themselves. >> whether they're supposed to be in these places or not, it's not really what i'm concerned about. for me it's mostly about giving them an opportunity to take care of their camps and keep it clean and try to take care of the river with us. >> reporter: when chris brocade started the clean river alliance he had no idea he'd effectively become a social worker. but it's meant reaching deep in to the forest and personally investing the homeless in the fight against pollution. >> you guys are bringing out

lout of trash. within the last couple of weeks we've gotten over 3,000 pounds of materials by the highways for us. >> reporter: all that progress could easily be lost. >> are you guys staying in shelter? >> yeah. >> reporter: the shelter is seasonal, meaning the camps and the trash could explode again come spring. >> it's a community issue. everybody has to be onboard. >> reporter: so while a divided community searches for a long-term solution to this problem -- >> some of these issues are systemic and holding the sign and waving and saying we want our town back is complete rubbish. >> reporter: some are simply truth to keep the problem from spilling in to the water. in the russian reserve valley, wilson walker, kpix 5. >> the county is now debating if and where to add an additional service center in the

guerneville area. the sheriff's office tweeted out this picture saying its team had to rescue a 10-year-old girl. the team was in the sierra for training at the time. the girl had fallen in to freezing cold water when a snow bridge collapsed in the boreal castle peak area. a mountain lion captured in santa cruz is back in the wild tonight. the state fish and wildlife department had to tranquilize the animal. it was first spotted in the backyard of a home and captured north of highway 1. the mountain lion was later released back in to the wild. officials say the young female may have been attracted to the urban area because of the large numbers of deer in the neighborhood. time now for a look at our work week forecast and the next chance of rain. here's brian hackney. >> a sunny sunday in the bay area will give way to a fairly clear week ahead. a chilly start as we head out

the door tomorrow morning. the readings only manage mid 40s. with plenty of sunshine around in the early going, then by tomorrow afternoon, look at this. the number skyrocketed all the way in to near record territory with readings as high as the low to mid 70s in parts of the bay area. once it gets there it's going to stay there for much of the week. high pressure is parked over the west coast. highs in the 70s in the week ahead. little rain in sight. but there's a little bit which we'll discuss in a minute. the storm track pushed well to the north because of the high pressure bubble that will be over the bay area for the next few days. futurecast shows for tomorrow, this is a picture of the sky conditions. the skies are mostly transparent with nothing coming in the day tomorrow. mostly all this week we're going to have severely clear skies. it will be clear and chilly tonight. lows will be in the low to mid 40s for the most part. then all week long, sunny and warm weather. temperatures will be in the 70s and then a hint of some rain

coming in by the weekend. but at this distance, the weekend is a good ways away. things could change so it could turn in to more rain or no rain at all. at least a suggestion something might happen by late friday and saturday. tomorrow there's going to be some fog in the southern half of great valley where tomorrow's high will be 68 degrees. 72 at redding. beautiful mendocino, 69 degrees. eureka, a temperature of 59 up there. monterey had sunshine and 70 degrees. overnight lows tonight, mostly in the low to mid 40s. sun up at 8 minutes before 7:00. then by tomorrow afternoon things would be warming up by 10 degrees above average. san francisco tomorrow, 70 degrees. in san jose we'll look at a temperature in the mid 70s. 74 there. mid 70s for everybody. that mirrors what's happening in the east bay. readings in the low to mid 70s. up in the north bay, santa rosa

at 73 degrees. ukiah tops at 74 tomorrow. and sunshine. extended forecast, warm will be the theme of the week as we have temperatures topping out in the low to mid 70s by wednesday and thursday. a little bit cooler on friday and a hint of some rain coming in on saturday. while we need the rain, might as well enjoy the sun. because we don't have a choice. the commute might get a little easier for east bay drivers in the morning. the westbound express lane will open on 580. the eastbound lane opened on friday. drivers need a fast track flex toll tag to use the lanes. they run from dublin at the 680 interchange all the way through livermore. express lanes will operate monday through friday from 5 a.m. to 8 p.m. still ahead, a new water crisis. this time in new york. the toxic substance found in one city's drinking water. >> game day show bottom of the hour. the warriors added a new player

a toxic chemical has been f ing water in the there's another water crisis tonight, this time in upstate new york. a toxic chemical has been found in the drinking water in the town of petersburg.

it's called pfoa and is used in stain resistant coatings. officials are trying to figure out where it came from. some believe a plastics plant is responsible. people are now being given bottled water until officials can clear the system. flint, michigan is still dealing with its water crisis. high levels of lead have been found in the water supply. the contamination started two years ago and is believed to be behind a disease outbreak that's killed 10 people. several lawsuits have been filed. we'll be right back. ,,,,,,,,,,,,,,,,,,,,
