hopes and cars are burned and what's next? >> anne makove reports from emeryville. >> reporter: there are closed roads in the area. a couple of things going on at the fire scene behind me. pg&e trying to restore power and the fire department still spraying water on what's left of this building as the investigation into how this fire started begins. the fire start at 2:45 a.m. quickly engulfing this five- story building under construction, spreading to townhomes and an auto shop nearby. >> this is not something that you prepare for. >> reporter: alexandra grant is one of 50 people evacuated from nearby homes to woke up to an inferno outside their window. >> all you saw was flames from the buildings, um, kind of just taking over. you can feel the heat inside our house. >> reporter: at least 4 townhomes next to the building are damaged. and about 50 cars at james auto body are destroyed. >> i mean, that's a total.

i can see that. so it's a total loss. >> reporter: they are all his customers' cars and he is hoping insurance will cover them. >> i have no idea but my next thing probably go tell my agent and let him know and go from there. >> reporter: this building that caught fire was going to be called, the intersection, a 105- unit apartment and retail complex. construction workers showed up this morning to this. >> really devastating for all of us. >> reporter: their jobs on hold. >> what's going to happen? >> reporter: the alameda county sheriff's office sent up its drone to get a picture from above. its inbra red camera shows one giant hot spot in what -- its infrared camera shows one giant hot spot in what used to be the foundation. they will stay on scene to be sure there are no hot spots. >> we want to be sure it doesn't spread to other buildings. >> reporter: on 39th and adeline back out here live now,

construction workers told me someone had broken into the main office of this building overthe weekend and said the sprinkler system was installed and was working properly. it will all be part of this investigation. live in emeryville, anne makovec, kpix 5. >> how long will it take for the neighborhood to get back to normal? >> reporter: i think the roads will be closed for the day and firefighters will be on scene definitely throughout the day probably throughout the night to make sure that the hot spots are not reigniting. we also have the evacuees, they are slowly being allowed back into their homes. but at this point, most of them don't have power or water service. so it is going to be at least 24 hours until it is business as usual here in emeryville. back to you. >> thank you. thousands of californians want to see a bay area judge taken off the bench but one small but respected group says that move would be a big mistake. kpix 5's maria medina is in palo alto with who says judge aaron persky should keep his job. >> i'm one of the signatories

on the letter. >> reporter: ladoris cordell one of nearly two dozen retired santa clara judges who signed an open letter warning the public of the consequences if they successfully recall judge aaron persky. >> the key to a good judiciary system and we have the best in the world is our independence. the ability of a judge not to look over his shoulder before rendering a decision to wonder what the people outside are going to say and whether or not i'm going to lose my job. >> reporter: there are several movements to try to remove persky from the bench after he sentenced stanford swimmer brock turner to a half year in jail for raping a drunk unconscious woman on campus including a recent online petition for those who refused to ever serve as a future juror for the palo alto judge. >> i'm very troubled by this. >> reporter: a woman's activist group who organized the petition says they have collected 5,000 signatures. it's not clear how many are santa clara voters. ladoris cordell our kpix 5 legal analyst says the petition

sets a concerning precedent. >> if you decide you want to get out of jury duty, you just say, oh, i don't like this judge. and that really will -- could get you out and really that shakes up the whole jury system and i think in a very bad way. >> reporter: but cordell says a judge's job to decide the fate of someone's future is not an easy one and while she may not agree on his controversial sentence, the answer is not to strip him of his duties or to refuse to do your civic duty as a juror. >> you don't take one decision and decide that that judge can no longer be on the bench. >> reporter: in palo alto, maria medina, kpix 5. >> if judge persky does get recalled, it can't be done until his next term begins next year. to san jose now, where police are looking for a shooter who is targeting cars. there have been four shootings since may on blossom hill road and monterey road last one last saturday each between 12:30 and 1 a.m. one man was grazed and a woman

hit by this shrapnel. another man's car was hit and he discovered it the next day. >> my drivers side window was completely shot out. half of it was shattered and on the floor. you could still see remnants of what looked like a bb hole and i think they were driving around and shooting with bb guns. >> the driver says that shooting was back in march. he lives to close to where the others happened. police are stepping up patrols to find the shooter. san francisco's board of supervisors is meeting today to discuss a proposal to raise the city's sales tax. supporters say it's necessary because of an estimated deficit of $250 million over the next two years. that deficit is largely due to a project decline in revenue from real estate taxes. say good-bye to the fourth trust of the old bay bridge. -- truss of the old bay bridge. crews are working to lower the segment on to a barge. it's a slow process. they started around 6 a.m. once it's on the barge, it will

be moved to the port of oakland to be disassembled. the process should be done in a couple of days. new developments in a deadly police shooting in louisiana. the justice department is opening a civil rights investigation after a black man was shot by officers. david begnaud has the cell phone video and some of the images are disturbing. >> reporter: cell phone video shows officers confronting the suspect outside a convenience store in baton rouge. someone showed he has a gone. then the cops shot him. the 37-year-old family and community leaders are calling it murder. sterling's son broke down. [ crying ] >> as his mother addressed the media. >> one of the greatest things is see your child hurt and knowing there's nothing you can do about it. [ screaming ]

>> reporter: baton rouge say officers were responding to a report of a man selling cds outside a cd store. that man threatened someone with a gun. >> suspicious on the corner gun in his pocket. he pulled a gun on the complainant. >> reporter: the convenience store owner says the gun was taken out of the suspect's gun when it was shot. >> the video speaks for itself. sterling was not reaching for a weapon. >> reporter: the shooting sparked protests in baton rouge. the head of the naacp is calling for the police chief to be fired. david begnaud, cbs news, baton rouge, louisiana. an autopsy found sterling died from multiple gunshot wounds to the chest and the back. >> president obama. president obama is pulling back on a plan to significantly cut u.s. troop levels in afghanistan by the end of the year. he now says the threat from the taliban is too great and that the war ravaged country still needs america's support. he announcedded today that instead of going down to 5500

discussed in the coming days. fbi director james comey has been called to capitol hill over his decision in the hillary clinton email investigation. cbs reporter craig boswell tells us that he is under scrutiny for not recommending charges. >> reporter: fbi director james comey will testify before the house oversight committee tomorrow morning. republicans want to know why comey did not recommend charges against hillary clinton for using a private email server while serving as secretary of state. >> we have seen nothing but stonewalling an dishonesty from secretary clinton on this issue and there are a lot more questions that need to be answered. >> reporter: comey said investigators found no criminal intent but that clinton and her aides were extremely careless in handling her emails. clinton took the fight to trump today outside his former trump plaza casino in atlantic city new jersey. >> what he did here in atlantic city is exactly what he will do if he wins in november. >> reporter: trump tweeted that he made a lot of money in

well, today's tip of the day is going to be is with collard greens. they would be the most nutritional of all vegetables. they are a superfood. i could spend the next 90 seconds talking about the nutritional value of collard greens but if you don't select them and store them right, forget about it. the nutritional value will be depleted. let's talk about selection. when you buy them, nice and green just like this all the way around. it has to feel nice and fresh. now, a lot of times you're going to find with some dirt on it because of how they're grown. sometimes you can't help but see some dirt so wash them carefully but don't wash them before you store them in the refrigerator just before you enjoy them. if you wash them sooner, they will decay quickly. sokol lard greens. i like to par boil them, saute them then with tomatoes, garlic, olive oil. they are beautiful! incredible. i'm tony tantillo, your fresh grocer.
