a far cry from last year. vandals turned oakland's auto row into an auto wreck smashing more than 60 cars at one dealership alone, broke windows, sprayed graffiti and started small fires in businesses along broadway. in san jose hundreds marched near city hall this afternoon to demand living wages, fair and humane immigration laws and respect for indigenous communities. various labor rights groups and unions organized the protests. hundreds celebrate the annual wine festival in the city, but john ramos shows us for one family this weekend is a time to mourn. ere gathering.no >> reporter: it's hard to find a parking spot downtown during the livermore wine country street festival. thousands of people arrived this morning to taste local wines and just generally have fun, but at a park just down the street from the festival there was another gathering, not nearly as big, not nearly

as fun. these are the family and friends of esperanza morales rodriguez. a year ago she and her 14-month- old daughter ulidia were hit and killed on the walk by an accused drunk driver. >> he killed the whole family. >> reporter: the suspect 36- year-old brian jones had just come from the wine festival and had a blood alcohol level nearly twice the legal limit. at today's vigil the family wanted everyone to know that what happened was no accident. >> he was drinking and driving and speeding, i mean you kill someone, that's a crime because you killed them. it's not just an accident. >> reporter: there were signs at the festival today encouraging not to drink and drive, but the problem may be for a lot of people wine tasting may simply not be seen as drinking at all.

>> wine, beer, hard liquor all have the same amount of alcohol in them. they are alcohol and people need to be careful how much they consume. >> i know that hey, it's just a cup of wine. nothing's going to happen, but after one comes another, another, another and at the end they don't look at the consequences of what could have happened. >> reporter: that's why the victims of drunk driving close this spot for their vigil, to get those heading to the festival to think about what could happen by reminding them of what did happen. in livermore john ramos, kpix5. >> the suspect in last year's deadly crash is currently in jail facing two counts of murder. he is reportedly charged with a previous dui in 2003. the muni and ocean view line is back up and running after a light rail vehicle collided with a car around noon near ocean avenue and eucalyptus in the lakeside neighborhood. no one was hurt. passengers used bus shuttles

while the scene was cleared. no word on the source of a natural gas odor that prompted a lot of calls to pg&e. people in alameda, san leandro, oakland and castro valley reported the smell after 7:00 last night. fire and pg&e workers spent several hours searching for the source but couldn't find any leaks. the smell has since disappeared. san francisco politic suddenly got a big infusion of extra cash. the donor? airbnb. according to the san francisco ethics commission, the home sharing site poured about $232,000 late last week alone into campaigns for moderate democratic candidates and their issues. the donations come just days after progressives at the board of supervisors threatened to impose fines and even misdemeanor charges for home sharers in violation of city hauls. >> they are intensely swaying the election -- city laws. >> they are intensely swaying the election. they just dropped a quarter

daughter to class with a device, the school district shut her down. >> we don't sleep much. it has affected our relationship. it has affected our ability to go out in the community. we're always exhausted and constantly living in a state of fair. >> reporter: the past few years darcy cotton has slept on the couch worrying that her 6- year-old autistic daughter jayden will wander out of the front door of their bakersfield home. safe >> i would say that we have to take precautions 24 hours a day seven days a week. jayden requires constant monitoring. >> reporter: after searching for a solution darcy came across the angel sent gps fracking device. >> to me this is a life saving device and at one point i believe it will save her life. >> reporter: the divorce is born like a belt and -- the device is worn like a belt and cannot be removed without a key, but for now the school district won't let jayden wear it to class. the superintendent says there are concerns it could pose

privacy risks for other students and staff and it doesn't qualify as a medical necessity under jayden's individualized program. >> as close as we can get to it right now, it would be like allowing students to come with smart devices and have them on and being used at all times during the day and our board policy right now does not allow that. >> the superintendent said he's committed to working with the family to find a solution and make sure jay den has a safe environment where she did learn. pilots at the sun power solar impulse 2 are getting ready for takeoff from the bay area. last weekend they completed their latest leg of the round of the world journey with this touchdown at moffat field and fittingly they will leave from moffat field as they arrived, in total darkness. that's where we find kpix5's maria medina out at moffat field. >> reporter: i could have tied down my hair, but i wanted to show you just how windy it is here. the solar impulse team promises

the wind will die down enough for takeoff at 5 a.m. tomorrow. it will take about 16 hours for them to land at phoenix, arizona, but they say their stop in the bay area has been unforgettable. >> arriving at the golden gate from hawaii and turning in the bay for a couple of hours, that was such an experience. >> reporter: in less than 23 hours the solar impulse 2 will take off to phoenix from moffat field where it sat since its historic landing from hawaii last saturday. crews waited for the wind to die down. >> we could have taken off friday, but there were crest winds that could have pushed the plane too much out of track. >> reporter: they flew 62 hours from hawaii. his co-pilot will take the flight to phoenix in the plane that uses absolutely no fuel. its propellers and batteries are charged instead with thousands of solar panels. the plane can essentially fly forever. the crew is attempting to fly around the world pushing its message of clean technology.

powerball 14, but no one hit all six numbers meaning the jackpot stands just under $350 million now. by the way, winning bay area ticket was purchased at the valero on saratoga avenue. that store will get a $6,000 bonus for selling that ticket. you wouldn't think it on a day like this, but plenty of sunshine and mostly clear blue skies that there are thunderstorms popping in parts of california not so far from the bay area. we fired up the cbs5 hi-def doppler to show you pretty good thunderstorm action and it will die down when the sun sinks lower in the horizon, a little snow in the mountains. back in the bay area not much. we've got build justifies over mount diablo and the range and thunderstorms above the san bonita peak in my home valley.

all of those thunderstorms blossomed in the afternoon and also on the did iable low range which goes -- diablo range which goes all the way down to southern california. we have a few fair weather cumulussing up over our range and the numbers now still 81 in corps cord, san jose 77, santa rosa 72 degrees, livermore at 79 right now. winds tomorrow morning, not bad, a lot of calm in the forecast until tomorrow afternoon when they pick up to about 10 miles an hour out of the north for san jose and out of the south for santa rosa, fairly mild day monday. as low pressure kicks out to the east, high pressure gets bumped to the south. as the high pressure lowers, the temperatures cop down a little tomorrow as much as 10 degrees. so look at the futurecast. plenty of low clouds tonight are working their way in and rapidly pulling back during the daytime to give us mostly sunny

dennis is live at the tanks. >> reporter: what a day to be a bay area sports fan. you could have done a doubleheader, started with the warriors and ended with the sharks. in their second round series they lead one game to one over nashville right now, 2nd period, no score. meanwhile the golden state warriors, let me tell you about the warriors minus steph curry. he within out with that knee injury. since he has not been playing the warriors have outscored their opponents by 72 points. game one today against portland, the warriors opened their 2nd round series and steph curry out with the knee sprain, but once again golden state offense didn't seem to miss curry. klay thompson hits the long three, 8-2 car yores. thompson 18 in the 1st quarter. andre iguodala drives and scores on the layup. warriors led 37-17 the end of the quarter. with a minute left in the half

18th. anne makovec, cbs5. the road to the white house runs through indiana this week. the presidential candidates are wrapping up their weekend there ahead of the state's primary on tuesday. a new nbc wall street journal poll puts trump ahead of ted cruz by 15 points in the hoosier state, but who really knows because just yesterday there's another poll that had cruz in the lead by 16 points. here's a look where the delegate count stands now, donald trump just shy of 1,000 delegates. he needs 241 more to clinch the nomination which could happen here in california next month. 218 dele on the democratic side hillary clinton has a commanding lead over bernie sanders, another 218 delegates and she'll wrap it up. it is official. president obama's oldest daughter is headed to harvard. malia obama will graduate high school in june, but she's the in a huge rush to walk harvard's hallowed halls. she'll start in the fall of 2017 after taking a gap year. harvard only allows about 100

president of the united states. >> people see something from the irs and get concerned. >> reporter: but tax attorneys say you shouldn't be concerned. when a company doesn't pay its taxes, the irs has other ways to get their money. it can seize assets or intercept money owed to the company by customers like johnson. >> it's just a matter of trying to collect. >> reporter: the irs wouldn't comment on the case, but an employee at this walnut creek office tells us they've been getting a lot of calls from people concerned about these notices. bottom line. if you get a notice of levy from a company you've done business with, your only obligation is to reply stating you've already paid in full or send the remaining balance to the irs instead of the company. >> i paid him off each time in full. >> reporter: quite a relief for johnson who by the way, loves his cabinet, just not what the owner of the company put him through. if you receive a notice like this, you are required to respond to the irs to let them know whether or not you still
