good afternoon, i'm kenny i breaking news. a man killed in a construction accident in san francisco. good afternoon. that construction worker has died in a tragic accident at the moscone center. police responded to a call around 8 a.m. on 3rd street between howard and folsom. we are told the worker was in

the bucket of a large cherry picker when the accident happened. >> a worker for a rental equipment company was picking up a piece of heavy equipment, um, and he got pinned against a cement concrete structure. 911 was called immediately. unfortunately, they were unable to resuscitate him. >> the victim had been working on a high-rise expansion project at the moscone center. a san jose elementary school is working fast to contain a flu outbreak that's infected nearly 100 students. kpix 5's kiet do on how the school is trying to stop the spread. >> reporter: the forecast in downtown san jose today, sunny with highs in the mid-70s. nonetheless, here at horace mann elementary school, they will be on their rainy day schedule where kids stay indoors all day including both lunch and recess. they are trying to contain a massive stomach flu outbreak. you're trapped indoors all day today, lunch and recess.

>> yay! we'll play games! >> reporter: the district calls it social distancing where they limit the contact between students, to try to stop the spread of germs. today, they got another six cases reported pushing the total to 96. these two just got over it themselves. how was it getting this sickness? >> bad. >> reporter: what happened? did you throw up? >> yes. >> reporter: how do you feel now? >> good. >> reporter: today after school crews come in for a third day of deep cleaning the campus. the school will then be locked down with no weekend events and what's more, six nurses are on campus helping out and reminding children to wash hands. rick carlson says, good luck with that. >> we stress, you know, watching hands and, you know, um, but they don't listen. >> reporter: this all started when a student was vomiting in class april 29th. since then, they have been averaging about 6 to 7 new cases a day and nurses say it's not slowing down as much as they would like. as part of the stepped up

efforts, the aladdin musical is postponed. are you mad that other kids got sick? >> it's normal that kids get sick. there's something going on. i'm not mad. >> reporter: potentially disappointing news about that aladdin musical. if they cannot drop the number of new cases down to zero by the end of the school year, they will have to cancel the musical altogether. last day of school is june 2. kiet do, kpix 5. san francisco police chief greg suhr is speaking out for the first time since four supervisors joined a group of protestors pressuring him to step down. >> so i know that we are also committed to the reforms that are going forward and the reengineering of the way we use force and especially the way we deal with the mentally ill, sadly of which there are many here in san francisco. but the amount of police work that's being done and the work being done deep the city safe and in our neighborhoods has never stopped. i mean, that's my job. >> mayor ed lee is still standing by chief suhr.

he calls the supervisor's latest moves politicizing and says he is committed to maintaining trust and transparency. >> i think we are and we got oversight by the professionals at the department of justice. i don't need four supervisors who are not professionals doing their political thing. i need them to pay attention to the reforms that we're putting out there and invest in that because that's what the public wants. >> mayor ed lee and the chief met with business and community members at a cafe. at least two other services are standing by chief suhr. a man is recovering this afternoon shot while driving on a freeway, i-80. this is the latest in a spring of freeway shootings. it happened last night around 10:30. officers say that the victim was driving this nissan altima when a driver and in a while sedan pulled up, shot into the car. the driver had two gunshot wounds to the leg. he will be okay. governor brown laying out the framework for increasing money to the state.

sean bennett is live outside the state capital with what the revised budget means for us. sean. >> reporter: there are so many things to digest, michelle. governor brown just wrapped up his revised may budget to a room filled with reporters from all over the state of california wanting answers and to know is the state going to be okay? governor jerry brown did maintain, though, his call to put an extra $2 billion into california's rainy day fund despite the lagging revenues. now, brown did say the state's primary physical goal should be fully filling the state's rainy day fund before the next recession beginnings. as far as some of the highlights from today's revised budget, brown is protecting social services from the devastating cuts they suffered during the great recession. as far as where the state stands now, here's more from the governor on that. >> california has done remarkably well but, like everything else, things don't last forever. right now, the surging tide of

revenue is beginning to turn. >> reporter: now, brown did say barring any significant changes, the budget over the next two years, the budget will be balanced. the years following that with shortfalls forecast to exceed $4 billion by 2019. live in the state capital, sean bennett kpix 5. in campaign 2016 it seems the rise of donald trump has incentivized california democrats to register to vote. california's secretary of state says that the number of registered democrats has risen since january, republicans are losing ground. according to the figures, democrats are locked down 44% of all registered voters. republicans make up 28% of the electorate. this is ahead of next month's primary. the obama administration is weighing in on how schools should treat transgender students. the new federal guidelines come as the debate over which bathrooms transgender people

should use spreads to more states. cbs news' weijia jang has the story. >> reporter: every public school in the country received this letter this morning from the department of education and justice. it offers guidance for how transgender students should be treated, especially with regard to bathroom and locker room access and housing. the guidelines dictate that transgender students are not to be discriminated against and should be treated consistent with their gender identity, even if it differs from school records. it's days after the obama administration ordered north carolina to repeal its law requiring people to use bathrooms corresponding to their actual gender. >> this action is about a great deal more than bathrooms. >> reporter: the lieutenant governor of texas says he will not enforce the guidelines. >> the president does not know the line he crossed this time. when you take on mom and dad in their homes, when the president threatens their children, um,

he has made a huge mistake. >> reporter: the obama administration letter cites title ix and warns noncompliance could cost schools billions. the guidelines say as a condition of receiving federal funds, a school must not treat a transgender student differently from the way it treats other students of the same gender identity. while some districts are welcoming the new guidance, many say school administrators are facing much larger problems. weijia jang, cbs news, the white house. >> a court will decide if north carolina's law violates title ix. the white house says the state will continue to receive federal education funds until the matter is resolved. an air force four star general will become the nation's first woman to lead a combat command. today general lori robinson will be sworn in to head the north american aerospace defense command or norad. she will oversee all defense of the skies over canada and the united states. she was chosen for her experience in defense as well

as her strategic military acts. new trouble for the tsa. a major meltdown over baggage. kris van cleave tells us thousands of pieces of luggage piled up at one u.s. airport because of a computer glitch. >> reporter: checked bags were everywhere but where they were supposed to be. even filling what's normally the cell phone waiting area. more than 3,000 missed their flights out of phoenix sky harbor airport thursday due to an unprecedented server failure that crippled the tsa preventing officers from using machines to screen the luggage. >> it's very stressful because i hope that everything that i packed is tell you in there after people have checked it. >> reporter: -- hope that everything i packed is still in there after people have hand checked it. >> reporter: it could take days for him to get to their destination but across the country there are long slow lines at tsa checkpoints frustrating flyers and complaints with coming from congress too. >> it's a huge failing government program. >> reporter: at a hearing

engage, meaning drivers cou subaru is recalling 52,000 cars due to a steering glitch. some of the steering columns fail to engage meaning drivers could lose control of the car. the company has stopped selling its 2016 and 2017 subaru legacies until the problem is fixed. owners should not drive them until they get their cars checked out. the recall also applies to 2016 and 2017 out back models. shares of j.c. penney tumbled today after the retailer reported a surprise

say, hey, the skies should be called pooky. i don't know what he means by that in redwood city. i have no idea. i just wanted to say the word pooky on tv. no, actually, i think he means it's like we have some sunny breaks and holes in the clouds, something like this, where we had the layer of low clouds over the city of san francisco. and then we have a few sunny breaks. temperature-wise 58 degrees in san francisco. it's cool and breezy. temperatures in the 60s across the board from san jose to the north to santa rosa. this is that very deep marine layer that's been hanging tight to the coast all enhanced by that right there. that area of low pressure part of the glitch in our satellite imagery there from goes west 10. there you have it. that low is encouraging and enhancing that marine layer. it's beginning to retreat now and the winds are increasing. a stiff sea breeze west 14 miles an hour in san francisco across the bay 11 in oakland, 15 in san ramon. fairfield breezy. clouds are slow to clear at the coast but we got the sunshine

around the bay. now, this area of low pressure is spinning for days off the coast and as it gets closer and closer to san francisco, a chance of showers on saturday. this is our futurecast. here's your evening commute where the marine layer begins to push back onshore and then you have the clouds and the rain showers offshore for saturday morning. it looks like by sunday we see the low slip to the south so we'll have better weather on sunday than on saturday for outdoor activities. 80 degrees at the state capital today. gorgeous in the high sierra at 71 degrees. we are playing out our numbers like this. seasonal actually. 50s at the coast. 60s around the bay up to the mid-70s away from the bay out towards fairfield. here's your sundown at 8:12. your sun-up at 6 a.m. seasonal high temperatures today but boy, feels cooler because -- it is! 10 degrees cooler inland today. and there's your extended forecast. we have nothing but sunshine and a dry weather pattern as we

but it's important to know t ore a i found a couple of new friends. cats are great companions but it's important to know what you're getting into before you adopt one of the our pet expert dr. jill chase is here today with some tips. first of all, we have to introduce minerva and postcy named at buster posey because the children in the household are giants fans. >> what do we need to know? >> i think the first thing is it depends on household. if you have children, are they really little children or are they like this family a little older so they can handle having a kitten in the household without damaging the kitten in the process? are you looking for an older cat? sometimes it's nice when people adopt older pets because they need homes and, you know, it's great that somebody takes that on. >> so you want to think about that. >> you want to think about your living conditions, apartment or house? is it going to be indoor or outdoor cat? and then once you've answered those questions, then you can

go in knowing what you're looking for. >> so how do you know if you're ready for one or two? i'm looking at minerva and posey and i want to take both of them but they may get big, but not so big. [ laughter ] >> so, actually it's kind of fun of if you just get one, if you adopt even one cat they tend to be more bonded to the human. if you get two cats, they tend to bond to each other and to the humans. so cats that are singly raised tend to be more people like, they tend to be more companions. the cats that are together here will be fun but they like to run around and play and they have each other to keep them company if you're working. that's nice to. >> dr. jill, thanks so much. thanks for bringing them in. they were so good. everyone wants to get away from me as quick as possible.
