jackie ward joins us live in oakland with a shocking allegation brought to court today about what the deputy did next. jackie. >>reporter: frank, that photo tt we saw at this press conference shows how badly [indiscernible] was beaten. the attorneys are planning on filing a lawsuit, but first they filed this claim and now need to wait 45 days until they pursue a law site. in the files you can read he was beaten with a steel baton on his head, neck and back. he never tried to flee. after their attorney pleaded for help, he was pushed into the pavement and held him there for a meeting. this is the end of a high speed chase that ended in the san francisco alley. >> it was [indiscernible]. but what was more wrong was deputies violating their duty and inflicting deadly force when there was no

justification for any force when a person has surrendered. >> in addition to him saying deputies used excessive force, he says that deputies stole his gold necklace and cash and used it to keep a homeless couple quiet. deputies are on leave. one is a veteran. >> jackie, did the officers have on body cameras this happened? >> they did, but for the department's policy, they don't have to turn them on. body camera footage was released ten days after this happened. it's in the hands -- >> jackie ward, thank you so much. no one will face criminal charges in the balcony collapse that killed 6 students. the alameda district attorney announced today. there's not enough evidence to file manslaughter charges.

7 others got hurt when the balcony gave way at berkeley. the da is looking into if she can pursue administrative action against the construction company. right now, a jury is deliberating a stanford rape case. turner says that the victim agreed to have sex, but they said the victim had 3 times the legal limit of alcohol in his system. san jose council will vote on regulations for marijuana dispensaries. kith shows us this could slap huge fees onto the growing business. >>reporter: running a medical marijuana business in san jose could get expensive because later today, the city council will consider establishing a brand new marijuana division and it will not come cheap. the new division will oversee the registration process and

current laws and collection of taxes. the city says it will take 3 to 4 new full time employees and cost nearly $3 million a year. that cost would be split evenly between san jose dispensaries which is $175,000 per business per year on top of a business tax they pay every year. >> oakland is not creating a medical marijuana division. san francisco is not creating one. no one in the state is doing it, but san jose feels the need to stipend money off businesses and put it in the pockets. >> the marijuana delivery have been banned in san jose since 2011. with the state debating it -- he has urging the city to get in line with state regulations. >> we don't what to be so far out from what the rest of the state is doing. we need to work with state and

>>reporter: a hostage scrambles to safety jumping out of a cockpit window during an hijacking. he was arrested where he forced the aircraft to divert and land. it began on an early morning flight from alexandria to cairo. he said he was wearing a suicide belt. official named him as mustafa. he released 49 hostages including two americans. he kept the pilot and copilot and several others onboard. there was an earlier press conference. >> in any case, it's not something -- >> the high deck remains unclear. witnesses say he threw a lesser on the tarmac and asked to be -- he threw a letter on the tarmac and asked it to be
