the man wanted in a hit-and-run crash in castro valley is in custody. >> good afternoon, everyone. i'm frank mallicoat. >> i'm michelle griego. chp believes 29-year-old daniel morris was the driver of a stolen black ford fusion that struck a boy as he was walking with his grandmother and brother last monday. officers say morris kept going, crashed a car into a pole and ran off. the 6-year-old boy was left with injuries so severe he may lose his legs. more coming up at 5:00. our second big story, two people are fighting for their lives after being shot in berkeley this morning. it's the second shooting in the city in less than 24 hours. anne makovec reports, they don't appear to be random. >> reporter: you can see the glass from several broken car windows still on the sidewalk at the scene of this morning's shooting. the shooter still on the loose. it was just after 1:00 a.m. when police got reports of gunshots five-day forecast near

tremont and prince. when they got here they found this car nearby a man and woman in their 20s in critical condition. >> it doesn't appear to be random. >> reporter: on the window of the car stickers for the ridesharing companies uber and lyft. >> as to whether or not either parties involved were drivers for either company, we don't know that at this point. >> reporter: lyft sent us a statement saying, we are actively reaching out to the driver to provide assistance and stand ready to support in any way we can. in morning's shooting was two miles from a the shooting in broad daylight yesterday. it was just before noon a man was shot here on delaware and san pablo. no arrests have been made in a crime police describe as targeted. we talked to neighbors who weren't shocked. >> it's not great but then again i'm not too concerned. >> common stuff every day. >> reporter: police say this kind of activity is unusual in berkeley. there have already been nine shootings so far this year.

last year, it was 13 total. >> we'll get the information and see if it's going to change how -- what strategies we are going to use to approach deployment of our officers. >> reporter: police aren't hearing suspect descriptions in either case. in berkeley, anne makevoc, kpix 5. chp is investigating a shooting on 880 near richmond parkway in the eastbound lanes. a woman told the chp a green toyota was alongside her car when a passenger rolled down a window and pointed a gun at her, he then fired several rounds into the air. nobody was injured. the incident have been hang on interstate 80 since november between berkeley and pinole. two of the shootings were fatal. let's take you outside. a live look at the bay bridge toll plaza looking like the morning commute. traffic backed up in the maze after a motorcycle crash on the upper deck about 9 a.m.

the crash temporarily blocked two lanes near the fremont street exit in the city. one person was taken to the hospital. happening today, a city advisory committee will hear a plan that would make it harder for san jose landlords to raise rents. the proposal would tie annual rent to inflation. landlords would not be able to hike rents past the consumer price index each year. that number typically between .7% and 2.8%. right now, the cap is 8%. also on today's agenda, pot. kpix 5 reporter kiet do on the marijuana rules being reconsidered in san jose. >> reporter: san jose has some of the toughest marijuana laws in the state. but the one that has the industry grumbling the most is the requirement that they can only sell what they grow on site. but that can all soon be changing. that's because councilmember has written a memo to the rules committee requesting san jose hold off an enforcing the law until state law is more clear.

he says it looks like california is moving away from requiring on site growing and san jose should wait to see how it shakes out. san jose's law started in 2014 as a way to the battle sales to recreational users. but many dispensaries went out of business and those that are left are warehouses or operating illegally. councilmember ash cholera joined us via facetime. >> we want to make sure that as the state moves forward, that we're making regulations that are sensible and consistent with state rules while still maintaining local control to keep our communities safe. >> i support many of the elements of the councilman's proposal. i think the details need to be hashed out. >> reporter: the rules committee meets today at town hall at 2 p.m. kiet do, kpix 5. new details this noon about president obama's pick for the supreme court. 63-year-old merrick garland became chief judge of the u.s. court of appeals in washington, dc in 2013. he is a respected liberal.

service to the nation's second largest subway system is shut down today due to safety concerns. official in washington, dc made the decision to inspect all cables on the metro system following a tunnel fire on monday. the shutdown is expected to last until tomorrow morning. and as you can imagine, it's creating congestion on the roads. some city buses are up to a half-hour late. starbucks adding cherry blossom frappucino to the menu, strawberries, cream, with chocolate sauce. you can see get it starting sunday. perfect timing because that's the first full day of spring. and it's about 3,000 calories.
