brendan o'brien who killed himself last year leaving a note admitting he had sent celeste inappropriate texts and alleged other officers did more. >> now to campaign 2016, fresh off a win in oregon, bernie sanders will soon take the stage at a rally in the south bay. kpix 5's kiet do is live in san jose where thousands of people are lining up to see the vermont senator. kiet. >> reporter: live here behind the main stage looking through the vip area here at the santa clara county fairgrounds. it is hot, the crowd is energetic, amazingly so. and they are being entertained by joan baez. it's a good thing, too, because they will have to wait another hour before bernie sanders takes the stage. it's nearly impossible for him to win the democratic nomination. but he has promised to contest california anyway until the last vote is cast. they were feeling the burn, all right. 90-degree heat didn't matter. robert was the first person in line who got here at the santa

that we want to pursue. >> reporter: sanders was in southern california yesterday. his third appearance in the state in two weeks. his presence in the bay area is a sign he is not conceding to hillary clinton. a state delegate from iowa drove in tonight. why are you here in san jose now? >> all the supporters of bernie, thousands and thousands of supporters, because they know that there's nothing more important than saving democracy which is government by the people by all of us not by billionaires, corporations or wall street. >> reporter: they are obviously worried about people fainting from the heat out here. the speaker just reminded people to drink water and bend their knees so they don't collapse from the hot temperatures out here. again, they have to wait at least another hour before bernie sanders takes the stage and after that, he is headed to vallejo for a 7:30 p.m. speaking engagement. live in san jose, kiet do, kpix 5. homicide detectives are on the scene of a death in san jose. around 7:30 a.m. officers responded to a call near berryessa road and spotted

a white van partially submerged. a man's body was also found. chopper 5 was overhead as investigators worked to determine how it ended up in the water. dive teams were called in to look for other potential victims. so far the man appears tonight only one. a pittsburg police officer was aiming his gun at one man but shot three. anne makovec has more on the incident and what started it. >> reporter: you can see the bullet holes there in the door where a father and two brothers were shot last night by police. this was the scene just after 9 p.m. last night when three family members were being loaded into ambulances on kingsley drive. >> officers reacted as they were trained. >> reporter: it started with a mother's call to 911 about her 20-year-old son rigoberto gutierrez pointing a gun at family members.

those family members were standing behind this locked security screen door when police showed up to confront rigoberto. >> giving commands to show his hands. he did not. he immediately reached for the firearm. >> reporter: they shot at him at least five times hitting him in the leg and through the door accidentally hit his father in the torso and 17-year-old brother in the leg. >> they were struck as a result of his actions. >> reporter: all three are expected to survive, the brother facing charges of assault with a deadly weapon. >> when the suspect is released from the hospital he will be transported to county jail. >> reporter: this shooting is under investigation by the pittsburg police department and the contra costa district attorney's office. in pittsburg, anne makevoc, kpix 5. >> the officer who fired the shots is on paid administrative leave. in less than an hour the san francisco police department will announce a reward for information in the case of a missing 2-year-old girl. police believe that arianna fitts could be in danger. her mother nicole fitts went missing on april 1 and was

found murdered a week later in mclaren park. the fbi and police have executed search warrants and seized evidence in several cities, but they have made no arrests. police are now calling the death of a millbrae father of two a homicide. keith green was found dead last week in a field off highway 101 near healdsburg. he had been missing since late last month. police are not releasing how he died for fear it could compromise the investigation. so far, no arrests have been made. grief counselors are on hand at a high school in alameda today after a student's sudden death. a football player from encinal high school collapsed on the field around 6:15 yesterday during practice. the 15-year-old was rushed to a hospital, where he passed away. he is giovanni pulido of oakland. one friend's twitter says rest in peace. another person writes be grateful for the people you got in your life because one day they may not be there anymore.

state water officials could decide to ease up on drought restrictions after a wet winter. the water resources control board may give local water districts the power to determine how water should be distributed. members are meeting today in sacramento. a group of key conservatives is heading to facebook headquarters in menlo park this afternoon for a meeting with the ceo mark zuckerberg. jan crawford tells us the sitdown comes amid claims the site excluded conservative stories. >> we can build something and make it better. >> reporter: mark zuckerberg will have to answer today to leading conservatives as he tries to bat down allegations of anti-conservative bias within his social media empire. among the expected attendees, senior trump adviser barry bennett, former senator jim dement, tv and radio host glenn beck. >> i just want to listen. i want to look zuckerberg in the eye and get a gauge of him as a man and see, is he telling the truth?

>> reporter: it was one of the topics censored in its trendy news section according to reports by the tech news site gizmodo. an anonymous former facebook staffer told the outlet that facebook employs manipulated user data to routinely suppress news stories of interest to conservative readers. >> i don't think it's a situation where all of facebook is in on some plan. um, i -- i don't think that. >> reporter: some are ready to listen to what zuckerberg has to say, not everyone has rsvp'd yet. >> i think this is a pr ploy and i think i would have just been, um, a prop in a meeting. >> reporter: matt is chairman of the american conservative union. >> what we want is transparency and fairness of in how they report and how their formulas work on the news. that's all we want. >> how to know what's trending -- >> reporter: facebook says it has no evidence of any bias but is conducting an investigation.

>> that was jan crawford record reporting. the meeting starts at 2:30. more americans will be eligible for overtime thanks to a chain in federal regulations expanding mandatory overtime pay to more than 4 million full- time workers. it applies to people who make less than $43,000 a year or $913 a week. that's roughly double the current salary threshold. officials say that they will update the qualifying salary figures to keep up with inflation and other factors. house lawmakers are expected to vote tomorrow and a scaled back funding plan to fight the zika virus. the $622 million plan is only a third of what the obama administration requested. the senate has given the go- ahead on a $1 billion plan and so far the zika virus hasn't hit the continental u.s. in full force but experts say as temperatures rise the number of infected people could also go up. still ahead, nasa makes a special delivery. the massive piece of space equipment traveling by sea and

last space-capable externall tank arrived by barge in southern californ it's meant for space travel but this morning nasa's last space-capable fuel tank arrived in southern california. the 66,000-pound tank sailed through the gulf of mexico and caribbean. once it squeezed through the panama canal it was brought to los angeles. it will be on display soon with the retired shuttle endeavour.

family member. >> the suspect now faces attempted kidnapping and child endangerment charges. the baby was checked out at the hospital and is fine. we often think of identity theft as a computer crime. scammers hacking into our accounts online. but cbs reporter brook silva- braga says, thieves are also stealing people's money using phones. >> reporter: when christie couldn't get cash out of the atm she called her bank to ask why. >> and so they said, well, you have to answer these three security questions. so i failed all three security questions. >> reporter: the questions had been changed and her account taken over using phone hacking. a con artist posing as her was able to answer a chase operator's questions about the school she went to her license plate number, even the bank she had a loan from. and that gave the scammers the ability to steal $2,800 by writing checks from her account. >> they made fake checks. >> that's right. >> with your account numbers? >> right. >> reporter: she doesn't know how the con artist got her

personal information. but security expert adam levin says criminals can buy it from hackers to breach the databases of major retailers, financial institutions, even local businesses and schools. >> it's really a question of when, not if, anymore, that each of us is going to suffer a form or multiple forms of identity theft. >> reporter: levin says to protect yourself, always use long and strong passwords online. and pick security questions you haven't shared on social media. the school you went to or your mom's maiden name, could be on facebook. in a statement, chase noted customers are not liable for fraudulent transactions that they report to us in a timely fashion. it took a couple of weeks but she did get her money back. >> this has been a full-time job. >> reporter: she has disabled telephone banking although chase stays could turn it back on. in floral park, new york, brook silva-braga for cbs news. google is kicking off its

annual developers conference today. they will unveil the latest and greatest in consumer gadgets and mobile apps. google is expected to focus on virtual reality and artificial intelligence. the golden state warriors are looking to tie the series tonight in game 2 of the western conference finals. on monday the thunder bounced back from a 14 point deficit beating the wars by 6 points. the warriors haven't lost back- to-back games since the nba finals last year. tip-off at 6 p.m. in oakland tonight. and on the ice, the san jose sharks were able to shut out the blues in a game 2 victory last night. by the third period the sharks were up by 4 with st. louis unable to answer. the series is tied up ahead of tomorrow night's return to the shark tank. time for a check of the weather right now. and roberta, you went out earlier for a run and it was hot. >> i did go out for a run and it was very warm for the city by the bay. also, lacking a good breeze. we're picking up some sea

breeze out there, some sea haze as evident by our live weather camera. not visible. can you see that there? we have that haze there. and some stagnant air, as well. but boy, it is beautiful around the bay area today. 66 san francisco with that marine layer air mass influence. otherwise 71 degrees across the bay in oakland. we are currently in the 80s away from the bay and charlie one of our weather watchers in vallejo is reporting 83 degrees. he says it's a wonderful day! thanks for checking in with us, charlie raines. the coast was clear and then that finger of low clouds and fog that came to the golden gate bridge, that's the haze at this hour. all that will hang low and then we'll see the clouds regather overnight tonight and will start thursday with overcast skies at the coast. we'll have seasonal temperatures tomorrow with the cooldown. rain chances return by the weekend. okay, see that right there? that's an area of low pressure. that's going to take a nosedive south bring you cooler air mass and also beginning to cloud up.

there you have that marine layer gathering late night tonight. so that's going to penetrate some of your inland areas and bring the temperatures down to seasonal readings. meanwhile, you do see the clouds gathering around the santa cruz area as well overnight on thursday. but between now and then it's a spring-like day at the coastline. 74 degrees in santa cruz. we have a chance of thunderstorms in the high sierra and yosemite. 90 inland. tri-valley warmer than that in concord, clayton and walnut creek back to fairfield. outside number 93 degrees. that will be in discovery bay and brentwood. our sunset tonight at 8:16. by then, again, temperatures unseasonably warm inland. we will be seasonal albeit cooler on thursday. almost 20 degrees cooler inland thursday. everyone in the 60s friday and yes, we have a chance of rain showers and isolated thunderstorms on saturday.
